Manager, ext. 2307 Joseph Pulcinella, Animal Shelter Director, 933-3373 TELEPHONE NUMBERS: Hillsborough 732-8181 Chapel Hill 968-4501 Durham 688-7331 Mebane 336-227-2031 PURPOSE: To present for BOCC approval a contract with Dr. Wendy Royce, DVM, that would expand and enhance spay/neuter service capabilities at the Orange County Animal Shelter. BACKGROUND: The Orange County Animal Shelter (OCAS) has the opportunity to expand the sterilization program for shelter animals to include Saturdays by adding an additional provider, Dr Wendy Royce, Dr. Royce is the owner of a mobile veterinary practice called "Pop- NC" (Pet Overpopulation Patrol - North Carolina - Mobile Spay/Neuter). This would enable the Shelter to conduct adoptions on Saturday, a day when many people prefer to visit the shelter. Providing adoptions on Saturday would be more convenient for clients, and would also allow them to bring their new pet home on a day when they will have more free time for supervision and training. The proposed contract also allows Dr. Royce to be available as the alternate veterinarian on record with the Shelter for Tuesday surgeries. Dr. Royce operates a mobile spay/neuter clinic and has had successful experience at Wake and Durham County shelters in both adult and pediatric sterilization. Dr. Royce would bring the mobile clinic to the shelter, alleviating the need to transport animals to the veterinary clinic. This would save both OCAS staff time and fuel expense. The contract format and requirements as attached are the same as negotiated during the Shelter transition by the team that consisted of Pam Jones - Purchasing, Rosemary Summers - Health, Joe Pulcinella - Shelter, John Sauls - Animal Control, and Kate Wilder - Health Board veterinarian. The fees under this contract for sterilization are $60 per animal with additional charges, as authorized, for special services. (This fee level is the same flat rate as that currently authorized by the Board in the existing contract with Dr. Marat Dubrovsky, d/b/a Nicks Road Veterinary Clinic.) FINANCIAL IMPACT: The estimated value of this contract through the remainder of FY 2004- 2005 is approximately $37,080. Dr. Royce will be compensated on an actual fee for service basis. The BOCC appropriated $132,000 in the Manager's Recommended Budget for spay/neuter services with offsetting revenue through adoption fees estimated at $154,000. While actual adoption fee income has been sufficient to defray spay/neuter costs, unanticipated overages in additional line items related to animal care and disease prevention have created financial pressure on the overall Animal Shelter budget. Staff is conducting a mid-year analysis of the Shelter operating budget and will report its findings and the need for any budget transfer within this fiscal year to the BOCC at an upcoming meeting. RECOMMENDATION(S): The Manager recommends that the Board approve the contract with Dr. Wendy Royce, d/b/a "Pet Overpopulation Patrol - North Carolina - Mobile Spay/Neuter" for spay/neuter services for the Orange County Animal Shelter, and authorize the Chair to sign the contract following final review by staff and the County Attorney. NORTH CAROLINA ORANGE COUNTY AN AGREEMENT BETWEEN ORANGE COUNTY HEREAFTER THE COUNTY AND WENDY ROYCE, DVM, PC DBA PET OVERPOPULATION PATROL-NORTH CAROLINA-MOBILE SPAY/NEUTER, HEREINAFTER THE VETERNARIAN, FOR THE PERFORMANCE OF SPAY/NEUTER SURGEORY SERVICE WHEREAS, the county has the need for spay/neuter surgery services for animals adopted from the Orange County Animal Shelter (Shelter), WITNESSETH A. The Veterinarian agrees to perform the following services. I -Spay and Neuter animals that are at least eight weeks old presented by County Shelter personnel related to operation of the Shelter. Female animals shall be spayed by the Veterinarian performing a complete oviohysterectomy. Appendix A is the Veterinarian's Fee Schedule. 2- Provide suitable facilities for surgeries and related procedures at the time animals are presented. Shelter animals will be presented on Tuesday and Saturday. (Arrangements to accommodate Veterinarian vacation, sick, or other leave will be negotiated with the Shelter Director as necessary.) The Veterinarian will house the animals in a humane manner consistent with industry standards and requirements. Surgery will be performed in a timely manner so that animals can be released for return to the Shelter by 3:30 pm on the day of surgery. If for any reason the animal needs additional hospitalization the . Veterinarian will provide suitable facilities and the appropriate monitoring until such time as the animal is able and can be returned to the Shelter. The Veterinarian will provide Shelter personnel with after hours contact information. 3- Conduct an examination of the animal's heart, lungs, gums and other areas deemed appropriate to determine whether the animal is suitable for surgery. Any major problems which present upon examination will be reported to Shelter personnel. If the problem disqualifies the animal for surgery, the Veterinarian will hold the animal until its regular time for return, and it will then be returned to the Shelter. The Veterinarian shall consult with the Shelter Director or appropriate designee prior to and concerning decisions to disqualify an animal for surgery. Minor problems can be resolved by Veterinarian and all problems will be noted accordingly. The Shelter Director and the Veterinarian shall develop all necessary protocol for determining whether problems are major or minor. Appendix B prescribes the physical examination and physical examination reporting responsibilities of the Veterinarian. Each physical examination report shall be provided to Shelter personnel for record keeping purposes. 4-Remove the rear dewclaws if deemed appropriate to avoid future problems. Restraining devices, such as an Elizabethan Collar, will be provided if deemed necessary. 5-Administer a rabies vaccination if requested by Shelter personnel and provide the necessary records. 6-Implant microchips at the request of Shelter personnel and provide necessary paperwork to Shelter personnel. 7-Prescribe pain medication when deemed appropriate or requested by Shelter personnel. 8-Prepare and return to Shelter personnel when the animal is returned to the Shelter all paperwork related to the services provided, including detailed records of services provided and any other information relevant to the humane treatment, health, comfort, and safety of the animal. 9-Maintain all required licenses and certifications as well as the level of expertise and education to keep abreast of current industry standards and practices. 10-Maintain all necessary insurance policies as may be prescribed by the County's Risk Manager. Veterinarian agrees to obtain personal liability insurance and agrees that Veterinarian is operation as an independent contractor and that no benefits, including Worker's Compensation coverage, is available to Veterinarian from the County. Proof of insurance including proof of Worker's Compensation coverage will be presented to the County on or before the effective date of this agreement and with each renewal thereafter. The Veterinarian agrees to hold the County harmless from any and all claims against the County, its elected officials, employees or volunteers, for injury or loss resulting from the service provided to the County pursuant to this agreement. 11-Comply with all applicable federal, State, and local laws, including non-discrimination laws as may be applicable in fulfilling this agreement. B. This agreement shall exist and continue from through and including , unless sooner terminated as provided herein. C. This agreement may be terminated by either party, with or without cause, with the terminating party providing the other party with 30 days written notice. D. Veterinarian performance under this agreement will be evaluated by the County according, but not limited to, the following service standards: 1) ability to meet workload and timeframes prescribed in the agreement; 2) incident of post surgical complications and how resolved; 3) accuracy, completeness, and timeliness of recordkeeping; 4) effective customer service (responsiveness to shelter personnel); 5) pet owner feedback-survey to be administered by the County. E. Terms of Payment: Veterinarian shall submit for payment monthly invoices to the County for fees charged for services provided to the animals presented by Shelter personnel according to the Fee Schedule attached as Appendix A.
