Map of Town of Carrboro's ETJ Expansion Request PURPOSE: To consider sending the Town of Carrboro a letter in support of the Town's request to move forward to a public hearing regarding extension of its ETJ over 2.9 acres of land along Highway 54 West. BACKGROUND: In late March the County received a letter from the Town of Carrboro (Attachment 1) requesting the Orange County Board of Commissioners favorably respond to the Town's desire to extend its ETJ over 2.9 acres along Highway 54 West. Upon a favorable response from the BOCC, the Town will proceed with holding a statutorily required public hearing on the potential ETJ expansion. Town staff has indicated the expected public hearing date is June 13, 2017. The Board of County Commissioners will be asked to adopt a formal resolution of support at a later date; staffs are discussing whether the resolution of support should occur before or after the public hearing date. This topic was discussed at the October 13, 2016 joint Orange County/Town of Carrboro meeting, as is referenced in the Town's letter. Additionally, the topic was touched upon by Orange County planning staff during the work session portion of the February 13, 2017 quarterly public hearing. Expansion of the Town's ETJ would relinquish County planning jurisdiction within the ETJ area and would allow the Town to exercise zoning and subdivision authority related to its plans and ordinances and to carry out building code enforcement. The land use plan and stipulations of the Joint Planning Agreement (JPA) currently apply in this area (link to overall JPA map only here). Currently, the portions of the parcels subject to the ETJ expansion request are designated "Rural Buffer". The Town would apply its own land use and zoning designations as part of the future public hearing process and the joint planning agreement would no longer apply to the newly-designated ETJ area. The map in Attachment 3 depicts the ETJ expansion request in relation to joint planning designations in the vicinity. 2 SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to this agenda item: • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND ENVIRONMENTAL POLICIES The fair treatment and meaningful involvement of people of all races, cultures, incomes and educational levels with respect to the development and enforcement of environmental laws, regulations, policies, and decisions. Fair treatment means that no group of people should bear a disproportionate share of the negative environmental consequences resulting from industrial, governmental and commercial operations or policies. FINANCIAL IMPACT: There is no financial impact to the County to send the letter of support, nor is there a direct financial impact if the Town eventually extends its ETJ. Future development of the properties in the expected non-residential uses would be expected to increase the County's non-residential tax base. The Town would like to set a public hearing for the extension of the ETJ as soon as possible based on the County agreeing with this change. The change would allow the Town to establish uniform zoning over five parcels that are currently split by our jurisdictional boundaries and was the subject of some discussion during our joint meeting on October 13, 2016. Though there was some interest expressed at the meeting in examining the ETJ boundary over a larger area, that effort is expected to require significant effort and a relatively long time frame. In the meanwhile, a local business has been actively working to prepare a plan/permit application to allow one of the parcels to be developed as a new site for their business. A shorter timeframe for resolution of the ETJ boundary for the commercial properties in the NC Highway 54 West corridor is highly desirable. If the Orange County Commissioners act favorably upon this request, the Town will move forward with setting a public hearing for extension of the ETJ.
