Statement of Qualifications PURPOSE: To approve a new agreement for general engineering and environmental services between the Orange County Solid Waste Management Department and SCS Engineers (SCS) of Midlothian, Virginia for consulting services for a five (5) year period. BACKGROUND: The Solid Waste Department has an on-going need for consulting and environmental services for work that goes beyond the Department's staff capacities. The Department's existing engineering consulting contracts are about to expire, so Request for Qualifications (RFQ) number 5225 was issued to solicit qualifications from consulting firms with experience in the solid waste field. Statements of Qualification were received from eight (8) firms on December 7, 2016 and were reviewed by a departmental staff team pursuant to review criteria included in the Request for Qualifications. SCS is currently working with the Department on a financial study of the Enterprise Fund and on assessing alternative waste disposal options. The Department has worked with SCS in the past on numerous projects such as quality control/quality assurance for a landfill cell construction and for at least three waste characterization studies, with good results. Anticipated ongoing services to be provided could include: 1. Assistance in preparing scope of work request for proposals, review of technical proposals, preparation of designs and bid documents for department projects, attendance at meetings, assistance with review of bid documents and proposals. 2. Preparation of drawing, calculations, evaluations, estimates, assessments, etc., conduct waste characterizations, develop master plan drawings, provide capacity calculations, conduct feasibility studies, prepare conceptual site and facility plans or develop recycling and waste reduction plans. 3. Facility design, permitting, regulatory compliance, site assessments, etc. 2 4. Development of emergency storm debris management plans, long term waste reduction and recycling strategic plans, or other planning and program assessment projects. 5. Other engineering and environmental services that the County or state regulatory agencies may require. Preparation of presentation material for public meetings including AutoCAD drawings, poster boards, renderings, etc. FINANCIAL IMPACT: Sufficient funds to cover anticipated expenditures are available in the approved FY 2016-2017 Solid Waste/Landfill Operations budget. The projected expense for the remainder of FY 2016-2017 is $100,000 - $150,000. Estimated annual expenditures vary depending on regulatory imperatives or local project requirements. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to this item: • GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY The creation and preservation of infrastructure, policies, programs and funding necessary for residents to provide shelter, food, clothing and medical care for themselves and their dependents SCS Engineers has confirmed that the firm pays in excess of the living wage for any and all personnel working on Orange County projects. RECOMMENDATION(S): The Manager recommends that the Board approve the contract with SCS Engineers for engineering and environmental services for the Solid Waste Management Department and authorize the County Manager to sign the Agreement on behalf of the Board. Attachment 1 3 [Departmental Use Only] TITLE FY NORTH CAROLINA SERVICES AGREEMENT OVER $90,000.00 RFP/RFQ ORANGE COUNTY This Services Agreement (hereinafter "Agreement"), made and entered into this day of February, 2017, ("Effective Date") by and between Orange County, North Carolina a political subdivision of the State of North Carolina (hereinafter, the "County") and SCS Engineers, PC, (hereinafter, the "Provider"). WITNESSETH: That the County and Provider, for the consideration herein named, do hereby agree as follows: 1. Services a. Scope of Work. i) This Services Agreement ("Agreement") is for professional services to be rendered by Provider to County with respect to (insert type of project): engineering and environmental services. ii) By executing this Agreement, the Provider represents and agrees that Provider is qualified to perform and fully capable of performing and providing the services required or necessary under this Agreement in a fully competent, professional and timely manner. iii) Time is of the essence with respect to this Agreement. iv) The services to be performed under this Agreement consist of Basic Services, as described and designated in Section 3 hereof. Compensation to the Provider for Basic Services under this Agreement shall be as set forth herein. 2. Responsibilities of the Provider a. Services to be provided. The Provider shall provide the County with all services required in Section 3 to satisfactorily complete the Project within the time limitations set forth herein and in accordance with the highest professional standards. b. Standard of Care. i) The Provider shall exercise reasonable care and diligence in performing services under this Agreement in accordance with the highest generally accepted standards of this type of Provider practice throughout the United States and in accordance with applicable federal, state and local laws and regulations applicable to the Revised 6/16 1 4 performance of these services. Provider is solely responsible for the professional quality, accuracy and timely completion and/or submission of all work related to the Basic Services. ii) Provider shall be responsible for all errors or omissions of its agents, contractors, employees, or assigns in the performance of the Agreement. Provider shall correct any and all errors, omissions, discrepancies, ambiguities, mistakes or conflicts at no additional cost to the County. iii) The Provider may, upon advance written notice to County, subcontract the performance of any work under this Agreement. Should Provider elect to subcontract the performance of any work under this Agreement Provider shall require the subcontractor(s) to indicate in writing that it agrees to be bound by Sections 7, 8, and 11 of this Agreement. This authorization for subcontracting and the requirements for compliance by subcontractor with Sections 7, 8, and 11 shall not create, between the County and the subcontractor, any contractual or any other relationship. iv) Provider is an independent contractor of County. Any and all employees of the Provider engaged by the Provider in the performance of any work or services required of the Provider under this Agreement, shall be considered employees or agents of the Provider only and not of the County, and any and all claims that may or might arise under any workers compensation or other law or contract on behalf of said employees while so engaged shall be the sole obligation and responsibility of the Provider. v) If activities related to the performance of this Agreement require specific licenses, certifications, or related credentials Provider represents that it and/or its employees, agents and subcontractors engaged in such activities possess such licenses, certifications, or credentials and that such licenses certifications, or credentials are current, active, and not in a state of suspension or revocation. 3. Basic Services a. Basic Services. i) The Provider shall perform as Basic Services the work and services described herein and as specified in the County's Request for Proposals or Request for Qualifications (the "RFP") "RFP Number 5225 for "Engineering and Environmental Services" issued November 17, 2016, and the Provider's proposal, which are fully incorporated and integrated herein by reference together with Attachments (designate all attachments). In the event a term or condition in any document or attachment conflicts with a term or condition of this Agreement the term or condition in this Agreement shall control. Should such conflict arise the priority of documents shall be as follows: This Agreement, the County's RFP together with attachments, Provider's Proposal together with attachments. Revised 6/16 2 5 ii) The Basic Services will be performed by the Provider in accordance with the following schedule: (Insert task list and milestone dates) Task Milestone Date 1. Engineering Services As set forth in Scope of Work iii) Should County reasonably determine that Provider has not met the Milestone Dates established in Section 3(a)(ii), County shall notify Provider of the failure to meet any applicable Milestone Date. The County, at its discretion may provide the Provider seven (7) days to cure the breach. County may withhold the accompanying payment without penalty until such time as Provider cures the breach. In the alternative, upon Provider's failure to meet any Milestone Date the County may modify the Milestone Date schedule. Should Provider or its representatives fail to cure the breach within seven (7) days, or fail to reasonably agree to such modified schedule, County may immediately terminate this Agreement in writing, without penalty or incurring further obligation to Provider. This section shall not be interpreted to limit the definition of breach to the failure to meet Milestone Dates. 4. Duration of Services a. Term. The term of this Agreement shall be from March 1, 2017 to February 28, 2022. b. Scheduling of Services i) The Provider shall schedule and perform its activities in a timely manner so as to meet the Milestone Dates listed in Section 3. ii) Should the County determine that the Provider is behind any County established schedule, it may require the Provider to expedite and accelerate its efforts, including providing additional resources and working overtime, as necessary, to perform its services in accordance with the approved project schedule at no additional cost to the County. iii) The Commencement Date for the Provider's Basic Services shall be March 1, 2017. 5. Compensation a. Compensation for Basic Services. Compensation for Basic Services shall include all compensation due the Provider from the County for services under this Agreement. This Agreement is intended to be an umbrella agreement for the performance of multiple services that may or may not be anticipated during the term of the Agreement. Prior to any service being provided County and Provider shall agree in writing on a compensation amount for that specific service. Upon completion of the service Provider shall submit an invoice to County as provided herein. In the event the amount stated on an invoice is disputed by the County, the County may withhold payment of all or a portion of the amount stated on an invoice until the parties resolve the dispute. Payment for Basic Services may only be made after receipt of a properly submitted invoice. Revised 6/16 3 6 Payment shall be made through the County's purchase order process and any such purchase order shall have attached a corresponding scope of work and shall be pre- audited as required by North Carolina law. b. Additional Services. County shall not be responsible for costs related to any services in addition to the Basic Services performed by Provider unless County requests such additional services in writing and such additional services are evidenced by a written amendment to this Agreement. 6. Responsibilities of the County a. Cooperation and Coordination. The County has designated (Gayle Wilson) to act as the County's representative with respect to the Project and shall have the authority to render decisions within guidelines established by the County Manager and/or the County Board of Commissioners and shall be available during working hours as often as may be reasonably required to render decisions and to furnish information. 7. Insurance a. General Requirements. Provider shall obtain, at its sole expense, Commercial General Liability Insurance, Automobile Insurance, Workers' Compensation Insurance, and any additional insurance as may be required by County's Risk Manager as such insurance requirements are described in the Orange County Risk Transfer Policy and Orange County Minimum Insurance Coverage Requirements (each document is incorporated herein by reference and may be viewed at http://www.orangecountync.gov/departments/purchasing division/contracts.php. If County's Risk Manager determines additional insurance coverage is required such additional insurance shall consist of (if no additional insurance required mark N/A as being not applicable). Provider shall not commence work until such insurance is in effect and certification thereof has been received by the County's Risk Manager. 8. Indemnity a. Indemnity. The Provider agrees to defend, indemnify and hold harmless the County from all loss, liability, claims or expense, including attorney's fees, arising out of or related to the Project and arising from bodily injury including death or property damage to any person or persons caused in whole or in part by the negligence or misconduct of the Provider except to the extent same are caused by the negligence or willful misconduct of the County. It is the intent of this provision to require the Provider to indemnify the County to the fullest extent permitted under North Carolina law. 9. Amendments to the Agreement a. Changes in Basic Services. Changes in the Basic Services and entitlement to additional compensation or a change in duration of this Agreement shall be made by a written Amendment to this Agreement executed by the County and the Provider. The Provider shall proceed to perform the Services required by the Amendment only after receiving a fully executed Amendment from the County. Revised 6/16 4 7 10. Termination a. Termination for Convenience of the County. This Agreement may be terminated without cause by the County and for its convenience upon seven (7) days prior written notice to the Provider. b. Other Termination. The Provider may terminate this Agreement based upon the County's material breach of this Agreement; provided, the County has not taken all reasonable actions to remedy the breach. The Provider shall give the County seven (7) days' prior written notice of its intent to terminate this Agreement for cause. c. Compensation After Termination. i) In the event of termination, the Provider shall be paid that portion of the fees and expenses that it has earned to the date of termination, less any costs or expenses incurred or anticipated to be incurred by the County due to errors or omissions of the Provider. ii) Should this Agreement be terminated, the Provider shall deliver to the County within seven (7) days, at no additional cost, all deliverables including any electronic data or files relating to the Project. d. Waiver. The payment of any sums by the County under this Agreement or the failure of the County to require compliance by the Provider with any provisions of this Agreement or the waiver by the County of any breach of this Agreement shall not constitute a waiver of any claim for damages by the County for any breach of this Agreement or a waiver of any other required compliance with this Agreement. e. Suspension. County may suspend the Basic Services and this Agreement at any time for County's convenience and without penalty to County upon three (3) days' notice to Provider. Upon any suspension by County, Provider shall discontinue the Basic Services and shall not resume the Basic Services until notified to proceed by County. 11. Additional Provisions a. Limitation and Assignment. The County and the Provider each bind themselves, their successors, assigns and legal representatives to the terms of this Agreement. Neither the County nor the Provider shall assign or transfer its interest in this Agreement without the written consent of the other. b. Governing Law. This Agreement and the duties, responsibilities, obligations and rights of respective parties hereunder shall be governed by the laws of the State of North Carolina. c. Compliance with Laws. Provider shall at all times remain in compliance with all applicable local, state, and federal laws, rules, and regulations including but not limited to all state and federal anti-discrimination laws, policies, rules, and regulations and the Orange County Anti-Discrimination Policy and Orange County Living Wage Policy viewable at the webpage referenced in Section 7a. above. Any violation of this Revised 6/16 5 8 requirement is a breach of this Agreement and County may immediately terminate this Agreement without further obligation on the part of the County. This paragraph is not intended to limit and does not limit the definition of breach to discrimination. By executing this Agreement Provider affirms that Provider and any subcontractors of Provider are and shall remain in compliance with Article 2 of Chapter 64 of the North Carolina General Statutes. By executing this Agreement Provider certifies that Provider has not been identified, and has not utilized the services of any agent or subcontractor, on the list created by the State Treasurer pursuant to G.S. 147-86.58. d. Dispute Resolution. Any and all suits or actions to enforce, interpret or seek damages with respect to any provision of, or the performance or non-performance of, this Agreement shall be brought in the General Court of Justice of North Carolina sitting in Orange County, North Carolina. It is agreed by the parties that no other court shall have jurisdiction or venue with respect to such suits or actions. Binding arbitration may not be initiated by either Party, however, the Parties may agree to nonbinding mediation of any dispute prior to the bringing of a suit or action. e. Entire Agreement. This Agreement, together with the RFP and its attachments and the Proposal and its attachments, represents the entire and integrated agreement between the County and the Provider and supersedes all prior negotiations, representations or agreements, either written or oral. This Agreement may be amended only by written instrument signed by both parties. Modifications may be evidenced by facsimile signatures. f. Severability. If any provision of this Agreement is held as a matter of law to be unenforceable, the remainder of this Agreement shall be valid and binding upon the Parties. g. Ownership of Work Product. Should Provider's performance of this Agreement generate documents, items or things that are specific to this Project such documents, items or things shall become the property of the County and may be used on any other project without additional compensation to the Provider. The use of the documents, items or things by the County or by any person or entity for any purpose other than the Project as set forth in this Agreement shall be at the full risk of the County. h. Non-Appropriation. Provider acknowledges that County is a governmental entity, and the validity of this Agreement is based upon the availability of public funding under the authority of its statutory mandate. In the event that public funds are unavailable and not appropriated for the performance of County's obligations under this Agreement, then this Agreement shall automatically expire without penalty to County immediately upon written notice to Provider of the unavailability and non-appropriation of public funds. It is expressly agreed that County shall not activate this non-appropriation provision for its convenience or to circumvent the requirements of this Agreement, but only as an emergency fiscal measure during a substantial fiscal crisis. In the event of a change in the County's statutory authority, mandate and/or mandated functions, by state and/or federal legislative or regulatory action, which adversely affects Revised 6/16 6 9 County's authority to continue its obligations under this Agreement, then this Agreement shall automatically terminate without penalty to County upon written notice to Provider of such limitation or change in County's legal authority. i. Signatures. This Agreement together with any amendments or modifications may be executed electronically. All electronic signatures affixed hereto evidence the consent of the Parties to use electronic signatures and the intent of the Parties to comply with Article 11A and Article 40 of North Carolina General Statute Chapter 66. j. Notices. Proposals must be received by Orange County Purchasing, PO Box 8181, 200 S Cameron Street, no later than 4:00 PM, EST, Wednesday December 7, 2016. Copies of the proposal are available on the County's website at www.co.orange.nc.us/purchasing under "Current Bids". No hard copies will be distributed except upon specific request. Orange County reserves the right to reject any or all proposals. 12 REQUEST FOR QUALIFICATIONS # ENGINEERING AND ENVIRONMENTAL SERVICES THE COUNTY OF ORANGE, NORTH CAROLINA Orange County's Solid Waste Management Department (Department) is soliciting multi-disciplined general engineering/solid waste services to be available to support the ongoing and recurring need for engineering and environmental consulting services to perform tasks beyond the capacity of the Department. INTRODUCTION The Department consists of recycling, sanitation and landfill functions. The recycling function includes recyclable materials collection, processing and marketing, and is provided through both in-house and contract services. Orange County is one of the leading state entities with regard to waste reduction success and is currently in the process of evaluating its solid waste goal with having exceeded its goal of 61 percent waste reduction. The landfill function includes oversight and maintenance of two closed MSW landfills, one of which was closed in 2013, oversight and maintenance of a closed construction and demolition landfill and operation of a construction and demolition (C&D) landfill. The County currently transfers waste out of county utilizing a non-County owned and operated transfer station. Additional landfill related functions include operation of scrap metal and white goods recycling, scrap tire recycling, cardboard recycling and yard waste/clean wood/storm debris recycling/mulching. Landfill staff also sells mulch and compost to the public. Methane is presently recovered by the University of North Carolina for conversion to electricity. The sanitation Division operates and maintains the County's Waste and Recycling Centers. All five of the County's staffed Waste and Recycling Centers have been studied for updating the site layout and services rendered. One center was updated and reopened in May 2013. Another is scheduled for updating in the very near future. The three remaining sites will need to be designed and permitted over the next five years. PROJECTS Typical projects/functions will include: • Preparation of presentation material for public meeting including AutoCAD drawings, poster boards, renderings, etc. • Attendance at meetings • Preparing design and bid documents for department projects • Assistance in preparing scope of work requests for proposals • Assistance with review of bid documents and proposals • Preparing drawings, calculations, evaluations, estimates, assessments, etc. • Examples of the possible types of projects that may be included: o Design of recycling/solid waste convenience centers/drop-off sites o Facility permit amendments o Transfer Station preliminary site assessment and feasibility/needs assessment Permitting of land clearing debris processing and treatment facilities/compost facilities o Interpretation of rules/legislation o Evaluation of sites for Transfer Station and/or material recovery facility o Design and permitting of Transfer Station o Construction & Demolition Landfill Phase II design and permitting 2 13 Experience and/or capability may be required in any of the following subjects: • Landfill Gas Management and Recovery • Composting & Organics Management • Groundwater Management • Landfill Redevelopment • Master Planning and Permitting • Geotechnical Engineering • Facilities Planning and Design • Gas and Groundwater Remediation • Quality Assurance/Quality Control • Materials Handling and Recovery • Regulatory Compliance • Site Assessment • Transfer Station Design and Construction • Waste Stream Analysis and Minimization • Rate Studies • Risk Assessment • Cost Estimating • Laboratory Analysis • Alternative/Emerging Technologies Assessment • Solid Waste Strategic Planning • Construction and Demolition debris recycling • Waste and Recyclables Collection Note: It is not required that a firm be experienced/capable in all of the above areas of expertise, however, the successful firm may need access to this expertise through sub-contracting or other arrangements as approved by County. SUBMISSION REQUIREMENTS PROPOSAL FORMAT Orange County has achieved one of the highest verifiable waste reduction rates in the State of North Carolina as calculated by the NC Waste Management Division. The 2014-2015 reduction rate exceeds the County's 61% reduction goal by 4%. In keeping with our efforts to reduce waste at its source, we are asking that respondents provide double-sided submission copies on recycled content paper, to the extent practicable. Each respondent is requested to submit two hard copies of your proposal and three (3) copies on CD's containing the complete RFP in Adobe Acrobat format by the submittal deadline at 4:00 pm (EST), Wednesday, December 7, 2016. Most of the selection team members will conduct their individual reviews from the material provided on the CD, so please ensure that they are readable before they are sent and that your firm's name appears on the face of the CD. Engineers should submit qualifications that include the following: • General information of the firm, available resources, subcontractors and range of services. • Experience of the firm with similar "as needed" engineering contracts. Include references. • Qualifications of the proposed Project Manager(s) and other key personnel that would most likely be assigned. • Geographic location of the firm (or office carrying out the work) relative to Orange County • Copy of current rate sheet 3 14 INSURANCE The successful respondent will be required to show proof of professional liability insurance that will cover the length of this project. Respondents will also cite in their response any and all claims that have been filed against the professional liability insurance carried by the respondent within the last five years. 4 15 EVALUATION Evaluation criteria will include, but not necessarily be limited to the following: • Overall qualifications and experience of the firm and any subcontractors. • Qualifications of individuals assigned to a project • Information supplied by references • Demonstrated response capability to complete work tasks on time and within budget • Interviews (if applicable) County staff will evaluate all proposals and may or may not require a presentation by qualified firms. Depending on the response pool, the Staff may choose to select the top two ranked firms to negotiate an agreement with. If negotiations prove unsuccessful with either or both, the County will proceed to the subsequently ranked firm(s) to negotiate an agreement. Orange County reserves the right to award to more than one firm. Orange County recognizes not all firms will meet all disciplines. Contract shall be awarded for a period of five(5) years with an option to extend the contract for two (2) additional three-year periods. Orange County is committed to providing its employees with a living wage and encourages agencies it funds to pursue the same goal. A copy of Orange County's Living Wage Contractor Policy is included with this addendum 2. HB786 imposes E-Verify requirements on contractors who enter into certain contracts with state agencies and local governments. The legislation specifically prohibits governmental units from entering into certain contracts "unless the contractor and the contractor's subcontractors comply with the requirements of Article 2 of Chapter 64 of the General Statutes." (Article 2 of Chapter 64 establishes North Carolina's E-Verify requirements for private employers). It is important to note that the verification requirement applies to subcontractors as well as contractors. The new laws specifically prohibit governmental units from entering into contracts with contractors who have not (or their subs have not) complied with E-Verify requirements. Orange County's Solid Waste Management Department is soliciting multi-disciplined general engineering/solid waste services to be available to support the ongoing and recurring need for engineering and environmental consulting services to perform tasks beyond the capacity of the Department. This Statement of Qualifications provides an overview of SCS' qualifications and our capabilities to perform the work described in the RFQ. Based on our understanding of the RFQ, the engineering firm(s) selected by the County must possess extensive knowledge, background, and expertise in solid waste management and be capable of providing the engineering and consulting services that are typically involved in administering the County's solid waste and recycling programs and facilities. The SCS Team has unsurpassed qualifications in solid waste management engineering and consulting as discussed herein. COUNTY SOLID WASTE PROGRAM BACKGROUND The Orange County Solid Waste Management Department(Department) solid waste and recycling program operations are organized under four Divisions. The Environmental Support Services Division consists of various Department support elements including planning and administrative functions, utilities, maintenance, education and outreach, and enforcement. The Landfill Services Division is responsible for the operation of the construction and demolition (C&D) landfill, scales and weighing, incoming waste materials inspections, maintenance and monitoring of the three closed landfills, oversight of temporary storm debris management sites, and general Eubanks Road site grounds maintenance and security. The Recycling Services Division manages a variety of recycling programs (including weekly urban curbside, semi- weekly rural curbside, and commercial recycling programs), services, and facilities. Finally, Sanitation Services Division responsibilities include the operation of five Solid Waste and Recycling Centers, collection of waste from County buildings and schools, and the collection of bulky waste items. Orange County owns the now-closed Orange County Landfill located at 1514 Eubanks Road in Chapel Hill,NC. The landfill was permanently closed prior to reaching its full capacity effective July 1, 2013. The site is located approximately 4 miles north of the Town of Chapel Hill and is co-located with two other closed landfills (one C&D unit and one MSW unit) as well as the active Orange County C&D Landfill, which is currently owned and operated by the County. C&D debris, stumps, land clearing waste, mobile homes, mattresses/box springs, yard waste, clean wood waste, and stockpiled tires are accepted at the materials handling area of the site. Old corrugated cardboard(OCC), oyster shells, electronics, residential/commercial tires, large appliances, and scrap metal are accepted from residents for free. Also located in the vicinity of 1 23 Orange County, NC RFQ 5225 SCS ENGINEERS the Landfill site is the Eubanks Solid Waste and Recycling Center, a residential drop-off material collection center, and the Solid Waste Management Department Administration Building. Orange County maintains one of the highest waste reduction rates in the state, with 64 percent waste reduction as compared to the 1997 baseline. The County currently transports the solid waste from the collection centers to a transfer station owned by the City of Durham. SCS understands that the County is currently exploring the potential to construct and operate a local transfer station and other alternatives to the current approach for solid waste management and disposal. SCS understands the importance of waste reduction and recycling to the County, and is prepared to help the County achieve its goals related to solid waste and recyclable materials. 3 25 Orange County, NC RFQ 5225 SCS ENGINEERS SCS has historically performed Orange County's waste stream characterization study every five years starting in 1990. Recently in May 2016, the County retained SCS to perform a financial analysis and rate study to examine the current Solid Waste Program Fee of$107 assessed to each improved property in the County in the context of current and projected Solid Waste Management Department budgets. SCS also reviewed and analyzed Orange County's programs and operations for efficiency. In addition to performing this financial planning assignment for Orange County, SCS has performed the full range of consulting services for a wide range of solid waste programs, including rate studies, financial assurance cost estimates, financial pro forma modeling, Pay-As-You-Throw(PAYT)program evaluations, recycling program funding and market studies, escrow account analyses, and tipping fee analyses. Our staff has the ability to offer an independent evaluation of solid waste rates and charges that will allow municipal solid waste departments to meet their financial obligations, capital funding needs for system expansion, renewal and replacements, and to set aside appropriate reserve fund balances. Our financial consulting experts have assisted more than 100 clients in the development of solutions for administering solid waste and recycling programs resulting in financial stability. By crafting innovative solutions to our client's problems, we have made formal and information presentations to county commissions, city councils, authority boards, and citizen's advisory boards to gain acceptance of proposed new or revised rate and financial recommendations. Solid Waste and Sustainable Materials Management Facilities Engineering and Construction Specific topics and subject areas that are identified in the RFQ and fall under SCS' solid waste and sustainable materials management facilities engineering and construction practice include Landfill Gas Management and Recovery, Geotechnical Engineering, Landfill Redevelopment, Facilities Planning and Design, Master Planning and Permitting, and Quality Assurance/Quality Control. Typical and anticipated possible projects/functions include, design of recycling/solid waste convenience centers/drop-off sites, facility permit amendments, design and permitting of a transfer station/MRF facility, and C&D Landfill Phase II design and permitting. SCS is familiar with the current and former landfill facilities located in the vicinity of Eubanks Road in Orange County. SCS understands the sensitivity of the issues surrounding the Orange County Landfill and is familiar with its background and reasons for its closure in 2013. SCS is aware of the County's previous efforts to site a transfer station in the Eubanks Road area, ultimately resulting in the current arrangement of transporting County solid waste to the City of Durham Transfer Station. SCS understands that a local, full-scale, County-owned transfer station/materials handling facility would give increased autonomy to Department operations and help the County achieve its waste reduction goals. 4 26 Orange County, NC RFQ 5225 SCS ENGINEERS The Landfill is currently utilizing an active landfill gas collection system to deliver gas to a 1,000 KW power generator used by the nearby University of Chapel Hill. In the future, the University and Orange County may decide to modify the landfill gas collection and control system or to re-structure the landfill gas-to-energy project and SCS' team of landfill gas experts are ready to assist the landfill with any current or future gas system inquiries should they arise. Other potential projects/functions that may be anticipated include preparation of presentation material for public meetings (including AutoCAD drawings, poster boards, renderings, etc.); attendance at meetings, preparing design and bid documents for department projects; assistance in preparing scope of work requests for proposals; assistance with review of bid documents and proposals; preparing drawings, calculations, evaluations, estimates, assessments, etc.; and interpretation of rules/legislation. SCS works with many of our clients similar to Orange County under multi-task, open-end contracts to prepare modifications to existing drawings, plans, and permit documents for a variety of solid waste facilities and infrastructure. Typical assignments have included estimating composition and quantity of solid waste, facility needs, siting requirements, analysis of alternatives, and recommending short and long-term management strategies. SCS understands how the elements of an integrated solid waste management system function and how they interact. SCS completed a comprehensive review of solid waste collection and disposal options for the Town of Chapel Hill,North Carolina in October 2012. SCS has conducted some of the largest solid waste composition studies in the United States, including the City of New York; Fairfax County, Virginia; Hillsborough County, Florida; and Washington, D.C. SCS has also conducted five waste characterization studies for Orange County and the Town of Chapel Hill beginning in 1990 and completed numerous waste characterization studies for Wake County and several other North Carolina municipalities over the past five years. Recycling Programs There is a science to managing recycling programs. Collection and transfer processes may be operating inefficiently, causing more headaches and costing more money than they should. SCS has met these and other solid waste management challenges by designing and implementing recycling programs through innovative, yet practical, applications and with clear, fiscal responsibility. Our aim is to create practical solutions within a client's time and budgetary constraints. Based on this foundation, we understand how to balance the often conflicting technical, financial, institutional, and regulatory issues inherent in developing recycling programs. SCS maintains full architectural and engineering capabilities that have been developed specifically for the planning, design, and construction administration of various types of solid waste facilities. Transfer stations and material recovery facilities (MRFs) designed by SCS range in size from 50 to over 5,000-tons per day and operate in a wide range of conditions. We have designed transfer stations and MRFs for the public sector and the private sector. While providing engineering solutions for these projects, SCS routinely addresses economic concerns, operational challenges and permitting/regulatory issues. Solid Waste Landfills With specific regard to solid waste management facilities, SCS provides a full range of engineering, permitting and design services for both small and large facilities, public or private owners, new cells, lateral or horizontal expansions, as well as closure design and post-closure engineering, end-use planning and construction engineering/quality assurance. Over the years, SCS has developed standardized specifications for our landfill design, LFG and construction projects. We have developed time-tested specification sections covering geomembrane liners, geosynthetic clay liners, geocomposite drainage nets, low permeability soil liners, leachate collection systems and other technical specification that are unique to SCS for our landfill projects. These technical specifications formed the basis for many landfills in the area, and are available to SCS staff via our intranet database. Also, these specifications are written in the Construction Specifications Institute (CSI) format for ease of use and uniformity. We also hold licenses for EJCDJ"front-end" documents that have become industry standards. 16 38 Orange County, NC RFQ 5225 SCS ENGINEERS SCS' Construction Engineering Group provides construction engineering services for new lined landfills, landfill expansions, closure capping, site improvements, LFG control systems, groundwater extraction systems, and other features. Our services range from full-time, on-site Resident Engineering, earthwork and geosynthetic observation, documentation and certification of construction to periodic observation and testing of individual features. We also serve in the capacity of Owner's Representative, assist in negotiations with contractors and issuance of change orders, review and comment on shop drawings, contractor pay requests, submittal reviews and related administrative functions. SCS staff have been involved in construction of conventional Subtitle D liners and alternative bottom liners, leachate collection and transmission systems and have experience in inspection and testing of geomembrane materials (e.g., HDPE, LDPE, PVC, VFPE and others), geocomposite drainage nets, geosynthetic clay liners, bentonite amended soil liners, granular drainage layers, as well as LFG extraction wells, groundwater monitoring wells, and many other landfill related structures and features. Leachate Collection and Treatment Systems SCS staff has been involved in design of leachate collection, recirculation, and treatment systems in many regions of the country. SCS has employed various technologies including extended aeration, nitrification/denitrification, activated carbon, constructed wetlands, and chemical treatment to address site-specific leachate characteristics and site conditions. The selection of a treatment approach is dependent on many variables, including site location, leachate quality and quantity, availability of utilities, discharge limitations, and environmental regulations. Because of variability in leachate quality, treatment approaches must be evaluated on a case by case basis. SCS has earned an international reputation in this specialty area, and is one of a handful of consulting firms in North America with a track record in LFG management. Billions of dollars' worth of property are protected by LFG control systems engineered, built, and/or operated by SCS. Landfill air emissions and permitting is a specialized area of expertise for SCS. We have performed NSPS and Emission Guidelines (EG)projects at over 200 landfill sites. In several projects, contaminants have been detected in wells that did not appear to be caused by a release from the buried waste. Following the exceedance of a Groundwater Protection Standard(GPS), SCS will delineate the nature and extent of impacted groundwater and develop a Nature and Extent Study(NES). Combined with the NES, SCS has experience developing an Assessment of Corrective Measures (ACM)to evaluate potential remedies for groundwater impacts. For several facilities, SCS has presented a Corrective Action Plan(CAP) outlining the selected remedies to remediate groundwater in order to achieve the GPS at the facility boundary. SCS designs and helps implement simple, effective approaches to preventing and controlling erosion, sediment, and contaminant discharges from new construction and established facilities. We also sample and analyze storm water discharges to confirm compliance with government regulations, and perform routine audits to evaluate compliance with facility Storm Water Pollution Prevention Plans (SWPPPs). They have provided construction for new LFG facilities, design-build services, and major repair and modification at more than 600 LFG facilities. SCS-FS has designed or design/constructed eight landfill gas delivery pipelines having a total length of 28 miles to deliver lightly cleaned landfill gas from landfills to end users. The pipelines are in rural and urban areas and have employed both open cut and directly drilled installation. SCS-FS was formed in 1985 to meet the growing needs for qualified design and construction in the LFG area. City, state, and federal regulatory agencies have dictated environmental requirements for installation of quality, cost-effective LFG control systems. SCS-FS has expanded to a staff of 154, which allows us to provide services on a national basis from regional centers located throughout the U.S. SCS-FS has completed the installation of gas systems and 25 47 Orange County, NC RFQ 5225 SCS ENGINEERS major repair/modifications of more than 165 LFG control and utilization facilities. We currently provide ongoing, long-term operation and maintenance services at over 170 active LFG systems. SCS ENERGY SCS Energy is an operating division within Stearns, Conrad& Schmidt Consulting Engineers, Inc. SCS Energy is responsible for the design, construction and operation/maintenance of LFGE facilities and other types of small power plants. SCS Energy has completed or has underway the design of 26 biogas fueled power plants. The power plants are fueled on landfill gas or digester gas and employ reciprocating engines, combustion turbines, microturbines or fuel cells. Mike Cobb, PG is a Senior Project Professional with over eleven years of professional experience on a variety of solid waste projects involving groundwater monitoring, landfill gas monitoring and design, air quality compliance, and greenhouse gas reporting. Mike routinely monitors groundwater wells and prepares semi-annual reports. Mike is also an experienced construction inspector/monitor. Josh DeGayner is a Project Professional with the Sustainable Materials Management division who provides environmental support for projects performed out of the SCS Reston, Virginia office. His assignments since joining SCS eight years ago include field investigations and project management to support solid waste management and recycling studies as well as other environmental projects. Stacey Demers, LEED AP has more than 25 years of experience in solid waste and recycling management planning, program assessments, data analyses, waste minimization, and facilities planning. She has extensive public sector(Northeast Maryland Solid Waste Authority and Loudoun County, VA) and private sector experience on major solid waste programs. She currently manages a multi-year engineering contract for Montgomery County, MD that covers waste audits, recycling studies, and waste characterization studies. She is currently the Project Manager to develop a Zero Waste Plan for Prince George's County, MD which involves interviews and information gathering from multiple stakeholders. Ms. Demers understands recycling processes and has been called upon frequently to assess waste collection operations and conduct benchmarking studies, most recently for Oklahoma City, OK. She currently serves 31 53 Orange County, NC RFQ 5225 SCS ENGINEERS as the Director for the Sustainable Materials Management Technical Division of the Solid Waste Association of North America(SWANA). Bob Dick, PE, BCEE will serve as Program Manager and will be the primary point of contact for the County. He joined SCS in 1990 and is a Vice President responsible for SCS' operations in the Richmond, Virginia office. Bob will serve as Task Manager for landfill gas management and economic planning/forecasting assignments. Mr. Dick has nearly 20 years of experience providing landfill gas management services at the Hanes Mill Road Solid Waste Facility. He has performed landfill and landfill gas engineering projects (design, permitting, and construction) in more than 15 states and several foreign countries. He has worked on over 30 major landfill multi-task assignments involving new landfill cell construction, vertical and lateral expansion, closure, post-closure care, groundwater monitoring, phasing operations, and financial assurance, and has performed over 200 landfill gas projects involving landfill gas migration control, odor control, emissions control and Clean Air Act compliance, energy recovery/utilization, and carbon credit monetization. His solid waste planning and facility projects have involved residential and commercial collections and recycling programs and material recovery facility design, permitting, construction, and operations consulting. Other project assignments have involved work related to air permitting at industrial facilities, stormwater management, storage tanks, brownfields projects, and wetlands. Brent Dieleman is a Senior Project Professional SCS Engineer's Sustainable Materials Management Division in Reston, Virginia. Project activities include field sampling, technical assistance, program analysis, program and industry research, consensus building, partnership advancement, data analysis, plan development, and database management. Mr. Dieleman has 13 years of experience in the solid waste and energy field. Ryan Duckett is responsible for Sustainable Materials Management, Solid Waste Facilities and Municipal Planning related projects in the SCS Richmond, VA office. He also supports environmental engineering projects related to permitting, compliance, regulatory reporting, landfill gas modeling, landfill and landfill gas system construction quality assurance (CQA), and pollutant emission inventories at solid waste management facilities. Mr. Duckett has assumed responsibilities for projects involving solid waste strategic planning, material collection/transportation optimization, waste characterization, economic analyses, and program evaluation. Albert Glenn, PE is a civil engineer with more than 19 years of professional engineering experience in solid waste, water, wastewater and civil/sitework. Mr. Glenn's career has focused on solid waste management and landfill gas engineering. His experience includes project management, planning, regulatory liaison, federal and state permitting, construction quality assurance and quality control, new and closure landfill design, transfer station and convenience center design, development of construction packages, and construction administration for the 32 54 Orange County, NC RFQ 5225 SCS ENGINEERS solid waste industry. Mr. Glenn has a good working relationship with NCDEQ, Solid Waste Section and Land Quality Section, having completed several solid waste engineering, permitting and operations support projects throughout the state. Nick Guarriello, PE joined SCS' Richmond, VA office in 2009 and is responsible for working on environmental engineering projects related to Clean Air Act permitting, compliance, regulatory reporting, as well as landfill gas modeling and pollutant emission inventories at solid waste management facilities. His work efforts have focused on landfill and landfill gas (LFG) studies, control system design and construction, LFG system operations, regulatory reporting, permitting, and monitoring projects. Mr. Guarriello has been involved with LFG control and remediation projects throughout Virginia and North Carolina. Bob Isenberg, PE, CPG is a Senior Vice President with over 40 years of consulting experience in geotechnical/civil engineering projects involving design, analysis, testing, permitting, construction, remediation and repair of solid waste facilities, retaining structures including dams, mine tailing basins, MSE walls and earthen berms, reservoirs, buildings including power plants, commercial and residential housing and soil and groundwater contamination studies. He has extensive experience with design of bottom liner and leachate collection systems, final covers, subsurface investigation, slope stability and settlement analysis, and redevelopment of older landfills. Mike Kalish, PE, LEED AP is SCS's National Partner for Transfer Stations, Mr. Kalish has been the Project Manager for several major transfer station renovations and expansions and new facilities across the country and especially in the Mid-Atlantic region. Additionally, he has worked on a variety of engineering projects involving LFG, LFG-to-energy, landfill closure, and sub-slab mitigation design for brownfields remediation. Prior to joining SCS, Mr. Kalish was the Solid Waste Engineer for San Joaquin County, California where he was responsible for the operational oversight of two transfer stations, two open landfills, and two closed landfills. Mr. Kalish is also an instructor for the SWANA Managing Transfer Stations course and is a LEED Accredited Professional. Brandon King is a Senior Project Scientist based in SCS' Richmond, Virginia office since 2006. His work efforts have focused on landfill and landfill gas (LFG) study, design, permitting, monitoring, and construction projects. Mr. King has performed and assisted in over 50 LFG control and remediation projects in Virginia,North Carolina, Russia, and India, including projects focused on LFG migration control and odor/emissions regulatory control. He also has a variety of experience with landfill construction quality assurance (CQA), groundwater monitoring, environmental services/storage tanks, and RCRA investigations. Steve Lamb, PE is a civil engineer and has been providing solid waste engineering and consulting services for over 27 years. Mr. Lamb has been with SCS for over 17 years and is a Vice President who manages the Charlotte,NC office and oversees most solid waste engineering work 33 55 Orange County, NC RFQ 5225 SCS ENGINEERS performed in North Carolina. Steve has experience in solid and hazardous waste management, environmental engineering, civil engineering, hydrology and hydraulics, landfill engineering, remedial design, and regulatory compliance. He has managed over 400 solid waste projects for design, permitting, and construction quality assurance (CQA)activities and he is well-versed in North Carolina's regulatory requirements and operating practices. James Law, PE has over 28 years of experience in geotechnical engineering related to subsurface site investigations, highway and building foundation evaluations, and various design aspects of landfill facilities including CQA and resident/construction engineering services. He has successfully completed slope stability analyses for new cell designs, closure projects, failed slopes, and other specialty facility designs and alternative liner and leachate collection system demonstrations. He has conducted material interface friction angle studies for various geosynthetic and geocomposite liner designs, and overseen the CQA of various liner installations. He is the past Chairman of the ASCE national Capital Section, Geotechnical Committee. James developed the geotechnical drilling/testing program and performed the slope stability analyses for the Duke Lee Steam Station CCP Landfill design. Charles W. Ralston provides SCS with 18 years of experience in landfill gas (LFG) operation, monitoring, and maintenance (OM&M). Based out of Raleigh, he currently works on active landfill sites in the Carolinas, involving activities such as routine testing, monitoring, maintenance, and repair of LFG collection headers and extraction wells, and installation and startup of blower/flare systems. Mr. Ralston's LFG experience includes routine operation and maintenance (O&M), extraction well monitoring, collection header line trenching and placement (both PVC and HDPE), and installation and startup of blowers, flares, pumps, and compressors. His work also involves construction of expanded systems, and repair and renovation of existing systems. As a Superintendent, he provides support in regulatory compliance and participates in the company's Health and Safety awareness and implementation program. Jennifer S. Robb is a Project Manager with the Solid Waste Services Division in SCS' Reston, office and serves as SCS's Groundwater Technical Advisor for the mid-Atlantic region. Her work efforts since joining SCS in 2001 have focused on providing support to over 40 landfills in the area of groundwater permitting, monitoring, and remediation services and other environmental service projects. She has represented clients in front of regulators and has provided litigation support to attorneys on behalf of her clients. Marc Rogoff, PhD, PE is a Project Director in SCS' Tampa, Florida office and a nationally recognized expert in the procurement and operations of solid waste collection, recycling and materials recovery programs and facilities, and the economic feasibility of solid waste systems. With more than 25 years of experience in solid waste management as a public agency manager and consultant, he has managed more than 400 assignments throughout the U.S. on all facets of solid waste management. He provides long term planning assistance to sites by evaluating airspace availability, estimates of future needs, and required timelines of future development. Landfill Groundwater Contamination Remediation. SCS - - provided field testing and designed a remedial strategy for removing contaminates from the landfill property's groundwater. The remedial strategy included a combination of monitored natural attenuation (MNA) and phyto-remediation. The phyto-remediation system, utilizing beds of hybrid poplar trees installed in the downgradient region of the groundwater monitoring wells in which 2L exceedances have occurred to restore groundwater quality in these regions. In areas of the landfill which are unsuitable to install phyto-remediation beds due to groundwater depths and/or steep topography, a groundwater extraction system is installed and the extracted groundwater applied to a phyto-remediation area through drip irrigation. Additionally natural attenuation is also used to degrade certain constituents of concern which have exceeded the 15A NCAC 2L groundwater quality standards (2L groundwater quality standard) within the reducing environment of the uppermost pervasive aquifer. Construction and Demolition (C&D) Landfill Closure. SCS staff prepared a closure design and bidding and construction drawings and specifications for 13.2 acres of the County's C&D Landfill that is located on-top of a non-Subtitle D MSW Landfill. In addition, bidding and construction administration support services were provided to the County during bidding, contractor - -r, procurement and construction. r-q• SCS staff provided construction quality assurance JA (CQA) services during landfill closure construction. Upon - completion of the landfill closure construction, a CQA Certification Report was prepared and submitted to NCDENR and subsequently approved. Project Profile 63 Union County Solid Waste Management SCS ENGINEERS Landfill Stormwater NPDES Permitting. SCS staff assisted the County in obtaining a NDPES general permit for stormwater discharges from the County's landfill property. To obtain the NPDES permit the stormwater outfalls and possible pollutants from the property were determined by SCS staff as well as preparing an outfall and site map drawing. In addition, a permit application was prepared including a description of the landfill operations. Annual Regulatory Landfill Disposal and Airspace Reporting. Solid Waste Budget An Enterprise Fund finances the County's solid waste program. SCS reviews the County's budget annually in accordance with the requirements of the Landfill Revenue Bond Covenant of the Virginia Resource Authority. The reviews examine the expenses incurred, revenues earned, operation loss/profit, etc. Also, we review current year budgets and projections for long-term costs of future development, closure, and post-closure costs for future Phase I, II, and III. Waste Characterization Study. SCS conducted a two-season characterization study of residential and commercial waste generated and collected in the County. Information gathered from this study will help the County plan for future waste diversion programs and coordinate outreach and education efforts. Additionally, the data from this study can be compared to future studies to help the County evaluate the effect of various programs and communication efforts. There were 100 samples acquired and hand-sorted into 46 material categories. Waste samples were acquired from single- family residential, multi-family residential and commercial sources. Recycling programs have decreased the proportion of recyclable materials in the waste stream since 1992. There has been a significant reduction in the proportion of glass, metals, and paper in the waste stream since 1992. However, the proportion of plastic has doubled since 1992 as a likely result of the increase in plastic packaging. Yard Waste Composting Facility Design and Permitting. SCS prepared the hydrogeological analysis, permit applications and designs for a yard waste-composting site at Ball's Ford Road to be operated by a Contractor.
