PURPOSE: To consider delegating authority to the County Manager to:
a) award a Construction Manager at Risk (“CMAR”) Agreement to a qualified firm for
the Orange County Northern Campus capital project; and
b) authorize the Manager to sign the necessary paperwork upon review by the
County Attorney.
BACKGROUND: On April 3, 2018, the Board of Orange County Commissioners authorized the
acquisition of approximately 21 acres of property to serve as the site for the Orange County
Northern Campus. This campus location contemplates housing the Orange County Detention
Center, Environment and Agriculture Center (“EAC”), and the Park Operations Base.
The County intends to employ the Construction Manager at Risk (“CMAR”) method of
construction delivery for this project. In accordance with North Carolina Procurement Law
regarding procurement of CMAR services, the County recently received responses to its
Request for Qualifications (“RFQ”) on May 23, 2018, for Construction Manager at Risk services
for the overall site, Detention Center, Environment and Agriculture Center (“EAC”), and the Park
Operations Base.
The CMAR method of construction project delivery as approved for use by the North Carolina
General Assembly in 2002 is recommended for this construction project. Under this method of
contracting, the owner contracts directly with the designer (Moseley Architects and HH
Architects in this case) and the CMAR, all of whom are selected based on their demonstrated
qualifications to design and construct the Northern Campus project. A staff panel consisting of
members from the Manager’s Office, Asset Management Services, the Sheriff’s Office, the
Department of Environment, Agriculture, Parks & Recreation (“DEAPR”), Cooperative
Extension, and Finance & Administrative Services is scheduled to interview the responding firms
and recommend to the Manager the most qualified firm to negotiate, finalize, and execute a
CMAR agreement over the summer break. The objective will be to engage with the CMAR as

the schematic and developmental design of the project begins in earnest so as to take
advantage of scope and related cost information provided by the CMAR.
The project program is developed as a collaborative partnership (County, Designer, CMAR)
through a pre-construction phase process and, when pricing is ultimately agreed to by the
parties, it is set in writing as the Guaranteed Maximum Price (“GMP”) and becomes the basis of
the CMAR contract, which binds the project to the agreed upon price unless Orange County
changes the scope of the project in some manner. This method allows for significant,
collaborative cost analysis with the full benefit of the CMAR during the pre-construction phase to
illuminate cost-benefit factors and appropriate value engineering throughout the design.
Prior to the BOCC’s authorization to construct the Northern Campus, staff will present a
Guaranteed Maximum Price (“GMP”) (featuring several construction alternates that will assist in
the flexibility of the project’s construction) that the CMAR will commit to within the Agreement.

FINANCIAL IMPACT: This Agreement, once executed, will stipulate a pre-construction fee that
will compensate the CMAR up to the BOCC’s potential authorization of the GMP. This pre-
construction fee will be negotiated as part of the process with the preferred qualified CMAR
candidate. Should the BOCC not approve the GMP and choose not to proceed with the project,
the pre-construction fee is paid to the CMAR and the Agreement is terminated. Funds for these
services are appropriated as part of the Capital Project budget.
RECOMMENDATION(S): The Manager recommends the Board delegate authority to the
County Manager to:
a) award a Construction Manager at Risk (“CMAR”) Agreement to a qualified firm for
the Orange County Northern Campus capital project; and
b) authorize the Manager to sign the necessary paperwork upon review by the
County Attorney.
