THIS AGREEMENT, entered into this 17 day of August, 2017, by and between Orange County
("County"), by and through the Orange County Arts Commission ("Arts Commission") and
Carter Hubbard ("Grant Recipient").
WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of
local arts experiences by providing funding and support for diverse high quality programs and
projects.
WHEREAS, the Arts Commission administers the annual Grants Program to provide
economic opportunities to Orange County artists and non-profit organizations coordinating arts
projects benefiting the citizens of Orange County.
WHEREAS, the annual Arts Grants Program is supported by Arts Commission with
funds from the Grassroots Arts Program of the North Carolina Arts Council, a division of the
Department of Natural and Cultural Resources, a state agency.
WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the
annual Arts Grant through the procedures duly adopted by the Arts Commission; and
WHEREAS, both parties wish to promote and maintain the integrity and clarity of the
Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the
County;
NOW, THEREFORE, the County and the Grant Recipient, for the consideration and
under the conditions hereinafter set forth, agree as follows:
1. Approved Grant Project. Grant funds are provided under this Agreement for the project
("Project") described in the Grant Recipient's Grant Application, attached hereto and
incorporated herein as Exhibit A.
2. Grant Award. Grant funds in an amount not to exceed one thousand five hundred ($
1,500) have been awarded by the Arts Commission to the Grant Recipient for the
approved Project. The Recipient shall be required to match funds at least dollar-for-
dollar with cash from the Grant Recipient's funds not derived from either Orange County
appropriations or the North Carolina Arts Council, as outlined in the attached Exhibit A.
3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots
Program funding to the Arts Commission. Final decisions on Grassroots Program funds
to the North Carolina Arts Council are subject to approval by the North Carolina General
Assembly.
4. Responsibilities of the Grant Recipient

A. Implementation. The Project implementation shall take place between July 1,
2017 and June 30, 2018. The Project shall be implemented in the manner
described in Exhibit A. Time is of the essence in the implementation of the
Project.
B. Modifications to project. Grant Recipient shall present major changes to the
original proposal, including but not limited to changes in design, implementation
schedule and increase in Project budget by more than 10%, in writing to the Arts
Commission for approval. Arts Commission shall approve or disapprove Grant
Recipient's request for modifications within seven (7) days of receipt thereof
Consent to project modifications shall not be unreasonably withheld. Arts
Commission's decisions shall be in writing. In the event the Arts Commission
fails to approve or disapprove the requested modifications within the time stated
herein, the modifications shall be deemed approved.
C. Non—assignment. The grant cannot be assigned or transferred to a different project
or artist without prior written approval of the Arts Commission.
D. Records. Grant Recipient must maintain records and other evidence pertaining
to costs incurred and revenues acquired during the Project implementation. Grant
Recipient shall maintain financial records pertaining to the Project for three (3)
years from the date of this Agreement, in case of audit.
E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding
taxes or other debts of any nature. The grants shall be utilized solely for the
purpose described in the attached Exhibit A.
F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report
on July 6, 2018. The Final Report shall be in the format required by the North
Carolina Arts Council. Failure to submit the Final Report or late submission of
the Final Report, for any reason, shall be grounds for denial and/or cancellation of
grant funds for the Project and future grant proposals.
5. Responsibilities of the Arts Commission
A. Payment. The Arts Commission shall release the grant funds in the amount of
$1,500 to the Grant Recipient.
6. Publicity
A. Acknowledgement. Credit must be given to the Orange County Arts
Commission and/or the North Carolina Arts Council using the proper logo(s)
and credit line in brochures, news releases, programs, and all other printed and
online publications. Copies of such printed materials must accompany the
evaluation report. Official Orange County Arts Commission and North Carolina
Arts Council logos may be downloaded at www.artsorange.org/grantee-resources
and may not be altered in any way. When no printed information is used, verbal

credit shall be given. In addition, all print and promotional material must include
the following credit line and logo(s) (check all that apply):
i. x County Funds Only. Orange County Arts Commission logo required.

ii. North Carolina Arts Council Funding. The Orange County Arts
Commission and the North Carolina Arts Council logos are required. Credit

Department of Natural and Cultural Resources. "
B. The Grant Recipient must enter all events, exhibits and performances open to the
public and related to this grant award on the ExploreChapelHillARTS.com
website and display Orange County Arts Commission publicity materials
(postcards, brochures, etc.) prominently and consistently at their venue or
performance space. In addition, the Grant Recipient must add a link to the
www.artsorange.org (Orange County Arts Commission logo preferred) to their
main webpage.
7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the
Arts Commission and the North Carolina Arts Council and their officers and employees
from any and all claims or actual injury, damage or loss to a person, or real or personal
property that results from or is in any way connected to the use of the grant funds.
8. Independent Contractor. The Grant Recipient is an independent contractor and not an
employee, agent or other representative of the County and/or the Arts Commission.
Nothing contained in this Agreement shall be construed to create the relationship of
principal and agent, or employer and employee, between Grant Recipient and Arts
Commission or Orange County Government. Grant Recipient understands and agrees
that he/she is not authorized to incur any expenses or any liability whatsoever on behalf
of the County or the Arts Commission and has no authority, expressed or implied, to
obligate or make representations on behalf of the County or the Arts Commission. In
addition, Grant Recipient agrees to maintain his or her own worker's compensation
insurance for himself/herself and his or her employees for the duration of the art work's
installation.
9. Termination
A. In the event of any of the circumstances set forth below (hereinafter referred to as
"default"), the Arts Commission may immediately terminate this Agreement:
(i) Any fraudulent representation in any verification required to obtain
payment under this Agreement or other dishonesty on a material matter
relating to the performance of services under this Agreement.
(ii) Nonperformance, incomplete service or performance, or failure to
satisfactorily perform any part of the Project or to comply with any

provision of this Agreement, as determined by the Arts Commission in its
sole discretion.
(iii) Failure to adhere to the terms of applicable county, state or federal laws,
regulations, or stated public policy.
B. In the event of default by the Grant Recipient, the Arts Commission has the
discretion to elect to terminate this Agreement, in whole or in part and/or require
the Grant Recipient to repay the grant funds within seven (7) from written notice
of default or allow the grant recipient the opportunity to cure the default. This
clause shall not be interpreted to limit the County's or the Arts Commission's
remedies in law or in equity.
10. Miscellaneous.
A. Entire Agreement. This Agreement and the attachments contain the final and
entire understanding of the parties with respect to the subject matter of this
Agreement. All modifications and amendments to this Agreement shall be in
writing. This Agreement shall be binding upon the parties, their heirs, successors
and assigns.
B. Governing Law. Both parties agree that this Agreement shall be governed by the
laws of the State of North Carolina. Provider shall at all times remain in
compliance with all applicable local, state, and federal laws, rules, and regulations
including but not limited to all state and federal anti-discrimination laws, policies,
rules, and regulations and the Orange County Non-Discrimination Policy and
Orange County Living Wage Policy (each policy is incorporated herein by
reference and may be viewed at
http://www.orangecountync.gov/departments/purchasing_division/contracts.php).
Any violation of this requirement is a breach of this Agreement and County may
immediately terminate this Agreement without further obligation on the part of
the County. This paragraph is not intended to limit and does not limit the
definition of breach to discrimination. By executing this Agreement Provider
affirms that Provider is and shall remain in compliance with Article 2 of Chapter
64 of the North Carolina General Statutes. By executing this Agreement Provider
certifies that Provider has not been identified, and has not utilized the services of
any agent or subcontractor, on the list created by the State Treasurer pursuant to
G.S. 147-86.58.
C. Entire Agreement and Signatures. The parties have read this Agreement and agree
to be bound by all of its terms, and further agree that it constitutes the complete
and exclusive statement of the Agreement between the parties unless and until
modified in writing and signed by the parties. This Agreement together with any
amendments or modifications may be executed electronically. All electronic
signatures affixed hereto evidence the intent of the Parties to comply with Article
11A and Article 40 of North Carolina General Statute Chapter 66.

FloraffitiTM: Bringing Words to Life and Life to Words

Proposed Project
Floraffiti is a placemaking and community engagement project. Using red clover,words
are planted mulched areas such as: medians, under trees, along the sidewalk and
streets, and in and around municipal parking lots and businesses that are willing
participants. The words are derived from community input, cultural surroundings, and
from spoken word poetry workshops held in the community. In the workshop, group
and solo poetry pieces are created and the participants learn to perform their piece for
a public audience. From each piece created, one specific word is chosen by each
participant to be planted. The workshop participants and artist, Carter Hubbard, plant
the words throughout the community. When the words are in full growth,the workshop
participants perform their pieces around each word that they planted in a public event.
The performances by the youth and adults will give the words another facet of
exploration that will entertain, inspire, inform, and enliven the spaces where the words
are planted in Chapel Hill and Carrboro.
With the help of Stephanie Trueblood, Hillsborough's Public Space Manager, Floraffiti is
planning to expand into Hillsborough in 2018 as a placemaking tool with hopes of
"cross-pollinating", collaborating to support the upcoming Bee Hotel project. The Town
of Hillsborough has received the "Bee City USA" designation to foster the health and
growth of the bee population and to educate the public about the bees' greater purpose
as a vital member of the ecosystem, integral to environmental well-being for all.
Examples of possible words planted for this project, such as 'Pollinate', 'Bzzzz...', 'Grow',
and visual images planted in the shape of flower, a bee, the honeycomb hexagon
pattern and more will tie in with the Bee Hotel project in the Spring. In the years
following 2018, Floraffiti will develop in ways to support the economic and cultural
diversity in the community specific to Hillsborough's objectives, as noted below.
There are many other words planted by the artist and Floragardeners throughout the
community to fulfill the larger scale placemaking initiative. For the community at large,
the words will be in both prominent areas, aimed at visitors' commonplaces, and as well
is in surprising places, more obvious to the local community. The words' growth period,
typically beginning in March, lasts for 4 months. As summer nears,the words will
diminish and the remains will naturally disappear into the mulch/dirt.
In 2017, Floraffiti saw its fifth year as a placemaking project in Chapel Hill and a year of
firsts; Carrboro was included and the series of community spoken word poetry
workshops were implemented throughout. The community workshops with teens and
adults were followed up with a series of very successful performances throughout
Chapel Hill and Carrboro during the 2nd Friday Art Walk in April.

It is the goal of Floraffiti 2018 to encompass more participants from broader parts of
Orange County, in addition to the participant partner organizations of 2017, including
Boomerang Youth, Inc, and The NC Art Therapy Institute. Additional partnerships are
being created with the Chapel Hill Public Library, youth groups in local high schools, PTA
Thrift Shop's YouthWorx, Transplanting Traditions, and Chapel Hill Seniors.
Floraffiti as a placemaking tool took a minimum four years to catch the eye of the
public. 2017 was the first year that Floraffiti, specifically as a placemaking project, was
truly widely known. This type of community art project is new and growing to become a
tool for personal and community growth. A deepened and broader impact is yet to be
realized in regards to the community engagement piece and continuation of this project
is warranted to fulfill its reach.
In addition to expanding the scope of the project with more people, we are working on
including Floraffiti as part of a world-wide event called Si Art D y,April 14th, 2018. It
is a day designated to take the time to look at art as a group followed by a discussion of
the work, perhaps around lunch. Floraffiti wants to partner with a local arts organization
as a host for this event, taking people outside of the gallery and consider art as design in
open spaces,temporary and permanent.
Community Impact
Employing nature as an art form more deeply roots the experiences of workshop
participants in addition to sharing their personal stories with the larger community. It
was discovered to be a bonding experience for those involved in 2017. Some teens
found that they were leaders and others helped those with no experience in gardening.
It was an exercise in working together through discussions as the participants planned
and designed the words in the sites available, all empowering components of the
project. Some of the participants planted words in Spanish, their native language,
explaining to the audience the meaning of the word in the context of their spoken word
piece performed. Floraffiti would like to continue to foster and engage the cultural
diversity that truly represents the community at large.
For the adult participants, it was the community reaction, inclusive of post event

remarks that were overheard that made a deep impression. It was the bold and brave
stories told by the adults at the Art Therapy Institute that drew strong admiration from
the crowd. Some of them were invited to share their stories for the teens at Boomerang.
This art form can be used for positive change in communities to address issues socially,
and culturally, reaching across lines of difference and expanding the message of
tolerance of diversity,fostering and strengthening strong relationships. Sonia
Frischemeier, the Director of Operations of Boomerang views this project as a well-
rounded opportunity for the teens to develop their voice in public and participate in
community service through the integration of engaging cultural arts. She finds this
important to the fabric and vitality of the community.

Placemaking initiatives such as Floraffiti aid in creating a sustainable visitor destination,
reflecting a town actively invested in the welfare of all ages of the community and in its
natural environment. It reflects back to the community at large what is important to the
community. It demonstrates how it values its cultural identity by cultivating a
stimulating means of strategic economic development. This four month long project has
the capacity to serve a large number of people that live and work in the three towns,
inclusive of UNC students faculty, and staff, and those who are passing through the
three towns using services, doing business, and seeking pleasure and entertainment
that the area has to offer.
The community impact is further described by the volume, scope, quality, and depth of
press received in 2017 and in the conversations that Carter had during the planting
process with the participants intermingling with the public. Carter alone talked to over
40 people while involved in the planting process receiving questions about the project
and positive feedback from every one of these people.

Artist Experience
Carter Hubbard has successfully implemented this project, Floraffiti,for the past five
years in the town of Chapel Hill expanding into Carrboro this past year, simultaneously
serving as the event coordinator. Specific to Chapel Hill, she has designed, created, and
implemented several other community interactive projects-'The Kitchen Window

Quilt', 2013 State Folk life Festival's exhibition, North Carolina Textiles: The Fabric of a
State at the ArtsCenter and "Memory Bubbles', a visual scavenger hunt as part of
Windows on Chapel Hill.
She is experienced working with youth in the area as she was awarded the Chapel Hill
Artist Residency working with art students at East Chapel Hill high school creating a
permanent 3-D installation. She has worked with youth involved in the Durham Art
Guild's Creative Mentorship Program that partners with 'Student U' and taught privately
for over 20 years.
For the 2016-17 school year, she was been awarded an artist in residence in 3 high
schools in Cary. She worked with the art students facilitating their knowledge of the
evolving face of Public Art creating large scaled installations encompassing several calls
to action for positive change in.The work included non-arts students, faculty, and
administration throughout the process, creating interdisciplinary opportunities for
cooperative based learning and project implementation. Additionally, Floraffiti was
implemented at Cary High School as a collaborative and interdisciplinary learning
opportunity culminating in off campus performances during Cary's Spring Daze Arts
Festival.
Carter is an experienced curator having planned and executed her largest project to
date, a 35-person exhibition in Raleigh, NC in a vacant manufacturing facility. It
encompassed video, installation, 3-D sculpture, interactive installations, and 2-D media.
And lastly, she has successfully created award winning large scaled installations in the
Scrapel Hill Show at University Mall and commission for Duke University.
In all of the above functions and through her administrative positions in several arts
festivals in the Triangle and Portland, Carter has developed strong writing skills for
grant, press release, and blog writing with a fluid knowledge of how and where to
disseminate this information inclusive of all social media platforms. Strong are her
abilities to organize and adapt with changes as they occur from any location, and her
ability to communicate with youth and adults in all capacities relevant to this project.

Dear Ms. Murray,
This letter is in support of artist Carter Hubbard's work and grant submission to Orange County Arts
Commission. We have committed agency funds for 2018 to support Carter, as well as the use of the 60f
brick planters that we manage and maintain fbrthmdownhzwn community, and our agency will be the fiscal
agent for the expanding project. Our agency has been funding this project consecutively for the last four
years.
The Chapel Hill Downtown Partnership (CHDP) is a nonprofit agency that brings together the resources of the
Town, University and downtown community to maintain, enhance and promote downtown as the social,
cultural, and spiritual center of Chapel Hill through economic development.
Our Plan of Work 2016-2018 leads with an objective of being downtown's managing entity and economic
development leader by specifically pursuing arts endeavors. Whether it is music, food &drink, visual art, or
performances arts
Carter's Floraffiti project has steadily grown to be a cultural institution in our community. I marvel and how
many people—from all over the community— know and love the'growing words'that she's created around
town. This year—and in the coming year—she has added dynamic and engaging elements to the work. She's
brought in youth and adults with cognitive disabilities to create works of poetry based on words. She's
engaged the private sector in her work too.
Floraffiti is exactly the kind of creative work that sets the tone for the engaging sense of place that we are
fostering downtown. The words bring a smile to people's faces and an audible'WOW'. I love that people are
engaging with her art; almost like they've been let in on a secret that they alone have discovered.
We hope you are as excited about this grant proposal as we are and will support Carter and the Floraffiti
project.

AS Open Eye Cafe, and an individual, that not only took part in the program this year, but actually donated and
supported thru infrastructure, I cannot say enough how beneficial and important this program is, and will
continue to be, as it grows and expands its scope and impact.
On so many levels this program mirrors our own desire to reach out to the entire community and find a way to
connect with individuals and groups and promote awareness and mind-expansion. Eye-Opening, if you will.
Beyond that you have the obvious positive visual impact and curiosity inducing aspects or the program that are
an excellent door-opener to the greater depth inherent in the program.
Should you go no further than the visual impact you still have a program that delights and creates a town
beautifying project well worth the time, effort and expense!
I realize the deadline for this was pushed up, so I am going to keep this brief, but I am available for any
followup questions or comments that may be needed.
In short, this is an important program for the towns and our communities and we will continue to support it
regardless of what other funding may or may not occur.
It is my hope that others see the benefits, both short and long term, that arise form it as well.
