UDO Amendment Outline Form 2018-4 – Revise Allowable Acreage and Include Additional Permitted Land Uses Within the Home Park Conditional Zoning District (HP- CZD) Craig Benedict, Director, 919-245-2575 Michael Harvey, Planner III, 919-245-2597 PURPOSE: To consider a modification to a previously approved Amendment Outline Form (AOF) and re-approve process/schedule components for a proposed text amendment to the Orange County Unified Development Ordinance (UDO). BACKGROUND: At its March 8, 2018 regular meeting, the BOCC approved AOF2018-4 authorizing staff to initiate a UDO text amendment modifying allowable land uses within the Home Park Conditional Zoning District (HP-CZD). Specifically, the amendment suggested on March 8th would add public parks and government offices as permitted land uses within the HP- CZD. While working on the amendment, staff determined there was a need to increase the maximum allowable acreage for a HP-CZD. Staff is recommending increasing the maximum allowable acreage for a HP-CZD from 50 to 100 acres. The amendment would allow for additional land area to be zoned HP-CZD and increase additional affordable housing opportunities. For more information please refer to Attachment 1. FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding for the provision of County services. Costs for the required legal advertisement for the text amendment will be paid from FY2017-18 Departmental funds budgeted for this purpose. Existing Planning staff included in the Departmental staffing budget will accomplish the work required to process these amendments. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to this item: • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND ENVIRONMENTAL POLICIES 1 The fair treatment and meaningful involvement of people of all races, cultures, incomes and educational levels with respect to the development and enforcement of environmental laws, regulations, policies, and decisions. Fair treatment means that no group of people should bear a disproportionate share of the negative environmental consequences resulting from industrial, governmental and commercial operations or policies. RATIONALE 1. Purpose/Mission In accordance with the provisions of Section 2.8 Zoning Atlas and Unified Development Ordinance Amendments of the UDO, the Planning Director has initiated text amendments to the UDO to increase the maximum allowable acreage 3 Form Revised 09-29-16 for, and include additional permitted land uses within, the Home Park Conditional Zoning District (HP-CZD). Specifically staff is proposing to increase the maximum allowable acreage for a Home Park to be 100 acres versus the current limit of 50 acres and allow for government office(s) and parks within the HP-CZD district. The purpose of the amendment is to allow for larger home parks within the County, given density limitations, thereby increasing opportunities for additional affordable housing, and allowing for the development of additional land uses within the HP-CZD conditional zoning district. 2. Analysis As required under Section 2.8.5 of the UDO, the Planning Director is required to: ‘cause an analysis to be made of the application and, based upon that analysis, prepare a recommendation for consideration by the Planning Board and the Board of County Commissioners’. The County has begun investigating opportunities to develop affordable housing units in the County. These units could be in addition to other existing, or proposed, County operated facilities (i.e. government offices, parks, etc.) located on the same property. Residential density (in AR, RI and RB zoning) in many parts of the county is relatively low so in order to cluster density to ‘threshold’ numbers, a larger parcel is suggested. Current regulations limit Home Parks to a maximum allowable area of 50 acres. Staff is recommending increasing the maximum allowable land area that can be zoned allowing for the development of a Home Park to 100 acres. Further staff has determined parks and government facilities are not listed as permitted uses of property within the HP-CZD. The proposed amendment will address this issue by allowing for the possible development of mobile home and recreational vehicle parks and government facilities within the District. 3.
