BACKGROUND: The Orchard subdivision was reviewed at both the concept plan stage and preliminary plan stage by the Planning Board earlier this year. The original plan submitted last November included two `lots-of-record' that were combined for purposes of development. Subsequently, portions of the original lots of record were subdivided out. This prompted the attached letters from the County Attorney and the Planning Director. The recommendation of the Planning Board preceded these letters. It is therefore appropriate for the Planning Board to consider again its recommendation. FINANCIAL IMPACT: None. RECOMMENDATION(S): The Administration recommends the BOCC approve the Resolution. Bruce Ballentine, agent for Black Diamond Properties Owners: Yukio & Yasuko Tanaka, Kathy Cheek & Karen Andrews WHEREAS, the Orchard Subdivision, a major subdivision, had been scheduled for BOCC review, and WHEREAS, the County Attorney and Planning Director have raised questions about whether The Orchard subdivision preliminary plan complies with County ordinance requirements; and WHEREAS, the Planning Board should have the benefit of the 8/17/06 letter from the County Attorney and the 8/18/06 letter from the Planning Director when making its recommendation on The Orchard Subdivision.
