Petition Letter & SR Addition Investigation Report for Boundbrook Drive PUBLIC HEARING: (Y /N) No INFORMATION CONTACT: Karen Lincoln, 245 -2594 PURPOSE: To approve a recommendation regarding petitions to add Willow Oak Drive, Scarlet Oak Lane and Boundbrook Drive to the State Maintained Secondary Road System. BACKGROUND: The Village of the Oaks: Property owners on Willow Oak Drive (5 homes) and Scarlet Oak Lane (3 homes) have petitioned the North Carolina Department of Transportation ( NCDOT) to accept maintenance responsibilities for those roads. Willow Oak Drive platted in the first section of the Village of the Oaks, is located off the south side of Bradshaw Quarry Road (SR 1100) in Bingham Township. Scarlet Oak Lane, platted in Section Four of the subdivision, is located off Chestnut Oak Drive (on the south side of Thom Road, the continuation of Bradshaw Quarry Road) in Alamance County,. The Orange County Board of Commissioners approved the preliminary plat for the first section of The Village of the Oaks subdivision in August 1993. The Board approved the section three and four preliminary plat in February 1994. Orange County resolutions approving the preliminary plats for both sections include language that stipulates a condition of approval that Willow Oak Drive and Scarlet Oak Lane "shall be irrevocably dedicated to the general public and be constructed to the standards of the North Carolina Department of Transportation" and that "approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication without maintenance responsibility." The resolutions further states that the owner /applicant shall maintain the roads "until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body." Richmond Hills: Property owners on Boundbrook Drive (21 homes) have petitioned the North Carolina Department of Transportation ( NCDOT) to accept maintenance responsibilities for the road. Richmond Hills is located on the northside of US Hwy 70 off the east side of Richmond Road, Cheeks Township. The Board of Commissioners approved the preliminary plat for Richmond Hills in August 2000, stipulating that the roads be built to NCDOT standards and dedicated to the general public. The Board recommended addition of other roads in Richmond Hills - Buckwalter Lane, the access into the subdivision off Richmond Road, and Alice Millar Court - to the State Maintained System in February 2003. NCDOT has investigated these requests (please refer to attached Secondary Road Addition Reports) and has submitted the petitions to the Board of Commissioners for its review and recommendation. In accordance with North Carolina General Statute §136 -62 *, the Board must take an administrative action to make a recommendation regarding the petitions to the North Carolina Board of Transportation before the NC Board of Transportation ( NCBOT) can consider the petitions. FINANCIAL IMPACT: There is no direct financial impact associated with this item, RECOMMENDATION(S): The Manager recommends that the Board receive the Petitions for Addition for Willow Oak Drive, Scarlet Oak Lane and Boundbrook Drive, and recommend that the NCBOT add those subdivision roads to the State Maintained System. North Carolina General Statute §136 -62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads.
