Map of Town of Chapel Hill's ETJ Expansion Proposal PURPOSE: To approve sending the Town of Chapel Hill a letter in support of the Town's proposal to move forward to a public hearing regarding extension of its ETJ over 184.9 acres of land in the northern portion of the town. BACKGROUND: Possible amendments to the Joint Planning Area were introduced to the Board of County Commissioners (BOCC) at a February 13, 2017 work session. Since February, Town of Chapel Hill staff introduced the possible amendments to the Town Council and the Mayor of Chapel Hill sent a letter to the County in July (see Attachment 1). The Town is interested in holding a public hearing on the proposed ETJ expansions (see map in Attachment 3). BOCC members may recall that the February work session introduction included an area encompassing 207.8 acres in the "southern triangle" of Orange County. There is interest on the part of the Town, per Town Council discussion, to jointly study this area to determine which portions may warrant changing the designation from Transition Area to Rural Buffer. However, because amending the "southern triangle" area would require a different process than extending the ETJ, it is not under consideration as part of the ETJ expansion request. Specifically, a change would have to be heard at a joint public hearing of Orange County and the Towns of Chapel Hill and Carrboro and must be approved by all three local governments. The action requested tonight is for the BOCC to approve sending the letter in Attachment 2 to the Town of Chapel Hill. This letter supports the Town moving forward to a public hearing on the ETJ expansions. Subsequent to the public hearing, if the Town is still interested in pursuing the ETJ expansion, the BOCC will be asked to adopt a formal resolution of support. As the letter in Attachment 2 acknowledges, amendments to the Water and Sewer Management, Planning, and Boundary Agreement (WASMPBA) would be necessary in order to serve the parcels in the Millhouse Road area with public water and sewer; this includes the 2 Mil!house Road Park parcel owned by Orange County. The 66 acres in the vicinity of Sunrise Road are already designated as "primary service area" on the WASMPBA map. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to this agenda item: • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND ENVIRONMENTAL POLICIES The fair treatment and meaningful involvement of people of all races, cultures, incomes and educational levels with respect to the development and enforcement of environmental laws, regulations, policies, and decisions. Fair treatment means that no group of people should bear a disproportionate share of the negative environmental consequences resulting from industrial, governmental and commercial operations or policies. FINANCIAL IMPACT: There is no financial impact to the County to send the letter of support to move forward to a public hearing, nor is there a direct financial impact if the Town extends its ETJ. RECOMMENDATION(S): The Manager recommends the Board approve sending the letter in Attachment 2 to the Town of Chapel Hill. Our request pertains to three assemblages of land, totaling 184.9 acres. The assemblages include property in the vicinity of Millhouse Road, property to the north of the Town of Chapel Hill's Operations Facility, and the northern Chapel Hill Transition Area. The areas in question are identical to those presented to the Board of Commissioners on February 13, 2017 for consideration as amendments to the Joint Planning Agreement. The Chapel Hill Town Council and I would appreciate the opportunity to engage in a dialogue , with the BOCC on this topic in the fall and have asked our Town Manager to coordinate next steps with the County Manager and her staff Thank you for your consideration of this request. Historically, I understand that the Board of Orange County Commissioners has provided initial feedback on these types of proposals prior to the Town's public hearing. The Board of Commissioners then takes official action following the public hearing and the Town's approval. I have asked staff to include this item in our agenda review process for a meeting in September. The County Manager has also asked staff to review any other land use or zoning issues that may be related to the expansion of the Town's ETJ such as adjustments to the water and sewer boundary. The Board of County Commissioners considered this topic at its September 5, 2017 meeting and the Board is in support of the Town moving forward on setting a public hearing for extension of the ETJ. Approximately 119 acres of this area, in the Millhouse Road vicinity, is currently outside of the Water and Sewer Management, Planning, and Boundary Agreement (WASMPBA) Primary Service Area. Staffs of the five signatory parties will be coordinating to determine a schedule for the governing bodies to consider amending the primary service area boundary to allow these acreages to be served by public water and sewer systems.
