PURPOSE: To consider making appointments and moving some positions on the Board of
Equalization and Review
BACKGROUND: The following information is for Board consideration:
• Appointment of two (2) regular members from the list of appointed Alternates and one (1)
additional alternate to the Board of Equalization and Review. BOCC TO DESIGNATE
CHAIR FROM THE LIST OF APPOINTED REGULAR MEMBERS.

TRAINING FOR BOARD MEMBERS:
The Tax office provides the following training each year to all E&R appointees:
• Staff reviews the comprehensive handbook provided by the NC Department of Revenue
that discusses Board of E&R responsibilities.

Proposed Addition to the 03/28/2017 Agenda
• In 2015 the School of Government started providing a 1.5 hour webinar that the Tax
office in turn provided to Board of E&R members. The webinar is still available to the Tax
office.
• At the E&R organizational meeting each year, the Tax office invites all members of the
E&R Board and staff is available to answer any questions they may have.
• New appointees receive the same training as seasoned members, and the training
session this year may be longer due to the increased number of appeals due to the
revaluation. By statute, Dwane Brinson serves as Clerk to the Board of E&R. The Board
of E&R hears evidence presented by both parties and adjudicates.
• The County Attorney office is available for any additional training, to answer questions,
etc.
PUBLIC SERVICE ANNOUNCEMENTS: have been sent out periodically since last Fall in an
effort to recruit new applicants.
FINANCIAL IMPACT: Each member will be paid $75.00 per meeting attended, and the Chair
will be paid $100.00 per meeting attended. The funds.are included in the Tax Administrators
budget.
SOCIAL JUSTICE IMPACT: Enable Full Civic Participation. Ensure that Orange County
residents are able to engage government through voting and volunteering by eliminating
disparities in participation and barriers to participation.
RECOMMENDATION(S): The Manager recommends that the Board consider making 10
appointments to the Board of Equalization and Review.

Alphin in Raleigh. In both positions, my practice is almost entirely real estate,including title work
and quasi-judicial proceedings.
What unique perspective can you bring to the Orange County Board of Adjustment?
As a real estate and land use attorney, I have represented both builders and developers seeking
variances and environmental groups opposing them.
What do you see as the responsibilities of this board,and what do you hope to
accomplish if appointed?
The primary responsibility of the board is to apply the appropriate ordinances to determine if
applicants have met presented appropriate evidence for their application to be granted. But in
the larger sense, I see Boards of Adjustment as akin to the old Courts of Equity.they provide
equitable relief from the strict letter of the development ordinance for uses that are non-
conforming in a minor way.They also serve the general principal that landowners should be free
to use their property as long as their use does not adversely impact their neighbors or the
community.
What do you consider to be be the most important issues facing Orange County related
to growth?
Allowing growth and development in a responsible way while avoiding sprawl. Orange County is
a desirable place to live and is positioned for extensive growth whether it wants it or not.The key
is to control that growth in a beneficial way without cutting it off entirely.
What role should the Board of Adjustment take in guiding and regulating growth?
This begins with the specific ordinances governing the various permits and variances,which
must be followed. But for matters within its discretion,the Board of Adjustment should guide
growth by approving land use when possible, but only if it does not adversely impact other
residents and the community.
How would you,as a member of the Planning Board,contribute to the implementation of
the Board of Commissioners'adopted Goals and Priorities?
By granting approvals where they are warranted and denying them where they are not, I would
support the policies of the Board of Commissioners as expressed in the LIDO and other related
ordinances.

Nearly all of my professional real estate career has been in Orange County with some in
Chatham and Durham counties.
In addition to the experience listed in the question above, please list the work/volunteer
experience/qualifications that would add to your expertise for this board.
Know the Orange County area thoroughly. Know the subdivisions, roads, locations of most
streets.Am able to run and organize a business.
What do you see as the responsibilities of this board,and what do you hope to
accomplish if appointed?
It is to be sure that the taxpayer/property owner is equitably and fairly assessed for his equitable
contribution to the tax revenues for the county. To assure that his dwelling is accurately
represented to the tax office so that is can be fairly assessed. In the event that he/she is being
inappropriately assessed or if there is an error in the data on file, It give the opportunity to prove
this.

It makes good use of my skills. Now that I work part time rather than full time, I can offer my
expertise and time to serve the county I have lived in since 1981.

Work Experience: Davis Appraisal Services (self-employed). 16 years of experience as a
Real Estate Appraiser with work done primarily in Orange County, North Carolina. Have
also done work as an appraiser in Durham and Chatham County. Have held a real
estate Brokers license since 1981. Was a full time real estate agent from1982 - 1985.
Have sold some propeerty since then on a limited basis. Own and manage some rental
property.
Volunteer Experience: Have served on the appraisal committee for the Chapel Hill Board
of Realtors. Volunteer 2 nights a month at the homeless shelter in Chapel Hill (since Jan.
2001). Have served on the E&R Board. In 2012 as an alternate, in 2011 as a member
on a few other years prior to that.
Education: High School Diploma. 1 1/2 years of liberal arts study at 4 year college in
NYS, 2 Year Associates Degree in Real Estate (from a technical school), graduate of The '
Realtors Institute (GRI), have taken many appraisal courses over the years for continuing

Other Comments:
I have personally inspected and appraised over 6,000 properties in this area and
reviewed many other appraisals for banks and attorneys. I know Orange County
residential property very well and would appreciate the opportunity to serve on this
board. John Smith called and requested that I consider applying for this position.
