Petition Letter & Secondary Road Addition Investigation Reports far: Creek Wood Dr. Creek Run Court Creek Ridge Lane INFORMATION CONTACT: Karen Lincoln, 245-2594 PURPOSE: To consider a petition to add subdivision roads in Creek Wood subdivision to the State Maintained Secondary Road System. BACKGROUND: The developer of Creek Wood subdivision has petitioned the North Carolina Department of Transportation (NCDOT) to accept maintenance responsibilities for Creek Woad Drive (25 homes), Greek Run Court, formerly "Creek Run", (6 homes) and Creek Ridge Lane, formerly "Wood Ridge Lane", (15 homes). Creek Waod subdivision is located off the west side of Turkey Farm Road in Chapel Hill Township. The Orange County Board of Commissioners approved the preliminary plat for Creek Woad subdivision in March 1999, stipulating in its resolution of approval that "All roads shall be irrevocably dedicated to the general public and be constructed to the standards of the North Carolina Department of Transportation" and that "approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Creek Woad Drive, Creek Run, Woad Ridge Lane, Bridgeton Drive and Forest Creek Road .. without maintenance responsibility." The resolution further states that the owner/applicant shall maintain those roads "until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body." Bridgeton Place (formerly Bridgeton Drive) and Forest Creek Road currently lack the required density of at least two (2) occupied homes for each one-tenth of a mile, or a minimum of four occupied homes for roads less than two-tenths of a mile in length to be accepted by the NCDOT for maintenance. NCDOT has investigated the request (please refer to attached Secondary Road Addition Report), and has submitted the petition to the Board of Commissioners for its review and 2 recommendation. In accordance with North Carolina General Stattate §136-62' the Board must take an administrative action to make a recommendation regarding the petition to the North Carolina Board of Transportation before the NCDOT can take action on the petition. FINANCIAL IMPACT: There is no direct financial impact of this action, RECOMMENDATION(S): The Manager recommends that the Board receive the Petition for Addition for Creek Woad Drive, Creek Run Court, and Creek Ridge Lane, and recommend that the NCBOT add those subdivision roads to the State Maintained System, "North Carolina General Statute § i 36-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations..."
