PURPOSE: To endorse plans to develop a permanent recycling dropoff site at the Hampton
Pointe shopping center in Hillsborough and to authorize staff to develop a memorandum of
understanding with Hampton Pointe/Home Depot regarding responsibilities far operation,
maintenance, and related issues for the recycling center..
BACKGROUND: When the Hampton Pointe shopping center was going through the Town of
Hillsborough's approval process a few years ago, one of the permit conditions was that the
developer was required to provide a dedicated area for a recycling site. The permit was non-
specific about when the site must be provided, and the first phase of Hampton Pointe was
constructed without the designation of a permanent recycling site. This did not create
operational concerns because the County was already operating a dropoff site approximately
one mile away on property leased by WalMart at the Hillsborough Commons shopping center.
However, when WalMart relocated to Hampton Pointe in 2003, the owner of the Hillsborough
Commons shopping center asked the County to remove its recycling dropoff site there, which
was accomplished in July 2004.
Since late 2003, County staff have been in discussions about a specific location for a recycling
site with the Hampton Pointe developers, and more recently, also with representatives of the
planned new Home Depot Store there. Staff have recently concluded successful discussions
with Hampton Pointe and Home Depot and have developed plans to construct a dropoff site
that will be convenient and accessible to citizens and safe and efficient for the County to
operate. The accompanying diagram outlines the general configuration of the recycling site,
adjacent to the planned Home Depot at the southern end of the Hampton Pointe development.
Staff recommends that the Board endorse the construction of the permanent recycling dropoff
site and authorize the Manager and staff to develop and enter into a memorandum of
agreement with Hampton Pointe/Home Depot that will govern the use of the site and mutual
responsibilities for its construction, operation, maintenance, etc.
Since the closing of the Hillsborough Commons dropoff site, staff have explored a number of
possibilities for locating a temporary recycling site in the Hillsborough area until the permanent
Hampton Pointe site becomes available, Staff have thus far been unable to identify an
appropriate temporary site but will continue to examine other opportunities as they may be
identified,
FINANCIAL IMPACT: Staff estimate that the cost of constructing the site, which is the
County's responsibility, will be approximately $100,000 to $110,000. Funds far that
construction were appropriated in the 2004-05 Solid Waste/Landfill Operations enterprise fund
btadget. The County already owns the containers and other equipment that will be necessary to
service the site, The exact cost of construction will be determined based on bids that will be
solicited and received later this calendar year, depending on the timeline of the Home Depot
store construction. It is anticipated that recycling center construction will not begin until the
2005-06 fiscal year due to the need far some of the basic site infrastructure to be developed by
Home Depot such as grading, site drainage features, and roadways, Timing of the construction
and opening of the recycling site will be tied to the timeline for construction and opening of the
new Home Depot store, which is unknown at this time, but could perhaps take place by late
2005.
RECOMMENDATION(S): The Manager recommends that the Board endorse the development
of the new Hampton Pointe dropoff recycling center and authorize the Manager and staff to
develop and enter into a memorandum of understanding with the appropriate parties regarding
the site's operation, maintenance, and the like..

MEMORANDUM OF UNDERSTANDING
This document constitutes a memorandum of understanding between The County of Orange and
Home Depot to define responsibilities for operations and maintenance, including litter/trash
pickup and other related issues/problems, at and around the permanent recycling center located
adjacent to the Hampton Pointe Home Depot store in Hillsborough, North Carolina.
The proposed recycling center site located adjacent to the new proposed Home Depot store in
Hillsborough was preliminarily planned with a fence located on the boundary between the
recycling center area and Home Depot. The Orange County Solid Waste Department has
identified such a fence to be a barrier to efficient and safe servicing of this center by department
staff. The County also understands that Home Depot has concerns regarding a recycling center
that is located close to its store, including outside storage and receiving areas,
Therefore, the County wishes to propose a means by which the currently proposed fence is
eliminated, while at the same time addressing some of the concerns posed by Home Depot Since
it is in the interest ofboth parties to co-exist in a mutually agreeable manner, minimizing
nuisances or other problems, it is important to set forth an understanding regarding
responsibilities of each party,
Coun Responsibility
• Regularly (at least twice weekly) clean up litter and other materials spilled or dropped that is
incidental to recycling center operation. This includes paper, etc, that has blown fmm or
been illegally dmnped at the recycling center and onto adjacent Home Depot property.
• Clean «p illegally dumped materials, including paper, fw°niture, appliances, tires, etc. on a
regular basis (at least twice weekly) and within 24 hours following notification by Home
Depot management staff to Solid Waste Department management staff. Should that 24-hour
period fall on a holiday or weekend, the cleanup will take place on the next regular County
workday,
• Delineate the area of responsibility for County pick-up of illegally dumped materials or
recycling center litter (see attached drawing).
• Except for County holidays or weekends, the County will respond to requests from Home
Depot regarding litter or illegal dumping immediately when possible, but in all cases within
24 hours. Should that 24-hour period fall on a holiday or weekend, the cleanup will take
place on the next regular County workday..
• The County will cooperate with Home Depot in pursuing extraordinary instances of illegal
dmmping, vandalism, or theft.
• County will not block or otherwise unnecessarily impede Home Depot service or customer
traffic (ingress/egress) or access to outside storage.
Home Depot Responsibility
Home Depot will be responsible for materials improperly placed, spilled or otherwise
dmnped by Home Depot employees, vendors or customers (where identifiable).,
Home Depot will cooperate with the County in pursuing extraordinary instances of illegal
dumping, vandalism, or theft.
I-Iome Depot will not block or unnecessarily impede service or customer traffic
(ingress/egress) to the recycling center.

It is expected that County management and Home Depot store management will maintain, as
necessary, ongoing avenues of communication with regard to utilization of the recycling center
and store operations. County staff will be responsive to issues raised by Home Depot and move
as quickly and effectively as possible to resolve problems.
Should problems arise that are likely to be resolved or substantially improved only with the
installation of a fence along the border between the Home Depot parcel and the recycling center
parcel, the County will install such a fence at County expense.
The memorandum of understanding will become effective upon initiation of recycling collection
services at the Hampton Point recycling center by the County,
