The Board of County Commissioners, under the authority of North Carolina General Statute, 46
appoints the Orange County Planning Board (OCPB) to uphold the written land development 47
laws of the County. The general purpose of OCPB is to guide and accomplish coordinated and 48
harmonious development. OCPB shall do so in a manner, which considers the present and 49
future needs of its citizens and businesses through efficient and responsive process that 50
contributes to and promotes the health, safety, and welfare of the overall County. The OCPB 51
will make every effort to uphold a vision of responsive governance and quality public services 52
during our deliberations, decisions, and recommendations. 53

55 PUBLIC CHARGE 56
The Planning Board pledges to the citizens of Orange County its respect. The Board asks its 57
citizens to conduct themselves in a respectful, courteous manner, both with the Board and with 58
fellow citizens. At any time, should any member of the Board or any citizen fail to observe this 59
public charge, the Chair will ask the offending member to leave the meeting until that individual 60
regains personal control. Should decorum fail to be restored, the Chair will recess the meeting 61
until such time that a genuine commitment to this public charge is observed. 62

68 AGENDA ITEM 7: UNIFIED DEVELOPMENT ORDINANCE (UDO) TEXT AMENDMENT- To re-review and make a 69
recommendation to the BOCC on government-initiated amendments to the text of the UDO to 70
modify the Mobile Home Park Conditional Zoning District (MHP-CZ) to a Home Park 71
Conditional Zoning District (HP-CZ). The Planning Board recommendation approval of this 72
item on December 7, 2016; subsequent revisions by the County Attorney’s office necessitates 73
that the amendment be reviewed again by the Planning Board. This item is scheduled for the 74
February 13, 2017 Quarterly Public Hearing. 75

Patrick Mallett Presented the proposed changes that were made to materials since the December 7, 2016 Planning 77
Board Meeting and needed to meet legal sufficiency. 78

Craig Benedict told Patrick Mallett that when he presents this item he can explain that it has not changed from the 80
way it was originally. 81

Buddy Hartley asked how they will enforce the regulations. 85

Michael Harvey explained there are conditions for the approval for the certificate of occupancy, which often include 87
time limits on how long the temporary structure can stay on the property. After that time frame if the structure is still 88
there the Planning Department issues a notice of violation; the notice of violation will allow the resident 30 days to 89
remove it, after that 30 days it is a $500 a day fine. 90

Patricia Roberts asked if there is a second impact fee if you build an efficiency unit. 92

Michael Harvey said that you do have to pay another impact fee based on the number of bedrooms of the efficiency 94
and then pay the difference in the number of bedrooms in the new house you’re building. 95

Patrick Mallett continued reviewing the abstract and text changes. 97

Tony Blake asked what the attorney’s concerns were with this text amendment 99

Patrick Mallett said that we needed to focus on what goes on in a mobile home park. The previous recommendation 101
by the Planning Board dealt too much sections beyond the scope of this amendment. 102

Craig Benedict explained that we will be coming up with a new method so that we don’t keep bringing things back 104
and forth to the Planning Board. 105

Paul Guthrie asked if there was a documented definition of what a customary use is. 109

Patrick Mallett explained that is would be an accessory structure. 111

Michael Harvey stated that it is defined in article 10 of the UDO defining what an accessory structure is. 113

Andrea Rohrbacher asked why the porch has to be covered as defined under attached structures 115

Lydia Wegman said that it says “including” which does exclude the porches from being covered or uncovered, rather 117
it just list covered porches as an example. 118

Patrick Mallett and Michael Harvey agreed with Lydia’s explanation. 120

Tony Blake asked if the addressing ordinance would apply to this as it does in the rest of the county. 122

Michael Harvey further explained that the director of land records is the one who assigns that addresses. 126
