PURPOSE: To hold a public hearing on a Planning Director initiated Unified Development
Ordinance (UDO) text amendment modifying acreage requirements, specifically increasing the
maximum allowable size of the district from 50 to 100 acres, and including new permitted land
uses (i.e. public parks and government land uses) within the Home Park Conditional Zoning
District (HP-CZD).
BACKGROUND: The County has begun investigating opportunities and constraints associated
with the development of affordable housing. This includes potentially allowing for development
of affordable housing units on County owned property in addition to existing, or proposed,
government facilities (i.e. offices, parks, etc.).
One opportunity being reviewed is the development of Manufactured Homes (i.e. Mobile
Homes) through the Home Park Conditional Zoning District (HP-CZD) rezoning process.
Current regulations limit HP-CZD to a maximum allowable area of 50 acres. Staff is
recommending increasing the maximum allowable land area for said district be increased to 100
acres.
Further, staff has determined that parks and government facilities are not listed as permitted
uses of property within the HP-CZD. If the properties under consideration were rezoned, other
uses such as a public park could not be developed. The proposed amendment will address this
issue by allowing for the development of parks and government facilities within the District.

Planning Director Recommendation: The Planning Director recommends approval of the
Statement of Consistency, as contained in Attachment 3, and the UDO Text Amendment, as
contained within Attachment 4.
Planning Board Recommendation: At its May 2, 2018 meeting, the Board voted unanimously to
recommend approval of the Statement of Consistency and the UDO amendment package. An
excerpt of the draft minutes and the signed Statement of Consistency from this meeting are
included in Attachment 2.
SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to
this agenda item:
• GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND
ENVIRONMENTAL POLICIES
The fair treatment and meaningful involvement of people of all races, cultures, incomes
and educational levels with respect to the development and enforcement of
environmental laws, regulations, policies, and decisions. Fair treatment means that no
group of people should bear a disproportionate share of the negative environmental
consequences resulting from industrial, governmental and commercial operations or
policies.
FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding
for the provision of County services. Existing staff, included in the Departmental staffing budget,
will accomplish the work required to process this amendment.
RECOMMENDATION(S): The Manager recommends the Board:
1. Receive the proposed amendments to the UDO as detailed in this abstract and
attachments;
2. Conduct the public hearing and accept comment on the proposed amendments;
3. Close the public hearing. (Note that, because this is a legislative decision, additional
comments at a later date are permitted); and
4. Decide on one of the following options:
a. Adopt the proposed amendments by approving the Statement of Consistency
(Attachment 3) and Ordinance (Attachment 4).
b. Defer a decision to a later BOCC regular meeting date.
c. Refer the item back to the Planning Board for a specific purpose.

B. RATIONALE
1. Purpose/Mission
In accordance with the provisions of Section 2.8 Zoning Atlas and Unified
Development Ordinance Amendments of the UDO, the Planning Director has

initiated text amendments to the UDO to increase the maximum allowable acreage
for, and include additional permitted land uses within, the Home Park Conditional
Zoning District (HP-CZD).
Specifically staff is proposing to increase the maximum allowable acreage for a
Home Park to be 100 acres versus the current limit of 50 acres and allow for
government office(s) and parks within the HP-CZD district.
The purpose of the amendment is to allow for larger home parks within the County,
given density limitations, thereby increasing opportunities for additional affordable
housing, and allowing for the development of additional land uses within the HP-CZD
conditional zoning district.
2. Analysis
As required under Section 2.8.5 of the UDO, the Planning Director is required to:
‘cause an analysis to be made of the application and, based upon that analysis,
prepare a recommendation for consideration by the Planning Board and the Board of
County Commissioners’.
The County has begun investigating the various opportunities and constraints
associated with the development of affordable housing units, including the
development of mobile home parks through the Home Park Conditional Zoning
District (HP-CZD) process. Staff has been directed to investigate the possibility of
locating a HP-CZD district on County property in addition to other existing, or
proposed, government operated facilities (i.e. offices, parks, etc.).
Residential density, based on the Watershed Protection Overlay district a given
parcel is located within, can be relatively low. In order to cluster density to ‘threshold’
numbers, a larger parcel is suggested. Current regulations limit HP-CZD to a
maximum allowable area of 50 acres. Staff is recommending increasing the
maximum allowable land area that can be zoned allowing for the development of a
HP-CZD to 100 acres.
Further, staff has determined parks and government facilities are not listed as
permitted uses of property within the HP-CZD.
The proposed amendment will address this issue by allowing for the possible
development of mobile home and recreational vehicle parks and government facilities
within the District.

STATEMENT OF CONSISTENCY
OF A PROPOSED UNIFIED DEVELOPMENT ORDINANCE TEXT AMENDMENT
WITH THE ADOPTED ORANGE COUNTY 2030 COMPREHENSIVE PLAN
Orange County has initiated an amendment to the Unified Development Ordinance
(UDO) increasing the maximum allowable acreage for, and including additional permitted land
uses within, the Home Park Conditional Zoning District (HP-CZD).
The BOCC finds:
a. The requirements of Section 2.8 of the UDO have been deemed complete; and,
b. Pursuant to Sections 1.1.5, and 1.1.7 of the UDO and to Section 153A-341 of the
North Carolina General Statutes, the Board finds sufficient documentation within
the record denoting that the amendment is consistent with the adopted 2030
Comprehensive Plan.
1. The amendment is consistent with applicable plans because it supports the
following 2030 Comprehensive Plan goals and objectives:
• Objective Housing – 4.1: Continue to permit HUD code-compliant
manufactured housing as a form of affordable housing in the
County.
These amendments are consistent with this goal and
objective by increasing the maximum allowable acreage of
property that can be rezoned to HP-CZD thereby increasing
the number of individual manufactured housing units that
can be located within the district.
• Objective Land Use – 4.1: Support the use of individual
manufactured housing units as a useful housing resource in the
County by increasing the opportunities where these units can
locate by-right.
These amendments are consistent with this objective by
increasing the maximum allowable acreage of property that
can be rezoned to HP-CZD thereby increasing the number of
individual manufactured housing units that can be located
within the district. The amendment also expands permitted
uses within the district allowing for more opportunities for co-
location of home parks on County owned property where
there are existing facilities (i.e. offices, parks, etc.).
c. The amendment is reasonable and in the public interest because it:
1. Increases opportunities to develop affordable housing.
The amendment increases the land area that can be rezoned to
HP-CZD thereby allowing for the location of additional
manufactured housing units.
2. Allows for additional governmental land uses within the HP-CZD.
The proposed regulations allow for increased opportunities for the
County to partner with developers to locate HP-CZD on County

owned property where existing, or proposed, government land uses
are located (i.e. offices, parks, etc.).
The Board of County Commissioners hereby adopts this Statement of Consistency and
findings expressed herein.

UNIFIED DEVELOPMENT ORDINANCE OF ORANGE COUNTY
Whereas, Orange County has initiated amendments to its Unified Development Ordinance
(UDO) to modify existing regulations modifying maximum allowable acreage, and permitted land
uses within, the Home Park Conditional Zoning District (HP-CZD), and
Whereas, staff has determined there is a need to increase the maximum allowable
acreage that can be re-zoned HP-CZD in order to address development of home parks within
various Watershed Protection Overlay Districts where density is limited (i.e. 1 dwelling unit for
every 2 and/or 5 acres of land area), and
Whereas, staff has determined there is a need to allow additional land uses, specifically
parks, government offices, and government protective services (i.e. fire and police departments)
to promote potential development of home parks on government owned property where
parks/government offices are planned, and
Whereas, the requirements of Section 2.8 of the Unified Development Ordinance have
been deemed complete, and
Whereas, the Orange County Planning Board has recommended approval of the proposed
text amendments, and
Whereas, the County has held the required public hearing and has found the proposed
text amendments are consistent with the goals and policies of the adopted Comprehensive
Plan.
Be it ordained by the Board of Commissioners of Orange County that the Unified
Development Ordinance of Orange County is hereby amended as depicted in the attached
pages.
Be it further ordained that this ordinance be placed in the book of published ordinances
and that this ordinance is effective upon its adoption.

Adequate housing is fundamental to the welfare of county residents;

Development Ordinance (UDO) to modify maximum allowable acreage and to add permitted uses
in the Home Park Conditional Zoning District (HP-CZD). The following Sections of the UDO are
proposed for amendments:
3.8 Base Zoning Districts – Home Park (HP) Conditional Zoning District
5.2.3 Table of Permitted Uses – Conditional Zoning Districts
The purpose of the amendments is to increase the number of acres that can be zoned HP-CZD
and to add additional permitted land uses to the HP-CZD district including public parks,
government facilities/office buildings, and government protective services (i.e. police and fire
stations).
The Orange County Planning Board, at its May 2, 2018 regular meeting, voted unanimously to

3. Unified Development Ordinance Text Amendments: In accordance with the provisions of
Section 2.8 Zoning Atlas and Unified Development Ordinance Amendments of the Unified
Development Ordinance, the Planning Director has initiated amendments to the Unified
Development Ordinance (UDO) to modify subdivision review processes, in accordance with
Session Law 2017-10. The following Sections of the UDO are proposed for amendments:
2.14 Minor Subdivisions
7.2 Classification of Subdivisions
The purpose of the amendments is to incorporate recent changes in State law relating to the
processing of subdivisions.

4. Unified Development Ordinance Text Amendments: In accordance with the provisions of
Section 2.8 Zoning Atlas and Unified Development Ordinance Amendments of the Unified

Development Ordinance (UDO) to clarify requirements for Neighborhood Information Meetings
(NIM). The following Sections of the UDO are proposed for amendments:
2.7.5 Special Use Permits – Neighborhood Information Meeting
2.9.1 (D) Conditional Use District – Neighborhood Information Meeting
2.9.2 (D) Conditional Zoning District – Neighborhood Information Meeting
5.10 8 (B) (2) Balloon Test – Telecommunication Facilities – Class B Special Use Permits
The purpose of the amendments is to amend the timeframe for holding of neighborhood
information meetings, eliminating confusion on the required time frame, and ensuring uniformity
within the UDO.
