County Manager Annexation Petition with Exempt Plat 245-2300 Parcel Craig Benedict, Planning Director Proposed School Site Plan 245-2585 Geoffrey Gledhill, County Attorney 732-2196 PURPOSE: To authorize the Chair of the Board of County Commissioners to sign a voluntary annexation petition fora 19-acre parcel that is under review for Chapel Hill-Carrboro Elementary School #10 in the Town of Carrboro's planning jurisdiction: BACKGROUND: Orange County purchased a 193-acre parcel in 2001 located approximately at the corner of Eubanks Road and Old NC 86. A few years of master planning led to a variety of park and school uses to be located within the overall site. The northernmost area of the site was planned for Chapel Hill-Carrboro Elementary School #10 which had been identified as a need under the School Adequate Public Facilities Ordinance and subsequent Capital Investment Plan. The proposed school is following an expedited review track in the Town of Carrboro's conditional use permit (CUP) process. The preliminary public information CUP review occurred on November 28, 2006: At its November 14, 2006 meeting, the BOCC approved the creation of an exempt plat for the school site to separate the parcel from the larger tract and to permit the Town of Carrboro to limit its permitting (CUP) conditions to this 19-acre parcel. The Chapel Hill-Carrboro Elementary School #10 is scheduled to open in August 2008 and the approval and construction timeline is critical. The Town of Carrboro has been very helpful to choreograph the expedited review. Collectively, many reviewing entities have offered suggestions and problem solving, keeping the project on schedule. The formal Public Hearing before the Carrboro Board of Aldermen on this school CUP application is January 9, 2007 and therefore BOCC action is needed now regarding annexation. Annexation is justified for the following reasons: 1. The property is located in the JPA `transition' area, intended for eventual annexation. 2. The public road that will serve the school and that will eventually be a part of the "north-south connector" to be located on the eastern edge of the school site could be designed and constructed to Town of Carrboro standards, which would allow for Carrboro's long term responsibility for maintenance of this roadway. Otherwise, the school would have to build to NCDOT standards with long-term responsibility for maintenance uncertain. 3. Streetlights and sidewalks can be designed and constructed by the school and then maintained by the Town of Carrboro. Otherwise, somewhat complex agreements would need to be formulated with NCDOT and the Town of Carrboro for sidewalk maintenance. 4. Annexation would permit an acceptable north-south collector road alignment, eliminating~the need for a regulatory land use buffer on land committed to school purposes, which buffer will potentially eliminate intended future school sites. At a minimum, the buffer is likely to create the need for significantly more land to be committed to school sites reducing that available for the Twin Creeks Park. Decisions about future annexation of other parcels can be considered by the BOCC on an as needed basis. Since the parcel is in the Joint Planning Area, the Chair of the BOCC can notify the County's JPA partners (Town of Chapel Hill and Town of Carrboro) as well as Duke Forest (nearby property owner) and OWASA (utility provider) of the decision to request annexation and the reasons for it. FINANCIAL IMPACT: There is no direct financial implication related to authorizing submission of the voluntary annexation petition. However, annexation of the property will clarify some heretofore unresolved issues and accordingly increase the. likelihood that the new elementary school will open in time for the 2008-09 academic year.
