PURPOSE: To approve the salary of the new Orange County Elections Director.
BACKGROUND: Section 163-35 of the North Carolina General Statutes contains provisions
for the appointment, compensation, and duties of a county director of elections. Whenever a
vacancy occurs in that office, it is the responsibility of the county board of elections to submit
the name of the person it recommends to fill the vacancy to the Executive Director-Secretary of
the State Board of Elections, who shall issue a letter of appointment.
As noted in the accompanying appointment letter, the State Board has approved the
recommendation of the Orange County Board of Elections that Barry Garner be appointed
Orange County's Election Director. Carolyn Gates, Orange County Elections Director since
1997, retired effective May 31, 2006. The Orange County Board of Elections conducted a
successful national search. They voted unanimously to recommend to the State Board of
Elections that Mr. Garner be appointed to succeed Ms. Cates as Elections Director for Orange
County, effective June 26, 2006,
NCGS § 163-35 provides that the county board of elections recommends the salary of the
director of elections, which is approved by the Board of County Commissioners. The Orange
County Board of Elections has recommended that the salary for Mr, Garner be set at $63,750,
which is between the minimum and first quartile of Salary Grade 27.
FINANCIAL IMPACT: Funding for the salary and benefits far this position are included in the
2006-07 Manager's Recommended Budget for the Elections Department,.
RECOMMENDATION(S): The Manager recommends that the Board of Commissioners
approve the Elections Director salary as recommended by the Orange County Board of
Elections.

This acknowledges receipt of the Orange County Board ofElections' unanimous
nornination of Barry Gamer to serve as Director ofElections to fdl the vacancy created in
that position by the retirement of Carolyn Cates.
Therefore, consistent with authority specified in N.C,G.S. 163-35(b) the undersigned
officer approves' the appointment of Barry Garner, as Director of Elections for the
Orange County Board of Elections, A copy of the duties and responsibilities officially
assigned by the Orange County Board to the Director of Elections should be provided for
our files.
G.S. 163-35 was amended as follows:
"(e) Training and Certification. -The State Boazd ofElections shall conduct a training
program consisting of four weeks for each new county director of elections. The director
shall complete that program. Each director appointed. after May 1995 shall successfully
complete a certification program as provided in Ci..S. 163-82.24(b) within three years
after appointment or by .Tamary 1, 2003, whichever occurs later." This section. became
effective January 1, 2002, Notice ofthis training schedule will be provided to county
boards of elections.
