in Perry Hills Subdivision
PURPOSE: To make a recommendation to the North Carolina Department of Transportation
(NCDOT) and the North Carolina Board of Transportation (NC BOT) concerning a petition to
add the remaining section of Paylor Street in Perry Hills Subdivision to the State Maintained
Secondary Road System.
BACKGROUND: On January 25, following Commissioner inquiries, Planning staff requested
the North Carolina Department of Transportation (NCDOT) investigate maintenance and access
concerns within the Perry Hills Subdivision, as well as evaluate the eligibility and the process for
having the roads not already maintained by the State accepted for maintenance. Perry Hills
Subdivision is located in the western part of the County, in Cheeks Township, north of US 70
and east of Mace Road (Attachment 1). Paylor Street (State Road (SR) 1393) consists of an
extended section of dirt road that has not previously been added to the State road system for
maintenance. There are also a few other roads, or portions of roads, within the Subdivision that
have not been accepted into the State system. A Perry Hills Subdivision road maintenance map
is attached for reference (Attachment 2).
This item was also discussed at the March 29, 2017 Orange County and NCDOT luncheon
meeting. At this meeting, it was recommended that Paylor Street should be the most immediate
focus since it would have the greatest impact given the State's requirements for acceptance and
existing restricted funding. At a July 31 meeting with residents, Planning staff and NCDOT
representatives in the subdivision, there was a general agreement that Paylor Street was among
the top priorities to address emergency response issues.

Perry Hills Subdivision
Perry Hills Subdivision was recorded on August 27, 1965 (Plat Book 14, Page 152) (Attachment
3). Paylor Street - extension of SR 1393 - was constructed in accordance with the public road
standards and regulations in place in 1965. This portion of the road has been a private road in
the interim, intended to become a public road when conditions met NCDOT maintenance
responsibility and ownership criteria. The single family residential subdivision is located within
Orange County's zoning jurisdiction but pre-dates zoning and subdivision regulations.
The petition for road addition of Paylor Street - extension of SR 1323 - includes the following
road information:

Extension of SR 1393
Paylor Street - extension of SR 1393 - has a length of .08 mile (422 feet +/-), providing access
for four (4) houses. The road has a right-of-way width of 60 feet, and a current pavement width
of 14 feet.
There are numerous requirements for addition of subdivision roads into the State Maintained
system, including a minimum housing density standard; the clearing of all trees, uncontrolled
vegetation, and any encroachments from the right-of-way; and compliance with minimum design
and construction standards. The NCDOT Subdivision Roads Minimum Construction Standards,

NCDOT has investigated this request and has submitted a petition to the Board of County
Commissioners (BOCC) for its recommendation (Attachment 4). North Carolina General Statute
§136-62 requires that road petitions for additions to the state system be made by the BOCC.
Adding this section of Paylor Street into the State Maintained Secondary Road System will be
the quickest and most effective way administratively to better serve the residents of Perry Hills
Subdivision. Following addition, Paylor Street extension will first be graveled as a two-lane road
under the Unpaved Road Program, and will then be eligible for being paved at a future date.
NCDOT will also improve the drainage ditches and pipes, and remove some trees and
uncontrolled vegetation and any unauthorized encroachments. Future paving of this section of
Paylor Street by NCDOT will occur with the appropriate priority under the Secondary Road
Construction Program, or with some other funding source such as State Contingency Funds.
As for the subdivision roads currently in the State Maintained Secondary Road System, NCDOT
maintenance staff recently performed pavement repairs, and the State maintained streets in the
subdivision are programmed for resurfacing in 2018. Paylor Street Extension may be included
with the 2018 resurfacing.
Perry Road (SR 1394) and Paylor Street (SR 1393) meet at the intersection of Shambley Road.
While this technically meets NCDOT standards, NCDOT has stated that it may manipulate the
State Route (SR) numbers so that they become one State Road number following addition to
the State system. Orange County Land Records Division has stated that the County's road

naming ordinance does not apply to public state maintained roads, and that any future road
renaming would be done by a request to NCDOT. The road renaming issue will be appropriately
addressed following addition to the State system, and will be consistent with County address
ordinance policies in the Land Records Division.
Conclusion
The above-referenced application meets the criteria endorsed by the BOCC for recommending
acceptance of public roads into the State Maintained System for roads approved through the
governing jurisdiction's subdivision process (NCDOT Subdivision Roads Minimum Construction
Standards, January 2010, revised May 2016).
FINANCIAL IMPACT: There is no direct financial impact to the County associated with this
item. NCDOT will incur additional maintenance responsibilities and costs.
SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is associated
with this item:
• GOAL: CREATE A SAFE COMMUNITY
The reduction of risks from vehicle/traffic accidents, childhood and senior injuries, gang
activity, substance abuse and domestic violence.
The addition of County private residential streets to the State Maintained Secondary Road
System results in positive outcomes related to the aforementioned goal.
RECOMMENDATION(S): The Manager recommends that the Board:
1. Forward the Petition for Addition to the State Maintained System to the NCDOT for Paylor
Street - extension of SR 1393; and
2. Recommend the Department of Transportation accept the road for maintenance as State
Secondary Roads.

3. Attach four (4) copies of recorded subdivision plat or property deeds, which refer to candidate road.
4. Adjoining property owners and/or the developer may submit a petition. Subdivision roads with prior
NCDOT review and approval only require the developer's signature.
5. If submitted by the developer, encroachment agreements from all utilities located within the right of
way shall be submitted with the petition for Road addition. However, construction plans may not be
required at this time.
6. Submit to District Engineer's Office.

REQUIREMENTS FOR ADDITION
If this road meets the requirements necessary for addition, we agree to grant the Department
of Transportation a right-of-way of the necessary width to construct the road to the minimum
construction standards of the NCDOT. The right-of-way will extend the entire length of the
road that is requested to be added to the state maintained system and will include the
necessary areas outside of the right-or-way for cut and fill slopes and drainage. Also, we
agree to dedicate additional right-of-way at intersections for sight distance and design
purposes and execute said right-of-way agreement forms that will be submitted to us by
representatives of the NCDOT. The right-of-way shall be cleared at no expense to the
NCDOT, which includes the removal of utilities, fences, other obstructions, etc.
General Statute 136-102.6 states that any subdivision recorded on or after October 1, 1975,
must be built in accordance with NCDOT standards in order to be eligible for addition to the
State Road System.
