On January 25, following a Commissioner inquiry, Planning staff requested the North
Carolina Department of Transportation (NCDOT) investigate maintenance concerns within
the Perry Hills Subdivision, as well as an evaluation of the eligibility and the process for
having the roads not maintained by the State accepted for maintenance. Perry Hills
subdivision was recorded on August 27, 1965 (Plat Book 14, Page 152). A Perry Hills
Subdivision Road Maintenance Map is attached for reference (Attachment 1). The following
roads, or portions of the following roads, within the Perry Hills Subdivision have not been
accepted into the State system for maintenance:
• Paylor Street, Extension of SR 1393, between Shambley Road and Alpha Drive
• Alpha Drive, Extension of SR 1403, north of Scarlett Drive
• Scarlett Drive, between Shambley Road and Lancaster Road
• Alpha Drive, between Scarlet Drive and US 70
There are numerous requirements for addition of subdivision roads into the State
Maintained system, including a minimum housing density standard; the clearing of all trees,
uncontrolled vegetation, and any encroachments from the right-of-way; and compliance
with minimum design and construction standards. The NCDOT Subdivision Roads

NCDOT Division 7 staff investigated the streets within Perry Hills Subdivision that are not
currently State maintained for eligibility for addition to the State system. Their findings are
provided in the Summary of Investigation Results (Attachment 2). The complete response
letter from NCDOT regarding maintenance concerns and the road addition inquiry for Perry
Hills is also provided (Attachment 3). The subdivision roads were constructed in
accordance with the standards and regulations in place in 1965. None of the four roads or
road portions meets current day standards for addition to the State Maintained system.
Extensive, costly corrective actions would be required for them to be eligible for addition.
NCDOT maintenance staff has recently performed pavement repairs and the State
maintained streets in the subdivision are programmed for resurfacing in 2018.
This item was also discussed at the March 29, 2017 Orange County & NCDOT luncheon
meeting. Discussions at the meeting recommended the following next steps: 1) As there is
not sufficient state funding to resolve all of the road issues for the subdivision residents,
Paylor Street should be the most immediate focus since it would have the greatest impact
for the least funds; 2) NCDOT will investigate a possible drainage issue on Paylor Street; 3)
Support from the adjoining property owners would be required and outreach to them should
be made; and 4) The process would be to first aim to get the road graveled as a two-lane
road under the unpaved road program, without acceptance into the State System at this
time. There was agreement that Paylor Street should be the primary focus, and a
suggestion that a section of Alpha Drive be a secondary focus is funding became available.
NCDOT representatives replied that there would not likely be funding to address Alpha
Street.

Subject: Maintenance Concerns and Road Addition Inquiry- Perry Hills Subdivision
Located off of SR 1310, Frazier Road
Dear Ms. Pittman,
I am writing in response to your recent inquiry concerning the above subject.
I am happy to report that our maintenance staff has recently performed pavement repairs
and that the State maintained streets in the subdivision are programmed for resurfacing in
2018.
District staff has conducted an investigation of the streets within the subdivision that are
currently not State maintained for eligibility for addition to the State system. Our findings
are provided below.
Paylor Street, Extension of SR 1393
The subject road segment is located between the current end of State maintenance
approximately 0.06 mile east of Shambley Road to Alpha Drive and is 0.08 mile in length.
The road is served by a 60' right of way recorded on August 27, 1965 in Plat Book 14, Page
152. The road directly serves 4 homes and also serves as a subdivision connector road with
an estimated ADT of 100 trips per day. The unpaved travel way is approximately 14' wide
and in poor condition primarily due to a lack of aggregate and reverse crown preventing
proper surface drainage.

Roadside ditches are approximately 41' center to center but are poorly defined with
missing or non-functional driveway pipes. Uncontrolled vegetation and trees are
encroaching on the shoulder and in ditches. A privately owned satellite dish is located
within the road right of way. The road currently meets the minimum housing density
requirements and can be considered for addition as an unpaved road. However, the road
currently does not meet the minimum maintenance condition and construction standards for
eligibility for addition. The following items must be satisfactorily completed prior to
addition to the State system:
1) The property owners shall sign a "Petition for Road Addition" and return it to this
office.
2) Construct an unpaved roadway cross section centered within the platted right of
way with properly drained ditches set a minimum of 36' apart and an 18" wide
gravel travel way stabilized with 3" of compacted aggregate base course in
accordance with minimum NCDOT unpaved road standards.
3) All drainage pipes and structures shall be adequately sized and installed per
NCDOT requirements.
4) Remove all trees and uncontrolled vegetation and unauthorized obstructions with
in the right of way.
5) Secure all necessary right of way encroachment agreements for all authorized
utilities with in the right of way and remove unauthorized encroachments from the
right of way.
Alpha Drive, Extension of SR 1403
The subject road segment begins at the existing end of State maintenance and extends
southward to a dead end and is 0.08 mile in length. The road currently directly serves 2
homes. A sufficient number of homes are present to meet minimum housing density
requirements for the total length of Alpha Drive inclusive of the subject extension. The
road is served by a 60' right of way recorded on August 27, 1965 in Plat Book 14, Pages
151 and 152. The single lane paved travel way is 11' in width and in good condition. The
pavement structure and suitability of the underlying subgrade is unknown. Roadside
ditches are approximately 41' center to center and in generally good condition with
significant siltation noted at one driveway pipe. Roadside vegetation management is
satisfactory. The road currently meets the minimum housing density requirements and
can be considered for addition. However, the road currently does not meet the minimum
maintenance condition and construction standards for eligibility for addition. The
following items must be addressed and satisfactorily completed prior to addition to the
State system:
1) The property owners shall sign a"Petition for Road Addition" and return it to this
office.
2) Upgrade the roadway section meeting NCDOT minimum standards as described in
the following options:

a) Remove existing pavement and construct an 18' wide , 2-lane, unpaved roadway
stabilized with a minimum of 3" of aggregate base, minimum 4' unpaved
shoulders and roadside ditches 36' apart per NCDOT minimum construction
standards.
b) Repair, strengthen and widen the existing pavement based upon assessment and
recommendations by a qualified Professional Engineer to provide an 18' wide, 2-
lane paved roadway with minimum 4' paved shoulders and roadside ditches a
minimum of 36' apart per NCDOT minimum construction standards.
3) Receipt of all utility encroachment agreements located within the right of way. The
property owner(s)/developer(s) shall contact all the utility companies and request
them to submit encroachment agreements for all the utilities that service these roads.
Scarlett Drive
The subject road section begins at the intersection of Shambley Road and extends eastward
to the intersection of Alpha Drive and is 0.12 mile in length. The road currently directly
serves 2 homes and serves as a connector road for Alpha Drive. The road is served by a 60'
right of way recorded on August 27, 1965 in Plat Book 14, Page 151. The unpaved travel
way is 12' in width and in good condition. Roadside ditches are approximately 37' center to
center and are blocked by uncontrolled vegetation, boulders and brush piles. The road
currently meets neither the minimum housing density requirements nor the minimum
maintenance and construction requirements for eligibility for addition to the State system.
The following items must be satisfactorily completed prior to addition to the State system:
1) The road shall serve a minimum of 4 homes or an equivalent traffic volume
2) The property owners shall sign a "Petition for Road Addition" and return it to this
office.
3) Construct an unpaved roadway cross section centered within the platted right of

unpaved travel way is 12' in width and in good condition. Roadside ditches are
approximately 37' center to center and are blocked by uncontrolled vegetation, boulders
and brush piles. The road currently meets neither the minimum housing density
requirements nor the minimum maintenance and construction requirements for eligibility
for addition to the State system. The following items must be satisfactorily completed prior
