The salary range for Salary Grade 27 is $63,120 - $100,906. BACKGROUND: In September 2006, the operational need for full time legal and analytical support to OPC Mental Health will conclude. The position and employee will be reassigned to the Personnel Department to provide specialized support for regulatory compliance to federal, state and county regulations, ordinances and policies with 25% of direct support provided to the Department of Purchasing and Central Services. Specifically, the proposed duties and responsibilities will include the following: Provides specialized legal support to ensure regulatory compliance to federal, state and county regulations, ordinances and policies concentrated in the function of human resource management and related risk management areas such as HIPAA, ADA and OSHA. Advises Department Heads on the construction, implementation and enforcement of policies, statutes and procedures. • Works collaboratively with the Director of Purchasing and Central Services for 25% (10 hours) of the normal workweek in the review, analysis, development and implementation of contracts, programs and projects as needed. The duties and responsibilities to be assigned to the position have been reviewed and are consistent with the class specifications of positions at Salary Grade 27. FINANCIA<_ IMPACT: Funding to accomplish this action are already available in the BOCC's adopted 2006-07 County operating budget. RECOMMENDATION (S): The Manager recommends that the Board amend the Classification and Pay Plan to add the new class of Policy and Compliance Officer at Salary Grade 27. It is also recommended that position number 411 be reclassified to the new class of Policy and Compliance Officer at Salary Grade 27. JOB TITLE: Policy and Compliance Officer (Grade 27) PER/9 DEPARTMENT: Human Resources JOB SUMMARY: This position is responsible for providing specialized legal support needed for regulatory compliance to federal, state and county regulations, ordinances and policies concentrated in, but not limited to, the area of human resource management and related risk management areas such as HIPAA, ADA, and OSHA. The positions' core responsibilities include but are not limited to the review, development, presentation, training and implementation of ordinances, policies, and procedures for the functional areas supported, MAJOR DUTIES: o Provides specialized legal support to ensure regulatory compliance to federal, state and county regulations, ordinances and policies concentrated in the function of human resource management and related risk management areas such as HIPAA, ADA and OSHA, o Renders verbal and written opinion to the County Manager, Department Heads and other County officials on policy issues and gives advice on the implications involved. o Advises Department Heads on the construction, implementation and enforcement of policies, statutes and procedures. o Provides assistance as requested or needed to the County Manager or Department Heads to ensure operational compliance with governing ordinances and policies that guide County services to citizens and employees, o Provides in service training to Department Heads on functionally related new polices, procedures and laws in order to promote regulatory compliance in the areas supported. o Conducts research and analyses to ascertain applicable statutes, rulings and precedents on policy issues that have broad ramifications to the County, the public or specific departmental operations. o Interprets policy and provides technical assistance in the evaluation and development of new policies and procedures; analyzes information from a variety of sources related to operational issues and programs; conducts and/or reviews research projects related to County programs and activities. o Works collaboratively with the Director of Purchasing and Central Services for 25% of the normal workweek in the review, analysis, development, and implementation of contracts, programs, and projects as needed,. o Serves as liaison with Department Heads, Wage Hour Investigators and contract compliance officials by answering questions regarding policies, procedures and regulations, and coordinating various resources or objectives. a o Participates in the development and revisions of the personnel ordinance and employee handbook. o Develops procedures, position papers and/or draft policies, regulations and legislation. o Keeps abreast of and informs staff of new laws or changes in law by researching federal, state and local statues, case law and constitutional provisions. o Prepares and reviews County impact statements and researches, drafts and/or reviews responses prepared on behalf of the County Manager, Human Resources Director and other County officials. o Serves as a member of the Risk Management Team, o Performs other related duties as assigned, KNOWLEDGE REQUIRED BY THE POSITION: o Knowledge of general state and federal laws, administrative policies, practices, principles and procedures as related to Human Resources and the operations, authority and responsibilities of County government programs. o Knowledge of project management. o Knowledge of policy analysis, legislative practices, research and evaluative techniques, and organizational components and services. o Knowledge of county ordinances and department policies and procedures. o Skill in problem solving and decision making. o Skill in gathering and analyzing complex data, o Ability to conduct and report analyses, write policy and procedures, analyze and appraise facts, draft opinions and proposed legislative measures, and interpret and apply legal principles in resolution of County issues, o Ability to conduct independent research and analyze o Ability to work with diverse groups of people, o Skill in public and interpersonal relations.. o Skill in oral and written communication. SUPERVISORY CONTROLS: The Human Resources Director assigns work in terms of department goals and objectives with specific feedback from the Director of Purchasing and Central Services and the County Manager, The work is reviewed through conferences, reports and observation of departmental activities. GUIDELINES: Guidelines include federal, state and county regulations and county and department policies and procedures. These guidelines require judgment, selection and interpretation in application. COMPLEXITY: The work consists of varied administrative, managerial and regulatory duties. The number of and frequent changes in applicable regulations and the diversity and uniqueness of interpreting policies and procedures to ensure compliancy contribute to the complexity of the work. SCOPE AND EFFECT: The purpose of this position is to provide specialized support needed for regulatory compliance to federal, state and county regulations, ordinances and policies concentrated in the area of human resource management and related risk management areas such as HIPAA, ADA and OSHA, Successful performance in this position ensures that County ordinances and policies and procedures are in compliance with appropriate regulatory requirements. PERSONAL CONTACTS: Contacts are typically with officials from federal, state and local government agencies; client groups; legislative staff members; research institution staff; special interest groups; and private industry representatives. PURPOSE OF CONTACTS: Contacts are typically to discuss County programs and operations, give and exchange information, resolve problems, motivate or influence persons and provide services. PHYSICAL DEMANDS: The work is typically performed while sitting at a desk or table. WORK ENVIRONMENT: The work is typically performed in an office. SUPERVISORY AND MANAGEMENT RESPONSIBILITY: This position may serve as a team leader directing studies, which are interdisciplinary in nature,. MINIMUM QUALIFICATIONS: o Knowledge and level of competency commonly associated with the completion of a baccalaureate degree in a course of study related to the occupational field. o Experience sufficient to thoroughly understand the diverse objectives and functions of the subunits in the division/department in order to direct and coordinate work within the division/department, usually interpreted to require three to five years of related experience. Possession of or ability to readily obtain a valid driver's license issued by the State of North Carolina for the type of vehicle or equipment operated.
