HomeMy WebLinkAboutAgenda - 03-02-2006-5iORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: March 2, 2006 Action Agenda Item No. 5-; SUBJECT: Contract with Orange County Speedway -Emergency Medical Support Services DEPARTMENT: Emergency Management PUBLIC HEARING: (Y/N) No ATTACHMENT(S): INFORMATION CONTACT: Contract Jack Ball or Mike Tapp, 919-644-3030 PURPOSE: To approve a contract with Orange County Raceway (OCR), Inc, to provide EMS coverage at events and races at the Orange County Speedway during 2006, BACKGROUND: For many years, Orange County has contracted with the owners of the Orange County Speedway to provide EMS coverage at races and related events. In 2005, the property underwent a change of ownership. Mr. Vance Agee was introduced by the Economic Development Director at the October 18, 2005 Board of Commissioner meeting as the new partner/Operations Manager of the Orange County Speedway. Mr. Agee has been meeting with the County Fire Marshal, Building Inspector, Emergency Management Deputy Director, and the Orange County Sheriff's Department to ensure that his facility will meet the safety requirements of the North Carolina Statute governing this type of operation, Mr. Agee has committed to following the requirements and has expended time, funding, and energy in preparing for the racing season. There are approximately 20 races scheduled for the 2006 season, The coverage staff consist of two ambulances, two paramedics, and two emergency medical technicians at each race.. The ambulances are staffed with either County EMTs or Rescue Squad members, and the paramedics are County staff. The charge rates for this coverage are based on actual overtime cast plus equipment rate. The charges are $75 per hour far a Paramedic vehicle, $30 per hour for an ambulance with paramedic, $30 per hour for each EMT needed, and a 1 hour travel charge per vehicle, Races are to begin March 11th, 2006, FINANCIAL IMPACT: The rates charged will fully cover the County's direct and indirect costs for personnel and vehicle use and no other impacts are anticipated. RECOMMENDATION(S): The Manager recommends that the Board approve the contract and authorize the Chair to sign it, subject to final review by staff and the County Attorney, a STATE OF NORTFI CAROLINA ORANGE COUNTY This Contract dated ,between (the "Speedway") and the County of Orange (the "County") for,joint and cooperative arrangements for the provision of emergency medical services at certain Speedway events. WITNESSETII WHEREAS, the County and the Speedway propose to worlc,jointly on matters of concern or interest; and WHEREAS, certain events at the Speedway bring spectators to Orange County to enjoy the events; and WHEREAS, the provision of adequate ewer°gency medical care at such events is a matter of mutual concern and interest to the Speedway and the County; and WHEREAS, detailed,joint and cooperative arrangements with respect to such events will nnrtually benef t the Speedway and the County; and WHEREAS, the County and the Speedway desire to provide such cooperative emergency medical care; NOW THEREFORE, in consideration of the premises and the mutual covenants and conditions set forth below, the Comity and the Speedway agree as follows: The County agrees to provide emergency care providers certified at the Emergency Medica] Technician and/or Paramedic level for events at the Speedway as outlined in the Orange County Speedway 2006 Sehedrrle. (Attaclunent A) 2. The County agrees to provide two (2) ambulances, two (2) paramedics with 3 equipment, and two (2) Emergency Medical Technicians for scheduled spectator events. Additional coverage will he negotiated at the time of need, based upon anticipated attenduree, at the general rate of one (1) additional EMT per each five thousand (5000) spectators above ten thousand (10,000) base spectators. Alternately, the County agrees to provide two (2) paramedics with equipment for the provision of Advanced Life Support (ALS) Dare in conjunction with other private Basic Life Support (BLS) EMS resources hired by the Speedway to provide coverage at Speedway events in lieu of County EMS. 3. The County agrees Co ]seep records of patients seen at the Speedway while covering Speedway events under° this conk°act and, with the consent of the patient, to provide such records to the Speedway, upon its request. Data available to the County firom the records of patients seen at the Speedway which is clearly not patient identifying maybe provided to the extent authorized by HIPPA to the Speedway, upon request of the Speedway and when appropriate. 4. The Speedway shall compensate the County for emergency medical services provided pursuant to this contract by paying to the County a sum based on a rate of $75.00 per hour per paramedic with equipment, $30.00 per' hour per ambulance, and $.30.00 per hour per each EMT for each event covered. These hours will include preparation and travel time of one (1) hour for each event plus the coverage time per event.. The county shall submit an invoice for these events within 14 calendar days of the event and payment by the Speedway shall be made within 14 calendar days of the invoice date to the order of the County and mailed to Orange County Department of Revenue , P. O. Box 8181, Hillsborough, NC 27278. The personnel providing the emergency medical services shall report to the Speedway at the time agreed upon by the Speedway and the County. The personnel providing emergency medical services under this contract will operate as employees of the County, not the Speedway, and will exclusively provide medical assessment and care as delineated by the Orange County Medical Director and Orange County. The Speedway shall purchase and maintain from an insurance company acceptable to the County, insurance with the following limits of liability: a. Comps°ehensive General Liability fiisurance -Comprehensive General Liability Insurance shall be carried in the following amounts: One Million Dollars ($1,000,000) bodily injury each person, One Million Dollars ($1,000,000) property damage. The County shall be an additional named insured on the General Liability Insurance Policy secured by the Speedway, and the Speedway shall provide appropriate documentation of this status to the County. 6. The coati act maybe reviewed anmially no later than .Ianuacy 1, and maybe renewed, modified, or amended at that time, or at any other time, upon the mutual written agreement of the parties. This contract may be terminated at any time by either party by giving 90 days notice to the other party in writing. If either party defaults in its obligations including remitting timely payments and does not cure such default within ten (10) days ofreceipt of notice of such default, the non-defaulting party may immediately terminate the conh~act. 5 IN WITNESS WHEREOF, the parties hereto have duly and validly authorized and executed this contract as of this day of , 2006.
