Benedict, Planning & Inspections Director, 919-245-2592 John Roberts, Staff Attorney, 919-245- 2318 Travis Myren, Deputy County Manager, 919-245-2308 PURPOSE: To rescind approval of and void the interlocal agreement with the Town of Hillsborough that sets forth conditions of utility installation and operation with associated land use consistency with prior cooperative planning efforts; and authorize the County Manager, County Attorney, and staff to continue to negotiate the interlocal agreement with the Town of Hillsborough over the summer break and present a new proposed agreement for consideration at a future Board meeting. BACKGROUND: Orange County and the Town of Hillsborough have been coordinating planning efforts around the common interest land fringes of the Town of Hillsborough since 2002. These efforts led to more a formalized 2007 acceptance of an area `Strategic Growth Plan' and the pursuit of an interlocal agreement that proposed additional implementation steps by both local governments. The Interlocal Agreement between Orange County and the Town of Hillsborough for construction and operation of water and sewer facilities in the Hillsborough Area Economic Development District of Orange County was presented and approved at the May 2, 2017 Board of County Commissioners meeting. Following this meeting, the attorney for the Town of Hillsborough suggested some modifications to the agreement adopted by the BOCC on May 2. The attorney for the Town and Town staff are also still reviewing the document in whole and the Town of Hillsborough Board of Commissioners has not approved or signed the agreement. For this reason the County Attorney is recommending the County Board of Commissioners rescind the May 2, 2017 approval of and void the interlocal agreement with the Town of Hillsborough, with the plan that the County Manager, County Attorney, and staff will continue negotiating the interlocal 2 agreement over the summer break and present a new proposed agreement at a future Board meeting. FINANCIAL IMPACT: There is no financial impact associated with the rescinding the Board's approval of the May 2, 2017 version of the agreement. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice goal is applicable to this item: • GOAL: ENSURE ECONOMIC SELF—SUFFICIENCY The creation and preservation of infrastructure, policies, programs and funding necessary for residents to provide shelter, food, clothing and medical care for themselves and dependents. RECOMMENDATION(S): The Manager recommends the Board: 1. Rescind the May 2, 2017 approval of the draft interlocal agreement and authorization to execute the agreement; and 2. Authorize the County Manager, County Attorney, and staff to continue to negotiate the interlocal agreement with the Town of Hillsborough over the summer break and present a new proposed agreement for consideration at a future Board meeting.
