BACKGROUND: The Board of County Commissioners, at their February 7, 2017 regular meeting, formally appointed Dr. Rosalind Barber to a partial term, in Position # 8, the At-Large Citizen/Commissioner position, though the Board of Health had submitted their recommendation for Ms. Johanna Birkmayer, for this position. This was discussed further at the Board of County Commissioners' February 21, 2017 regular meeting and the direction given by the Board was for the Chair to write a letter to Dr. Barber reiterating the circumstances surrounding this appointment and asking for her resignation. As of March 17th, there was no response back from Dr. Barber. Chair Dorosin then asked the Clerk to the Board to contact Dr. Barber asking whether or not she received the letter and to ask her if she was still interested in serving, upon which Dr. Barber indicated that she did receive the letter and yes, she was still interested in serving on the Board of Health. County Attorney John Roberts has indicated that the Board may consider two options as relates to the BOH appointment: • One option is to inform Dr. Barber that she has been appointed and notify her when the next BOH meeting is that she should attend. • Another option is the Board may revisit this at their next meeting (21S) and upon making appropriate findings, rescind the motion to appoint her and follow that up with appointing someone else. The findings may be as follows: PROPOSED ADDITION TO THE AGENDA AS ITEM- I I-F o The Board was unaware of the existence of the Board of Health bylaws that prohibit the appointment of former health department employees to the Board of Health; o The Board acknowledges that the bylaws are not binding upon the Board's appointment process; o The Board, however, desires to remain in compliance with the bylaws to avoid any unnecessary conflicts among Board of Health members or between Board of Health members and the health department and its employees; o Dr. Barber has not taken the oath of office associated with membership on the Board of Health or assumed any duties related to such membership and has therefore not officially been appointed to that board; o For these reasons the original appointment of Dr. Barber to the Board of Health is rescinded. During the County Attorney's research on this issue and these options a professor at the School of Government opined that provisions of the Board of Health's bylaws that have the appearance of conflicting with state law should be amended. The County Attorney has recommended to the Interim Health Director that the bylaws regarding the appointment process be amended to include a specific statement that they are advisory in nature and do not govern the Board of Commissioners' ultimate appointment authority. I have a Masters in Public Health from the Department of Health Behavior at the UNC Gillings School of Global Public Health and a PhD in Health Policy from Harvard University. My work experience has spanned public health topics and projects, domestically and globally, with direct relevance to health issues facing residents of Orange County, North Carolina. I have worked as an evaluator for a county health organization conducting community assessments and evaluating health services, mental health and health promotion programs; directed federal technical assistance projects to assist State substance abuse prevention agencies design evidence-based prevention policies and program; and directed an analytical support contract to monitor State compliance with the SYNAR program, a Federal performance system requiring all States to reduce youth access to tobacco products. Globally, I have designed community health assessments, collaborating with local leaders to interpret and use results to design community health programs and designed, implemented and evaluated vaccination, malaria and diarrheal disease programs. Over the last 8 years I have focused extensively on tobacco control policy. Before moving to North Carolina, I was the research director for a DC based advocacy organization and provided assistance to civil society organizations in low-and middle-income countries to use data and evidence to advocate for effective tobacco control policies. Currently, I Page 2 of 2 Johanna Birckmayer am coordinating the work of multiple international organizations funded through the Bloomberg Philanthropy to support the enactment of effective tobacco tax policies to reduce tobacco use, again in low-and middle-income countries. In alignment with the Boards€TMs current focus on substance abuse, I would bring to the Board a deep commitment and extensive technical knowledge and experience in the policy options available to communities to reduce the negative impacts on families and the community affected by substance abuse, including tobacco, alcohol, and illicit drugs. I have evaluated substance abuse programs,conducted research on the impact of alcohol, illicit drugs and tobacco policies, designed tools to assist local communities assess substance abuse issues, conducted reviews of best practices, provided technical assistance on best practices to governments and trained civil society groups to advocate for effective public health policies. My policy interest and expertise is directly applicable to other priority issues for the current Board, including food policy, physical activity, and mental health, among others. From experience, I know that the potential of policies to improve population-level health are often hard for both the public and policy makers to understand and thus support. I would bring the Board a grounded understanding of the positive impacts and a great deal of experience communicating and promoting the importance of such policies. My work experience spans cultures, languages, and political systems in the United States and globally. I would bring this experience and a sincere commitment to understanding and improving the health of all persons in Orange County. Reasons for wanting to serve on this board: I moved with my family to Orange County in 2015, and we plan to make North Carolina our long- term home.
