HomeMy WebLinkAboutAgenda - 06-27-2006-5uREVISED Abstract &Attachments on 6/26/06 to Correct Event Date ORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: June 27, 2006 Action Agenda Item No. 5-- iJ SUBJECT: Pyrotechnics Permit -Orange Speedway DEPARTMENT: Purchasing & Fire Marshal PUBLIC HEARING: (Y/N) No ATTACHMENT(S): Checklist Permit INFORMATION CONTACT: Pam Jones, 245-2652 Mike Tapp, 968-2050 PURPOSE: To approve a pyrotechnics permit for Orange County Speedway for July 1, 2006 (rain date of July 8, 2006), BACKGROUND: Orange County Speedway has requested that the County Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for .1tlly 1, 2006 (rain date of July 8, 2006) in conjunction with the regularly scheduled race, GS 14-414 indicates that the Board shall consider a fireworks permit for "any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes." GS 14-413 empowers the Commissioners to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions,..btat only after satisfactory evidence is produced to the effect that said pyrotechnics will be used far the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. The documents attached indicate satisfactory evidence that these requirements have been met, It should be noted that issuance of the permit is conditioned upon safe burning conditions being present on the day of the fireworks presentation, FINANCIAL IMPACT: There is no financial impact as a result of this action. RECOMMENDATION(S): The Manager recommends that the Board approve a pyrotechnics permit for the Orange County Speedway for July 1, 2006 (July 8, 2006 rain date); and authorize the staff to execute permits as needed. a PYROTECHNICS PERMIT CHECKLIST--ORANGE COUNTY SPEEDWAY 7-1-06 (rain date 7-8-06) North Carolina General Statue 14-473 empowers County Commissioners in the State to issue permits for the use of pyrotechnics in connection with shows of all descriptions after satisfactory evidence is produced to the effect that the pyrotechnics will be used for the aforementioned purposes and no others. The Orange County Commissioners have adopted a policy which cites the completion of the following criteria as prerequisite to the issuance of a pyrotechnics permit. Verification of the receipt of information will be evidenced by the signature of the appropriate official on this form, Only after all criteria listed below have been met will the permit be issued. It should be further noted that all signatures must be written on the face of the permit in order for the permit to be valid. Penalties for use of pyrotechnics without a permit are cited in the North Carolina Building Code, Administration and Enforcement, Volume 1A, Chapter 8.1. CRITERIA APPROVED BY DATE 1. Limits of liability are no less than $1,000,000 per occurrence, Show setup will be approved by the Orange County Fire Marshal or his designee, prior to the beginning of show, Permitted explosives include those identified in the information submitted by requestor and approved by the Fire Marshal as part of the pyrotechnics approval process, Note: FIRE OFFICIAL SHALL NOT EXECUTE THIS PERMIT IN THE EVENT ENVIRONMENTAL CONDITIONS AT TIME OF PERFORMANCE PRESENT A HAZARD FOR EITHER BURNING OR AIR QUALITY (CODE RED), Orange County Speedway has a current fire inspection and is in compliance with the North Carolina Fire Prevention Code, 2000 lntemational Fire Code with North Carolina amendments.
