Study Area Parcel Summary INFORMATION CONTACT: Craig Benedict, 245-2592 Dianne Reid, 245-2326 PURPOSE: To authorize Planning and Economic Development staff members to develop a Small Area Plan process far the NC Highway 57 Speedway area, BACKGROUND: Planning and Economic Development staff have been reviewing the issues surrounding the possible establishment of a new zoning and land use district/designation for an area along NC Highway 57, in the northeastern corner of the County near the border with Person and Durham Counties (please see attached map). The area in question is located within the Little River Township, which came under the Orange County zoning jurisdiction in 1994, As the various commercial operations in the area were established prior to the adoption of comprehensive zoning regulations, they were allowed to continue operation as nonconforming land uses per Article Eleven (11) of the Orange County Zoning Ordinance,. There is a concern among various commercial property owners over the nonconforming designation of their property and the impact such a designation might have on their ability to continue to utilize their property, Staff determined that the most appropriate course of action was to begin development of a Small Area Plan to address local nonresidential and owners' concerns as well as expand rural economic development opportunities within the area. This work was originally being completed in accordance with the planned update of the Orange County Land Use Element, As the Land Use Element's timeline for completion has been extended, staff believes that this project should be completed independently of the update. At the May 22, 2006 Joint Public Hearing between the County Board of Commissioners and the Planning Board, staff was asked to prepare an abstract outlining the recommended process of developing a Small Area Plan for the NC Highway 57 Speedway area. ISSUES/QUESTIONS In completing this project staff will study, at a minimum, the following issues/questions, which are not provided in any order of priority, Additional issues/questions may arise following community meetings: 1, Is the creation of the proposed new district consistent with the goals and objectives of the existing Orange County Land Use Element? 2, Is there a desire for non-residential development? 3, Will the proposed new district be consistent with the desire to allow far additional non- residential development within the rural areas of the County? 4, What is an appropriate level of nonresidential development within the area? 5. Haw will buffering and transitioning of existing, and possible future, nonresidential development be accomplished to avoid impacts on existing, and possible future, low- density residential development within the area? 6. How will the County address noise levels generated by the Speedway and go-kart track? 7. What types of additional nonresidential land uses are to be considered for the area and how will their impact be mitigated? 8, What additional traffic related issues will be generated by potentially allowing for additional nonresidential development? 9, How will allowing far additional nonresidential development within the area affect the existing groundwater public water supply and how will existing, and future, residential developments be protected from the increase in demand? 10, What will be done to protect the environmental integrity of the Flat River and Little River Watershed Overlay districts? 1 t, What ancillary impacts will be generated in Person and Durham Counties as a result of potentially allowing for additional nonresidential development? The attached Proposed Process and Schedule of Events detail a proposed timeline and include opportunities for neighborhood participation, public involvement and input. FINANCIAL IMPACT: No County financial impact at this time with human resources being used from existing departmental staff. The northern portion of the Speedway property, the entire go-kart tract, and all property north of Mile Branch Road are located within the Flat River watershed totaling approximately two hundred and ninety (29Q) acres of land area, The remaining property, including the remaining portion of the Speedway property and the entire quarry site, are located within the Little River watershed, The majority of the property within the study area is currently zoned Agricultural Residential (AR) with existing parcels zoned Existing Commercial Five (EC-5).. The current Future Land lJse Map classifies the study area as Agricultural Residential. The boundary for the proposed Highway 57 Speedway Area Small Area Plan was determined in the following manner: 1. Staff drew the boundary line to include the entire Orange County Speedway property and go-cart property to the west of NC Highway 57 towards the Person County border to the north. 2. The boundary extends east along the Person County border, terminating and heading south along the Durham County border to include three (3) properties to the south along NC Highway 57 towards Mile Branch Road, 3, The boundary area continues south along the Durham County border to include the entire quarry property and then turns west towards NC Highway 57 to include an undeveloped eleven (11) acre parcel of property directly adjacent to the quarry, The rationale far the boundary was to include all existing nonresidential developments in the area and any existing undeveloped property that was potentially suitable to support additional nonresidential development, Abstract: NC Highway 57 Speedway Area Small Area Plan Attachment Three (3) -Proposed Process and Schedule of events: Key Dates: Proposed Activity: Product: June 13, 2006 gOCC Review and Authorization: Authorization to commence project The Orange County Board of Commissioners reviews and approves proposal for Planning and Economic Development staff to begin the process of completing the NC Highway 57 Speedway Area Small Area Plan, June 14, 2006 public Notice -Neighborhood Participation: Detailed letters informing all parties of the process, Staff shall send out notices to local property estimated timeline, and owners within the proposed area of the intended results of the Highway 57 Speedway Area Small Area Plan, Community Outreach as well as all property owners within five meetings, hundred (500) feet of the study area boundary, to inform them of the project and invite them to attend a Community Outreach meeting to begin the process at 6:30 p,m, an June 27, 2006. The letter will indicate that staff will be asking for volunteers to serve on an Ad-Hoc committee to assist with the completion of the project and that the County will continue to inform local residents of future Community Outreach meetings to review the constraints and opportunities of allowing for additional development within the area to ensure adequate neighborhood involvement with this project. Staff shall also send notification to the Planning Department's of Person and Durham Counties to involve them with the project. These letters will request a separate meeting with each individual department to review the work plan and scope of the project.
