OCPB shall do so in a manner which considers the present and future needs of its residents and businesses through efficient and responsive process that contributes to and promotes the health, safety, and welfare of the overall County. The OCPB will make every effort to uphold a vision of responsive governance and quality public services during our deliberations, decisions, and recommendations. Public Charge The Planning Board pledges to the residents of Orange County its respect. The Board asks its residents to conduct themselves in a respectful, courteous manner, both with the Board and with fellow residents. Should decorum fail to be restored, the Chair will recess the meeting until 56 such time that a genuine commitment to this public charge is observed. 57 58 Lydia Wegman read the public charge aloud. 59 60 AGENDA ITEM 6: CHAIR COMMENTS 61 There were no comments. 62 63 AGENDA ITEM 7: LAND USE PLAN AMENDMENTS TO EXPAND HILLSBOROUGH ECONOMIC DEVELOPMENT AREA - 64 Hillsborough/Orange County Central Orange Coordinated Area Land Use Plan Amendment & Orange County 65 Comprehensive Plan Future Land Use Map Amendment - To review and make a recommendation to the BOCC on 66 land use map amendments to expand the Hillsborough Economic Development area south of Interstate 40 in the 67 vicinity of Old Highway 86. 68 PRESENTER: Tom Altieri, Comprehensive Planning Supervisor. 69 70 Tom Altieri explained that the Planning Board was only being asked to review and not make a recommendation to the 71 BOCC this evening because the Town of Hillsborough’s public hearing on this matter was postponed from January 72 due to snow and would be taking place February 15. Generally, the county likes to hear from the town first. He noted 73 the discussion involves the town’s water and sewer services and the county wants to hear the town’s thoughts, some 74 of which the county has heard previously due to the adjacent Settler’s Point property. Tom Altieri also said the county 75 wants to be careful that this process isn’t confusing to the public. He noted that paper copies of the revised 76 recommendation from the planning director were in front of the Planning Board members. The discussion this 77 evening would be purely informational. He reviewed that he would give a brief PowerPoint presentation and share a 78 timeline of events. 79 80 Tom Altieri reviewed that there is the Central Orange Coordinated Area and Orange County Comprehensive Plan. 81 The county has plans to extend infrastructure south of I-40 along Old N.C. 86 and there is interest in preserving those 82 resources for nonresidential uses. The town has expressed interest in that as well. Businesses look for sites already 83 correctly zoned. Land receives a zoning designation for economic development opportunities and for consistency. 84 85 Lydia Wegman asked if the town supports nonresidential uses. Do we know that? Tom Altieri answered I think in 86 general we know that. Most particularly in this area, this would be the southern most extent of water and sewer 87 services and I think if possible the town would like to not have any residential at all. 88 89 Planning Director Craig Benedict added that sewer systems flow downhill by gravity adjacent to streams. This 90 extension would go to the ridgeline. The ridgeline is the limit to sewer service in that area. The other side of the 91 ridgeline involves joint planning with Chapel Hill and Carrboro. Regarding the question Lydia Wegman posed about 92 what type of use, the county has an inter-local agreement with the Town of Hillsborough for extension to the south. 93 That agreement does not include this area. Hillsborough has some input regarding what goes in this area. The 94 agreement we have now says the land in this area is for light industrial, so it’s not for residential. It’s more 95 complicated than usual in that Hillsborough has the water and sewer services and the county has the economic 96 development area. 97 98 Tom Altieri shared a timeline in his presentation from June 2017, when the county put forth water and sewer 99 boundary map amendments, to February 2018, when county staff met with Hillsborough Planning Director Margaret 100 Hauth to coordinate a restart of the Economic Development area expansion and agreement on future land uses. 101 102 Tom Altieri shared a map of the Hillsborough primary service area. Craig Benedict indicated I-40, Davis Road, the 80 103 acres and 14 acres on opposite sides of the road, and the ridgeline. 104 105 Paul Guthrie asked if the Town of Hillsborough is prepared to serve everything up to that ridgeline. Tom Altieri 106 answered everywhere in the map. This area is outside the map. 107 108 Craig Benedict said if we want it to be used for economic development, then we will expand the agreement. He 109 reviewed that the county also has inter-local agreements with Mebane and the City of Durham. 110 7 111 Paul Guthrie said so the short answer is no. Craig Benedict affirmed that. 112 113 Tom Altieri reviewed that the Joint Land Use Plan is about the future, long-term vision, with coordination around the 114 fringe, using a variety of urban-style land use categories and some rural. The text and map form the “plan.” The 115 Orange County Comprehensive Plan Future Land Use Map is also about the future, long-term vision. It is county-116 wide, consistent with joint plans, has broad categories of land uses, including many rural uses. Text and map form 117 the “plan.” 118 119 Tom Altieri said there is no rezoning proposed today but the staff proposal would be to apply Suburban Office 120 Complex zoning to the expanded area. Office and employment enterprises that don’t rely on walk-in customers are 121 allowed in that zoning designation. He knows the town had expressed some concern about too much retail. That’s 122 one reason this land use category is being proposed. 123 124 Tom Altieri said the proposed amendment would be to expand the county’s economic development area to include 125 these approximately 89 acres which involve 20 parcels. 126 127 Craig Benedict reviewed that Rural Buffer is also a zoning category, allowing one residential unit per 2 acres. There 128 are some non-residential uses that can go in the rural areas like kennels (approved through a quasi-judicial process). 129 130 Lydia Wegman asked if there are residences along Davis Road. Tom Altieri said there are some. He thinks there are 131 four residences on Davis Road and some along Scarlett Mountain Road. 132 133 Lydia Wegman asked for confirmation that there is no one living on the rectangular parcel along Davis Road. Tom 134 Altieri answered no and it is 12 acres. Craig Benedict noted the owners of that parcel were attending this evening’s 135 meeting. 136 137 Kim Piracci asked about green blobs on the map, which seemed random. Tom Altieri explained they are not random. 138 They indicate historic sites, preservation of a species, flood plains, etc. Craig Benedict added those are flags to look 139 at in the zoning area or on a future site plan as possible protected areas. 140 141 Tom Altieri reviewed the map, indicating areas where no rezoning is proposed. He reviewed areas in purple are 142 already zoned EDH4, EDH5. Craig Benedict said the purples to the north are now part of the Settler’s Point 143 conditional zoning district. 144 145 Lydia Wegman asked that before any future non-residential activity took place on the parcels up for discussion this 146 evening, the zoning would have to precede it. Tom Altieri confirmed that is right. 147 148 Craig Benedict said let me restate that. Orange County can suggest a zoning and land use change. The county isn’t 149 doing that here because it is in the interest of the residents and local governments involved to know what would be 150 put there. That’s a zoning process. See the zoning category and the uses that are in there. If someone was to do a 151 master plan development conditional zoning, there would be a rudimentary site plan. For a typical conventional 152 zoning from R1 to EDH5, they don’t have to say it’s an X, Y, Z store. With conditional zoning, they have to show 153 where roads are, environmental areas and follow an abridged list of uses. 154 155 Lydia Wegman asked again that landowners of those 20 parcels now can build low-density residential. 156 157 Craig Benedict said correct. If people want to do low-density residential, they can. 158 159 Hunter Spitzer asked if any other uses were considered other than Suburban Office Complex. 160 161 Tom Altieri answered yes, Employment was considered but that would allow walk-in customers so we determined 162 Suburban Office Complex was preferred. Another option could be a 10- or 20-year transition area with high-density 163 residential and we know the town is opposed to high-density residential in this area. 164 165 8 Craig Benedict added the Employment zoning designation would also have more traffic than the Suburban Office 166 Complex designation. 167 168 Paul Guthrie asked where the high-transition line is located. Craig Benedict indicated it on the map, at the top of the 169 straight yellow section. Paul Guthrie asked about its future. Craig Benedict said we don’t know and it’s not in our 170 control. Paul Guthrie said he asks that because the tower by the road has become a transition line tower with a great 171 many feeds. Craig Benedict said 20 years ago, people didn’t think you could put cell phone towers on those transition 172 line towers and now you see those antennae. 173 174 Tom Altieri reviewed that next steps include additional coordination with town staff to schedule and hold a joint public 175 information meeting. The Planning Board recommendation and BOCC decisions would be rescheduled. The 176 Hillsborough Planning Board will discuss the zoning of this land on February 15. The town and county boards of 177 commissioners have a joint meeting February 22. 178 179 Tom Altieri said these amendments are based on the premise that the county wants to expand the economic 180 development district. If something different comes from those two boards, then staff will change direction. 181 182 Buddy Hartley asked why the town does not want residential usage for its water and sewer. 183 184 Tom Altieri answered the town does not want residential in this area because of traffic concerns in Hillsborough and 185 an interest in focusing on in-fill development with the approved Collins Ridge development and the potential 186 redevelopment of Daniel Boone. The town is sensitive to additional residential for this area. 187 188 Craig Benedict said the counter argument is that Hillsborough’s strategic planning process regarding that growth ring 189 around town, before Waterstone existed, was that the town didn’t want any residential north of town because people 190 would be trying to get to interstates 85 and 40, so there was interest in putting residential south of town. Now, 191 Hillsborough’s argument is they have interest in walkability. If residential were allowed on this land being discussed 192 tonight, you’d have this satellite community south of I-40 that didn’t have continuity with this compact urban form. If 193 the county could provide water and sewer, we would suggest residential that is senior housing to fulfill a need. It 194 would have to be higher density residential -- perhaps people who live there and get on the interstate to go to work 195 and maybe go to a restaurant in Hillsborough. 196 197 Lydia Wegman asked if anyone has questions or comments. 198 199 Nathan Robinson addressed the board. He says he owns a 14-acre parcel in this area in discussion. He said we 200 originally bought it to build single-family houses there. He said we don’t want to get stuck with property that we can’t 201 build houses on and isn’t zoned for economic development. He said he has talked with Craig Benedict. 202 203 Kim Piracci asked Nathan Robinson why he didn’t sell it to Settler’s Point. Nathan Robinson answered that the 204 Settler’s Point developers wanted to look at it for two years and only pay us $5,000 for that time. 205 206 Adam Beeman asked Nathan Robinson if he would have to perk the land out now to build houses. Nathan Robinson 207 answered yes. Adam Beeman asked for confirmation that the Settler’s Point developers don’t want to give Nathan 208 Robinson residential access to his property. Nathan Robinson said that’s his understanding. 209 210 Craig Benedict showed on a map where Hillsborough water comes to now. 211 212 Nathan Robinson said he was thinking high-density residential to transition from Settler’s Point but there isn’t sewer. 213 There is a water line close by but he doesn’t know if he can tap on to it. 214 215 Paul Guthrie asked Craig Benedict to expand about the transition water line. He’s not so sure it’s a retail water line. 216 It’s an emergency water line to get water to Cary and Durham. 217 218 Craig Benedict answered they got close when OWASA needed water. Hillsborough had to flush the line. People in 219 that area cannot connect to that emergency line. There’s a similar one between Hillsborough and Durham. 220 9 221 Craig Benedict said a part of the overview in a public information meeting will be the perspective that the municipal 222 areas and economic development areas add up to only 16 percent of the county. We’re trying to balance that to 223 preserve the rural lifestyle of the other areas and to prevent sprawl, he said. He mentioned transit plans. 224 225 Kevin Nicholson addressed the board. He asked about exits in the county. At the Efland interstate exit, signs have 226 been out for years saying land for sale. You’d catch 85 and 40 traffic. Why wouldn’t you want to develop that? 227 228 Craig Benedict answered he would be meeting with a prospective buyer the following day. There is sewer under 229 construction that did create a problem for awhile in that area. 230 231 Kevin Nicholson said he lives a littler farther down Davis Road and wonders how the ridgeline affects him. What is 232 the future to the west? He doesn’t want water or sewer services. Craig Benedict answered in the short term and mid 233 term, there would be no public water and sewer there. It’s agricultural and low-density residential. 234 235 Tom Altieri said it’s outside the Town of Hillsborough’s service area. He would be happy to follow up with Kevin 236 Nicholson. 237 238 Kevin Nicholson asked what are the plans for Davis Road with this expansion. He has heard about the future 239 stoplight at the end of Davis Road and he wonders if the road will be widened. 240 241 Craig Benedict answered the county will work with DOT for any development. He foresees a traffic light and right and 242 left turn lane right at the end of Davis Road. There would be no expansion of Davis Road and no acquiring additional 243 right of way. 244 245 Lydia Wegman asked if there are any other questions. 246 247 Craig Benedict said there will be another public information meeting in the area. 248 249 Lydia Wegman encouraged those in the audience to go to the neighborhood information meeting if possible. 250 251 252 AGENDA ITEM 8: BOCC RETREAT UPDATE 253 Craig Benedict reported that the retreat was held a couple of weeks ago at Mapleview Farm. The morning discussion 254 was about financial sustainability for counties. There have been some changes in funding at the state level. 255 256 The second item was about strengths, weaknesses, opportunities and threats to developments in Orange County. 257 Those attending the retreat looked at the county’s existing zones. Orange County is fortunate to still have interstate-258 positioned properties. 259 260 When people look at properties, they want to know that the environmental issues are identified, the zoning is in place. 261 If you can get down the list, that’s how you can compete with other counties, he said. We’re going to talk about pre-262 zoning. When Orange County changed the Economic Development zones in the 1990s, they created Buckhorn 263 Economic Development area. 264 265 There are legislative, quasi-judicial, which does have standards. The third is administrative. Staff looks at the Unified 266 Development Ordinance and goes through prescription. 267 268 Craig Benedict reviewed that in the retreat discussion, there were other suggestions about process streamlining, pre-269 zoning and taking a look at our standards. He doesn’t think our standards are overburdening. 270 271 Randy Marshall asked if that portion of the meeting will be written up so that the Planning Board can read it. 272 273 Craig Benedict said he can gather the thoughts of the BOCC and share that. 274 275 10 Craig Benedict said we have underdeveloped economic development zones that have been on the maps since the 276 1980s. He said the railroad company won’t let anyone cross the economic development area at Buckhorn so it can 277 only be accessed at the ends. There is also interest in exploring creating mobile home parks in these areas. 278 279 Lydia Wegman asked Craig Benedict do you think you’ll be coming with ideas we might be able to consider. Craig 280 Benedict said yes and he can explain to the new Planning Board members why the county does things a certain way. 281 Sometimes the county makes some changes. We have probably the heaviest reliance on residential property tax and 282 lowest reliance of retail sales of anywhere around. Some of the sales taxes gained by the county goes back to 283 municipalities. The state formula for sharing sales tax revenue changed around 2008, to the county’s detriment. 284 285 Adam Beeman asked what the big hang-up is with drive-thru windows. Craig Benedict answered at one point it was 286 the idling of the cars causing pollution. Staff suggested standards of drive-thrus with location and noise. They are 287 allowed in some areas of the county and not in others. He thinks that needs to be addressed again. 288 289 Buddy Hartley asked if it was time to reevaluate the Efland area. Craig Benedict said that was mentioned in the 290 SWAT analysis. We’re seeing more interest with water and sewer in the Efland area. NIM Materials PURPOSE: To review and make a recommendation on a Major Subdivision Preliminary Plat application proposing a residential development called Morgan Ridge. The proposal involves 0.65 acres adjacent to a 52-acre 16-lot single-family development located in Chatham County. BACKGROUND: The applicant is requesting approval of a public road extension and right-of-way dedication to connect to a planned public road (tentatively called Morgan Ridge Way). This area lies within Orange County and contains the only frontage and feasible access onto a public road (Jones Ferry Road SR 1942). The Orange County portion of this project would extend a 20 foot wide paved road within a 50 foot wide right-of-way from the county line approximately 89 linear feet to connect to Jones Ferry Road. Per Section 7.2 of the UDO, any dedication or improvement of a new public street other than widening is classified as a Major Subdivision, and therefore must follow the Major Subdivision process as outlined in Section 2.15 of the UDO. The basic facts concerning the application are as follows: Note: This request only involves the 0.65 acre portion of property within Orange County’s jurisdiction. The remainder of the project lies within Chatham County’s Planning jurisdiction. Subdivision elements involving this area are for contextual purposes only. Water and Sewer Service: The property is not located within a primary public utility service area according to the Water and Sewer Management Planning Boundary Agreement (WASMPBA). Proposed lot within Orange County does not require public or private individual well and septic systems. Lots within Chatham County will be served with private systems regulated by Chatham County. WEST: Single family residences and undeveloped properties (zoned AR within Orange County and zoned R-1 within Chatham County) Development Process, Schedule, and Action: The typical cadence for the review of a major subdivision is as follows: • First Action – Planning staff schedules a Neighborhood Information Meeting (NIM). Staff Comment – DONE. This meeting was held on February 13, 2018. No residents attended meeting. • Second Action – The Planning Board reviews and takes action on the Preliminary Plan application recommending approval or denial of the road extension. 13 Staff Comment. This review and recommendation will begin at the March 7, 2018 Planning Board meeting. • Third Action – The BOCC reviews and takes action on the Preliminary Plat application and proposed revisions. Staff Comment. The review and decision to approve or deny the proposed road extension and Preliminary Plan is scheduled for the April 3, 2018 BOCC regular meeting. • Fourth Action – Once all construction activities have been completed, or appropriate bonds have been approved, staff will sign off and allow the recordation of a Final Plat allowing for the individual lots to be recorded. Proposal: The petitioner has submitted a request to the approve a Major Subdivision Preliminary Plat application package (called Morgan Ridge). All the proposed single-family lots and most of the common open space for this development is located within Chatham County. The development proposes to: 1. Dedicate public right-of-way and build a NCDOT maintained public street (tentatively called Morgan Ridge Way) across the Chatham-Orange County line to connect to Jones Ferry Road (SR 1942); 2. Designate 0.45 acres of common open space within Orange County’s jurisdiction that would be included with 0.11 acres within Chatham County, which would be held by a subdivision HOA; and 3. Construct a mail kiosk and subdivision signs within the common open space area. STAFF COMMENT – SUBDIVISION TYPES: The proposal does not conflict with Orange County UDO requirements for subdivisions and is consistent with Orange County Comprehensive Plan. 14 Roads: The applicant is proposing the creation of public road (20 foot wide asphalt pavement within a 50 foot right-of-way) that would serve the proposed 16 single-family lots and common open space. Because the project is split between two NCDOT Districts, the proposed road has been reviewed by the NCDOT District Engineer Offices in Pittsboro and Graham. The location for the connection was reviewed and deemed acceptable by both offices. Permitting and road construction oversight has been assigned to the Pittsboro District Engineer’s Office. The road also requires a stream crossing and Section 401/404 permits by the US Army Corps of Engineers (USACE) and the NC Department of Environmental Quality (NCDEQ). STAFF COMMENT - ROADS: Staff has determined that the proposed new roadway layout is consistent with the requirements of the UDO, and given the surrounding topography and existing roads, is likely the most desirable and safest location for a public street intersection. Staff will continue to work with NCDOT and Chatham County during the review, approval and permitting for this project. Both County offices will sign-off on the Final Plat prior to recordation. Utilities – Water and Sewer: The applicant is proposing to serve the project with individual wells and septic systems developed on each lot. All are located in Chatham County. STAFF COMMENT - UTILITIES: Orange County and Chatham County Environmental Health Departments will coordinate and document the final locations for well and septic areas along the county line. Stormwater Drainage: Orange and Chatham County Storwater and Erosion Control have coordinated regarding reviews and permits for temporary and permanent site drainage. STAFF COMMENT - STORMWATER: Orange County Stornwater and Erosion Control Staff have reviewed and issued Erosion Control and Stormwater Permits. Open Space: The development calls for +/-.56 acres of common open space. These areas will be maintained by a Homeowners Association. STAFF COMMENT – OPEN SPACE: Staff has determined the proposed open space and land use buffers meet the applicable requirements of the UDO. Land Use Buffer: The development will require a 30-foot Type B land use buffer along Jones Ferry Road. STAFF COMMENT – LAND USE BUFFER: Section 6.8.6 (D) of the UDO requires that this project maintain a thirty (30) foot land use buffer separating the project from adjacent roadways. Staff has determined the proposed open space and land use buffers meet the requirements of the UDO. This buffer will be shown on the final plat and inspected for zoning compliance prior to recordation. Staff Generated Correspondence: Attachment 3 contains the various comments for this project as of the date of abstract preparation. Joint Review: The property is not located within a defined Joint Planning Area (JPA). Staff has however coordinated with Chatham County Planning regarding their review of the subdivision. 15 Chatham County Staff anticipates a determination by the Chatham County Commissioners in April. Analysis: As required under Section 2.15.2 (E) of the UDO, the Planning Director is required to: ‘prepare and submit a recommendation’ on the concept plan to the Planning Board for consideration. In analyzing this request, the Planning Director offers the following: 1. The Preliminary Plat application has been deemed complete in accordance with the requirements of Section 2.2 and 2.15.2 of the UDO. 2. Staff has determined that the property is of sufficient size to support the proposed road extension. 3. The proposal appears consistent with the various goals outlined within the Comprehensive Plan concerning development, including: a. Land Use Overarching Goal: Coordination of the amount, location, pattern, and designation of future land uses, with availability of County services and facilities sufficient to meet the needs of Orange County’s population and economy consistent with other Comprehensive Plan element goals and objectives. b. Land Use Goal 2: Land uses that are appropriate to on-site environmental conditions and features and that protect natural resources, cultural resources, and community character. c. Land Use Goal 3: A variety of land uses that are coordinated within a program and pattern that limits sprawl, preserves community and rural character, minimizes land use conflicts, supported by an efficient and balanced transportation system. 4. Proposal: The petitioner has submitted an amendment to the approved Major Subdivision Preliminary Plat application package (called Triple Crown Farms), which was reviewed and approved by the BOCC on June 17, 2014. The amendment proposes to change: 1. The requirement to build the roads serving the single-family residential lots from a public road to a private road standard. 2. The proposed asphalt pavement widths of the roads 20’ to 18’ wide. 3. The total area and number of single-family lots from 20 to 19 (Lots 9 and 10 from the original plan were combined and recorded via an Exempt Subdivision via Plat Book 118 Page 21 with the Orange County Register of Deeds and assigned PIN 9860-01-0141). 4. The provision for the potential Fire Pond to a provision to provide fire protection via a nearby OWASA owned fire protection water line and hydrant. Other than the above changes the amended plan keeps the same lot, road and, open space design indicated in the original subdivision plan. The applicant has decided to submit a Flexible Development layout with proposed lots adhering to the 1 acre minimum lot size, and approximately 36.25 acres of Common Open Space. A summary of the revised proposal is as follows: 128 Subdivision Type Number of Lots Average Lot Size Area in Open Space Open Space Percentage Flexible Development Plan 19 lots (+1 Exempt lot) (density is 1 dwelling unit for every 5.2 acres of the total property) 3 acres 38.53 acres in open space 41.4% open space proposed (33% required by the UDO) STAFF COMMENT – SUBDIVISION TYPES: The proposal is in accordance with the anticipated densities for properties located within the Rural Buffer land use category as defined within the adopted Comprehensive Plan, Rural Designated area as denoted on the Growth Management Systems Map, and the requirements of the Joint Planning Land Use Plan. Roads: The applicant is proposing the creation of two private roads serving the proposed 19 single- family residential lots and Open Space. Per Section 7.8.5 of the UDO the roads will have to be constructed to appropriate private road standards. Specifically, the plan calls for: • Two cul-de-sac roadways. The first roadway (tentatively named Secretariat Court) will provide access to lots 12 through 19. The second roadway (tentatively named Gallant Fox Crossing) will provide access to lots 2 through 11. • Both roads require stream crossings and Section 401/404 permits by the US Army Corps of Engineers (USACE) and NC department of Environmental Quality (NCDEQ). These permits have been obtained. STAFF COMMENT - ROADS: Staff has determined that the proposed new roadway layout is consistent with the requirements of the UDO. However, staff does recognize the differences in construction and maintenance between public and private roads. Staff recommends that the roads as proposed be reflected in a revised Private Road Maintenance Agreement (RMA), and that the developer record a disclosure statement with the recordation of the Final Plat. Both documents would acknowledge that the roads do not meet the NCDOT design standards and would require significant improvements to meet those standards if converted to public roads meeting the NCDOT design standards. Staff also recommends that the developer finalize all temporary and final driveway permits for the intersection of these private roads with Triple Crown Drive right-of-way and traffic circle. Utilities – Water and Sewer: The applicant is proposing to serve the project with individual wells and septic systems developed on each lot. STAFF COMMENT - UTILITIES: Orange County Environmental Health approved the previous Preliminary Plat layout identifying septic and well locations for each proposed lot. No significant changes are proposed. 129 Stormwater Drainage: Site drainage will be engineered according to Stormwater Control Measures (SCMs) as provided with the subdivision’s approved Erosion Control and Stormwater Permits. STAFF COMMENT - STORMWATER: Orange County Stornwater and Erosion Control has reviewed and issued Erosion Control and Stormwater Permits. They also conducted a Pre- development meeting on-site prior to commencement of land disturbing activity. Open Space: The flexible development plan denotes the maintenance of a 30-foot natural buffer along Dairyland Road and a 100-foot building setback along the perimeter of the project. Open space is identified open space in and around the existing streams. The total area reserved as open space is approximately 1,678,305 square feet of land area or 38.53 acres. The proposed open space is composed of existing, mature, vegetation and trees with an approximate height of between 50 to 70 feet. STAFF COMMENT – OPEN SPACE: Staff has determined the proposed open space and land use buffers meet the requirements of the UDO. Land Use Buffer: The site plan indicates there will be a 30-foot buffer along Dairyland Road comprised of existing, dense, vegetation composed of existing, mature, shrubs and trees with an approximate height of between 50 to 70 feet. STAFF COMMENT – LAND USE BUFFER: Section 6.8.6 (D) of the UDO requires that this project maintain a thirty (30) foot land use buffer separating the project from adjacent roadways. Staff has determined the proposed open space and land use buffers meet the requirements of the UDO. Staff recommends that if the Planning Board recommends approval of the revised Preliminary Plan that it consider also recommending conditions of approval that address the Road Maintenance Agreement (RMA); Design Standards; and Disclosure Statements regarding the private roads as outlined in this abstract. RECOMMENDATION: The Planning Director recommends the Board: 1. Receive the Preliminary Plat application, 2. Deliberate on the proposal, and 3. Recommend approval of the proposal, with the following suggested conditions: a. The developer shall submit and record a Road Maintenance Agreement (RMA) and a Disclosure Statement with the final plat. These documents shall acknowledge and assign perpetual maintenance responsibility for the private roads to the Homeowners Association. It shall also acknowledge that any future effort to convert these roads from private to public would require significant design changes, construction costs and additional permitting with Orange County, NCDOT, USACE and NCDEQ. b.
