HomeMy WebLinkAboutAgenda - 06-19-2018 6-c - Orange County Consolidated Plan – FY 2018-2019 Revised Annual Action Plan and Proposed FY 2018-2019 HOME Activities ORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: June 19, 2018 Action Agenda Item No. 6-c SUBJECT: Orange County Consolidated Plan – FY 2018-2019 Revised Annual Action Plan and Proposed FY 2018-2019 HOME Activities DEPARTMENT: Housing and Community Development ATTACHMENT(S): 1) Resolutions 2) Draft FY 2018-2019 Revised Annual Action Plan Executive Summary 3) Revised Summary Sheet for FY2018- 2019 Proposed Projects INFORMATION CONTACT: Sherrill Hampton, Housing and Community Development Director, (919) 245-2490 PURPOSE: To consider: 1) Adoption of a Resolution approving the Consolidated Plan’s proposed FY2018- 2019 revised Annual Action Plan; 2) Adoption of a Resolution approving the proposed revised HOME Program Activities for FY 2018-2019; and 3) Authorizing the County Manager to implement the revised HOME Program as approved by the BOCC, including the ability to execute agreements with partnering non-profit organizations after consultation with the County Attorney and based on the allocation received from HUD. BACKGROUND: Each year, local communities are required to reassess the needs of the community. Orange County completed the required notice and public hearing process earlier and the Board of County Commissioners approved, by resolution, the FY 2018-2019 Annual Action Update and proposed uses of funds on May 1, 2018. However, HUD allocated a funding increase of $111,647 from the anticipated HOME budget advertised on March 13, 2018 and discussed at the Board’s public hearing held on April 3, 2018. Due to the substantial increase in funding, the County held another public hearing on June 5, 2018 as it relates to the additional funds received, revised budget and proposed use of funds. In addition, there was a 30-day comment period from May 18, 2018 – June 18, 2018, which allowed the general public to provide written comments and input on the increase in the HUD HOME allocation and proposed revised uses of the funds to be received. Notices were placed in The Herald-Sun, the News of Orange and La Noticia. Copies of the proposed revised Annual Action Plan were made available at Orange County Housing and Community 1 Development Department’s Main Office, Orange County Library and the Chapel Hill Library, as well as on the Orange County Website. All public comments received are summarized in the proposed FY 2018-2019 revised Annual Action Plan. The Orange County HOME Consortium, known as the Orange County Local Government Affordable Housing Collaborative, anticipates the following Federal financial resources for FY 2018-2019: FY 2018 HOME Funds $401,340.00 HOME Program Income $ 13,306.00 HOME Match $ 90,302.00 Total $504,948.00 The above amounts are estimates only and may be adjusted according to the exact allocation received from HUD. Given the proposed increase in HUD HOME funds to be received, the HOME Consortium, comprised of one (1) elected official and staff members from Orange County, the Town of Carrboro, Town of Chapel Hill and Town of Hillsborough, reviewed the received applications on May 22, 2018 and again on June 14, 2018 as it relates to the proposed FY 2018-2019 HOME funds and made the following revised recommendations regarding funding for consideration by each of the Consortium member jurisdictions’ elected bodies as follows: Community Home Trust - Homeowner Assistance $ 60,000.00 Empowerment, Inc. – Rental Acquisition $145,000.00 Habitat for Humanity – Homeownership $ 60,000.00 FY 2018-2019 CHDO Set-Aside Activities $ 60,201.00* Orange County – Countywide TBRA, including assistance for the Rapid Re-Housing Program $139,613.00 Administration $ 40,134.00 Total $504,948.00 (*- Denotes Orange County HOME Consortium’s CHDO Set-Aside) The requested amounts above may still be adjusted based on the exact allocation the HOME Consortium receives from HUD. While HOME funds will not be used in FY 2018-2019 to undertake single-family housing rehabilitation activities, Orange County will provide local funding for single-family housing rehabilitation activities as the need for low income owner-occupied rehabilitation was identified in the 2015-2019 Consolidated Plan and subsequent Annual Action Plans. In accordance with the Orange County HOME Consortium Agreement, approved in May 2011, the HOME Program Design for each year must be approved by all jurisdictions prior to submission to HUD. The HOME Program Revised Design is scheduled for approval by the Town of Carrboro on June 19, 2018 and staff believes the Town of Chapel Hill will consider this item on June 27, 2018. The Town of Hillsborough will adopt the HOME Program Revised Design on June 25, 2018. The Board of County Commissioners (BOCC) is therefore asked to consider approval of the attached revised HOME Program Resolution. The FY 2018-2019 Revised Annual Action Plan will be submitted to HUD on or before July 2, 2018. 2 HOME Program Implementation After approval of the FY 2018-2019 Revised HOME Program Design by all Consortium participants, authorization is also requested to allow the Orange County Manger, based on the HUD allocation received, to execute agreements with partnering non-profit organizations as necessary to implement the approved revised HOME Program Design. All agreements will receive the review and approval of the County Attorney’s Office. FINANCIAL IMPACT: There is no financial impact anticipated with this item. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goals are applicable to this item: • GOAL: FOSTER A COMMUNITY CULTURE THAT REJECTS OPPRESSION AND INEQUITY The fair treatment and meaningful involvement of all people regardless of race or color; religious or philosophical beliefs; sex, gender or sexual orientation; national origin or ethnic background; age; military service; disability; and familial, residential or economic status. • GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY The creation and preservation of infrastructure, policies, programs and funding necessary for residents to provide shelter, food, clothing and medical care for themselves and their dependents. • GOAL: CREATE A SAFE COMMUNITY The reduction of risks from vehicle/traffic accidents, childhood and senior injuries, gang activity, substance abuse and domestic violence. Furthermore, the proposed HOME projects, before implementation begins, will be assessed for any environmental impacts according to HUD requirements and the appropriate action(s) will be undertaken, as specified in the environmental review process. RECOMMENDATION(S): The Manager recommends that the Board: 1) Adopt a Resolution approving the Consolidated Plan’s FY 2018-2019 Revised Annual Action Plan; 2) Adopt a Resolution approving the proposed revised HOME Program Design for FY 2018-2019; and 3) Authorize the County Manager to implement the FY 2018-2019 Revised HOME Program Design, as approved by the BOCC, including the ability to execute agreements with partnering non-profit organizations, after consultation with the County Attorney and based on the allocation received from HUD. 3 RES-2018-048 Attachment 1 RESOLUTION AUTHORIZING THE SUBMISSION OF FY 2018 – 2019 Revised Annual Action Plan for the FY 2015 - 2019 CONSOLIDATED HOUSING PLAN FOR ORANGE COUNTY, NORTH CAROLINA BE IT RESOLVED, by the Orange County Board of Commissioners that the Commissioners authorize the County Manager to submit the Orange County Consolidated Plan for Housing and Community Development Programs’ FY2018-2019 Revised Annual Action Plan to the U.S. Department of Housing and Urban Development, including all understandings, assurances, and certifications required therein. Second Mortgage Assistance Funds will be allocated to Orange County Habitat for Humanity to provide deferred payment, zero interest second mortgages for ten (10) homes throughout Orange County. Homes will be sold to households earning between thirty percent (30% and sixty-five percent (65%) of the area median income. (Requested amount: $60,000) $60,000 Homeownership Assistance Funds will be allocated to the Community Home Trust (CHT) to provide homebuyer financial assistance for two (2) families in the Northside and Pine Knolls Neighborhood of Chapel Hill. (Requested amount: $60,000) $60,000 Acquisition Funds will be allocated to EmPOWERment, Inc., for the acquisition of a single family property for lease to households earning 80% or less AMI. The Federal Fiscal Year begins October 1st and ends September 30th of each year. The Orange County Fiscal Year begins July 1st and ends June 30th of each year. The Federal Fiscal Year is abbreviated as "FFY" and the Orange County Program Year is abbreviated as "PY." Five Year Conso�l'dad Plan: The Five Year Consolidated Plan- elied pon efforts of many individuals, organizations and citizens, in the development of a com ehensive strategy to address the needs of the County. The goal of Orange County is to improve the quality of life for County residents by funding improvements to public facilities, infrastructure, public services, and by retaining and increasing the stock of affordable owner and rental housing units. This planning process also involves an analysis of HUD Comprehensive Housing Affordability Strategy (CHAS) data, which provides statistical data on housing needs. To prepare its estimates and projections, the 2007 -2011 American Community Survey Estimates and the 2010 U.S. Census were used. This data is the most current information available to assess housing needs, homeless needs, special needs, social service needs, economic development needs, and other related needs. In HUD's assessment of Consortia across the country, those who truly meet the HOME program goals to address the most pressing affordable housing needs look less at geographic boundaries OMB Control No: 2506- 0117(exp.07/31/2015) 2 9 FFY 2018 Annual Action Plan Orange County HOME Consortium in their operations. Those Consortia allocate funding according to local needs, the capacity to use the funds, and a regional strategy that addresses the broader housing needs of the Consortium as a whole —for the success and betterment of the whole —for a better quality of life and economic vitality for all the communities individually and collectively. The lRvappears to be an adequate supply of market -rate housing. However, there is a lac0- affo dable housing. The County has a growing population, and new construction and rehabilita work is increasing again as evidenced by the number of building and renovation permits issued throughout the County. Real estate values continue to rise, which benefits property owners and most homeowners. However, these rising real estate values negatively impact very low -, low -, and moderate - income households who are increasingly cost - overburdened in their homes by 30 to 50 percent or greater; additionally, this hurts those who cannot find affordable housing and are having to increasingly seek housing outside of the County or live in substandard conditions not by choice, but by necessity. Housing values (both rental and owner - occupied) have increased with the rise in the number of households to the area. This increase has been especially burdensome on low- and moderate - income renter households. A decrease in the quality and the quantity of affordable rental housing has placed many of the very low- income households at imminent risk of becoming homeless. OMB Control No: 2506 -0117 (exp.07 /31/2015) i[t; FFY 2018 Annual Action Plan Orange County HOME Consortium It is estimated that there are approximately 1,600 owner and renter occupied housing units that are suitable for rehabilitation work in Orange County. However, the cost of rehabilitation exceeds the income and assets of many low- and moderate- income persons. Therefore, many of these housing units will remain vacant and or, in substandard, deteriorating conditions since the financial resources are not available to rehabilitate the housing units. There is a need for increased local, State, Federal, and private funds to provide financial assistance to lower income families to rehabilitate properties for more affordable housing. In addition, 21,663 housing units (38.38 %) were built before 1980, and therefore have a potential to be a lead -based paint hazard. For orange County, it is estimated that 15% of low or moderate income families living in owner- occupied units are at risk of lead -based paint hazards and that 25% of low or moderate income families living in rental units are at risk of lead -based paint hazards. There is a lack of affordable housing for the very -I <.Inco in Orange County. Many of t�F SQ mo,,jle home parks are in poor condition. It is estimated that there are appr imately 21,07 moot e Ame units in these parks. These units account for most of the affordable housing i Orange County. Of these units: 378 (18.74 %) are in sound condition; 990 (49.08 %) are in need of minor repairs; 580 (28.76 %) are in need of major repairs; and 69 (3.42%) are economically infeasible to repair. The areas impacted with cost overburdened households are located in and around the urban areas of the County. These areas contain the largest concentration of employment opportunities and public and private amenities, but lack affordable housing. The urban areas of the County have the most public and community facilities. These areas also contain the majority of available public transportation. The urban neighborhoods contain many of the County's employment opportunities and existing housing stock. However, these areas are cost prohibitive for low- and moderate - income persons. Orange County has a community health clinic and a County Health Department clinic that provides dental and health services, which are relatively inexpensive. The County is also served by the UNC Hospital System and the Duke Hospital System. However, there is still a need for more free or low- OMB Control No: 2506 -0117 (exp. 07/31/2015) 11 FFY 2018 Annual Action Plan Orange County HOME Consortium cost healthcare for people experiencing homelessness or at risk of becoming homeless. There is a great need for mental health and substance abuse case management and treatment for people experiencing, or at risk of, becoming homeless. Orange County Employment Services need to increase its focus and resources to assist this population, including people with criminal histories and youth aging out of foster care. According to the 2012 -2016 American Community Survey data, Orange County has an unemployment rate of 5.9% which is lower than the North Carolina unemployment rate of 8.3% for that same period. The unemployment rate is larger in the 16 -29 age group as opposed to older age groups. According to the 2012 -2016 American Community Survey data, there are job deficiencies in certain sectors (the number of qualified workers exceeds the number of jobs available). Conversely, Orange County is also experiencing a9-pajo- ent deficiency in other areas (the n umber ofjobs available exceeds the number of qu ers). To meet the need of affordable rental assistance the orange County HOME Consortium Is funding a Tenant -Based Rental Assistance (TBRA) program. These funds will be used for rental subsidies to help individual households afford housing costs such as rent, security deposits, and utility deposits in Orange County. The County may also assist tenants with utility deposits, but only when HOME is also used for rental assistance or security deposits. Administration Planning, and Management PrioritV - There is a continuing need for planning, administration, management, and oversight of Federal, State, and local funded programs, as well as an increasing'need for cooperation and collaboration among public and private partners. These responsibilities of the Collaborative include strategizing about funding options, posting updates on projects and affordable housing efforts, and providing guidance on administration of the HOME Program activities (i.e. recommending criteria for HOME Program funding, evaluating and recommending applications for HOME funding, and establishing a scoring system to review applications). Furthermore, the Collaborative would be responsible for utilizing potential affordable housing resources, reviewing all applicable leveraged resources, developing goals for development, and serving as advocates for affordable housing in Orange County. In addition, the Orange Water & Sewer Authority is now a member of the Collaborative.
