THIS AGREEMENT, entered into this 17 day of August, 2017, by and between Orange County
("County"), by and through the Orange County Arts Commission ("Arts Commission") and
Donn Young ("Grant Recipient").
WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of
local arts experiences by providing funding and support for diverse high quality programs and
projects.
WHEREAS, the Arts Commission administers the annual Grants Program to provide
economic opportunities to Orange County artists and non-profit organizations coordinating arts
projects benefiting the citizens of Orange County.
WHEREAS, the annual Arts Grants Program is supported by Arts Commission with
funds from the Grassroots Arts Program of the North Carolina Arts Council, a division of the
Department of Natural and Cultural Resources, a state agency.
WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the
annual Arts Grant through the procedures duly adopted by the Arts Commission; and
WHEREAS, both parties wish to promote and maintain the integrity and clarity of the
Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the
County;
NOW, THEREFORE, the County and the Grant Recipient, for the consideration and
under the conditions hereinafter set forth, agree as follows:
1. Approved Grant Project. Grant funds are provided under this Agreement for the project
("Project") described in the Grant Recipient's Grant Application, attached hereto and
incorporated herein as Exhibit A.
2. Grant Award. Grant funds in an amount not to exceed one thousand fl"uv; hundred re d. (S
1,500) have been awarded by the Arts Commission to the Grant Recipient for the
approved Project. The Recipient shall be required to match funds at least dollar-for-
dollar with cash from the Grant Recipient's funds not derived from either Orange County
appropriations or the North Carolina Arts Council, as outlined in the attached Exhibit A.
3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots
Program funding to the Arts Commission. Final decisions on Grassroots Program funds
to the North Carolina Arts Council are subject to approval by the North Carolina General
Assembly.
4. Responsibilities of the Grant Recipient

A. Implementation. The Project implementation shall take place between July 1,
2017 and June 30, 2018. The Project shall be implemented in the manner
described in Exhibit A. Time is of the essence in the implementation of the
Project.
B. Modifications to project. Grant Recipient shall present major changes to the
original proposal, including but not limited to changes in design, implementation
schedule and increase in Project budget by more than 10%, in writing to the Arts
Commission for approval. Arts Commission shall approve or disapprove Grant
Recipient's request for modifications within seven (7) days of receipt thereof.
Consent to project modifications shall not be unreasonably withheld. Arts
Commission's decisions shall be in writing. In the event the Arts Commission
fails to approve or disapprove the requested modifications within the time stated
herein, the modifications shall be deemed approved.
C. Non—assignment. The grant cannot be assigned or transferred to a different project
or artist without prior written approval of the Arts Commission.
D. Records. Grant Recipient must maintain records and other evidence pertaining
to costs incurred and revenues acquired during the Project implementation. Grant
Recipient shall maintain financial records pertaining to the Project for three (3)
years from the date of this Agreement, in case of audit.
E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding
taxes or other debts of any nature. The grants shall be utilized solely for the
purpose described in the attached Exhibit A.
F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report
on July 6, 2018. The Final Report shall be in the format required by the North
Carolina Arts Council. Failure to submit the Final Report or late submission of
the Final Report, for any reason, shall be grounds for denial and/or cancellation of
grant funds for the Project and future grant proposals.
5. Responsibilities of the Arts Commission
A. Payment. The Arts Commission shall release the grant funds in the amount of
$1,500 to the Grant Recipient.
6. Publicity
A. Acknowledgement. Credit must be given to the Orange County Arts
Commission and/or the North Carolina Arts Council using the proper logo(s)
and credit line in brochures, news releases, programs, and all other printed and
online publications. Copies of such printed materials must accompany the
evaluation report. Official Orange County Arts Commission and North Carolina
Arts Council logos may be downloaded at www.artsorange.org/grantee-resources
and may not be altered in any way. When no printed information is used, verbal

credit shall be given. In addition, all print and promotional material must include
the following credit line and logo(s) (check all that apply):
i. x County Funds Only. Orange County Arts Commission logo required.
Credit line required for audio projects: "This program is supported by the
Orange County Arts Commission."
ii. North Carolina Arts Council Funding. The Orange County Arts
Commission and the North Carolina Arts Council logos are required. Credit
line: "This program is supported by the N.C. Arts Council, a division of the
Department of Natural and Cultural Resources. "
B. The Grant Recipient must enter all events, exhibits and performances open to the
public and related to this grant award on the ExploreChapelHillARTS.com
website and display Orange County Arts Commission publicity materials
(postcards, brochures, etc.) prominently and consistently at their venue or
performance space. In addition, the Grant Recipient must add a link to the
www.artsorange.org (Orange County Arts Commission logo preferred) to their
main webpage.
7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the
Arts Commission and the North Carolina Arts Council and their officers and employees
from any and all claims or actual injury, damage or loss to a person, or real or personal
property that results from or is in any way connected to the use of the grant funds.
8. Independent Contractor. The Grant Recipient is an independent contractor and not an
employee, agent or other representative of the County and/or the Arts Commission.
Nothing contained in this Agreement shall be construed to create the relationship of
principal and agent, or employer and employee, between Grant Recipient and Arts
Commission or Orange County Government. Grant Recipient understands and agrees
that he/she is not authorized to incur any expenses or any liability whatsoever on behalf
of the County or the Arts Commission and has no authority, expressed or implied, to
obligate or make representations on behalf of the County or the Arts Commission. In
addition, Grant Recipient agrees to maintain his or her own worker's compensation
insurance for himself/herself and his or her employees for the duration of the art work's
installation.
9. Termination
A. In the event of any of the circumstances set forth below (hereinafter referred to as
"default"), the Arts Commission may immediately terminate this Agreement:
(i) Any fraudulent representation in any verification required to obtain
payment under this Agreement or other dishonesty on a material matter
relating to the performance of services under this Agreement.
(ii) Nonperformance, incomplete service or performance, or failure to
satisfactorily perform any part of the Project or to comply with any

provision of this Agreement, as determined by the Arts Commission in its
sole discretion.
(iii) Failure to adhere to the terms of applicable county, state or federal laws,
regulations, or stated public policy.
B. In the event of default by the Grant Recipient, the Arts Commission has the
discretion to elect to terminate this Agreement, in whole or in part and/or require
the Grant Recipient to repay the grant funds within seven (7) from written notice
of default or allow the grant recipient the opportunity to cure the default. This
clause shall not be interpreted to limit the County's or the Arts Commission's
remedies in law or in equity.
10. Miscellaneous.
A. Entire Agreement. This Agreement and the attachments contain the final and
entire understanding of the parties with respect to the subject matter of this
Agreement. All modifications and amendments to this Agreement shall be in
writing. This Agreement shall be binding upon the parties, their heirs, successors
and assigns.
B. Governing Law. Both parties agree that this Agreement shall be governed by the
laws of the State of North Carolina. Provider shall at all times remain in
compliance with all applicable local, state, and federal laws, rules, and regulations
including but not limited to all state and federal anti-discrimination laws, policies,
rules, and regulations and the Orange County Non-Discrimination Policy and
Orange County Living Wage Policy (each policy is incorporated herein by
reference and may be viewed at
http://www.orangecountync.gov/departments/purchasing_division/contracts.php).
Any violation of this requirement is a breach of this Agreement and County may
immediately terminate this Agreement without further obligation on the part of
the County. This paragraph is not intended to limit and does not limit the
definition of breach to discrimination. By executing this Agreement Provider
affirms that Provider is and shall remain in compliance with Article 2 of Chapter
64 of the North Carolina General Statutes. By executing this Agreement Provider
certifies that Provider has not been identified, and has not utilized the services of
any agent or subcontractor, on the list created by the State Treasurer pursuant to
G.S. 147-86.58.
C. Entire Agreement and Signatures. The parties have read this Agreement and agree
to be bound by all of its terms, and further agree that it constitutes the complete
and exclusive statement of the Agreement between the parties unless and until
modified in writing and signed by the parties. This Agreement together with any
amendments or modifications may be executed electronically. All electronic
signatures affixed hereto evidence the intent of the Parties to comply with Article
11A and Article 40 of North Carolina General Statute Chapter 66.

artist UNITED is a c011ective of,artists from the Triangle area joining together to voice a theme on limy humans treat each
other.The artist UNITED project, The Walls We Build„” will:raise awareness of how..peopie treat one other.14;1Q will
bring together galleries,MUM?LUTLS,schools,and artists to present their work,du„ring art walk events in Carrborn. Chapel
blill. Durham,and 14,illsborough„ with a goal to,also partner with Pittsboro,and Raleigh, in June 2018. This will allow for
prograinming on the',Find'Friday, Second Friday,.Ill ird Friday, and Last Friday art'walks, the Walls We Build" is

'Because the goal of this phiject is to help break down the,social„ economic,and political walls we builds it is imperative that
we include artists from diverse races,ethnicities, and cultural backgrounds. We anticipate including il wide range of voices,
including,African American, Latino, and inimigrant artists,as well as those,finom,diverse religious backgrounds;we seek to
also incluck established and up-and-coming artists as a way of also building bridges across age groups and levels of
accomplishment.In order to meet these goals, we will organize as series of acaandtahle discussions to engage the regional art
community and network to identify participating artists and venues, We are confident we will feature artists from diverse
backgrounds in the June 2018 activities, as this is an essential aspect of the project. We will evaluate our success by the
participation and attendance of a diverse group of artists and audience.
By partnering with nearby counties arid supported by a cross marketing campaign this project will bring greater attention
to the artists and venues in Orange County, as well as the diverse talents in our comniunity,The artist,UNITED piuject,
"The Walls We Build"will give an important voice to artists by bringing them to the table to address the divisions among

Katie Bowler'Young is a poet and author and is a community arts events organizer for programs such as the Louisiana.

at UNC-Cha,pel Hill and organizes inulticultural events in Chapel Hill and high-profile events around the world,

Field of Ice
Lake Saint John this morning is like a field of ice
with the sun caught in patches. I've lived between this lake
and a cotton field for two weeks. .:ut my husband
is back at work, near the city,Asking him not to go
only left me standing alone on an unfamiliar highway.
When [try to sleep,there's an old woman
in the kitchen again, talking to her husband
while she clears the kettle from the stove.
He's near the front door, adjusting his hat.
She wants him to come back in, but he just shouts
his goodbye, opens the front door. She wants
to give him a warning, but when she looks back
over her shoulder,there's all that water rushing in.
The only light in our city, my husband says,
is the light of fires burning in the night.
This morning I woke from the dream again,
walked to the edge of the field
to watch the early morning sky
turn the cotton baby blue. Here,
in Ferriday, uisiana, that barn out there
still watches over cotton.
Sunrise and the lake is like a field of ice with the sun
caught in patches.An egret slices rose-colored water
with one wing, like she just wanted to see
what would happen. Max perks up too, curious.
There's one soft line usbing across the surface,
Max scoots closer, puts his tail across my feet.
It's September 11_, 2005,
The world's been different such a long time,
and I just want to go home.
My coffee mug, on the ground
beside the swing, has had too long to cool.

Mom, Sophie says, the big wind took our house.
It'S still standing, reply,
but I it for hours in my backyard,
don't know what to do
about the fallen trees.
Maybe I should take a walk
to the highway to find a sign for help,
The highway is littered with spray-painted signs.
DRUNKS WITH GUNS
YOU LOOT, WE SHOOT!
Maybe l'd rather sit
and watch the wind blow dead branches.
I'll watch the crisp blue sky overhead,
that big blue smart-aleck sky.
Everything is so dry now it cracks.
Sticks and leaves. Sticks and leaves.
My porch is gone so I sit
where it used to be, Sophie opens
the front door,asks,Areyou reading
that poetry again?She sits down.
While I read passages out loud,
Sophie watches the sky.

Guessin the Direction of the Eye
Most of us want to believe in ythology,
or some kind of god with a preference for women
swimming in lakes.Or at least the patron saint of weather
less turbulent Somewhere nearby,
men put boats to hopeful anchor,and barges clang
like cymbals beneath ash-green clouds.
Even the trees sway like they know what's coming.
But these numb hands are just tying ladders to fences
again.Seasonal obligations keep the wrong objects
from flying.Once, when my mother and I drove home
from,Mississippi, we came over the bridge,
our city like a map of light beneath us.
Maim, she said, this is such a pretty city
to come home to. What's pretty becomes pretty
when Mother sys so. Men dangle in the air
holding electrical cords, stringing poles together
that broke in last week's tropical storm.
But today, a hurricane strengthens in the Gulf of Mexico,
stand still in the yard when birds ke flight.
My father hammers boards against the windows
again,hollers, for a handful of nails.
In the middle of a temporary calm,
a phone call from a friend who says,
Katie,there doesn't have to be such struggle.
I ask if he remembers the girl on a porch,
another child Eudora Welty turned into a photo,
as if this answers his questions about my marriage
ending a few months into another storm season.

I am Stephe Hawking and I want to know how our universe works
is what he said over dinner,his synthesizer a voiced map
of letters flashing.What could I possibly want
as much as Stephen wants? It's true I have never cared
What happens to objects that fall into black holes,
but Stephen wants me to think about how all objects change
once they slip over the horizon of a coll,,psing star,.
are never really gone.
I'd like to throw more useful objects
into black holes, like socks that lost their match,an ex-husband
perhaps, and the driver of a truck who led dozens of migrants
to the dark cavern of a trailer and barreled from Syria to Austria
to abandon them, That driver set those people
over a kind of black hole event horizon, turning them
from whole sets of information
into nothing but soulless bodies.
Where is he now,that driver? is he a solid set of atoms?
Carbon,hydrogen, nitrogen, phosphorus, calcium—oxygen?
Can these elements together make a man whole?
And what about the scientist at the end of the table,
the one who offered another explanation.
He held a sheet of paper
with its hand-written words,,
and said we could burn this page, its poem.
becoming photons rearranging in a smoke—
not lost but lifting, to an indecipherable
golden height in a starry night above.

I've often thought about Hardy Jackson,
whose story I heard about a decade ago.
I was 'watching an interview with a man whose son
had fallen from a cliff in a strong wind.
The boy was sixteen, but the wind didn't know.
Hearing about this boy and,his lather,,I was reminded
of the man whose story has lingered through the years,
my brother's version the only version
had ever known. Mikey first told me Hardy's story
while standing at the door, ry keys in his hand,
after pumping more gas, car after car
as the rations went low. Our town,back home,
a hundred miles away—was gone.
At the s my brother saw Hardy on the TV.
His face was crumpled like a sorrowful puzzle.
didn't know what to do but sit there 'watching his.face„
as though my watching might change the ending,
The reporter was broken by her own tears too,,
he said,and lost the rest of the story. He also said
Hardy's story started,like v iost,with a house,
though cracked in half by a tree—and that Hardy's wife
was all Hardy ever had I didn't know then,
like I don't know now,what ;Lardy must have felt
when his fingers went slack, that storm inside their home„
that storm and their child held tight,in one hand
when his wife was released from the other.

For years the trees had no one
to look over them.
ins followed by drought
followed by floods and other hardships
kept them alone in the cycle
of winter,spring, summer, fall.
Sometimes they shivered
while snow balanced on branches.
Cars drifted past, wide brims of light at night,
not even a glance,and the ground
was absorbed with its own issues
of sun or shade, rain or dew.
Finally from a nearby window came the faces
of two girls and their voices calling to the birds
who sang in the trees,the deer chewing leaves,
the rabbits and squirrels, Quiet, he quiet,
our mother's sick and she's sleeping,
Day after day their mother turned
toward the window—awakening.

After a top down view of the Statue of Liierty„
the plane flies low near rows if barbed wire„and a sliver
of the East h!iver gives way to the Bronx and Queens.
Suddenly, from the front of the jet, a child's appeal,
Look, look!she yells, and points toward the ground—
Where eyeless blocks of jails and narrow patches of grass
are surrounded by coastal rocks and imprisoning rails.
A sign!A sOnl she says, as we tilt toward the ground.
Around the sign, a painted line restrains a group of letters.
Welcome to New York! says the airport sign, Welcome!
says the sign, But ten thousand people are stored in jails below.
All with numbered names and numbered days
While I'm just one of hundreds wearing headphones
and passing overhead.And I'm going home.

Columbus Fountain,Washington, D.C.
In his 1912 monument to Christopher Columbus,
Lorado Zadoc Taft put a heaven-facing angel
between an icon for the Old World and an American
Indian. Like Columbus, they stand above pools
where water once flowed,where the homeless now sleep.
Columbus stands in front of II:ion Station, his back
to the terminal as though he's heralding the masses.
In these last hundred years, has he had time to reflect?
He's still standing above an Indian who's crouching on his knees.
There's paralysis in white marble and the marble grew stained.
And that angel,with her eyes closed—hovers! Now,
with whiter coming and its windy sting upon my cheeks,
there's the almost-whisper of Christopher Colum*us.
He says he feels Lorado's marks in his hand-chiseled clothes,
and regrets the darkened stains that are growing from his feet

Path
Down the road, a path through the woods
leads to graves where the tombstones are
too weathered to be read. !;eside the path,
a tree nu never know by genus or species,
its roots torn from the ground by a strong wind
years ago. Now its a mound over which the earth
has grown, upon which some vines have grown
in their own twisted way.
I like to think that some of our languages
will last, our words like rocks polished in tumblers.
And what of our children and their families?
And what of the people who will live here
decades from now?And why can't anything go on
in a man's heart that hasn't gone on
in a man's heart before?Years ago,
the Occaneechi lived on the land
we now call home. They too would have seen bottom
in a drought in a summer in which our rivulet
ran dry. I stand beside it now, in a year
in which water is too plentiful
to be sacred. The sun overhead casts a long shadow.
I stretch my arms and bend my knees.
Even my longest shadow disappears
when I walk amongst the trees.

savvy and those who aren't, 'between those who grew up in a digital landscape and th.ose who
continue to struggle with increasingly obsolete modes of comnutoleation, threatens to create a
permanent pa.rtition in our country that resembles the ancient division between landowners and
