PURPOSE: To consider approving right-of-way requested by Duke Power for new pole
locations on the Southern Human Services Center property,
BACKGROUND: Duke Power is making certain upgrades to the power supply that serves the
general Homestead Road area, but would specifically benefit the County's Southern Human
Services Center by providing greater redundancy and a more reliable power supply, In order to
carry out this work, Duke Power has requested that the County grant right-of-way along
Homestead Road, as depicted on the attached map. Two new poles would be added and one
existing pole on the east side of the access drive would be abandoned. Richard Gurlitz,
designer for the Southern Orange Senior Center, and Pam Jones, Director of Purchasing and
Central Services, have worked with Duke Power representatives to obtain a pole configuration
that will not only improve the reliability of the electrical services to the campus buildings, but will
also present a less cluttered line arrangement at the entrance of the site.
It is staffs understanding that Duke Power plans to carry out this work in late-Spring 2005. The
issue of placing the lines underground has arisen. However, Duke Power has not provided any
cost estimates to place the lines underground due to the fact that the lines are major
transmission lines and therefore Duke believed that the cost would prove prohibitive.
FINANCIAL IMPACT: There is no financial impact associated with this action.
RECOMMENDATION(S): The Manager recommends that the Board grant the Right-of-Way
as requested by Duke Power; and contingent upon staff and Attorney review, authorize the
Chair to sign the agreement on behalf of the Board.

divisions, hereinafter called "Gratttee," the perpetual right, privilege and easement to go in and upon that certain land of Grantor
(hereinafter "premises") situated in said County and State, property described as:

construct, maintain and operate with poles, crossarms, wires, guys, anclmrs, cables, tmnsfbnners and other apparatus and
appliances, overhead lines for the purpose of transporting electricity and for the communications purposes oC the Grantee and
regulated telephone utilities The following rights are also granted to Grantee: to enter said premises to inspect said lines, to
perform maintenance and repairs, and to make alterations and additions thereto, to remove from the righhot=way strip, now ur at
wty' time in the future, trees, structures or other obstructiwts that may endanger the proper maintenance and operation of said lines
and trees of any species that Grantee determines will grow at maturity to a height that will endanger the proper maintenance and
operation of said lines; to trim or remove and to keep trimmed or remove dead, diseased, weak or leaning trees or limbs outside of
the right-of--way strip which, in the opinion of the Grantee, might interfere with or fall upon the electric or communications
facilities within the right-of--way strip; and to install guy wires anti anchors extending beyond the limits of the right-of--way strip,
® having a width of 15 feet on each side of a centerline determined by the cenrerlinc of the electrical facilities as installed, to

ground, to include transformers and service connections, for the purpose of transporting electricity and for the communications
purposes of Gramee and its licensees. The fbllowing rights are also granted to Grantee: to enter said premises to inspect said lines,
to perfornr maintenance and repairs, and to make alterations and additions thereto: and to clear the land within the righbof--way
strip and to keep it clear of trees, structures or other obstructions; and to clear that land outside the right-of-way strip within ten
feet of the service door of any transformer or cabinet located within the right-of-way strip and to keep the area within ten feet of
said door clear of trees, structures or other obstructions.. All underground facilities are to be installed in accordance with the
provisions of Grantee's underground Distribution Installment Plan, NCUC Docket [-7. Sub 552, receipt of a copy of which is
acknowledged by Grantor
This righbof-+vay is given to perntit the construction of facilities presently proposed. Facilities at other locations and future
extensions of presently constructed facilities are not permitted by this agreement. The foregoing notwithstanding, Grantce may
relocate its facilities and righrof--way strip over the premises to conform to any future highway or street relocation, widening or
improvement.
