BACKGROUND: Request -Preliminary Plan Applicant: Heffner Properties, Inc, Owner: Annie Sturdivant Subdivision follows the Conservation-Cluster Option of Flexible Development. Total acreage is 130.08 acres including right-of-way. Subdivision Type Number of Average Lot Size Percent of Open ~ Lots ~~__,Space ____-- Conservation-Cluster ~ 19 I 3,79 ~ 41 Acres in Open 52,76 2 Net Subdivision Land Area 130.08 acres Area in ublic road r.o.w. 4.56 acres Area outside of ublic road r.o.w. 125.52 acres Platted lot area 72.02 acres Area in common o ens ace 52.76 acres 41 Location Southwest side of Hatch Road in Chapel Hill Township, Existing and Proposed Conditions Existing: Zoning: Rural Buffer (RB) Chapel Hill/Carrboro/Orange County Joint Planning Agreement minimum lot size - 2 acres.(Section 5,1,1 Orange County Zoning Ordinance), Zoning Overlay: • The property is in the University Lake protected watershed (max. density = 2 acres /dwelling and 5 acres /dwelling after first five lots) (Section 6.23,2 Orange County Zoning Ordinance).. Physical Features: • There are several County designated streams on the south side of the tract to be protected with stream buffers, A named stream is known as Phil's Creek. The site is mostly wooded with a mixture of pines and hardwoods. • The topography is gently rolling with steeper slopes along the streams. Adjacent Land Use: • Robinswood Subdivision is located to the east with an average lot size of 1,14 acres; Reaves Estate Subdivision is located to the west with an average lot size of 1.36 acres. • Properties to the north and west are divided into large acreage tracts ranging in size from 2 to 16 acres. • Phil's Creek a tributary to Neville Creek which flows to University Lake and a 108 acre tract are located to the south, The 108 acre tract has one single family residence, centrally located on the tract. Proposed: Roads: • Access is from Hatch Road (SR 1944), Designated as a local road it is an existing paved public road in Chapel Hill Township, • The proposed street (Westhampton Way) provides access from Hatch Road. Weston Lane, a small loop road serving 4 lots, extends from Westhampton Way. Brookford Court also extends from Westhampton Way and serves 4 lots, • All roads are to be constn~cted to NCDOT standards. • NCDOT comments indicate subdivision streets are required to meet "local subdivision road" minimum design standards, minimum 22 foot travelway, for rolling terrain. Sidewalks must be located outside of the right-of-way, • Comments from Carrboro indicate a stub out to the south should be considered, However, a stub out at that location would have to cross Phil's Creek, In addition the tract to the south is under single ownership and is developed, Planning Staff, due to topography (steep slopes) and environmental concerns, is not recommending a stub out to the south, • ERCD is recommending dedication of open space along Phil's Creek to further accent the value of the stream that could be compromised by a stream crossing, 3 • Adjacent properties have been developed with a cul-de-sac lotting pattern.. There are streams along the western and southern boundaries.. Open Space/Buffers: • 52,76 acres (41 %) of common area open space is proposed. All of the open space is wooded with a large portion along Phil's Creek, some with steep slopes, The lot sizes average 3.79 acres, 90% above minimum lot size of 2 acres, • Approximately 6.37 acres for recreation and open space has been offered to Orange County by the developer which offer is recommended for acceptance. This would leave approximately 46,39 acres dedicated to and to be owned by the Homeowners Association, Density of the proposal is 6,84 acres per house, • Homeowners Association will be farmed to own and maintain open space, buffers, signage, • Sidewalk will be built within 30 foot roadside buffer along one side of the proposed streets, Water/Sewer/Fire: • Individual wells. • Individual septic systems, • The closest water and sewer is in Rangewood subdivision which is approximately 1000 feet north of this subdivision. • Extension of water and sewer is prohibited in the Rural Buffer except for an Essential Public Facility or to address an Adverse Public Health Condition, Recreation Requirement: • Chapel Hill District Park ("Greenway" system) per Orange County Zoning Ordinance and Joint Planning Area Land Use Plan (part of Orange County Comprehensive Plan), • The Orange County Environment and Resource Conservation Department is recommending a portion of the open space property be dedicated to Orange County for recreation and open space. The proposed dedication is a variable with parcel of land that forms the south property boundary (memo and map attached), This area has been identified as part of the "Greenway" system jointly adopted by Orange County, Chapel Hill and Carrboro where dedications to create a "comprehensive parks and open space system ,,. linked together by a system of greenways extending along drainageways .,." (see attached memo from Craig N. Benedict elaborating on the greenways system with attached maps). Payment in lieu would be based on 1/20~h of an acre per lot (i.e, 19 lots x 1/20 acre per lot = 19/20 acre or approximately 41,382 square feet), The dedication proposed exceeds the aforementioned minimum and would replace the payment-in-lieu option. The land to be dedicated to Orange County connects with an existing parcel of land owned by Orange County which abuts and connects to Neville Road (a public road). Development Process Schedule, and Action Planning Board: • First Action: Concept Plan approved by the Planning Board December 7, 2005 with the following conditions: 1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT collector standards with a 60 foot right-of-way and 34 foot B-B pavement. The sidewalk is to be outside of the right-of-way,(NCDOT Recommendation) 2. Homeowners Association documents that provide for maintenance of the Open Space shall be submitted with the preliminary plan. Provisions shall be included in the Homeowners Association documents that would prohibit tree cutting in the Open Space except for maintenance purposes. 3, The cul-de-sac at the end of Westhampton Way shall be increased to a minimum of 95 feet in diameter, Turning radii at all corners shall have a 32 foot minimum. 4. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of 4 existing R/W, whichever is greater, along Hatch Road on the Preliminary Plan. 5, Weston Lane must have 4 lots accessing it to meet NCDOT requirements. 6. Show five-foot utility easements along both sides of all rights-of-way. 7. ERCD has recommended that a portion of the open space be dedicated (deeded) to Orange County far recreation and open space. The dedication is a 200-foot-wide strip located parallel to a 770 foot segment of property boundary formed by Phil's Creek, This will meet the requirement for recreation and reduce or eliminate the amount of the recreation payment-in-lieu, 8, Show location of subdivision sign on Preliminary Plan. 9. Any lighting shall meet Orange County Outdoor Lighting Standards, 10, A minimum 50 foot wide Pedestrian Open Space Area (POSA) shall be provided between lots 7 and 8. Preliminary Plan: Addresses the conditions of approval of the Concept Plan, The applicant has submitted responses to Staff comments and responses to Planning Board comments from the December 7, 2005 meeting, Subdivision streets are designed, as required by NCDOT, to "local subdivision road" minimum design standards for rolling terrain, Items of concern to the Planning Staff are dedication of open space to Orange County along Phil's Creek and Pedestrian Open Space Areas (POSA) needed between lots 3 & 4 and between lots 9, 10 & 11. Additional conditions have been added to the Resolution of Approval to meet these concerns. Several neighbors in the June 7, 2006 Planning Board meeting indicated they had not encountered problems but were concerned with water quality (see attached minutes), The developer indicated in the June 7, 2006 Planning Board meeting they did not see a need for condition E.3, in the Resolution of Approval "Provide a 20 foot public access easement from Westhampton Way to the dedicated open space along Phil's Creek," They were concerned about the public parking on Westhampton Way and walking across the open space to Phil's Creek. Second Action: Planning Board on June 7, 2006 unanimously recommended approval with the deletion of E.3, from the Resolution of Approval, Third Action: 1, The Board shall consider the application within a reasonable amount of time, 2. During deliberations and consideration of the application the Board may defer consideration at any point to pursue additional analysis and review, 3, If the Preliminary Plan is approved by the County Commissioners the applicant shall have one (1) year to prepare and file a Final Plat or to request aone-year extension from the Planning Director, August 22, 2006 the Orange County Commissioners Meeting: Considered the Preliminary Plan and requested the following additional information: 1, A description of a "Ultra Shallow Innovative w/pump" septic system: Anew report from Environmental Health is attached (attachment 9) which describes this type of system. 2. Information provided regarding the no open burning requirements in Orange County: This has been added in the attached Resolution of Approval Item F..6 3. Consideration of turn lanes: Conditions in the area do not indicate that there is likely to be a need for turn lanes from Hatch Road into the nineteen-lot subdivision. Current (2003) annual average daily traffic (AADT) counts on Hatch Road indicate 1,000 vehicles south of NC 54 and 750 vehicles north of Old Greensboro Road. Capacity of a suburban two-lane undivided road at Level of Service (LOS) C is 11,000 vehicles per day (between 10,500 and 12,000 depending on agenr,,y). Nineteen lots will generate approximately 190 vehicle trips per day. The vehicle to capacity ratio (V/G) at level of service C (considering the additional 190 trips per day from the proposed subdivision) is 0.108. A V/C ratio of less than 0..80 (a V/C ration of 1,0 indicates that the road is operating at capacity) indicates that the road is operating at acceptable conditions with sufficient capacity. At a LOS 0,80, Hatch Road would experience an AADT of 8,SQ0. The Triangle Regional Model (TRM), used to project future traffic and speeds for the regional network, classifies Hafch Road as a local road, Future traffic projections are not available for Hatch Road using traffic projections for the 2030 Regional Long-Range Transportation Plan (see Attachment #11 from Planning Director suggesting consideration of Orange County standards to be established). 4. If outdoor lighting is considered in the future it must meet Orange County s outdoor lighting requirements: This has been added in the attached Resolution of Approval Item F.4 5. The Commissioners requested additional options be considered for the proposed Dedicated area to Orange County along Phil's Creek. The planning staff and attorney's office met with the applicant and developed a dedication and access configuration that exceeds the minimum dedication requirement and creates a better access connection system within the subdivision common areas that also supports the Joint Planning Area greenway system. FISCAL IMPACT: The Fiscal Impact Analysis is included as an attachment. RECOMMENDATION(S): Administration Approval, in accordance with the attached Resolution of Approval Planning Board Approval, in accordance with the Resolution of Approval attached to the August 22, 2006 BOCC meeting agenda abstract with item E, 3 deleted from Resolution. 5 Planning Staff Approval, in accordance with the Resolution of Approval attached to the August 22, 2006 BOCC meeting agenda abstract with a condition E. 3. Property Identification: TMBL # 7.113.B.39 /Parcel ID # 9768-37-0974 Total Acreage: The site consists of one tract of land that is 130..08 acres in size, Zaning: Rural Buffer (RB) District with University Lake Watershed Protection Overlay Developer: The site is proposed to be developed by Heffner Properties, Inc., of Chapel Hill. Tom Heffner, the president of Heffner Properties, Inc., has developed and/or been associated with several high-quality residential communities located within Orange County in the past. Zoning: The Rural Buffer (RB) zoning district was established to provide for rural residential development within the portion of Orange County designated as Rural Buffer. Since no extensions of public water and sewer lines are allowed within the Rural Buffer, development within the Rural Buffer (RB) zoning district relies on wells for domestic water supply and ground absorption systems for sanitary sewage disposal. This property is also located within the University Lake Watershed Protection Overlay District which restricts development to one dwelling unit per five acres.. Subdivisions within this overlay district may also contain up to, but no more than, fve residential lots with a density of'one dwelling unit per two acres. Developer's Program: The developer of this property proposes to use one of Orange County's Flexible Development options to develop the property.. Selection of this development option allows more flexibility in the proposed lot sizes (as long as the allowable density is not exceeded) and affords the opportunity to save more open space than traditional subdivision development.. For example, we note that the amount of land that is required to beset aside as open space within the Rural Buffer (RB) zoning district is .33% of the site; however, based on the reduction in five-acre lot sizes that are provided by the Flexible Development option, approximately 41% of the site is proposed to be preserved as open space, If~esdiarnp~on - Project Os~erview March 22, 2006 Pnge 1 of 3 1J ;!. J In particular, this Flexible Development option allows for additional open space to be located along the various water features and stream corridors that are located adjacent to and on the subject site. This approach also allows for larger-than-required buffers to be placed around the portion of the property that is adjacent to the Robins Wood subdivision, as well as other existing residences that are adjacent to the property. Furthernrore, with a 120-foot buffer designated along the site's Hatch Road frontage, the existing scenic viewshed will be preserved as rural streetscape. A total of nineteen (19) single-family residential lots are proposed for the site.. Each lot will be served by an individual well system for potable domestic supply water and individual ground absorption septic systems for' sanitazy sewage. Based upon a preliminary soils analysis prepared by Soil and Envirorunental Consultants and actual in- the-field inspections by Orange County Health Department staff; it has been determined that there aze adequate suitable soils within each proposed residential lot area to support the proposed number of lots. As required within the University Lake Watershed Protection Overlay District, there is sufficient septic tank drainage area, and an equally sized repair area, provided on each lot with no off-site easements for septic tank drainage areas on adjoining lots or within the open space areas. A 27-foot wide public street cross-section (measured from back-of--curb to back-of--curb) is proposed within 50-foot wide right-of--ways for the public streets serving the site. A five-foot utility easement is also proposed adjacent to both sides of the 50-foot right-of= ways in order to ensure that there is ample space for utility installation, Also, a 30-foot landscape buffer is proposed adjacent to the right-of--way in order to allow afive-foot wide sidewalk to meander within the trees on one side of the street in order to create an enjoyable walking experience that is separated from the public roadway. This meandering sidewalk will be maintained by the Westhampton Homeowners Association, The NCDOT District Engineer has reviewed this proposed street geometry and has endorsed both the proposed street design and the location of the proposed entrance on Hatch Road,. Recreation: Located ,just LS miles from the Hank Anderson Community Park in Carrboro, ample opportunities for off-site recreation will be available to the residents of Westhampton in addition to the proposed on-site sidewalk network that will cover approximately 0.75 miles. Accordingly, the developer proposes to make a recreational payment-in-lieu in order to meet the recreational requirements for this project However, we also note that the Orange County Environment and Resource Conservation Department has recommended that a portion of the site's open space along Phil's Creek be dedicated (deeded} to Orange County for recreation and open space. It has been further noted that dedication of this land will apply towazds the recreation requirement and therefore reduce or eliminate the amount of the potential recreation payment-in-lieu.. We are in agreement with this proposed condition of approval, and will work with the Orange County Environmental and Resource Conservation Department to dedicate the desired land for recreation and open spaces purposes. idresthm~~plon - Project O~-ernleiv Alm ch 21. ?006 Pnge 2 oJ3 ~~0 Conclusion: The developer believes that the proposed development is situated in an excellent location for convenient access to work and play. Furthermore, the developer believes that the utilization of'the Flexible Development option produces a site design that (a) provides ample privacy and protection for adjoining residences, (b) preserves over 41% of the site as permanent open space, and (c) protects sensitive environmental features associated with the property.. We hereby provide our response to each recommended Condition of Approval below. 1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT collector standards with a 60-foot right-of--way and 34-foot B-B pavement, The sidewallt is to he outside of the right-of--way. Applicant's .Response: We have met with NCDOT to discuss whether or not Westhampton Way should be classified and constructed as a collector street, After revisiting this issue and meeting with the developer at the site, the NCDOT District Engineer has agreed that Westhampton Way should not be classified as a collector street. Accordingly, NCDOT has indicated to us that a 27-foot back-of=curb to back- of-curb street (which is their standard street width), located in a 50-foot wide right-of- way, would be the appropriate design cross-section for Westhampton Way and all other Westhampton streets. 2. Fomeowners Association documents that provide for maintenance of the Open Space shaII be submitted with the preliminary plan, Provisions shall he included in the Homeowners Association documents that would prohibit tree cutting in the Open Space except for maintenance purposes. Applicant's Response: We have included the proposed "Declaration of Covenants, Conditions and Restrictions of Westhampton" with our Major Subdivision Preliminary Plat submittal. Please note that Article X (Use Restrictions), Section 16 (Open Space Maintenance) includes appropriate language stating that tree cutting in the open space areas shall be prohibited except for maintenance purposes. ii~esthampmn -Response to Staff Connnenlr RTarch ZZ, Z006 Page ! of a ~~~2 3. The cut-de-sac at the end of Westhampton Way shall be increased to a minimum of 95 feet in diameter. Turning radii at all corners shall have a .32-foot minimum. Applicant's Response: Our original proposal during Concepk Plan review was that the cul-de-sac at the end of Westhampton Way shall be 75 feet in diameter from back-of-curb to back-of-curb. Furthermore, it was noted during the Concept Plan review that this review comment was preliminary, and that the Fire Mazshal had not provided a formal response. Given that a 95-foot diameter significantly exceeds NCDOT's standard cul-de-sac requirement fora 75-foot diameter and that this excess pavement does not seem necessary or desirable in a watershed azea, we have pursued this issue with fire protection providers and ascertained that the NCDOT standazd width (75 feet) is reasonable and appropriate for the provision of emergency services within Westhampton. Accordingly, for both Westhampton cul-de-sacs, we continue to propose a 75-foot diameter, which conforms with NCDOT standards and will provide ample access and turning space for emergency service vehicles.. In addition, we also note that turning radii at all intersection corners have been designed with a .32-foot minimum radius. 4, Show proposed dedication of an additional 5 feet of right-of--way, or .35 feet from the centerline of the existing right-of-way, whichever is greater, along Hatch Road on the Preliminary Plan, .4pplfcant's Respmzse: We agree to this dedication of additional right-of--way for Hatch Road, and have illustrated the dedication on Sheet 3 of the Major Subdivision Preliminary Plat (as revised on Ivlazch 22, 2006), 5. ERCD has recommended that a portion of the open space be dedicated (deeded) to Orange County for recreation and open space. The dedication is a 200-foot wide strip located parallel to a 770-foot segment of property boundary formed by Phil's Creek. This will meet the requirement for recreation and reduce or eliminate the amount of the recreation payment-in-lieu. Applicant's Response: We are in agreement with this proposed condition of approval, but have not illustrated the dedication on the preliminary plat since there was still some question as to the exact location and amount of property being requested for dedication at the time of preliminary plat application. It is our belief that this desired dedication of recreational open space property is best handled by a written condition of approval for the preliminary plat once the desired area for dedication is better defined and described. We note that once the desired land has been identified for dedication to Orange County for recreation and open space purposes, then a final determination can be made as to whether or not this land dedication fulfills the site's recreational requirements, or if a reduced payment-in-lieu will still be needed. 8. Show location of subdivision sign on Preiirrrinary Plan. Applicant's Response: We have indicated the location of entry wall signage at the site's main entrance on Hatch Road (please see Sheet 3, Major Subdivision Preliminary Plat, as revised on March 22, 2006}. Signage will be designed in conformance with Orange County regulations, 9. Any lighting sha[i meet Orange County Lighting Standards. Can the access to the stream corridor be located between Lots 14 and 15 rather than Lots 7 and 8 (as suggested by staff)? Applicant's Response: As recommended by the Planning Board, we have created an open space corridor between what is now designated as Lots 15 and 16 (formerly Lots 14 and 15). We have also adjusted lot lines in this area in order to provide more favorable topography for a pedestrian path through this "pedestrian open space area" (POSA) that varies from 140 feet to over 500 feet in width as it connects to the Phil's Creek stream corridor. 4. How will access be provided to the proposed community well system? Applicant's Response: We have actually revised the developer's program for Westhampton to utilize the more conventional approach of individual wells on each individual lot.. After doing additional reseazch, we concluded that this was a better, more envirorunentally sensitive approach (dispersing wells throughout the site rather than focusing on a single, concentrated location) and was also the method of providing potable water that the rnazket actually seems to prefer, Therefore, the question about access to the community well location is now moot. 5. Get clarification from NCIDOT regarding size of cul-de-sacs and width of right- of-way. Also, would like for developer to meet on-site with NCDOT to discuss the reaction times associated with the proposed entrance road and Hatch Road. Applicant's Response: We mek on site with the NCDOT District Engineer (Chuck Edwards) and the Assistant District Engineer (1Vanette Fogleman) to discuss the classification of Westhampton Way and the location of the site entrance on Hatch Road. Based on this meeting, it was agreed that Westhampton Way should not be designed as a collector street, and alternatively should be designed as a 27-foot back- of-curb to back-of-curb street, located in a 50-foot wide right-of-way. Therefore, we have (1) adjusted the proposed street geometry for the internal streets of Westhampton in accordance with NCDOT's guidance {27-foot back-of--curb to back- of-curb streets, 50-foot right-of--way, 5-foot utility easements on both sides of the 50- foot right-of--way, and 75-foot diameter cul-de-sacs located within a 100-foot diameter right-of-way). In addition, NCDOT reviewed the proposed location for the site entrance (Westhampton Way) off of Hatch Road, and agreed that the proposed location was acceptable and provided adequate sight distances to both the east and west. We have subsequently further enhanced the available sight distance to the west by adjusting the entrance location eastward approximately 50 feet. li~estharnptmi -Response !o Slajf Connnenls A4arch 22, 2006 Page 2 of 4 ~~7 6, Review layout f'or Lots 1 and 2 and proximity of septic systems to stream, Applicatzf's Response: We actually have some questions regazding the criteria used to identify these drainage areas as "streams and/or water features" by a former staff member of the Orange County Erosion Control Division, particularly since the 100- foot buffer (a 200-foot corridor) is applied equally to all features irregazdless of its nature (ephemeral, intermittent or perennial), However, to this point in time, we have dutifully surveyed the flags that were placed in the field and represent these features and the required 100-foot buffer at this time, With this background however, we would like to note that our site visits and field surveys clearly indicate that these drainage areas on Lots 1 and 2 aze best described as ephemeral in nature rather than as intermittent or perennial streams. In other words, these features do not have standing water and/or exhibit the stream-like characteristics that are associated with intermittent or perennial streams.. With regard to the proposed location of septic systems on Lots 1 and 2 with relation to this ephemeral feature, we provide the following additional information: Lot 1: The house will be located between the ephemeral feature and Westhampton Way, while the septic field will be located on the other side of the ephemeral feature. In particulaz, the septic field will be located a minimum of I50 feet away from the centerline of this drainageway, providing an additional 50 feet of buffer to the regulated 100-foot buffer. A pump system will be used to transfer wastewater from the house to the septic field. Lot 2: The house and the septic field are both proposed to be located on the west side of the depicted ephemeral feature, The septic field will be located a minimum of 125 feet away from the centerline of this drainageway, providing an additional 25 feet of buffer to the regulated 100-foot buffer. In surmnary, based on the minimum distances between these septic fields and the ephemeral feature, and the mostly-dry nature of this drainageway, we do not believe that these septic systems will pose a threat to the quality of water traveling in this channel during rain events. 7, Concern was expressed regarding the impervious surface levels for larger homes and garages within Westhampton as compared with existing smaller homes within Robins Wood. Applicant's Response: Being located in the University Lake protected watershed, this development is limited to a maximum of six (6%) percent impervious surface. In t4~es0~mnpton -Response to StaffConmaents A4arch 22, 2006 Pao e 3 of 4 o(~ry ~ (p~[ ~l' fA V keeping with this requirement, the developer is proposing to limit impervious surface on each lot to a maximum of 11,000 SF of land area (this includes house footprint, patios, sidewalks, driveways, etc.).. This allocation is, of course, simply a inaximum limit, so it is quite possible (and actually would be expected) that residents will not maximize the amount of impervious surface on their individual lots. However, if every homebuilder were to actually utilize the maximum amount of impervious surface available on each lot, this would cause .3.7% of the site to consist of impervious surface. We note that approximately 2.3% of the site is proposed to be used for streets and sidewalks. Therefore, when the maximum buildable azeas on each lot and the streets and sidewalks are combined (.3.7% + 2.3% = 6.0%), it becomes evident that the overall site will be carefully regulated so that it does not exceed the University Lake watershed impervious surface limitations.. In contrast, existing developments, such as the Robins Wood subdivision lots that adjoin Westhampton to the east, may indeed have smaller houses than Westhampton, but they also have much smaller lots and essentially no dedicated open space areas. Therefore, even if the house, driveway, and sidewalk for each of these approximate 1.2-acre (or smaller) lots were limited to only 2,000 square feet in impervious surface, they would have approximately the same relative impervious surface impact on the watershed.. Because of the amount of open space provided within Westhampton, the amount of land area (outside public right-of-ways) associated with each home is approximately 6.6 acres. Therefore, the maximum of 11,000 square feet of impervious surface apportioned per lot is equivalent to 3..8% of this associated land azea. This compares favorably with Robins Wood lots where a 2,000 squaze foot impervious surface budget on an approximately 1.2 acre lot (there is essentially no dedicated open space areas to add to these lot areas) would result in the same 3..8% of the land outside of publicright-of--ways being covered with impervious surfaces. In addition, the Robins Wood lots that adjoin Westhampton have the north-south water feature located east of Westhampton's Pedestrian Open Space Ai'ea (POSA) as their rear property lines, with no stream buffer provided at all, whereas Westhampton will provide a 100' stream buffer measured from each bank. We believe that the combination of the provision of 52.76 acres of open space areas along all of the edges of Westhampton, the incorporation of 100' strearn buffers (measured from the bank of the water feature for a total of 200'+ of stream buffer), and the lazger lot sizes (ranging from 2..58 acres to 5.21 acres) within Westhampton combine to provide a superior level of protection for the University Lake watershed that was not previously provided by the existing developments to which it is being compared. ldreslhamp(on -Response (o StajjConvnen[s Alm ch 22, 2006 Page 4 nj4 Vi' N V ORANGE GOUNTY ENVIRONivIENT AND RESOURCE CONSERVATION C~EPARTt'~€ENT MENIORANC3Ui'VI To: Eddie Kirk, Orange County Planner From: Rich Shaw, Land Conservation Manager Date: April 20, 2006 Re: Westhampton Subdivision Proposal Thank you for the opportunity to review and comment on the proposed Westhampton Subdivision. Included in that open space are fairly large areas of mixed hardwood forest adjacent to Phil's Creek. in both the southwest and southeast corners of the property. This forest would provide a small wildlife refuge and provide residents of the subdivision with woodlands for walking and nature study. That 102-acre tract includes approximately 20 acres on the north side of Phil's Creek, which is isolated from the bulk of the tract. When this large tract is developed someday the owners might be vdilling to convey a portion of this land to help fill in the gap, Let me know if you have any questions or would like to discuss these findings. cc: David Stancil Environmenf and Resource Conservation PO Box 818 f / 306-A Revere Road Hillsborough, NC 27278 (919) 245-2590 34 ORANGE COUNTY PLANNING & INSPECTIONS DEPARTMENT Craig N. MEMORANDUM TO: Board of County Commissioners FROM: Orange County Planning Staff DATE: August 9, 2006 SUBJECT: Access to the Dedicated Open Space as Recommended by Environment and Resource Conservation Department The Environment and Resource Conservation Department is recommending the County request that a portion of the open space be dedicated to Orange County for recreation and open space (see Rich Shaw memo of April 20, 2006). The proposed dedication is as follows: a) a 200-foot-wide strip located parallel to a 770-foot section of Phil's Creek that helps to form the southeastern property boundary, and b) a 200-foot-wide strip located parallel to a 150-foot section of Phil's Creek that helps to form the southwestern property boundary. As indicated in the Rich Shaw April 20, 2006 memo the construction of a public walking trail is not likely to occur until additional lands along Phil's Creek are dedicated for recreation and open space purposes. Until this happens it is apparent that the proposed 200-foot wide strip located parallel to the 770-foot section as identified in "a" above will need access. This access can be obtained by providing a 20 foot dedicated public access easement from the proposed new public road (Westhampton Way) to the 200-foot wide dedicated section along Phil's Creek. This recommendation is being brought forward as item E,3 in the attached Resolution of Approval. H:\MSECHRIST\AGENDA\ABSTRACTSO6\QB-22-06\Pianning- Westhampton-ERCD-Memo doc {~riEMORANDUM Date: April 25, 2006 To: Eddie Kirk, Orange County Planning From: Marty Roupe, and Members of Planning Department Staff Subject: Courtesy Review Comments Project: Westhampton (March 27, 2006 transmittal) The purpose of this memo is to provide comments for the proposed referenced subdivision which is within the Joint Planning Area. 1, Consider reconfiguring lots i and 2 so they share stream buffer, which may minimize potential driveway crossings of the stream buffer, and which could allow pedestrian access easements (within the stream buffer) to the open space (north of lots 1 and 2).. 2. Please check Orange County's Greenway Plan. It appears that opportunities exist for public dedication of some open spare along the stream corridors; 3. Please find the Town's first review comments repeated below, as they did not seem to he directly addressed within this submittal. Comments from 15r Review (i.e.: Concept Plan stage): 1) The site plan (and this area, in general) exhibits no neighborhood connectivity. Such connectivity ran reduce trip generation for neighborhood residents and service providers, There seems to be one remaining opportunity for a connection. A site plan that includes astub-out to the property to the south across Phil's Creel< is recommended for your consideration. 2) This property has approximately 2,400 linear feet of frontage along the Phil's Creek drainage. The Joint Planning Area (JPA) Land Use Plan suggests that many of the JPA drainages be designated for pedestrian access and I believe this concept is echoed in the Report on the Recreation and Parks Work Group, I do not recall whether this particular location was designated for that purpose and am copying this note to Dave Stancil to request that he respond to that question. Heffner has requested that a Certificate of Adequate Public Schools be issued for a minor subdivision development project called Westhampton. This 19 unit, single family detached subdivision is located on the south side of Hatch Road. This request is in compliance with the Schools Adequate Public Facilities Ordinance (SAPFO), enacted in July of 2003. The requested subdivision will have 19 single family houses.. The request qualifies for a CAPS using the ezisiing capacity and student generation rates as approved by the Orange County Commissioners, The spreadsheet used in that determination is attached, Occupancy is expected to take place during 2007.. The project will generate approximately seven students. As this request has been made during the 2005-2006 school year, and as the current school capacity has been approved by the County Commissioners during the 2004-2005 school year, Support Services recommends that the Board of Education award CAPS Number CH 0012 to Thomas H. As occupancy is expected in the 2007-2008 school year, additional high school capacity will be available at high school #3, Resolution: Be it, therefore, resolved that the Board of Education awards Certificate of Adequate Public Schools # CH 10012 to Thomas H. The plan is preliminary in nature and does not show all the technical information required. Therefore our comments will be general in nature. 1. We have met with the developer on site and have inspected and approved the proposed site access on Hatch Road. No road improvements are warranted in a accordance the requirements of the NCDOT driveway manual, 2. The plan provides adequate minimum housing density to meet NCDOT requirements for road addition at full build ouk, However, lots 16, 17, 18, and 19 must be fully developed and access Weston Lane in order to ensure eligibility for addition of this road. 3. 10'X70' site distance easements are required at all stop condition intersections and adequate permanent drainage easements are required at all pipe crosstines and drainage outlets. 4, As previously requested by the developer and County staff, IJCDOT will require that all subdivision streets be designed to the NCDOT "local subdivision road" minimum design standard for rolling terrain, It should be noted however, that this design does not specifically provide for bicycle accomodations or parking. 5. Complete construction drawings and design calculations must be submitted for NC:DOT review and approval if the developer wishes for these roads to be State maintained. However, it was pointed out to Deputy Chief Crabtree that due to the extremely low impervious surface limit required within the University Lake watershed protection azea, that Westhampton does not have any stortnwater ponds. Furthermore, stormwater ponds aze usually required by state law to be designed to essentially drain dry within five days after a rainfall event, and were therefore not the type of permanent pond they were seeking. The Surveyor, when surveying the property, found out that there were 9..34 more acres than originally thought, so one additional lot was created. There are now 191ots proposed, rather than 18. The average lot size has increased, and the same 41 % of open space was maintained. As a result of the additional lot, an additional road has been added. Staff has recommended the connection with the Pedeshian Open Space Areas, and with ERCD's request far dedication along Phil's Creek, Staff would like to have an access to the trail. Jack Smyre: Since you last saw the concept plan, the County has ascertained that there aze suitable soils for' the development, and maintained the 41 % open space, which is a ]azge margin. We aze in agreement with Staff's recommendations, but we disagree with Staff's recommendation on page 8, item E-3. We aze supportive of the trail concept along Phil's Creek made by ERCD, and will dedicate the land for that cause. There are numerous ways for residents to access the trail. Rich Shaw of ERCD was unaware of the request for the additional access, and our concern is thrat not only is it unnecessary, it will create a de facto trailhead for the public. The trail is intended for the neighborhood's use, not a public access. Renee Price-Saunders: Regazding Phil's Creek, if this land is dedicated, wouldn't that decrease the acreage for lots 1 and 2, and 15, Jack Smyre: That area is shown on the plans as across-hatched area, and is a stream buffer. It is not a public access azea. ~-5 Renee Price-Saunders: Will this be a gated community? Jack Srnyre: No. Jay Bryan: Isn't there a proposed greenway in the area? Eddie Kirk: The County owns some greenway already, and this dedication will extend it. Brian Dobyns: The baseline documentation from the Triangle Land Conservancy shows a trail currently exists from Neville Road, and the character of that trail, is that it is not a public trail. It is in people's back yards, and there isn't any place along Neville Road that promotes access or use. The Triangle Land Conservancy feels that this is a easement designed to protect natural areas and floodplains, and not for public use. Renee Price-Saunders: What about the soils on Lots 1, 2, and 15? They are near the streams. Have you already reviewed these locations? Jack Smyre: The County has already done the testing for septic areas outside of the stream buffers, Jeff Schmitt: Why is the Staff proposing E-3? Eddie Kirk: It is to present an access to the dedicated azea. Jeff Schmitt: Haw does that fit with Brian's comments? It seems apparent that there with the access off Neville Road, there is currently access. Sam Lasris: I seem to recall a discussion about an alternate route out of the subdivision, Brian Dobyns: I believe we were looking at an access between lots 7 and 8, but there was nothing between 9, 10 and 11 in the original concept plan, and we were suggesting something to the west. Now that has been pravided,,just in a different location. Eddie Kirk: The Health Department provided information in helping to determine these Pedestrian Open Space Areas. Jeff Schmitt: Where could citizens get access to the trail today? Neville Road? Brian Dobyns: People can use the trail, but there is no parking, There is no goal to make this a public trail system, Renee Price-Saunders: What would prevent someone from pazking on Westhampton Way to use the trail? Jack Smyre: It could be done, but it would be considered private property 2 4~ Tom Heffner: With other subdivisions where Hameewner Associations own land, there are lots of homes that allow parking, and I'm not aware of any problems with this, MOTION by Jeff Schmitt to approve the preliminary plan for the Westhampton subdivision, with the exception that item E-3 be deleted, Seconded by Brian Dobyns, Vo'rE: Unanimous Kip Weinert (citizen): I live on Carl Drive nearby, and am concerned about the water. As a part of the approval, you might want to consider adding an aquifer study requirements to make certain that the development can sustain itself, and not affect the neighbor's water supply. Michelle Kempinski: Have you experienced any water concerns? Kip Weinert: I have not personally, but neighbors in Robinswood have had some bad quality, as well as in surrounding areas, Brian Dobyns: There is an Orange County map showing aquifer resources, Perhaps we could use this map in looking at future subdivisions. Also, we could look at the 2001 and 1996 groundwater studies, Renee Price-Saunders: We have been addressing water resources in this Board, and unfortunately, right now there is little we do, ICip Weinert: Could the Commissioners consider this? .Tay Bryan: They can consider at the time this is presented for their approval, if you wish to address this, Craufurd Goodwin: Not only do we not have the authority, there is no degree of confidence that adjacent well situations could be affected by the subdivision. Sandy Quinn: Many citizens have brought up water concerns in the past, While we do not have the power or authority to do anything, it's important that we continue showing our interest as reflected irr our minutes. Vivian Phillips: I live on Carl Drive, Since I first learned about the proposed subdivision at the Neighborhood Information Meeting, few people were aware of it, and through ward of mouth, are getting concerned about the water supply situation. It does affect large neighborhoods. I suggest publicizing potential developments, especially in protected watershed, Otherwise, who would protect the neighbors? ,Tay Bryan: Is there a difference in the advertising for this meeting as opposed to when we reviewed the concept plan? ~-~ Eddie Kirk: The only notification required to neighbors is for the Neighborhood Information Meeting at the time of the concept plan, Robert Davis: The best way to advertise generally is by word of mouth, Craig Benedict: Also, we notify both OWASA and Cazrboro of the proposed development as part of the Joint Planning Agreement. Jay Bryan: We may want to look at a broader form of notification when proposed subdivisions are in protected watersheds. Michelle Kempinski: Water issues don't only deal with new subdivisions. We need to acknowledge that this is a recurring comment at our meetings, Sam Lasris: Maybe we can start a process for pursuing mitigation of water systems as a long- term strategy. Jay Bryan: So, for our future consideration of subdivisions, we would like to look at the aquifer maps that Brian alluded to. Copies of our minutes need to be provided to the Commissioners. Sherri Ingersoll: This portion of the minutes will be included with the agenda abstract. .Tay Bryan: Please highlight this section of the comments so that it is cleazly indicated to them, Michelle Kempinski: Do we know when this is scheduled for review by the Commissioners? Benedict, Planning Director DATE: September 5, 2006 SUBJECT: Westhampton; .Joint Planning Area Agreement and Land Use Plan and Greenways CC: Geoff Gledhill, County Attorney Research shows that the Rural Buffer land use description and the 'Resource Protection Areas' as defined in the JPA (with associated greenway connector pathways) are areas where the County currently has the authority to require public access to and "greenway" dedications. The County has used its authority to require dedications for public access to greenways on both sides of the Westhampton site in past years (1988 Turtledove subdivision and 1992 Shenandoah subdivision). (See attached map.) This dedication requirement is consistent with the similar JPA implementation strategies and requirements of our JPA partners, Carrboro and Chapel Hill, each of which have similar language requiring greenway public dedications for their respective transition areas. The operative language from the JPA Land Use Plan is as follows: "These areas form the basis for a comprehensive parks and open space system which provides the framework within which other land use categories are to function. Parks have been generally located throughout the Joint Planning Area using a neighborhood park one-half mile service radius. The parks, as well as portions of Duke Forest, are linked together by a system of greenways extending along drainage ways, and pedestrian routes (sidewalks) along thoroughfares." P:\6rian rertell\Onnge CountyV'tanning\Wusth.unpton\Dedicated access to greemvny incinu BF revised - f'or inergc rev by geg doc sa Uur JPA partners are requiring dedications in the transition areas that connect with the County's Twin Creeks Park so that residents may eventually use the park trail system network to access the park via walking trails. In non-JPA areas of the County, the County has not established a 'greenway system as part of its Land Use Plan. However, on a case by case basis, such as the Habitat for Humanity Richmond Hills subdivision in Efland, the applicant publicly dedicated land along McGowen Creek, as well as an easement, for a connecting path (to be built by the County at a later date) from the creek to the Efland-Cheeks Park, In addition, the Ashwick subdivision publicly dedicated areas along McGowen Creek during its subdivision process., As the County updates its Parks and Recreation Element of the Comprehensive Plan, consideration can be given to a pathway system connecting the aforementioned park and McGowen Creek Preserve (64-acre purchase). In summary, the JPA contemplates that public dedication will occur along the designated 'greenway' system whether these dedications are acquired by the Towns or the County. The proposed public recreation dedication in the Westhampton subdivision implements the dedication for greenways as set forth in the JPA, This dedication may eventually be a pathway to the OWASA reservoir area near High 54. In fact, Phil's Creek benefits from water flaw release from the reservoir through the creek to Neville Creek, and eventually to University Lake. f:\Brimi Feaell\Dmnge CountyNlanning\Westhamplon\Dedicaled access to greenway memo BP revistd -for merge rev by geg Jac 53 ORANGE COUNTY PLANNING & INSPECTIONS DEPARTMENT Craig N. Benedict, Planning Director DATE: September 5, 2006 SUBJECT: Development Review and Transportation Impact ReviewlRequirements Questions have been raised regarding how and when the development review process prompts traffic improvements (i.e, right and left turn lanes, traffic signals, etc.) The subdivision and zoning requirements that give guidance to Staff on this issue are listed below. NGDOT standards require a Traffic Impact Study for activities generating more than 3,000 daily trips (approximate number of trips generated by a 300-lot residential subdivision.) Orange County requires a traffic impact study for any Special Use Permit or Site Plan generating more than 800 daily trips (approximate number of trips generated by an 80-lot residential subdivision,) The Planning Department has not reviewed any new subdivision of that size during the past several years. The current standards for traffic improvements for new subdivisions deal, for the most part, with an analysis of existing traffic conditions and existing traffic capacities, This view from the `present' does not include or project the cumulative impact that future development may have on the existing roadways. A potential consequence of this "present" analysis is that the first large scale development (or the first few small scale developments) built in an area with previously low traffic volume can 'use up' the capacity of a roadway system without any contribution from these early developers for traffic increases caused by their subdivisions. As a result, it is possible that the future projects in the same area may bear the brunt of deficient traffic improvements and deficient service capacity. In this scenario, costs for later improvements are borne by the NCDOT (the taxpayers) and subsequent developers while earlier projects in the same area are not required to share in the cost of the necessary improvements. f:\Drian Fencll\Ormge County\Planning\WesthnmplonCrrmspni7ntion Impact Mcmo 6F Revised - Rn mergo rev by gcg doc 5~}- Staff suggests that the QUTBQARD (which includes Planning Board members) review the factors listed below and other ideas in order to develop development standards that capture the cumulative effects of development so that public road improvement requirements for new developments can be employed in a consistent manner at every level of the development review process,. A long term view of traffic impacts may show that a relatively small development that generates less than 800 daily trips will have an impact on future traffic patterns.. The future traffic impact will depend a great deal on a variety of factors including the functional classification and capacity of the roadway that the proposed development abuts. Staff requests direction as to 1) whether or not the Board would like Staff to develop traffic impact threshold criteria for developments that generate less than 800 daily trips; and 2) if the Board wants Staff to move forward on this issue, which of the following road factors (and any other) the Board finds important to the traffic impact determination: 1. Size, type and location of development; 2. Functional classification of road; 3, Capacity of abutting roads to handle traffic; 4. The most recent traffic counts; 5. The volume-to-capacity (v/c) ratio; 6. Connectivity to other undeveloped properties) 7. Right of way requirements; 8. Impact Assessments; and 9. Mixed Use development. September 1, 2006 Mr, Craig N. Benedict, AICP Planning Director Orange County Planning Department 306F Revere Road Hillsborough, NC 27278 Subject: Westhampton Recreation Space & Dedication of Land to County Dear Craig: At the Orange County Board of Commissioners meeting on August 24, 2006, we noted our opposition to the proposed stipulation E(3) which stated that the developer shall "provide a 20-foot public access easement from Westhampton way to the dedicated open space along Phils Creek." We appreciate County Attorney Geoff Gledhill, you, and members of your staff taking the time with us earlier today on Friday, September 1 s`, to further discuss this issue and reach a mutually beneficial compromise. Irr particular, we are pleased to leazn that Orange County already has an existing county-owned access corridor from the west that currently provides public access to the land that we aze proposing to dedicate to the County for conservation and/or recreational purposes. As noted at our meeting, in exchange for deleting stipulation E(3), we will provide an additional 50-foot wide access corridor connecting the two pieces of land previously requested for dedication by County staff'. This additional 1,87 acres of land (which increases our proposed dedication of land from 4.50 acres to 6..37 acres) will provide a continuous publicly-accessible corridor from Neville Road (to the west) to the eastern edge of the proposed Westhampton site, and will also alleviate the need for the County to pursue future land dedication from the property owner to the south in order to provide continuity along the Phils Creek open space corridor, Consequently, in exchange for the deletion of condition E(3), we are hereby proposing to deed an approximate total of 6.37 acres of land to Orange County, as illustrated on the attached exhibit. As you have previously noted in your August 24's materials to the County Conmrissioners, we continue to provide a much larger dedication of public recreation space than required by the .Orange County Subdivision Regulations, Finally, we note that the additional 1.87 acres of land that we are proposing to deed to Orange County (in addition to the 4.50 acres that were previously proposed for dedication) is being provided as an alternative to the potential additional payment-in-lieu ($8,645) that was mentioned by the developer at the last meeting.. We believe that tlils offer is a mutually beneficial solution that provides Orange County with an additional one-half mile of publicly accessible land along the Phils Creek corridor, creating a desirable conservation and/or recreational area that should provide a significant public benefit both now and in the future, Sincerely, THE DESIGN RESPONSE, INC.. !- V .Jac L.
