PURPOSE: To review the proposed Supplemental Scope of Services for the Transfer of
Development Right (TDR) Feasibility Study and consider approval of an amended professional
services contract with the Louis Berger Group, Inc.
BACKGROUND: On June 23, 2004, the BOCC authorized staff to review consultants for a
TDR Feasibility Study. In December 2004, the Louis Berger Group/UNC-Charlotte Urban
Institute was selected and the contract approved on March 1, 2005, A TDR Task Force was
created and the consultant began their analysis.
The contract approved was for $39,100, and provided for:
• 6 staff meetings,
• 4 Task Force meetings, and
• 2 public meetings.
To date:
• 3 staff meetings have occurred, and
• All 4 Task Farce meetings have occurred, and a fifth meeting was added and held April 4
to stay on schedule.
However, the Task Force has requested further information and review regarding:
• Scenarios scoring models for the TDR sending and receiving areas,
Economic model development, and
• Assemblage of different policy options.
The staff and consultant are proposing a supplement to the TDR contract to accomplish the
goals of the Task Force.
This supplement would include:
• 2 additional Task Force Meetings (one of which was held on Apri14,)
Please note that staff anticipates the remaining public meetings, as part of the original contract,
are as follows:
1. One advisory board/public meeting to invite the following boards, commissions, task
forces and steering committees (to be held within the next month):
a. TDR Task Farce;
b, Efland-Mebane Small Area Plan Task Force;
c, Hillsborough-Orange County Strategic Growth Plan Steering Committee;
d, Orange County Planning Board;
e. Orange County Economic Development Commission;
f, Commission for the Environment;
g. Agriculture Preservation Board; and
h. Other interested boards, commissions, task forces, and/or steering committees,
2. One public meeting where BOCC will receive the final feasibility study (tentatively
scheduled for May 22 regular Quarterly Public Hearing as anon-Public, Hearing agenda
item, )
FINANCIAL IMPACT: The original quotation for the contract supplement was approximately
$15,000, but staff has negotiated the revision to not exceed $4,971,10, Funds to cover this are
proposed to come from the BOCC Contingency account,
RECOMMENDATION: The Manager recommends that the Board approve the Supplemental
Scope of Services from the Louis Berger Group, Inc, for:
A, Two additional TDR Task Force meetings and
B. Modification to the public meeting format to have an advisory board emphasis,

Dear Mr. Bowles (Glenn):
Please find attached our suggested scope of services and cost estimate for
Supplement No. 1 to our original contract. As stipulated in that contract, we are
adhering to the same service rates and overhead figures as those shown in the initial
contract.
The following are those items that are considered additional to the original scope of
services and that are indicated on the attached cost proposal:
o Two additional Task Force meetings;
a One meeting with the Efland-Mebane Task Force; and
o Digitizing five maps that are not readily available in GIS format from the County.
One task in the original scope of services, a Public Meeting, is suggested to be deleted
as a part of this modification The cost for that meeting is shown as a deduction in the
attached cost proposal. The Louis Berger Group, Inc, and the UNC-Charlotte Urban
Institute have also exceeded our scoping requirements in the numbers of internal staff
meetings/communications, newsletter provisions, and development of a project
website. We are not attempting to recoup any costs incurred on these additional items,
which we consider voluntary on our part to ensure the ultimate success of the project.
We appreciate the opportunity to continue to work with Orange County on this
important project, and are available to answer any questions that you may have
concerning this proposed Supplemental scope of services.

Subject: Suggestions regarding the proposed addendum to the TDR Feasibility
Study
The County's consultant on the TDR Feasibility Study has proposed to revise the existing
contract to deduct one public meeting, add two Task Force meetings, add one external
meeting, and perfornr additional digitized mapping. The proposed contract revision will
come to a total not to exceed $4,971.10.
The contract stipulates that the consultant shall
1. Conduct six Staff Meetings (SM), of which Four maybe via conference calls,
2. Conduct four Task Force (TF) meetings, and
3, Conduct two Public Meetings (PM).
