Owner: Annie Sturdivant Subdivision follows the Conservation-Cluster Option of Flexible Development.. • Total acreage is 130,08 acres including right-of-way, Subdivision Type Number of Lots Conservation-Cluster 19 Flexible Option Average Lot Size Percent of Open Space 3.79 Net Subdivision Land Area 130.08 acres Area in ublic road Ri ht of Wa . 4.56 acres Area outside of ublic road r.o.w. 125.52 acres Platted lot area 72.02 acres Area in common o ens ace 52.76 acres 41 Location Southwest side of Hatch Road in Chapel Hill Township, 41 Acres in Open Space 52,76 Existing and Proposed Conditions Existing: • Zoning: Rural Buffer (RB) Chapel Hill/Carrboro/Orange County Joint Planning Agreement 2 minimum lot size - 2 acres (Section 5.1.1 Orange County Zoning Ordinance). Zoning Overlay: • The property is in the University Lake protected watershed (max. density = 2 acres /dwelling and 5 acres /dwelling after first five lots) (Section 6.23.2 Orange County Zoning Ordinance).. Physical Features: • There are several County designated streams on the south side of the tract to be protected with stream buffers.. • The site is mostly wooded with a mixture of pines and hardwoods. • The topography is gently rolling with steeper slopes along the streams. Adjacent Land Use: • Robinswood Subdivision is located to the east with an average lot size of 1.14 acres; Reaves Estate Subdivision is located to the west with an average lot size of 1.36 acres. • Properties to the north and west are divided into large acreage tracts ranging in size from 2 to 16 acres. • Phil's Creek, a tributary to Neville Creek which flows to University Lake, and a large 108 acre tract are located to the south. Proposed: Roads: • Access is from Hatch Road (SR 1944), an existing paved public road in Chapel Hill Township. • The proposed street (Westhampton Way) provides access to the lots. Weston Lane, a small loop road serving 4 lots, extends from this road, • All roads are to be constructed to NCDOT standards, • NCDOT comments indicate subdivision streets are required to meet "local subdivision road" minimum design standards, minimum 22 foot travelway, for rolling terrain.. Sidewalks would be outside of the right-of-way and Weston Lane will require 4 lots accessing it. • Comments from Carrboro indicate a stub out to the south should be considered. However, a stub out at that location would have to cross Phil's Creek, In addition the tract to the south is under single ownership and is developed. Planning Staff, due to topography and environmental concerns, is not recommending a stub out to the south. • ERCD is recommending dedication of open space along Phil's Creek to further accent the value of the stream. • Adjacent properties have been developed with a cul-de-sac lotting pattern. There are streams along the western and southern boundaries.. Open SpacelBuffers: • 52.76 acres (41 %) of common area open space proposed. All of the open space is wooded with a large portion along Phil's Creek, some with steep slopes. • The lot sizes average 3.79 acres, 90% above minimum lot size of 2 acres. • Approximately 4.5 acres of dedicated open space to Orange County is recommended along Phil's Creek. This would leave approximately 48,26 acres in the Homeowners Association. • Density of the proposal is 6.84 acres per house. • Homeowners Association will be formed to maintain open space, buffers, signage. • Sidewalk on one side will be built within 30 foot roadside buffer along proposed streets. • Staff recommends developer provide a Way to the dedicated open space along Staff memo). Water/Sewer/Fire: minimum 20 foot wide public access from Westhampton Phil's Creek (see attached August 9, 2006 Planning • Individual wells. • Individual septic systems.. 3 • The closest water and sewer is in Rangewood subdivision, which is approximately 1,000 feet north of this subdivision. • Extension of water and sewer is prohibited in the Rural Buffer except for a public purpose or to address a health situation. Recreation: • Chapel Hill District Park • The Orange County Environment and Resource Conservation Department is recommending a portion of the open space property be dedicated to Orange County for recreation and open space, The proposed dedication is a 200-foot-wide strip located parallel to a 770 foot segment of property boundary formed by Phil's Creek and a 200-foot-wide strip located parallel to a 150 foot section of Phil's Creek that helps to form the southwestern property boundary (memo and map attached), Payment in lieu would require 1/20th of an acre per lot which would be approximately 41,382 square feet. This dedication of 4.5 acres would replace the payment-in-lieu option,. Development Process Schedule and Action Planning Board: First Action: Concept Plan approved by the Planning Board December 7, 2005 with the following conditions; 1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT collector standards with a 60 foot right-of-way and 34 foot B-B pavement. The sidewalk is to be outside of the right-of-way,(NCDOT Recommendation) 2. Homeowners Association documents that provide for maintenance of the Open Space shall be submitted with the preliminary plan. Provisions shall be included in the Homeowners Association documents that would prohibit tree cutting in the Open Space except for maintenance purposes. 3, The cul-de-sac at the end of Westhampton Way shall be increased to a minimum of 95 feet in diameter, Turning radii at all corners shall have a 32 foot minimum, 4_ Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of existing R/VV, whichever is greater, along Hatch Road on the Preliminary Plan, 5. Weston Lane must have 4 lots accessing it to meet NCDOT requirements, 6. Show five-foot utility easements along both sides of all rights-of-way. 7. ERCD has recommended that a portion of the open space be dedicated (deeded) to Orange County for recreation and open space, The dedication is a 200-foot-wide strip located parallel to a 770 foot segment of property boundary farmed by Phil's Creek. This will meet the requirement for recreation and reduce or eliminate the amount of the recreation payment-in-lieu. 8. Shaw location of subdivision sign on Preliminary Plan. 9. Any lighting shall meet Orange County Outdoor Lighting Standards, 10, A minimum 50 foot wide Pedestrian Open Space Area (POSA) shall be provided between lots 7 and 8. Preliminary Plan: Addresses the conditions of approval of the Concept Plan. The applicant has submitted responses to Staff comments and responses to Planning Board comments from the December 7, 2005 meeting. Subdivision streets are designed, as required by NCDOT, to "local subdivision road" minimum design standards for rolling terrain. Items of concern to the Planning Staff are dedication of open space to Orange County along Phil's Creek and Pedestrian Open Space Areas (POSA) needed between lots 3 & 4 and between lots 9, 10 & 11. Additional conditions have been added to the Resolution of Approval to meet these concerns. Several neighbors in the .June 7, 2006 Planning Board meeting indicated they had not encountered problems but were concerned with water quality (see attached minutes), 4 The developer indicated in the June 7, 2006 Planning Board meeting they did not see a need far condition E.3. in the Resolution of Approval "Provide a 20 foot public access easement from Westhampton Way to the dedicated open space along Phil's Creek," They were concerned about the public parking on Westhampton Way and walking across the open space to Phil's Creek. • Second Action: Planning Board on .June 7, 2006 unanimously recommended approval with the deletion of E,3, from the Resolution of Approval. • Third Action: 1. The Board shall consider the application within a reasonable amount of time, 2. During deliberations and consideration of the application the Board may defer consideration at any point to pursue additional analysis and review. 3. If the Preliminary Plan is approved by the County Commissioners, the applicant shall have one (1) year to prepare and file a Final Plat or to request aone-year extension from the Planning Director, FISCAL IMPACT: The Fiscal Impact Analysis is included as an attachment., RECOMMENDATION(S): Administration Approval, in accordance with the attached Resolution of Approval which includes item E, 3, Planning Board Approval, in accordance with the attached Resolution of Approval with item E. 3 deleted from Resolution, Planning Staff Approval, in accordance with the attached Resolution of Approval with a condition E. 3. "Provide a 20 foot public access easement from Westhampton Way to the dedicated open space along Phil's Creek," RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date: August 22, 2006 Name of Subdivision: Westhampton Owner/Applicant: Heffner Properties, Inc. The Board of County Commissioners hereby approves Westhampton subdivision preliminary plat, dated March 22, 2006 and containing 19 lots, subject to the fulfillment of requirements specified herein. Westhampton Way, Weston Lane and Brookford Court shall be irrevocably dedicated to the general public and constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept far Orange County and on behalf of the public generally, the offer of dedication of Westhampton Way, Weston Lane and Brookford Court. This acceptance by Orange County of the dedication to the general public of Westhampton Way, Weston Lane and Brookford Court shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of Westhampton can be recorded: A. Sewage Disposal Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2, The septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. B. Roads and Access Westhampton Way, Weston Lane and Brookford Court shall be constructed to standards of the North Carolina Department of Transportation, within a 50-foot right-of-way with 5-foot utility easements on each side, and the construction shall be inspected and approved by NCDOT. The pavement width shall be a minimum of 20 feet. OR A letter of credit, escrow agreement, or bond shall be submitted to secure construction of Westhampton Way, Weston Lane and Brookford Court to the standards of the North Carolina Department of Transportation., An estimate of the construction cast must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina, The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. All lots shall receive access from the internal subdivision roads. No driveway shall be permitted within 50'of a street intersection. Lot 19 shall receive access from Weston Lane, Lots 10 and 14 shall receive access from Brookford Court. 3. An erosion control plan for construction of the roads shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval prior to any land disturbing activity on the site. 4. Approved street name signs shall be erected at all intersections prior to Planning Department signatures on the final plat or prior to issuance of any building permit if construction is secured by letter of credit., 5. Prior to any construction or alteration of any existing access within the right-of-way of Hatch Road, the developer/owner shall secure a driveway permit from the NCDOT District Office. Submit a copy of the NCDOT- approved permit and letter to the Planning Department at the same time as the request for Planning Department signatures on the Final Plat. 6. Sight triangles (10'x 70') shall be shown on the Final Plat at each intersection,. 7, Dedicate, in fee simple, five (5) feet of additional right-of-way, or 35 feet from the centerline of the existing right-of-way, whichever is greater, along the frontage of Hatch Road. Said dedication shall meet major collector road right-of-way standards as identified in the Comprehensive Plan and required in Section IV-B-3-c-1 of the Subdivision Regulations. C. Land Use Buffers and Landscaping Landscaping shall be installed or preserved as indicated on the approved landscape plan (open space and pathways plan), and shall be inspected and approved by the Planning and Inspections Department prior to signatures on final plat.. No part of the landscaping shall encroach into the 10' x 70' sight triangles at intersections. OR Guaranteed financially through a letter of credit, escrow agreement, or bond submitted to secure required landscape installation and preservation. An estimate of the cost for required preservation, plantings and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina.. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. No clear cutting on individual lots per section IV-B-8-c of the Orange County Subdivision Regulations is permitted. 2, A Type A Land Use Buffer shall be provided along Hatch Road, The buffer shall be 30 feet in width along Hatch Road and shall be composed of deciduous and/or evergreen vegetation, forming semi-opaque intermittent visual obstructions from the ground to a height of at least thirty (30) feet. Said buffer shall be so noted on the plat, and described in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. Locate drainage easements on the final plat as required following review and approval of the Erosion Control Plan. 2. Drainage culverts shall be sized and located as required by NCDOT and a North Carolina licensed Professional Engineer, E. Parkland 1. The southern portion of the open space property shall be shown on the final plat and dedicated by deed to Orange County far recreation and open space, The dedication is approximately 4.5 acres as follows: a) a 200-foot-wide strip located parallel to a 770-foot section of Phil's Creek that helps to form the southeastern property boundary, and b) a 200-foot-wide strip located parallel to a 150-foot section of Phil's Creek that helps to farm the southwestern property boundary. 2. The second paragraph of Section IV-B-7-b of the Orange County Subdivision Regulations references the required minimum recreation space ratio in the Orange County Zoning Ordinance, Article 5.1.1, which requires 0.028 square feet of recreation space per land area dedicated to residential use [0,028 ~ 130.08= 3.64 acres or 158,655 square feet]. In those cases where the required minimum recreation space results in a larger amount than the public recreation space requirement of 1/57 acre per lot, the difference shall be established as private recreation space far the use of the residents of the development (158,655 - 14,520 = 144,135 square feet (3.30 acres). The developer has planned 52.76 acres of open space (41 %) to be awned and maintained by the Homeowner's Association, except far the approximate 4,5 acres proposed to be dedicated to Orange County, which will meet the County's requirement for private recreation use, 3. Provide 20 foot public access easement from Westhampton Way to the dedicated open space along Phil's Creek. F. Miscellaneous The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations, 2.. The portion of open space not deeded to Orange County shall be conveyed into the Homeowner's Association. 3. A 50-foot Pedestrian Open Space Area (POSA) between lots three (3) and four (4) and between lots nine (g), ten (10) and eleven (11) shall be shown on the final plat connecting the open space to Westhampton Way, 4. Prior to installation of street lighting within the subdivision a lighting plan shall be submitted to the planning office for review and approval. 5, A permit shall be obtained for the entrance sign prior to beginning construction. G. Certifications A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3, The North Carolina Department of Transportation shall certify that the platted portion of Westhampton Way, Weston Lane and Brockford Court have been entirely constructed to State standards or that construction plans have been approved prior to Planning Department signatures on final plat, 4. A Certificate of Approval signed by the Orange County Planning and 9 Inspections Department, NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners that the Preliminary Plan for Westhampton Subdivision is approved in accordance with the above mentioned conditions and attached Preliminary Plat dated March 22, 2006. Tom Heffner, the president of Heffner Properties, Inc., has developed a~xl/or been associated with several ]nigh-quality residential communities located within Orange County in the past. 7,oning: The Rural Buffer (RB) zoning district was established to provide for rural residential development within the portion of Orange County designated as Rural Buffet, Since no extensions of public water and sewer lines are allowed within the Rural Buffer, development within. the Rural Buffer (RB) zoning district relies on wells for domestic water supply and ground absorption systems for sanitary sewage disposal. This property is also located within the University Lake Watershed Protection Overlay District which restricts development to one dwelling unit per fve acres. Subdivisions within this overlay district may also contain up to, but no more than, fve residential lots with a density of one dwelling unit per two acres.. Developer's Pr°ogram: The developer of this property proposes to use one of Orange County's Flexible Development options to develop the property. Selection of this development option allows more flexibility in the proposed lot sizes (as long as the allowable density is not exceeded) and affords the opportunity to save more open space than traditional subdivision development. For example, we note that the amount of land that is required to be set aside as open space within the Rural Buffer (RB) zoning district is 33% of the site; however, based on the reduction in five-acre lot sizes that are provided by the Flexible Development option, approximately 41% of the site is proposed to be preserved as open space. it~esd~mnp~on - Projec! Furtherniore, with a 120-foot buffer designated along the site's Hatch Road frontage, the existing scenic viewshed will be preserved as rural streetscape, A total of nineteen (19) single-family residential lots are proposed for the site. Each lot will be served by an individual well system for potable domestic supply water and individual ground absorption septic systems fox sanitary sewage. Based upon a preliminazy soils analysis prepared by 5oi1 and Environmental Consultants and actual in- the-field inspections by Orange County Health Department staff, it has been determined that there are adequate suitable soils within each proposed residential lot area to support the proposed number of lots.. As required within the University Lake Watershed Protection Overlay District, there is sufficient septic tank drainage area, and an equally sized repair area, provided on each lot with no off-site easemenks for septic tank drainage areas on adjoining lots or within the open space areas, A 27-foot wide public street cross-section (measured from back-of--curb to back-of--curb) is proposed within 50-foot wide right-of--ways for the public streets serving the site.. A fve-foot utility easement is also proposed adjacent to both sides of the 50-foot right-of- ways in order to ensure that there is ample space for utility installation. Also, a 30-foot landscape buffer is proposed adjacent to the right-of--way in order to allow afive-foot wide sidewalk to meander within the trees on one side of the street in order to create an enjoyable walking experience that is separated from the public roadway. This meandering sidewalk will be maintained by the Westhampton Homeowners Association. The NCDOT District Engineer has reviewed this proposed street geometry and has endorsed both the proposed street design and the location of the proposed entrarrce on Hatch Road. Recreation: Located just 1,5 miles fiom the Hank Anderson Conununity Park in Can-boro, ample opportunities for off=site recreation will be available to the residents of Westhampton in addition to the proposed on-site sidewalk network that will cover approximately 0.75 miles. Accordingly, the developer proposes to make a recreational payment-in-lieu in order to meet the recreational requirements for this project However, we also note that the Orange County Environment and Resource Conservation Department has recommended that a portion of the site's open space along Phil's Creek be dedicated (deeded) to Orange County for recreation and open space. It has been further noted that dedication of this land will apply towards the recreation requirement and therefore reduce or eliminate the amount of the potential recreation payment-in-lieu. We are in agreement with this proposed condition of approval, and will work with the Orange County Environmental and Resource Conservation Department to dedicate the desired land for recreation and open spaces purposes. We hereby provide our response to each recommended Condition of Approval below. 1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT collector standards with a 60-foot right-of-fvay and .34-foot B-B pavement. The sidewall< is to be outside of the right-of--way. ,4pplicar:f's Response: We have met with NCDOT to discuss whether or not Westhampton Way should be classified and constructed as a collector street.. After revisiting this issue and meeting with the developer at the site, the NCDOT District Engineer has agreed that Westhampton Way should not be classified as a collector street. Accordingly, NCDOT has indicated to us that a 27-foot back-of=curb to back- of-curb street (which is their standard street width), located in a 50-foot wide right-ot- way, would be the appropriate design cross-section for Westhampton Way and all other Westhampton streets Z, Homeowners Association documents that provide for maintenance of the Open Space shall be submitted with the preliminary plan. Applicant's Response: Our original proposal during Concept Plan review was that the cul-de-sac at the end of Westhampton Way shall be 75 feet in diameter from back-of--curb to back-of--curb. Furthermore, it was noted during the Concept Plan review that this review conunent was preliminary, and that the Fire Marshal had not provided a formal response. Given that a 95-foot diameter significantly exceeds NCDOT's standard cul-de-sac requirement fora 75-foot diameter and that this excess pavement does not seem necessary or desirable in a watershed area, we have pursued this issue with fire protection providers and ascertained that the NCDOT standard width (75 feet) is reasonable and appropriate for the provision of emergency services within Westhampton. Accordingly, for both Westhampton cul-de-sacs, we continue to propose a 75-foot diameter, which conforms with NCDOT standards and will provide ample access and turning space for emergency service vehicles. In addition, we also note that turning radii at all intersection corners have been designed with a .32-foot minimum radius. 4. Show proposed dedication of an additional 5 feet of right-of--way, or 35 feet from the centerline of the existing right-of-way, whichever is greater, along F3atch Road on the Preliminary Plan. Appiicant's Response: We agree to this dedication of additional right-of--way for Hatch Road, and have illustrated the dedication on Sheet .3 of the Major Subdivision Preliminary Plat (as revised on March 22, 2006). 5, Weston Lane must have 4 lots accessing it to meet NCIDOT requirements. Apniicartt's Response: Weston Lane continues to be proposed as a street accessing four lots (Lots 16 - 19), in conformance with NCDOT requirements. In addition, the five lots that have frontage on the newly-created cul-de-sac to the south (Lots 10 - 14) will all be restricted to access from the cul-de-sac (Brookford Court) instead of the main spine road (Westhampton Way), allowing Brookford Court to also be in conformance with NCDOT requirements.. 6. Show five-foot utility easements along both sides of all rights-of-way, Applicant's Response: A five-foot utility easement has been provided along both sides of all rights-of way (Irlease see Sheet 3, Major Subdivision Preliminary Plat, as revised on March Z2, 2006), if%sdiampfai -Response to Sla(fComments Alrn-ch 22, ?006 Pngc 3 of4 ~1, ~, 7, ERCD has recommended that a portion of the opera space be dedicated (deeded) to Orange County for recreation and open space. AnpCleattt'S Response: We are in agreement with this proposed condition of approval, but have not illustrated the dedication on the preliminary plat since there was still some question as to the exact location and amount of property being requested for dedication at the time of preliminary, plat applicafron, It is our belief that this desired dedication of recreational open space property is best handled by a written condition of approval for the preliminary plat once the desired area for dedication is better defined and described. We note that once the desired land has been identified for dedication to Orange County for recreation and open space purposes, then a final determination can be made as to whether or not this land dedication fulfills the site's recreational requirements, or if a reduced payment-in-lieu will still be needed.. 8. Show location of subdivision sign on Preliminary Plan. ~4nnficant's Response: We have indicated the location of entry wall signage at the site's main entrance on Hatch Road (please see Sheet 3, Major Subdivision Preliminary Plat, as revised on March 22, 2006). Signage will be designed in conforniance with Orange County regulations. 9. Any lightnxg shall meet Orange County Lighting Standards. Aonlicant's Response: We will comply with the provisions of the Orange County Zoning Ordinance that pertain to lighting standards within Orange County 10. A minimum of 50-foot wide Pedestrian Open Spacc Arca (POSA) shall be provided between lots 7 and 8, Annlicartt's Response: We have revised the open space area located south of Westhampton Way (main entry road), east of Lots 12, 13, and 15, and west of the north-south water feature that defines the rear property lines of the Robins Wood subdivision lots in this area. We hereby provide our responses and/or additional information on each issue. 1. Would like to review the giomeowners Association documents. Applicant's Response: As requested, we have provided a copy of the proposed "Declaration of Restrictive Covenants, Conditions and Restrictions of Westhampton" with our' Major Subdivision Preliminary Plat submittal. 2. Explain what is meant by "prohibit tree-cutting in the Open Space except for maintenance purposes," Applicant's Response: We provide the following excerpt from the proposed restrictive covenants for Westhampton (Article X, Section 16), which explains the phrase "except for maintenance purposes." "OPEN SPACE MAINTENANCE: The Open Space owned by the Association is intended to remain in its natural state. Hence, removing, destroying or cutting trees and vegetation within the Open Space is strictly prohibited except for: (a) selective removal of trees or vegetation for the prevention or treatment of disease, (b) removal of dead or fallen trees posing a hazazd, (c) removal of invasive, non-native or noxious plants that tlueaten indigenous plant species, (d) relocation of exposed root balls to their original position, and (e) minimal and selective clearing necessary to maintain best forestry practices in the management of wooded azeas. Trees and limbs fiom trees may be removed from the Open Space only with the prior approval of the Architectural Committee to determine if a tree has falter or constitutes a hazard. The method of removal shall be approved by the Architectural Committee, and may include on-site chipping or grinding, provided the methods and machinery used shall not result in erosion or compaction of soil." Can the access to the stream corridor be located between Lots 14 and 15 rather than Lots 7 and S (as suggested by staff)? Applicant's Response: As recommended by the Planning Board, we have created an open space comdor between what is now designated as Lots 15 and 16 (formerly Lots 14 and 1S). We have also adjusted lot lines in this area in order to provide more favorable topography for a pedestrian path through this "pedestrian open space area" (POSA) that varies from 140 feet to over 500 feet in width as it connects to the Phil's Creek stream corridor. 4. How will access be provided to the proposed community well system? ApplLCaltd'S Response: We have actually revised the developer's program for Westhampton to utilize the more conventional approach of individual wells on each individual lot, After doing additional research, we concluded that this was a better, more enviromnentally sensitive approach (dispersing wells throughout the site rather than focusing on a single, concentrated location) and was also the method of providing potable water that the market actually seems to prefer. Therefore, the question about access to the community well location is now moot. 5. Get clarification from NCDOT regarding size of cul-de-sacs aad width of right- of-way. Also, would like for developer to meet on-site with NCDOT to discuss the reaction times associated with the proposed entrance road and IIatctr Road. Applrcant's Response: We met on site with the NCDOT District Engineer (Chuck Edwards) azrd the Assistant District Engineer (Nanette Fogleman) to discuss the classification of Westhampton Way and the location of the site entrance on Hatch Road, Based on this meeting, it was agreed that Westhampton Way should not be desigred as a collector street, and alternatively should be designed as a 27-foot back- of--curb to back-of--curb street, located in a 50-foot wide right-of way. Therefore, we have (1) adjusted the proposed street geometry for the internal streets of Westhampton in accordance with NCDOT's guidance (27-foot back-of--curb to back- of-curb streets, 50-foot right-of=way, 5-foot utility easements on both sides of the SO- foot right-of-way, and 75-fook diameter cul-de-sacs located within a 100-foot diameter right-of-way). In addition, NCDOT reviewed the proposed location for the site entrance (Westhampton Way) off of Hatch Road, and agreed that the proposed location was acceptable and provided adequate sight distances to both the east and west.. We have subsequently further enhanced the available sight distance to the west by adjusting the entrance location eastward approximately 50 feet. ilresYlrampton - Respaue to Staff Comments dfarch ??, 2006 Page 2 of 4 ~~~ 6. Review layout for Lots 1 and 2 and proximity of septic systems to stream. Applicant's Response: We actually have some questions regarding the criteria used to identify these drainage areas as "streams and/or water features" by a former staff member of the Orange County Erosion Control Division, particularly since the 100- foot buffer (a 200-foot corridor) is applied equally to all feahrres irregardless of its nature (ephemeral, intermittent or perennial}, However, to this point in time, we have dutifully surveyed the flags that were placed in the field and represent these features and the required 100-foot buffer at this time. With this background however, we would like to note that our site visits and field surveys clearly indicate that these drainage areas on Lots 1 and 2 are best described as ephemeral in nature rather than as intermittent or perennial streams. In other words, these features do not have standing water and/or exhibit the stream-like characteristics that are associated with intermittent or perennial streams. With regard to the proposed location of septic systems on Lots 1 and 2 with relation to this ephemeral feature, we provide the following additional information: Lot 1: The house will be located between the ephemeral feature and Westhampton Way, while the septic field will be located on the other side of the ephemeral feature.. In particular, the septic field will be located a minimum of 150 feet away from the centerline of this drainageway, providing an additional 50 feet of buffer to the regulated 100-foot buffer. A pump system will be used to transfer wastewater from the house to the septic field. Lot 2: The house arrd the septic field are both proposed to be located on the west side of the depicted ephemeral feature. The septic field will be located a minimum of 125 feet away from the centerline of this drainageway, providing an additional 25 feet of buffer to the regulated 100-foot buffer. In sununary, based on the minirnurn distances between these septic fields and the ephemeral feature, and the mostly-dry nature of this drainageway, we do not believe that these septic systems will pose a tlueat to the quality of water traveling in this channel during rain events. 7. Concern was expressed regarding the impervious surface levels for larger homes and garages within F'<'esthampton as compared with existing smaller homes within Robins Wood. App/cant's Response: Being located in the University Lake protected watershed, this development is limited to a maximum of six (6%) percent impervious surface. In H~esdunnpron -Response to Stnj(Co~nmerrrr d•farch 22, 2006 Page 3 oj4 ~~~3 keeping with this requirement, the deve]oper is proposing to limit impervious surface on each lot to a maximum of 11,000 SF of land area (this includes house footprint, patios, sidewalks, driveways, etc..). This allocation is, of course, simply a maximum limit, so it is quite possible (and actually would be expected) that residents will not maximize the amount of impervious surface on their individual lots. However, if every homebuilder were to actually utilize the maximum amount of impervious surface available on each lot, this would cause 3 7% of the site to consist of impervious surface.. We note that approximately 2.3% of the site is proposed to be used for streets and sidewalks.. Therefore, when the maximum buildable areas on each lot and the streets and sidewalks aze combined (.3.7% + 2.3% = 6.0%), it becomes evident that the overall site will be carefully regulated so that it does not exceed the University Lake watershed impervious surface limitations. In contrast, existing developments, such as the Robins Wood subdivision lots that adjoin Westhampton to the east, may indeed have smaller houses than Westhampton, but they also have much smaller lots and essentially no dedicated open space areas Therefore, even if the house, driveway, and sidewalk for each of these approximate 1.2-acre (or smaller) lots were limited to only 2,000 square feet in impervious surface, they would have approximately the same relative impervious surface impact on the watershed. Because of the amount of open space provided within Westhampton, the amount of land area (outside public right-of-ways) associated with each home is approximately 6.6 acres.. Therefore, the maximum of 11,000 square feet of impervious surface apportioned per lot is equivalent to 3.8% of this associated land azea This compares favorably with Robins Wood lots where a 2,000 square foot impervious surface budget on an approximately 1 2 acre lot (there is essentially no dedicated open space azeas to add to these lot areas) would result in the carne 3 8% of the land outside of public right-of-ways being covered with impervious surfaces. In addition, the Robins Wood lots that adjoin Westhampton have the north-south water feature located east of Westhampton's Pedestrian Open Space Area (POSA) as their rear property lines, with no stream buffer provided at alt, whereas Westhampton will provide a 100' streani buffer measured from each bank. We believe that the combination of the provision of 52.76 acres of open space areas along all of the edges of Westhampton, the incorporation of 100' stream buffers (measured from the bank of the water feahrre for a total of 200'+ of stream buffer), and the larger lot sizes (ranging fiom 2.58 acres to 5.21 acres) within Westhampton combine to provide a superior level of protection for the University Lake watershed that was not previously provided by the existing developments to which it is being compared. May 30, 2006 Eddie Kirk Orange County Planning Department 306F Revere Road Hillsborough, NC 27278 Re: Response to Carrboro's April 18a' Alternative Water Point for Westhampton Request Memo Dear Eddie: As we have discussed, in response to Deputy Chief Travis Crabtree's April 18a' memo to Mike Tapp, we have researched alternative water points for' the Westhampton subdivision and located the following sources of water within the requested 1.5 miles of distance from Westhampton: - there is an operable fire hydrant on the OWASA system located 0.6 miles from the Westhampton entrance, just west of Hatch Road's intersection with NC 54. - there is an existing pond that is accessible to Cazrboro's fire department as a water source within Carrboro's Hank Anderson Pazk, located 1.5 miles from Westhampton on the north side of NC 54, In a telephone conversation with Deputy Chief Travis Crabtree, some interest was also expressed in perhaps converting any stormwater ponds that Westhampton might have to be alternative water points, However, it was pointed out to Deputy Chief Crabtree that due to the extremely low impervious surface limit required within the University Lake watershed protection azea, that Westhampton does not have any stormwater ponds. Furthermore, stormwater ponds are usually required by state law to be designed to essentially drain dry within five days after a rainfall event, and were therefore not the type of permanent pond they were seeking. The Surveyor, when surveying the property, found out that there were 9..34 more acres than originally thought, so one additional lot was created. There are now 191ots proposed, rather than 18, The average lot size has increased, and the same 41% of open space was maintained, As a result of the additional lot, an additional road has been added, Staff has recommended the connection with the Pedestrian Open Space Areas, and with ERCD's request for dedication along Phil's Creek, Staff would like to have an access to the trail. .Tack Smyre: Since you last saw the concept plan, the County has ascertained that there are suitable soils far the development, and maintained the 41% open space, which is a large margin. We are in agreement with Staff's recommendations, but we disagree with Staff's recommendation on page 8, item E-.3. We are supportive of the trail concept along Phil's Creek made by ERCD, and will dedicate the land for that cause. There are numerous ways for residents to access the traih Rich Shaw of ERCD was unaware of the request for the additional access, and our concern is that not only is it unnecessary, it will create a de facto trailhead for the public, The trail is intended for the neighborhood's use, not a public access, Renee Price-Saunders: Regarding Phil's Creek, if this land is dedicated, wouldn't that decrease the acreage for lots 1 and 2, and 15. Jack Smyre: That area is shown on the plans as across-hatched area, and is a stream buffer. It is not a public access area, 47 Renee Price-Saunders: Will this be a gated community? .Jack Smyre: No. .Tay Bryan: Isn't there a proposed greenway in the area? Eddie Kirk: The County owns some greenway already, and this dedication will extend it, Brian Dobyns: The baseline documentation from the Triangle Land Conservancy shows a trail currently exists from Neville Road, and the character of that trail, is that it is not a public trail. It is in people's back yards, and there isn't any place along Neville Road that promotes access or use, The Triangle Land Conservancy feels that this is a easement designed to protect natural areas and floodplains, and not for public use. Renee Price-Saunders: What about the soils on Lots 1, 2, and 15? They are near the streams. Have you already reviewed these locations? .Tack Smyre: The County has already done the testing for septic areas outside of the stream buffers. .Jeff Schmitt: Why is the Staff proposing E-.3? Eddie Kirk: It is to present an access to the dedicated area. .Teff Schmitt: How does that f t with Brian's comments? It seems apparent that there with the access off Neville Road, there is currently access, Sam Lasris: I seem to recall a discussion about an alternate route out of the subdivision. Brian Dobyns: I believe we were looking at an access between lots 7 and 8, but there was nothing between 9, 10 and 11 in the original concept plan, and we were suggesting something to the west, Now that has been provided,,just in a different location, Eddie Kirk: The Health Department provided information in helping to determine these Pedestrian Open Space Areas. Teff Schmitt: Where could citizens get access to the trail today? Neville Road? Brian Dobyns: People can use the trail, but there is no parking. There is no goal to make this a public trail system, Renee Price-Saunders: What would prevent someone from parking on Westhampton Way to use the trail? .Tack Smyre: It could be done, but it would be considered private property. 2 48 Tom Heffner: With other subdivisions where Homeowner Associations own land, there are lots of homes that allow parking, and I'm not aware of any problems with this, MOTION by ,Jeff Schmitt to approve the preliminary plan for the Westhampton subdivision, with the exception that item E-3 be deleted. Seconded by Brian Dobyns. VOTE: Unanimous Kip Weinert (citizen): I live on Carl Drive nearby, and am concerned about the water. As a part of the approval, you might want to consider adding an aquifer study requirements to make certain that the development can sustain itself; and not affect the neighbor's water supply. Michelle Kempinski: Have you experienced any water concerns? Kip Weinert: I have not personally, but neighbors in Robinswood have had some bad quality, as well as in surrounding areas, Brian Dobyns: There is an Orange County map showing aquifer resources. Perhaps we could use this map in looking at future subdivisions. Also, we could look at the 2001 and 1996 .groundwater studies. Renee Price-Saunders: We have been addressing water resources in this Board, and unfortunately, right now there is little we do. Kip Weinert: Could the Commissioners consider this? .Jay Bryan: They can consider at the time this is presented for their approval, if you wish to address this, Craufurd Goodwin: Not only do we not have the authority, there is no degree of confidence that adjacent well situations could be affected by the subdivision, Sandy Quinn: Many citizens have brought up water concerns in the past, While we do not have the power or authority to do anything, it's important that we continue showing our interest as reflected in our minutes. Vivian Phillips: I live on Carl Drive. Since I first learned about the proposed subdivision at the Neighborhood Information Meeting, few people were aware of it, and through word of mouth, are getting concerned about the water supply situation. It does affect large neighborhoods, I suggest publicizing potential developments, especially in protected watershed, Otherwise, who would protect the neighbors? Jay Bryan: Is there a difference in the advertising for this meeting as opposed to when we reviewed the concept plan? 49 Eddie IGrlc The only notification required to neighbors is for the Neighborhood Information Meeting at the time of the concept plan, Robert Davis: The best way to advertise generally is by word of mouth. Craig Benedict: Also, we notify both OWASA and Carrboro of the proposed development as part of the Joint Planning Agreement. .Jay Bryan: We may want to look at a broader form of notification when proposed subdivisions are in protected watersheds. Michelle Kempinski: Water issues don't only deal with new subdivisions. We need to acknowledge that this is a recurring comment at our meetings. Sam Lasris: Maybe we can start a process for pursuing mitigation ofwater systems as a long- term strategy. Jay Bryan: So, for our future consideration of subdivisions, we would like to look at the aquifer maps that Brian alluded to, Copies of our minutes need to be provided to the Commissioners. Sherri Ingersoll: This portion of the minutes will be included with the agenda abstract. .Tay Bryan: Please highlight this section of the comments so that it is clearly indicated to them. Michelle Kempinski: Do we ]snow when this is scheduled for review by the Commissioners?
