Mebane 336-227-2031 PURPOSE: To consider approving a contract with Swanson and Associates to develop an interim plan for landscaping and revegetating the closed portion of the landfill north of Eubanks Road and the construction and demolition (C8~D) landfill area that is expected to reach capacity in 2002. BACKGROUND: Federal regulations require that entities operating landfills closely monitor and maintain those closed landfills for a period of 30 years following closure. Staff included a proposal in the 2000-01 fiscal year budget to pursue a pilot project that would examine the best ways to restore the closed areas at the Eubanks Road landfill to a natural state that is aesthetically pleasing and environmentally sensitive, subject to any regulatory constraints. The revegetation plan contemplated under this agreement would be implemented for the period of the 30-year regulatory post-closure period.. At some time in the future, perhaps 10-15 years from today, a permanent master development plan for the property could be developed that could draw on the information collected from the County's actual experience with the interim landscaping and revegetation project. The revegetation plan was reviewed and discussed by the Solid Waste Advisory Board at its October 12, 2000 meeting. The intention of the study and planting plan is to determine what types of habitats are appropriate for the site, what are their wildlife potentials, how to integrate them into the site and opportunities for education and interpretation that could be provided on the site. The work product is a detailed landscape restoration plan for the closed portion and a schematic and detailed implementation strategy for closure of the C&D area and surrounding landscape. The 35-acre portion that is already closed was used for waste burial from 1972- 1995 and is now covered with lespediza grass. There is a passive methane gas venting system with pipes protruding throughout the site. This closure design meets or exceeds state performance standards for closed landiflls. The 11-acre C&D site, due to be closed within the next eighteen months at current rates of use, is the other area subject to this contract. Additionally, other areas on the north side, such as buffer areas, may also be considered. Typical landfill closure plans require a vegetative cover of low grasses and plants an two feet of soil overlaying a 6" impervious clay cap. There are no specifications for the types of vegetation used as long as they are not deep-rooted and will not potentially pierce the clay cap, thus allowing more infiltration of rainwater to create additional landfill leachate and methane production. The closed portion of the landfill and soon-to-be-closed portion of the C&D site represent an environmental opportunity to do more than simply meet the letter of the law. For example, these open spaces could possibly be used to recreate an almost extinct Piedmont prairie environment. The spaces also present opportunities for future botanical research and open space resources. Staff realizes that this is the time to begin planning for past-closure plantings that enable a more diverse environment to be created as well as simply maximizing the ecological potential the non-operational areas of the landfill during the 30-year post-closure period. Due to Federal and State regulations as well as sound engineering practice, it would not be passible to create active recreation or structures on the site far at least thirty years. It is the opinion of staff that creation of an environment of restored prairie or other native species represents an appropriate opportunity to begin the long and delicate process of total restoration of the landfilled areas, which could be modified or otherwise developed at some future time. A proposal letter from Swanson and Associates as.well as a proposed contract is attached. FINANCIAL IMPACT: The cost of this contract is $7,500 for detailed plan development. Actual planting and removal of existing vegetative cover could have further financial impacts that will not be known until the plan is complete. Adequate funds for the plan development agreement are included in the FY 2000-01 Salid Waste/Landfill Enterprise Fund operating budget. STATE OF NORTH CAROLINA AGREEMENT FOR THE COUNTY OF ORANGE ARCHITECTURAL and ENGINEERING CONSULTANT SERVICES This Agreement made and entered into by and between The County of Orange, on behalf of the Solid Waste Management Department, hereinafter "County" and Swanson and Associates hereinafter "Consultant" far services as hereinafter described for the development of a detailed vegetation and planting plan for the closed portions of the Eubanks Road landfill. WITNESSETH That for and in consideration of the mutual promises and conditions set forth below, the Consultant agrees: 1. Duties of Consultant: Consultant agrees to provide services as described in Exhibit A and incorporated herein by reference. 2. Duties of the County: The County shall pay for Consultant's services as set forth in Exhibit A and incorporated herein by reference. 3. Billing and Payment: Consultant shall submit regular invoices for work performed and shall be paid for completion of the work performed during that period under the terms of this Agreement. Payment will be made by the County within thirty (30) days of receipt of an accurate invoice. The value of this contract is not to exceed $7,500 except as agreed by the parties. 4. Amendment :This agreement may be amended or cancelled by mutual agreement of the County and the Consultant. Either the County or the Consultant may terminate this Agreement at any time with or without cause upon giving the other party 21 calendar days prior written notice. County shall within sixty calendar days following termination pay the Consultant for all services rendered and all costs incurred up to the date of termination, in accordance with the compensation provisions of this contract. Any amendments to the contract are not valid unless signed by the County Manager and the Finance Director. 5. INSURANCE PROVISIONS l . Worker's Com ensation: Coverage to apply for all employees for statutory limits in compliance with the state and federal laws. The policy must include employers' liability with a limit of $100,000 each accident, $100,000 bodily injury by disease each employee and $500,000 bodily injury by disease policy limit. 2. Comprehensive General Liability: Shall have minimum limits of $1,000,000 per occurrence combined single limit for bodily injury, liability and property damage liability. This shall include premises and/or operations, independent contractors, products, and/or completed operations, broad form property damage and explosion, collapse and underground damage coverage and a contractual liability endorsement. 3. Profe sional Errors and Omissions Liabili :Coverage shall have minimum limits of $1,000,000 per claim and $1,000,000 aggregate. SPECIAL REQUIREMENTS: A. The County is to be included as an additional insured on -the Comprehensive, General Liability. This requirement is to be stated on the Certificate of Insurance. 8 B. Current, valid insurance policies meeting the requirements herein identified shall be maintained during the duration of the named project. Renewal certificates shall be sent to the County thirty (30) days prior to any expiration dates. There shall also be a 30 day notification to the County in the event of a cancellation or modification of any stipulated insurance coverage. Certificate of insurance meeting the required insurance provisions shall be forwarded to the County of Orange. Wording an the certificate which states that no liability shall be imposed upon the company for failure to provide such notice is not acceptable and should be deleted. Original policies or certified copies of policies maybe required by the County of Orange at any time. 4. Certificates of Insurance for all the insurance coverages described herein shall be Submitted to the County upon execution of a contract by Consultant. 5. All insurance required under this agreement shall be written with a company licensed to do business in North Carolina. Certified copies insurance policies may be requested by the County. Hold Harmless: Consultant agrees, to the fullest extent permitted by law, to indemnify and hold the County harmless from any damage, liability or cast (including reasonable attorneys' fees and costs of defense) to the extent caused by the Consultant's negligent acts, errors or omissions in the performance of professional services under this Agreement and those of his or her subconsultants or anyone for wham the Consultant is legally liable: County agrees, to the fullest extent permitted by law, to indemnify and hold the Consultant harmless from any damage, liability or cost (including reasonable attorneys' fees and costs of defense) to the extent caused by the County's negligent acts, errors or omissions and those of his or her subcontractors or consultants or anyone for whom the County is legally liable, and arising from the project that is the subject of this agreement. The Consultant is not obligated to indemnify the County in any manner whatsoever for the County's own negligence. 6. Term: This Agreement, unless amended as provided herein, shall be in effect from November 1, 2000 through Junel, 2001.
