Note: This is a meeting of the Ordinance Review Committee (ORC) for Planning Board members
who would like to review and comment on proposed amendments before the items are formally
considered by the Planning Board. Attendance is not mandatory and a quorum is not necessary for
meetings of the ORC.
That said, the item on tonight’s agenda is a significant work item for 2017 and Planning Board
members are strongly encouraged to attend this meeting.

To continue review and discussion on proposed amendments to the
UDO that would reorganize the Tables of Permitted Uses in response
to the Byrd v. Franklin County judicial decision. As work progresses
on this item, which is expected for the September 2017 quarterly
public hearing, the ORC will have additional opportunities for review
and comment.

PURPOSE: To continue review and comment upon proposed modifications to the tables of
permitted uses.
BACKGROUND: In November of 2015 the State Supreme Court in Byrd versus Franklin County
rejected the argument that the mere omission/listing of a particular land use within a table of
permitted uses constituted a prohibition of same. The Court stated: ‘…. law favors uninhibited
free use of private property over government restrictions’. In consultation with the County
Attorney’s office, staff has determined the permitted use table(s) need to be modified to ensure
compliance with the aforementioned court case clarifying allowable/prohibited land uses and
ensuring uniformity amongst the various existing tables.
The list needs to be as exhaustive as practical. The simple rule we need to remember, based
on the Byrd case and guidance from the County’s Attorney Office, is: if a land use is not listed
within the table of permitted uses it is considered to be permitted.
The amendment outline form for this project, contained within Attachment 1, was approved by
the BOCC at its November 1, 2016 regular meeting. Agenda materials from this meeting can

The Planning Board Ordinance Review Committee (ORC) began review of this item at its
January 4, 2017 meeting addressing the following elements:
1. Determining if an existing ‘list’ of land uses can be incorporated into the UDO.
STAFF COMMENT: Staff has proposed incorporating the North American Industry
Classification System (NAICS), the standard used by Federal statistical agencies in

classifying business establishments. With respect to the NAICS code staff has
identified the following potential benefits and constraints:

• The UDO, most notably the

utilizes the standard.
• NAICS only addresses non-
residential land use activities and
does not address other
categories (i.e. residential).
• NAICS provides a detailed list of
non-residential land use
activities, assisting the County

• There is no flexibility with NAICS.

references within the UDO.
• The NAICS code is subject to
periodic change/update. If we
are referencing a specific version
in the UDO, updates may be
necessary to ensure consistency.
Staff began investigating the use of the Land Based Classification Standards (LBCS)
as prepared by the American Planning Association (APA). Similar to NACIS, the
LBCS model seeks to integrate various land uses into central categories and provide
a detailed list of various activities.
The model extends the notion of classifying land uses by refining traditional
categories into multiple dimensions, namely:
a. Activities - the actual use of land based on its observable
characteristics,
b. Functions - refers to the economic function or type of establishment
using the land,
c. Structure - the type of structure or building on the land,
d. Site - refers to the overall physical development character of the land,
and
e. Ownership - the relationship between the use and its land rights.
For the purposes of this review, staff has incorporated the ‘Activities’ code(s) into the
UDO serving as the table of permitted uses as contained in Attachment 2. With

respect to the LBCS staff has identified the following potential benefits and
constraints:

may find itself ‘adding’ additional
uses to address the findings of

various land use activities,
residential and non-residential,

a numbering system that can
create confusion for users.
• LBCS also includes a detailed
definitional framework on what
each land use category is
intended to allow.
• The LBCS system relies on a
tiered approach to classify land
uses. Certain ‘tiers’ in this
system offer less detail than
NAICS and can be argued are
contradictory in nature.
To fully implement the LBCS
system the County would have to
implement all 5 tiers (i.e. activity,
function, structure, site, and
ownership).

It should be noted the County’s Attorney Office has not expressed a preference for
either model. Their advice thus far is to be as detailed as possible.
Our goal for the February 1, 2017 ORC meeting is to decide which ‘model’ (NAICS
versus LBCS) to utilize moving forward with the project. Attachment 2 contains a
comparison of several existing land use categories with LBCS and NAICS codes to
provide additional detail on how each system would be employed in a revised table of
permitted uses.
Based on our initial review the NAICS code provides the County with a
comprehensive list of land uses addressing the findings of Byrd consistent with the
County’s Attorney office direction.
2. General discussion on the continued need for certain general use zoning districts. This
process will not involve the elimination or reclassification of existing general use zoning
districts. The purpose of this discussion is to ascertain the need for future modifications.

This item is currently going through staff peer review. Initial recommendation(s) for the Planning
Board to consider are as follows:
a. Current Planning staff is recommending we utilize the NAICS code and
incorporate it, by reference, within the UDO. This will avoid staff having to
incorporate the definitional framework into Article 10 Definitions for the various
land use categories.
As we continue with this project, there will undoubtedly be modifications to existing
land use definitions in the UDO to ensure consistency with NAICS.
b. For those land use categories where NAICS does not provide a comprehensive
land use list, most notably residential, Current Planning staff is recommending
incorporating the APA LBCS codes as detailed herein to develop an appropriate
list of land uses.
This same recommendation is being made to internal peer reviews. If agreed to, staff will begin
to finalize the new table (i.e. a single master table of permitted uses) for final peer review in the
coming months. This new table will be reviewed at a future ORC meeting.
FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding
for the provision of County services. Existing staff, included in the Departmental staffing budget,
will accomplish the work required to process this amendment.
RECOMMENDATION(S): Planning staff recommends the Ordinance Review Committee review
and comment upon the proposed amendments to the UDO.

B. RATIONALE
1. Purpose/Mission
In accordance with the provisions of Section 2.8 Zoning Atlas and Unified
Development Ordinance Amendments of the UDO, the Planning Director is

proposing to initiate text amendments to clarify allowable and prohibited land uses
within the various general use zoning districts throughout the County.
These amendments are in response to recent court decisions, most notably action by
the State Supreme Court in Byrd versus Franklin County, placing the onus on local
governments to have sufficient specificity ‘spelling out’ allowable and prohibited land
uses.
This outline form was originally reviewed and approved by the BOCC at its May 5,
2016 regular meeting. Recent discussions between the Director and the Attorney’s
office, as well as on-going amendments, have required a reevaluation of the project.

2. Analysis
As required under Section 2.8.5 of the UDO, the Planning Director is required to:
‘cause an analysis to be made of the application and, based upon that analysis,
prepare a recommendation for consideration by the Planning Board and the Board of
County Commissioners’.
In November of 2015 the State Supreme Court in Byrd versus Franklin County
rejected arguments that the mere omission/listing of a particular land use within a
table of permitted uses constituted a prohibition of same. The Court stated: ‘…. law
favors uninhibited free use of private property over government restrictions’. A copy

Originally the amendment was intended to clarify allowed/prohibited land uses,
provide additional specificity, and ensure uniformity. Recently the Director, in
responding to comments from the Attorney’s office, determined the scope of the
project needed to change and will now involve:
1. Incorporating the North American Industry Classification System (NAICS)
land use classification system into the UDO, consistent with text
amendments reviewed at the September 12, 2016 quarterly public hearing
and slated for continued review and the BOCCs November 1, 2016 regular
meeting.

2. Expanding the list of non-residential land uses (i.e. agricultural, medical,
recreational, residential land uses) to comply with the findings of Byrd.
3. Collapsing the general use, EDD general use, and Conditional Zoning
district tables of permitted uses (Sections 5.2.1, 5.2.2, and 5.2.3
respectively) into one central table in order to decrease anticipated page
counts and avoid unnecessary duplication.
As a result, the schedule for this was revised.

Staff anticipates the need for work sessions with the BOCC and Planning Board to
review the particulars of the NAICS code, discuss the expansion of various land use
categories, and review options with respect to the ‘status’ (i.e. permitted or
prohibited) of various land uses.

Land Use Goal 2: Land uses that are appropriate to on-site environmental
conditions and features and that protect natural resources, cultural resources, and
community character.
Land Use Goal 4: Land development regulations, guidelines, techniques and/or
incentives that promote the integrated achievement of all Comprehensive Plan goals.
Land Use Goal 6: A land use planning process that is transparent, fair, open,
efficient, and responsive.

General Public: Staff will schedule an open house meeting to solicit public
comment on the proposal in March of 2017. Advertisement
of this meeting shall be coordinated with the Manager’s
