PURPOSE: To consider the legal advertisement for items to be presented at the Joint Board of
County Commissioners/Planning Board Quarterly Public Hearing scheduled for May 22, 2006.
BACKGROUND: The Board of County Commissioners reviews proposals to be considered at
public hearing for consistency with general County policy and presentation format. The following
items are proposed for consideration at the May 22, 2006 Jcint Quarterly Public Hearing.
A. PUBLIC HEARING ITEMS
1. Efland-Mebane Small Area Plan
An appointed citizen Task Force has been working with Orange County staff to develop a
Small Area Plan for the Efland-Mebane area since .January 2005. The draft of the plan
was completed in early 2006 and a Community Meeting was held on March 27, 2006 to
receive citizen comments on the plan.
The draft plan contains numerous recommendations in the following topic areas:
• Water and Sewer
• Land Use/ Community Character/Design
• Transportation
• Housing
• Parks, Recreation and Open Space
• Communications
• Intergovernmentallssues
• Other Recommendations, including:
o Potential Transfer of Development Rights (TDR) Program
o Emergency Shelters
o Impact Fees
o Historic Preservation
o Plan Updates
The draft Efland-Mebane Small Area Plan and Map is available on the Orange County
Planning Department website at http://www.co.orange.nc.us/planning/index.htm.
B. NON-PUBLIC HEARING ITEMS
1. Orange County Comprehensive Plan Update Process
In response to the public comments received at Public Hearings held on the
Comprehensive Plan, Land Use Element Update on November 21, 2005 and February
27, 2006, the Board of County Commissioners (BOCC) has restarted the Land Use
Element Update process and placed the Planning Board in charge of developing a
new process for BOCC consideration. The County Commissioners have also asked the
Planning Board for their suggestions on an approach/process for updating the overall
Comprehensive Plan. A brief update on the progress of the Planning Board will be
provided.
2. Update on Rural Enterprises Project (Agricultural Support Enterprises)
Planning and Economic Development staff will present draft text amendments to allow
for changes to the Orange County Zoning Atlas through a new conditional district
rezoning process, Unlike general rezoning, property subject to the conditional district
rezoning process may be used only for a specific land use(s), based on asite-specific
development plan. This new mechanism would be used to rezone properties for
agriculturally related businesses as an extension of the existing Agricultural Services
floating zoning district. Staff will respond to questions and requests direction from the
Board on how to proceed. A formal version of these amendments will be considered at a
future public hearing to ensure opportunities for public comment.
3. Update on Transfer of Development Rights (TDR) Feasibility Study
The BOCC will review the issues and concerns raised during the Transfer of
Development Rights (TDR) Feasibility Study and consider the TDR Task Force
recommendations on whether to proceed with the completion of the study.
FINANCIAL IMPACT: Other than advertising casts, there are no direct financial impacts
associated with the approval of this item.
RECOMMENDATION(S): The Administration recommends APPROVAL of the proposed May
22, 2006 .loint Quarterly Public Hearing legal advertisement.
NOTICE OF JOINT PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
ORANGE COUNTY PLANNING BOARD
A joint public hearing will be held in the Judge F.. Gordon Battle Superior Courtroom of the
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Monday, May 22, 2006, at 7:30 PM for the purpose of giving all interested citizens an
opportunity to speak for or against the following items:
A. PUBLIC HEARING ITEMS
1. Efland-Mebane Small Area Plan

draft of the Plan was completed in early 2006 and presented at a community
meeting on March 27, 2006 to receive citizen comment.

• Land Use/Community Character/Design
• Transportation
• Housing
• Parks, Recreation and Open Space

Purpose: To receive public comment on the data, assumptions, and
recommendations contained in the Draft Efland-Mebane Small Area Plan and
receive direction from the Board of Commissioners as to subsequent steps.
B. NON-PUBLIC HEARING ITEMS

In response tc the public comments received at Public Hearings held on the

The BOCC will review the issues and concerns raised during the Transfer of
Development Rights (TDR) Feasibility Study and consider the TDR Task Force
recommendations on whether to proceed with the completion of the study.
Pur ose: To provide an update on the progress of the TDR Feasibility Study and
receive direction from the Board on how to proceed.
Changes may be made in the advertised proposals that reflect debate, objections
and discussion at the hearing.
Accommodations for individuals with physical disabilities can be provided if the
request is made to the Director of Planning at least 48 hours prior to the Public
Hearing by calling the appropriate number listed below. The full text of the
changes may be obtained after May 17, 2006 from the Planning Department. Also,
the text may be obtained at the County website www.co.orange.nc.us at the
Meeting Agendas link prior to the meeting.
