McAdams Company, Inc., (hereinafter referred to as "Provider "). WITNESSETH: THAT WHEREAS, the County and Provider entered into a contract dated M a y 2, 2017 (internally designated as HBO EDD, Ph. 1 W &S), for the provision of services to the County (hereinafter the "Original Agreement "); and WHEREAS, the County and Provider desire to modify the Original Agreement while keeping in effect all terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. NOW THEREFORE, for and in consideration for the mutual covenants and agreements made in the Original Agreement and herein, the parties agree to amend the Original Agreement as follows: 1. The Scope of Work and Basic Services shall be expanded to include all of "Additional Geotechnical Investigations" as described in Attachment B. 2. The work included in Attachment B shall have a milestone date of August 8, 2018 and include both fieldwork and an updated geotechnical report. 3. The additional work shall not alter the existing milestone dates or compensation for tasks listed in the Original Agreement. (For example, Task 3 Site Survey & Assessment still has a milestone date of 1.0 month following completion of Task 1 and shall still be compensated at 1 /8th of $189,770.) 4. The compensation for the additional work included in this amendment shall be eighteen thousand five hundred fifty dollars ($18,550). This amount may be invoiced and payable upon the successful completion of both the additional fieldwork and the updated geotechnical report. 5. The Original Agreement's maximum amount payable for Basic Services compensation in Section 5(a) shall be revised accordingly from "One Hundred Eighty -Nine Thousand, Seven Hundred and Seventy Dollars ($189,770)" to "Two Hundred Eight Thousand, Three Hundred and Twenty 52418jcb DocuSign Envelope ID: 505AD303- 2BD7- 47C5- A103- 8219E0353948 Dollars ($208,320) ". 6. The Original Agreement's termination date in Section 4(a) shall be revised to December 31, 2018. 7. Except for the changes made herein, the Original Agreement shall remain in full force and effect to the extent it is not inconsistent with this Amendment. Box 8181 Hillsborough, North Carolina 27278 Re: Proposal for: Additional Geotechnical Investigations (311 Revision) Hillsborough Area EDD Ph 1 Water & Sewer Extensions ORA -17000 Dear Mr. Sandt: Attachment B "Additional Geotechnical Investigations" In response to our discussions regarding the need for additional geotechnical investigations for the Hillsborough Area Economic Development District — Phase 1 Water and Sewer Extensions project, McAdams Company offers this proposal for additional professional services. PROPOSED SERVICES AND FEES We propose the services described below. McAdams' sub - consultant, Falcon Engineering, Inc., will perform this work under contract with McAdams. A table summarizing the fees follows the task descriptions: THREE (3) BORINGS AT NEW TUNNEL LOCATION • This task is for the drilling of three (3) borings along the proposed new tunnel alignment for the subject project. • The three (3) borings would be advanced near the beginning, end, and middle (I -40 median) of the tunnel. The borings within the I -40 median will require traffic control services consisting of a shoulder closure. We anticipate the shoulder closure will occur under the terms of our prior encroachment agreement, between the hours of 9AM and 4PM. A single day of traffic control is included in this proposal. If our boring cannot be completed in a single day, will contact you to discuss the most appropriate course of action. • All borings will be located in the field by Falcon personnel using handheld GPS equipment and approximate coordinates correlated from GIS data. Approximate boring elevations will be estimated from the County GIS online topographic data, or site topographic data provided by others if available at the time of our report. Borings will be advanced to a depth of approximately 5 feet beneath proposed pipe invert elevation, including rock coring if necessary. If extensive rock coring is necessary, the borings may be terminated at or slightly above the invert elevation. The water table will be measured in the boreholes following completion of drilling in all borings, and again after approximately 24 -hours or more in select borings. Borings in close proximity to existing roadways will be backfilled immediately due to safety considerations. Following completion of all borehole readings, boreholes will be backfilled with soil cuttings, and excess cuttings will be evenly dispersed around the ground surface surrounding the borehole or in nearby landscape /wooded areas. Our drilling activities will cause some disturbance to the existing ground surface and vegetation, including tire ruts. No site restoration efforts aside from backfilling the boreholes are included in this cost estimate. • Soil samples obtained during drilling will be visually - manually classified in general accordance with Unified Soil Classification System (USCS) by a Falcon geotechnical professional, collected in moisture proof containers and transported to our laboratory where they will be selected for laboratory testing. The laboratory test program will consist of three (3) Atterberg limits, grain size analysis, and natural moisture content tests on soil samples, and three (3) unconfined compressive strength tests on rock core samples. • Upon completion of additional field investigation and laboratory testing Falcon will revise the previously issued report to include the new data, and revised discussions /recommendations based on the planned alternative tunnel route. In order to meet the overall project schedule, Orange County and the Town of Hillsborough must provide timely responses as indicated in the following schedule outline. The following is the expected schedule for completion of work on these additional items: Three Borings at New Tunnel Location — Initiation of work within 3 weeks following Notice to Proceed. • Field work to be completed within 7 business days of initiation of work. • Update of Geotechnical Report to be completed within 5 weeks of completion of Field Work. OWNER'S RESPONSIBILITIES Owner shall be responsible for the following: - Notification to proceed - Timely review and approval of reports CONCLUSION We are eager to launch forward on these additional services in an effective and efficient manner to make this project a success for Orange County and the Town of Hillsborough.
