THE ORANGE COUNTY BOARD OF HEALTH MET ON September 27, 2001 at the Southern Human Services Center in Chapel Hill, North Carolina. BOARD OF HEALTH MEMBERS PRESENT: Jonathan Klein, Chair; Janet Southerland, Vice-Chair; Barry Adler; Mel Hurston; Barry Jacobs; Lee Werley; Kate Wilder; Alice White. BOARD OF HEALTH MEMBERS ABSENT: Alan Rimer; Martha Stucker; Sharon Van Horn. STAFF PRESENT: Rosemary Summers, Health Director; Ron Holdway, Environmental Health Services Division Director; Donna King, Health Promotion and Education Division Director. GUESTS PRESENT: Randa Meehan, UNC-CH student nurse; Julie Skolmanski, UNC- CH MPH student; Erin Fields, UNC-CH MPH student; Gwendolyn L. Trice; Carol R. Trice; Tyrone Trice; Denise Spector, UNC-CH MPH student; Christopher Cooke, DHHS Turning Point Project Director. I. CALL TO ORDER AND INTRODUCTION OF GUESTS Jonathan Klein called the meeting to order at 7:05 p.m. and introduced Christopher Cooke. II. SOCIAL MARKETING AND PUBLIC HEALTH A special presentation, "Social Marketing: A Planned Approach to Behavior Change", was given by Christopher Cooke, Turning Point Project Director. III. APPROVAL OF SEPTEMBER 27, 2001 AGENDA Motion to approve the Agenda of September 27, 2001 was made by Mel Hurston, seconded by Lee Werley, and carried without dissent. IV. APPEALS AND HEARINGS A. Possible Action: Ivey Hearing James Ivey appealed an authorization for construction of a new septic system denial by the Environmental Health staff. A hearing was held on August 23, 2001. This item was reviewed by the ACEH Committee on September 13, 2001. The Board of Health has the authority to affirm, modify or reverse the staff decision in the appeal of the authorization denial according to NCGS § 130A-24. Anne Miles 2 September 27, 2000 Motion was made to uphold the Environmental Health staff authorization denial decision by Janet Southerland, seconded by Kate Wilder, and carried without dissent. During the August 23 hearing, Mr. Ivey indicated that he thought there may be some area of usable soil on the tract not previously considered by the staff. Subsequent to the hearing Mr. Ivey applied for an evaluation of this new site. The results of the further evaluation revealed there is a repair area in good soils on another portion of the property. A permit for repair was issued. V. PUBLIC COMMENT FOR ITEMS NOT ON AGENDA None VI. ACTION ITEMS ON CONSENT AGENDA A. Minutes Approval of August 23, 2001 Meeting Motion to approve the minutes as presented was made by Barry Jacobs, seconded by Janet Southerland, and carried without dissent. VII. REPORTS AND DISCUSSION WITH POSSIBLE ACTION A. ACEH Committee 1. L & W Mobile Home Park Update A hearing to appeal the order to vacate additional spaces was held in April. After consideration, the full Board voted to extend the requirement to vacate until later this year if several conditions were met, including the construction of a private pump station connecting the park to the City of Durham sewer system. Mr. Paschall, the owner of the park, was contacted on September 5, 2001 for an update on the progress of the private pump station and its connection to the City system. He indicated that the original plan to install a private station is not being pursued at this point and that he is waiting for the regional basin to be developed that will serve the area along Highway 70 between the county line and Interstate 85. He further related that Orange County Manager, John Link, was meeting a representative of the City of Durham sometime during the week of September 10th through 14th to discuss the matter. He also indicated that the construction of the basin area pump station would be complete with "60 days" once the governments agreed on the matter. The ACEH Committee reviewed the matter on September 13th. Anne Miles 3 September 27, 2000 Paschall from the Board expressing concern over the lack of progress on the project the Board voted to support in May. That letter is being drafted. Finally, staff was notified on September 17th that Mr. Paschall had reoccupied at least one of the spaces vacated by the original consent order. This report is being investigated and if verified as correct, staff will pursue further legal action as necessary to assure compliance with the consent order. The County Manager and Board of County Commissioners will be updated on all developments. 2. Request for Delay: Tyrone Trice Report Mr. Trice approached the Board during it's June meeting asking for a 60 day extension of his deadline to install a repair septic system on his property in Bingham Township. The repair is necessary to serve a relatively new modular home he has on the property. The system the modular home is currently connected to is undersized and encroaches on the existing well on the property. The Board informally asked the staff at the June meeting to delay any further enforcement actions for at least 60 days given the understanding the system was not currently failing. Mr. Trice has expressed his commitment to correcting the situation and has received bids from two contractors. There is no current surface failure of the existing system. This matter went before the ACEH Committee for review on September 13th. The Committee recommended that no action be taken by the Board or staff until October. Should the situation not be resolved by the October Board of Health meeting, the staff would proceed with the usual routes of relief to achieve compliance with the rules. Mr. Trice provided an update to the Board on this matter and requested a further extension due to extenuating circumstances. Due to the fact that the existing system is not failing at this time, the Board felt that a monitoring process should be set up to include well water testing by the Health Department. Mr. Trice's family would also be required to budget water consumption. Lee Werley recommended a 6 month review of conditions and further action at that time. Motion to grant a 6 month extension contingent upon the system showing no signs of failure, implementation of a monitoring process by the Health Department and water budgeting by the Trice family was made by Lee Werley, seconded by Mel Hurston, and carried without dissent. Letters Requested by Orange County Asthma Coalition The Orange County Asthma Coalition recently drafted letters to the school systems and to the Town of Chapel Hill regarding indoor air quality matters. The Asthma Coalition is asking the Board of Health to support their efforts in these letters. The letters were reviewed by the ACEH Committee of the Board. Barry Jacobs suggested a modification of the letters to acknowledge the positive approach being taken by the schools regarding indoor air quality. Motion to support the letters drafted by the Orange County Asthma Coalition by sending letters of support as modified was made by Kate Wilder, seconded by Alice White and carried without dissent. VIII. BOARD COMMENTS/ANNOUNCEMENTS Rosemary Summers passed out update information to the Board members. IX. ADJOURNMENT Motion to adjourn was made by Kate Wilder, seconded by Mel Hurston, and carried without dissent.
