THE ORANGE COUNTY BOARD OF HEALTH MET ON April 27, 2016, at the Orange County Health Department, 300 West Tryon Street, Hillsborough, NC. BOARD OF HEALTH MEMBERS PRESENT: Liska Lackey, Chair, Nick Galvez, Vice Chair, Commissioner Mia Burroughs, Barbara Chavious, Paul Chelminski, Dan Dewitya, Susan Elmore, Jessica Frega, Sam Lasris, Reena Mehta and Timothy Smith. BOARD OF HEALTH MEMBERS ABSENT: None. STAFF PRESENT: Dr. Colleen Bridger, Health Director; Coby Austin, Senior Public Health Educator; Christy Bridges, Family Nurse Practitioner II; Krista Burnette, Nursing Assistant; Alan Clapp, Environmental Health Director; Rebecca Crawford, Finance and Administrative Services Director; Wanda Crisp, Licensed Practical Nurse; Donna King, Health Promotion & Education Services Director; Pam McCall, Public Health Nursing Director; Stacy Shelp, Communications Manager; Meredith Stewart, Public Health Program Manager; La Toya Strange, Administrative Assistant II; Jacqueline Stewart, Property Development Technician and Hannah Welch, Temporary Clinical Social Worker Intern. GUESTS PRESENT: Dr. Lou Turner. I. Welcome New Employees Dr. Bridger introduced new staff members: Krista Burnette, Nursing Assistant and Jacqueline Stewart, Property Development Technician. II. Public Hearing: Board of Health Rule on E-cigarettes Use in Restaurants and Bars: Liska Lackey, Chair, informed all that the public comment period will last an hour with everyone limiting their comments to three minutes. III. Break IV. Approval of the April 27, 2016 Agenda Motion was made by Susan Elmore to approve the agenda, seconded by Reena Mehta and carried without dissent. V. Public Comment for Items NOT on Printed Agenda: None. VI. Action Items (Consent) A. Minutes Approval of March 23, 2016 Meeting Motion to approve Consent Agenda without correction to the March 23, 2016 minutes was made by Mia Burroughs, seconded by Nick Galvez and carried without dissent. VII. Action Items (Non-Consent) A. BOH Rule on E-Cigarette Use in Restaurants and Bars a. Results of survey/public comment Coby Austin, Senior Public Health Educator, began by reporting that there were a total of 155 respondents that gave comment by using the various formats (online survey, telephone message, snail mail and email) during the public comment period of April 10th through 24th. She continued by providing a map of the Online Survey respondents regionally by zip code, as well as showing the distribution of Orange County respondents by zip code. Online Survey responses were also reported and categorized by perspective, such as medical provider and owner/manager of a restaurant or bar, along with respondents’ stance regarding the rule. Ms. Austin presented a summary of comments comprised of those who opposed, supported, and supported with reservations or held another position on the proposed Board of Health rule. A qualitative analysis of the comments highlighted the most common themes, including: Key Themes: Opposing comments • Decision should be left up to local businesses • Believes the risks are minimal or non-existent • E-cigarettes can promote cessation • Research showing harms of e-cigarettes is flawed or insufficient Key Themes: Supportive comments • Concern regarding secondhand exposure • Precaution should be taken because of unknown effects • Worried about use among youth MINUTES-Final ORANGE COUNTY BOARD OF HEALTH April 27, 2016 S:\Managers Working Files\BOH\Agenda & Abstracts\2016 Agenda & Abstracts/ April Page 3 • Important for protecting vulnerable populations Key Themes: Supportive with reservations and “Other” comments • Prohibit in restaurants, but allow it in bars • Encourage harm reduction (smokeless tobacco, e-cigs) • Focus on enforcing existing smoke-free rules • “I am a daily user of vapor products and would not Vape in a public place because not all people want to be bombarded with vapor when they're trying to enjoy a time out.” Ms. Austin reminded the Board that a copy of all of the public comments had been sent to them earlier in the week along with links to research articles and other documents referenced in the public comments. She ended by stating that the Surgeon General’s report is due out sometime this year. The BOH members had questions that were addressed by Ms. Austin and Dr. Bridger. b. Deliberation and Vote Dr. Bridger addressed the Board and informed them the staff’s recommendation to the Board is to postpone the vote until after the Surgeon General’s report comes out. She expressed that while it is important to hear the public’s opinion, the only criteria a Board of Health can consider during rule making is the rule’s effect on public health. The BOH members had questions that were addressed by Dr. Bridger. Motion to table the vote until the Surgeon General’s report comes out and is reviewed and discussed by the Board was made by Susan Elmore, seconded by Barbara Chavious, and carried without dissent. B. Board Reappointments Liska Lackey, Chair, conveyed that there were three Board members whose term will be ending soon. The Board of Health will vote to recommend Paul Chelminski to his 3rd term; Dan Dewitya to his first full term; and Sam Lasris to his 2nd term. Motion to reappoint Paul Chelminski, Dan Dewitya, and Sam Lasris was made by Jessica Frega, seconded by Nick Galvez, and carried without dissent. VIII. Reports and Discussion with Possible Action A. Health Director Report The BOH members did not have any questions. B. Media Items Media items were in the packet which focused on Orange County’s events and our involvement in various efforts. IX. Board Comments MINUTES-Final ORANGE COUNTY BOARD OF HEALTH April 27, 2016 S:\Managers Working Files\BOH\Agenda & Abstracts\2016 Agenda & Abstracts/ April Page 4 No additional comments were given. X. Adjournment A motion was made by Jessica Frega to adjourn the meeting at 8:35 p.m., was seconded by Mia Burroughs and carried without dissent.
