REPORT--SOCIAL SERVICES MANDATED SERVICES ti 1 (lc MINUTES JANUARY 18, 1983 The Orange County Board of Commissioners met in regular session on Tuesday, January 18, 1983, at 7:30 P.M. in the Courtroom of the Old Post Office Building in Chapel Hill, North Carolina. Commissioners present: Chairman Richard E. Whitted and Commissioners Ben Lloyd, Shirley E. Marshall, Norman Walker and Don Willhoit. A. BOARD COMMENTS Commissioner Whitted added two items to the agenda, both dealing with pro- posed local legislation. Commissioner Lloyd announced that a local newspaper had incorrectly reported his comments on meeting once a month in Chapel Hill; he said he is in favor of meeting in Chapel Hill. 3. AUDIENCE COMMENTS Commissioner Whitted said that he knew there were several people in the audience who wished to address the Board about items on the agenda and they would be given that opportunity during the course of the evening. Chapel Hill Councilmember Jonathan Howes welcomed the Commissioners to Chapel Hill on behalf of the Council; Chapel Hill-Carrboro Chamber of Commerce President John Morgan welcomed the Commissioners to Chapel Hill on behalf of the Chamber. C. PUBLIC HEARING: PRELIMINARY ASSESSMENT ROLLS--MACE ROAD AND DUMONT DRIVE PARTICIPATORY PAVING MACE ROAD: Ms. Susan Smith, Planning Department, told the Board that all participants were in favor of the project for Mace Road. Commissioner 'Willhoit moved, seconded by Commissioner Marshall, approval of the Final Assessment Roll for Mace Road Participatory Paving at 7:36 P.M. Vote: Ayes, 5; noes, O. (All documents relating to the Assessment Roll for Mace Road may be found on pagesJ‘,$'31,71 of this book.) DUMONT DRIVE: Ms. Smith made two corrections in the Assessment Roll for Dumont Drive. The first is an error in the names of Jack Patterson by and Gladys C. Loy who are listed as Jake Patterson Loy and Gladys Patterson on the Assessment Roll as prepared from the Tax Listing. The second is an error on the tax maps of one of the lots owned by Mr. John H. McInnis showing 1001rapre than actually exists on Mr.Mclnniss plat. Ms. Smith said the County Commissioners could do one of two things regarding this error: 1) readvertise and reassess the ind- 1 04 ividual property owners, or, 2) the County could absorb the cost of the error. Ms. Smith said the County Attorney said it would cost approximately $195.00 to readvertise plus attorney's fees and staff time. The error is approximately $195.00 also. Commissioner dillhoit moved, seconded by Commissioner Marshall, to confirm the Final Assessment Roll for Dumont Drive as corrected at 7:40 P.M. and for the County to absorb the cost of the error on Mr. McInnis' property. BOARD DECISIONS, D-3 SEVEN SPRINGS ROAD ADDITION Commissioner Walker moved, seconded by Comrnissionar Lloyd, the addition of Seven Springs Road in Seven Springs Subdivision to the State maintained secondary road System. Vote: Ayes, 5; noes, O. D-4 COMPLAINTS RE: WILD AND VICIOUS ANIMALS The Board chose to listen to citizens' comments prior to discussion of this issue among themselves. Mr. Bill Sheffield, an attorney: Said that he was representing a number of people from both Duke University and UNC who owned small animals called servals. He said the Board had several options: 1) do nothing--he advises against that option; 2) flat prohibition--he feels this option is "unwise"; 3) adopt an Ordinance regulating wildlife--he feels this is most appropriate, Mr. Sheffield passed copies to the Board of an Ordinance regulating wild animals which he helped draft. He said the unique quality to this ordinance was its classification system of animals. He urged the Board to consider this proposed ordinance closely. Ms. Lode Stephenson, a resident near an animal compound: Spoke asking that an ordinance be adopted which prohibits such wild animals /leopards, tigers, bears, etc. within Orange County. She presented a petition to the Commissioners from people in her neighborhood who supported such a prohibition. /That petition is on permanent file in the Office of the Clerk to the Board.? Ms. Stephenson cited safety concerns for adults and particularly children should such exotic animals escape. She added that she was concerned for the animals' safety too, as, in con- versation with Dr. Richard Kelly of the USDA in Raleigh, she learned that the com- pound off NC 86 does not meet minimum requirements for such enclosures. 1 ;'. r.4JL Mr. Jack Griffith, UNC Staff and County resident: Urged the Board to consider an ordinance of the type presented by Mr. Sheffield which claosifies animals. He said such an ordinance provided protection for citizens and personal freedom for individuals who wished to keep such animals; an example he gave was keeping the animals for research purposes. He said he does keep servals for researc and described his enclosure for the animals. Mr. Griffith cited the unique aspects of the Research Triangle Park, climate, professional researchers and yet still rural , r which made it attractive to those doing such animal research. Mr. Griffith summed , up his statement by saying that adoption of an ordinance such as Mr. Sheffield's , would: 1) protect the public; 2) protect the animals; and, 3) provide a humane , environment for the animals. Mr. Paul Modrich and Ms, Vickers Burdette, a husband and wife who live in , Orange County and are on Duke's Staff: Both urged a rational approach to animal , control . They own servals. They urged the classification approach to exotic animal , control . Mr. Tim Greene, Orange County resident and owner of several exotic animals: , Said he wished to clarify that the animals belong to him personally, and are not in , any way connected with Greene Valley Kennels. He maintains that his animals are , properly enclosed however, he said he planned to put up a fence. Mr. Greene invited , the Commissioners to visit his animals. He said the USDA had refused him accredition , for two reasons: 1) fecal discharge; and, 2) a mudhole that existed when the inspector , visited. Mr. Greene described his enclosures and reiterated the safety of such • enclosures. He urged a "reasonable" ordinance and said he is opposed to banning , exotic animals from the County. Ms. Patrice Solberg, an attorney representing residents near Mr. Greene's property, including herself: Cited the series of events which led to several of , the exotic animals being moved from Chatham County to Orange County. She continued , that cows had miscarried in Chatham County, due, presumably to the lions making noise; , and, that one cow had been killed while the leopards were loose in Chatham County. • She added that there were no eyewitnesses to the killing but the cow's owner had , said its back was slashed open. She said the risk to human life was not worth taking • and asked for a total ban on exotic animas in Orange County under the authority • granted the Board by G,S. 153-A Article 6. Ms. Solberg said Ms, Sue Pressman, • of the Humane Society of America and the American Veterinary Association both , • recommended a ban on private ownership of these types of animals. Mr. Wilson McKerrow, Chapel Hill resident: Said that he was a member of the Board of Directors of the National Humane Association for eighteen years and it is ' not in the interest of either the public or the animals that such animals be kept in • confinement such as he had heard described tonight. He urged the Board consider an ordinance for protection of the public and the neighborhood, Ms. Karla Ball, County resident: Cited an obligation to "these rare animals" and called for a responsible County ordinance which set reasonable standards for keeping exotic animals. She asked that they not be banned from the County. Mr. Olin Doar, County resident: Said he worked at Green Valley Farms where his wife is a partner. Green Valley Farms is, he emphasized, a dog and domestic cat boarding and breeding facility only; no exotic animals are kept there, He added that Ms. Sue Pressman had helped Mr. Green obtain his first leopard in Virginia where the Greens had gone to an animal auction. Mr, Green was interested in the leopard and Ms. Pressman told him there was a question as to whether or not this "was a free and legal ' cat" due to its having been purchased in North Carolina and taken without a permit to • Virginia. With Ms, Pressman's help the Greens bought the leopard legally and returned to North Carolina without a permit, The USDA discovered this via the press which reported it, A representative of the USDA visited the Greens and eventually "con- fiscated that animal on our property for the leopard's life, until it died." He said . the leopard belongs to Tim Green and is on his property now. Mr. Doer added that ' they had been unable to give the cat to any zoo because the zoos were unwilling to , accept it, Ms. Jacquline Moredoch, Curator at the NC Museum of Life and Science and Orange County resident: Said the public was not well educated about exotic animals • and that indiscriminate breeding of such animals needed to be controlled. She said she owned a cat and doesn't think they should be banned. • Commissioner Whitted asked Ms. Moredoch how, if private ownership were per- • mitted, breeding could be controlled. Ms. Moredoch said the owners would have to • come to an agreement regarding that. Commissioner Lloyd asked if the animals could be kept without endangering the public, Ms. Moredoch replied that the Museum was able to do so adding that housing requirements should be very strict. Commissioner Marshall asked who provided the license and inspection for the Museum and Ms. Moredoch replied the Fish and Wildlife Service inspected every six weeks. She continued replying to Commissioner Walker that the Fish and Wildlife Service had no jurisdiction over Mr. Greene as he is a private individual . Mr, Sheffield said that the servals were particularly selected for their . genetic makeup and that most zoos don't want genetically unknown cats. He con- . tinued that devices were implanted in the females to prevent conception and removed if a zoo wished to breed the animals. Mr. Greene: Replied that the tigers from Pittsboro were particularly selected for genetic content, He continued that the animals were very rare and we should do something to preserve them. He contended that the bears had not escaped from their enclosure, but from leashes; he said the tigers had been frightened by a helicopter which landed near their cage and escaped then. He said that Dr. Bleyman had tranquilized the animals by hand even though "they are wild and vicious animals." Mr. Bruce Gay, a neighbor of Ms. Stephenson's: Cited safety concerns for his family. He noted that he was present when the bears escaped and said the keepers "scratched their heads" and wandered what to do. Mr. Greene: Replied that the bears would be gone in six months. Mr. Whitford, a geneticist and researcher: Urged serious consideration of the ordinance proposed by Mr, Sheffield, noting that the classification system for different animals distinguished between those animals which are dangerous to human beings and those which normally are not by specifying different confinement requirements, As a geneticist he noted the importance of preserving animals for research and said he felt that the private, well-informed individual could do a better job breeding animals than zoos. There were no other citizens who wished to speak on this matter and Board discussion ensued. Enforcement of any proposed ordinance, the Board agreed, • appeared to be a major problem. Commissioner Marshall moved, seconded by Commissioner Willhoit, to refer • all ordinances provided in the agenda packet and those presented by Ms, Solberg and Mr. Sheffield to the Manager and County Attorney; enforcement questions as well as fiscal impact are to be included in the Manager's report. Vote: Ayes, 5; noes, 0. • Mr. Bleyman, an animal owner from Chatham County, said that most people will • comply with an animal control ordinance but that he foresaw the possibility that those people who own poisonous reptiles would be driven underground. • Following this vote the Commissioners took a five minute break. Commissioner Walker left the meeting during the break and did not return. • D-5 SECTION 8 HOUSING CONTRACT The County Manager reviewed the contract with the Board of Commissioners. Commissioner Marshall moved, seconded by Commissioner Willhoit, to approve the contract. Vote: Ayes, 4; noes, 0. D-6 AUDIT CONTRACT Commissioner Willhoit moved, seconded by Commissioner Marshall , to approve the audit contract for 1982-83 to Touche Ross and Company, for the County audit. Vote: Ayes, 4; noes, 0. 0-7 BUDGET AMENDMENT Commissioner Willhoit moved, seconded by Commissioner Marshall , to approve the budget amendments as recommended by the Manager. Vote: Ayes, 4; noes, O. (See page 41O11 of this book`for those amendments.) 0-8 HOUSING REHAB AWARDS, Commissioner Marshall moved, seconded by Commissioner Whitted, to award the rehabilitation contracts to Taylor Home Improvement for units 29 and 29A ($8,010.00 and $8,115.00 respectively) and to Eugene Morrow for unit 35 for $7,148.00. Vote: Ayes, 4; noes, 0. (For complete bid results see pages W di of this book.) 0-9 FEBRUARY MEETING SCHEDULE Commissioner Lloyd moved, seconded by Commissioner Willhoit, to cancel the fourth Monday meeting in February (February 28). Vote: Ayes, 4; noes, 0, Commissioner Whitted announced that the Manager had a tentative date for a joint meeting with the two Boards of Education; this meeting is a follow up meeting to the October 7, 1982, where capital needs were discussed. The Manager announced February 14th as the recommended date. Commissioner Willhoit moved, seconded by Commissioner Lloyd, to schedule a joint meeting with the Chapel Hill- Carrboro and Orange County Boards of Education to discuss capital needs budgeting. Vote: Ayes, 4; noes, 0. E.. SOCIAL SERVICES REPORT Mr. Tom Ward, Social Services Director, presented a report on the Child Protective Services and Adult Protective Services showing the impact on meeting the mandated services of the 0S5 of the additionally-funded personnel °in the Protective Services program; statistics indicate that now the time mandates usually can be met and indicate that the increase in the percentage of neglect over abuse cases may be due to the earlier intervention possible with the increased workers. OSS, now meeting mandated schedules in Child Protective Services is much closer to meeting them in Adult Protective Services where there is an increased demand for services. Ms. Janice Schopler, Chair of the Social Services Board, said that morale in the department has improved due to the increase in workers and everyone is doing a better job. 0-10 PARCEL IDENTIFICATION NUMBER INDEX--Added Item Commissioner Willhoit moved, seconded by Commissioner Marshall, to approve the Register of Deeds' request that we ask our local legislators to introduce a bill enabling Orange County to institute the PIN prior to July 1, 1983, Vote: Ayes, 4; noes, 0, D-ll ONE STOP ABSENTEE VOTING--Added Item Commissioner Whitted said he had received a letter from Representative Barnes wherein she proposed legislation to permit establishment of a branch voter registration office in Chapel Hill if the Board so desired, Commissioner Willhoit moved, seconded by Commissioner Marshall, to request this legislation of our delegation for Orange County. NEED: Various citizens have raised concerns over wild non-domestic, or vicious domestic animals being harbored in the County. The concern is that they are dangerous to persons or property or have the potential of being dangerous to persons or property. Looking just to the recent past, several incidents can be noted. In October complaints were reported over the escape of a bear from a kennel , located near Chapel Hill. In December, the Health Denartment investigated an incident where a pit bull dog had escaped the owners property near • Hillsborough and attacked an 18 month old boy inflicting life-threatening injury. In January a boa constrictor escaped its owner in an apartment complex in Chapel Hill . All of these incidents point out insufficient attention by the owners as to what is necessary for security of confine- ment and proper care. The question is whether Board action is necessary to insure health, safety and welfare measures for the public's protection. Present local laws (zoning ordinance, animal control ordinance) do not address these types of animals. The State Uildlife Commission rules only apply to animals which are indigenous to the area. The U.S. Department of Agriculture's regulation apply only to persons interested in securing licenses as a dealer or exhibitor of exotic animals. They do not apply to people who might contend the animals are being kept as personal pets. In regard to kennels, USDA only inspects once a year. It's response time would be slow in dealing with animal escapes or allegations of inhumane treatment. If Board action is deemed necessary the General Statutes of North Carolina authorize boards of county commissioners to take action. Section 153A-121 permits counties "to define, regulate, prohibit, or abate acts, omissions , or conditions detrimental to the 4lealth, safety or welfare of its citizens and the peace and dignity of the county". Section 153A-131 permits counties to regulate, restrict or prohibit the possession or harboring of animals which are dangerous to persons or property. Two approaches are attached as exhibits. The Chatham County proposed ordinance describes a regulatory approach whereas one in effect in Nilson County exemplifies a prohibition approach. AND WHEREAS the Board of Commissioners is concerned for the safety and welfare of all of the citizens of Chatham County and desires to enact an ordinance regulating the keeping of wild animals in Chatham County pursuant to Article 6 of Chapter 153A of the General Statutes of North Carolina. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF CHATHAM COUNTY as follows: Section 1, Definitions. As used hereinafter, the following terms shall mean: a. Horner: Any person, firm or corporation who keeps, has charge of, shelters, feeds, harbors, or takes care of any wild or vicious animal in Chatham County. b. Permittee: Any individual who has been granted a permit to keep, shelter, feed, harbor, or take care of any wild or vicious animal in Chatham County.Y c. Primary Enclosure: Any metal building, wire cage or pen or similar enclosure designed and used for the purpose of restraining and confining any animal, the keeping of which is regulated by this ordinance. All such enclosures shall be constructed and maintained according to the standards set out in the appendix of this ordinance entitled "Standards for Primary and Secondary Enclosures of Wild or Vicious Animals' . d. Secondary Enclosure: An enclosure which is not used for primary confinement, exercse of wild or vicious animals or training. Each enclosure shall. be constructed to standards specified for keeping each type of animal as identified in Appendix A of this ordinance. Section 3. Permit Required. As a condition precedent to the keeping, sheltering or harboring of any wild or vicious animal, a prospective owner shall make written application for and receive from the Chatham County Animal Control Officer, a permit and authorization to keep any such animal . Said application shall contain at least the following: a. Name and address of prospective owner; b. Species, size and other identifying characteristics of each wild or vicious animal the applicant desires to keep; c. The birthplace of each animal and history or each animal including wheth r the animal has ever harmed any human being, including all medical history including immunizations. d. Description of the nature, size, type of construction and location of any enclosure in which the applicant intends to keep said wild or _ ii ` . 041 'to compensate persons for personal injury and property damage which may s result. A copy of the current policy shall be attached to the :application. f Names. addresses and telephone numbers of all persons resid- ing within five (S) miles of the proposed location for the keeping of said t, animals. v g. A schedule of the personnel who will service and maintain this facility on a daily and hourly basis. h. A list of tranquilizing equipment, chemicals, and instruments of destruction required by Section 11 of this ordinance. i. A list of all State and Federal permits and licenses required for such animals and a statement of whether said licenses and permits have been obtained, Section 4, As a condition precedent to the keeping, sheltering or harbor- ing any wild or vicious animal, the prospective owner shall continuously main- tain liability insurance coverage in at least the amount of $1„goO,QUA per claim to compensate persons for personal injury and/or property damage which may result from the keeping of said animals. Section 5. Duties of Animal Control Officer. Upon receipt of a written application for permit to keep a wild or vicious animal, the Chatham County Animal Control Officer shall inform the applicant in writing if the enclosure standards for each type of animal are different from the Construction standards proposed and shall notify the County Manager who will report the application to the Board of County Commissioners. Upon the construction of the enclosures specified, the Caa.tham County Animal Control Officer shall promptly inspect the primary encl sure and the secondary enclosure intended for the keeping or harboring of any wild or vicious animal. a. , If the Animal Control Officer shall determine that the nra- this ordinance i and the applicant certifies th:it he has all necessary State and Federal permits, he shall promptly issue :a permit authorizing the appli- cant to locate said wild or vicious animal in Said enclosure. No wild or vicious animal shall be brought into or kept in Chatham County until after the permit cis issued. b. If the Animal Control Officer shall determine that the proposed enclos re is not reasonably or sufficiently secure to harbor or keep the wild or vicious animal applied for or that it fails to meet the specifica- tions set forth herein, he shall notify the applicant of any defects or irreg- ularities which make said enclosure insecure. The applicant may cause such defects to be r medied and request another inspection brthe Animal Control Officer. Section 6. inspections. At any time after the receipt of an applica- tion referred z hereinabove, the Animal Control Officer shall be authorized to inspect the premises at any reasonable time and shall file a written report of his findings with the County Manager on a quarterly basis. Section 7. Additional Standards. If, at any time during or after an ' inspection of the facilities by the Animal Control Officer, it is the determina- tion of the Ani. al Control Officer that the "Standards for Primary and Secondary Enclosures" are inadequate for keeping any species or individual animal of a species, the Ani`nal Control Officer shall not issue a permit and shall recom- mend to the County Manager necessary changes in ties Wards sufficient to t the public. protect th pu c Section 8. Deficiencies. Any deficiencies in the primary or secondary enclosures recognized by the Animal Control Officer after issuance of a permit shall be communicated immediately to the owner in writing and immediately• cor- . r.. rected by the ow?er. These deficiencies shall be communicated immediately to - , T. 0 ' vicious animal at the date of the adoption or this ordinance shall comply with the application and permit provisions herein within twenty (20) days of the adoption o this ordinance, and shall meet the primaary enclosure standards within twenty (20) days, and the secondary enclosure standards within sixty (6p) days. Section 1 iteporting of Escapes. At any time after the permit referred to hereinabove is issued, any wild or vicious animals are brought into the county, and any of these animals escape their confinement the following steps shall be taken by the owner to assure that the public is notified and all possible measures are taken for the protection of the public: . a. Immediately upon knowing that any wild or vicious animal is outside of the second enclosure and out of the sight of the owner, the owner shall contact the Chatham County Emergency Communications Center and give a detailed, report of how many animals are at large, what_ kind. of animals . ,.. are at large, the area where they are expected to be, any particular dangers which are created for'the public, and any precautions which the public should take to avoid harm. b. The Emergency Communications Center will then notify the neighbors who are listed on the original application, the Sheriff, and the Animal Control Officer. . Section 11 , Tranquilizing, and Annihalating Equipment Required. Each permittee shall have on hand at all times sufficient equipment and chemi- cals necessary to tranquilize any animal for which. he or she has a permit to keep. Each per 7 ittee shall have on hand at all times sufficient equipment to kill any animal for which he or she has a permit to keep. Section 12. Transport and Exhibition. No owner shall exhibit any wild . or vicious ,animal within the county or transport any such animal from one 'Animal Control Officer may make an exception to the requirement of having an animal in a secure enclosure for transport if the animal is sick or injured and is sufficI ntly sedated or tranquilized to the point that it could do no harm to any human h being. , V Soctia`n 13. It shall be unlawful for any person to release from capti- vity any wild or vicious animal within Chatham County. .. Section 14. Any owner as defined in this ordinance shall at all times have on site with said animals a person experienced in the handling of such ' animals. Section 1S. The permit of any permittee may be suspended or revoked by the Animal .Cont l Officer upon a finding of any one or more of the following: " a. That the permit was issued to the permittee not entitled thereto under t )i.s ordinance. b. That the permittee's enclosures do not comply with this ordi- trance. c. That one or more animals have been brought into the county or kept by the permittee without first obtaining a permit therefor. d. That the permit application contained false or misleading information. e. That the permitter does not'possess all licenses and permits required by the Mate of North Carolina and the Federal Government. The permittee shall be notified in writing of any such suspension, and shall have the right to appeal said decision to the Board of Commissioners, provided notice of same is given in writing to the County Manager within ten days of notice of such suspension or revocation. Section 16. Any person violating any provisions of this ordinance shall be guilty of a misdemeanor, 045 section �. This ordinance shall be effective upon its adoption. • 0 `8 „ . .. 046 APPENDIX A STANDARDS FOR PRIMARY AND SECONDARY ENCLOSURES OF WILD OR VICIOUS ANIMALS This appexxd.ix specifies minimu m standards For the construction of primary - and secondary enclosures which are to be used to keep, harbor or restrain wild or vicious animals. If, because of the breeding, history, character, or other particular trai1t, it is the opinion of. the Animal Control Officer that these standards are insufficient to restrain any wild or vicious animal he shall report such findings to the Sheriff and County Manager, and issue no permits until standards sufficient to restrain the animal are developed and adopted by the County Commissioners. 1. Prima Enclosures used to keep, harbor, or restrain the following animals shall be constructed with the materials and in the manner specified. a. Tigers. Tigers of any species shall be housed within a primary enclosure which has at a minimum 600 square feet per animal. There shall be no more than one male and two females per primary enclosure. The enclosure shall be constructed of not smaller than nine guage steal chain link fence attached to not smaller than 2 1/2 inch diemoter, schedule 40 steel poles placed at least 30 inches in the ground. The poles shall be of sufficient long h to extend at: least twelve (12) feet above the ground and no more than ten (10) feet apart. In the event the cage has a roof constructed of the same mat rial as required for the sides, then it shall be at least 8 feet tall and the poles shall be spaced no more than 8 feet apart. All fencing and poi s shall be anchored in concrete. Cages with roofs as above referred to shall be at least 15 feet wide and 30 feet long per animal. There shall be no common fences between enclosures housing tigers anchor any other animal . If adult male tigers are placed in adjacent enclosures these enclosures shall be constructed of no smaller than nine guage steel , * 'between two males. All enclosures shall have double safety doors. b. Lions. Lions of any species shall be housed in enclosures constructed to the same standards as those required for tigers, c. l.eoprds.__ Leopards of any species and age shall be kept - o in enclosures constructed to the same standards as required for tigers and in addition theret , all primary enclosures shall have a top or roof firmly attached to all sides with no gaps, said roof or top to be constructed of not less than nine guage steel chain link fencing. d. Jaguars. Jaguars of any species shall be housed in enclosures constructed to the same standards as those required for tigers except the fenc- ing shall be nol less than six guage steel chain link fencing, and steel posts at least two inches in diameter no more than ten feet apart (schedule 40 steel posts), anchored in concrete and at least 30 inches in the ground. Air- primary enclosures shal)i have a top or roof firmly :attached to all sides with no gaps, and constructed of not less than six guage steel chain link fencing. e. Bears. Large bears are considered to be among the more dangerous animals as well as the more escape prone. Bears shall be housed in a primary enclosure with at least 600 square feet per animal. There shall be no more than ne male and one female per primary enclosure. The primary enclosure shall be constructed of steel bars at least 3/4 inch in diameter, anchored in the round at least 30 inches in concrete. The enclosure shall be at least ten (10) feet in height and shall have a top or roof constructed ' of the same mate ial as the sates and firmly attached thereto with no gaps therein. All such enclosures shill be constructed so as to have a "crossweld!' at least each for (4) inches. . . 2. Secondary enclosures shall be constructed of not less than 11 1/2 guage steel chaz.rr link fencing and shall encompass all primary enclosures. . 048 at least 30 inches in the ground and anchored in concrete and spaced not more than ten feet apart. No secondary enclosure shall have any common wall with any prima y enclosure. All secondary enclosures shall be electrified. 3. No variations from these standards shall be made by the Animal. . Control Officer. Any variation requested shall be brought to the Board of County Commissioners and acted upon after a public hearing. 4. The updated contract was approved by the Housing Authority Board at its January 11, 1983 meeting, IMPACT: Some features of the contract are - Submission by the Authority to the County of monthly financial reports of receipts and disbursements - Vesting of authority in the County Board of Commissioners to approve any amendments to the budgets of the Section 8 programs - Requirement that the Authority inventory all fixed assets acquired with Orange County Housing Assistance Payments Program Funds - Submission by the Authority to the County of copies of all correspondence with the U. WITNESSETH: THAT WHEREAS, County has been authorized to institute a county wide Housing Assistance Program to be funded through an Annual Contract with the United States Department of Housing and Urban Development, and WHEREAS, iI he Chapel Hill Housing Authority is a Housing Authority organized and existing under the Housing Authority Laws of North Carolina, and WHEREAS, the Authority has the requisite personnel and the experience in administering Housing Assistance Program in all of Orange County, and WHEREAS, the Parties hereto do agree that in the interest of the program and its continued implementation, the Chapel Hill Housing Authority is a proper agency to operate such a program for and in behalf of the County of Orange under the terms and conditions hereinafter set forth, and WHEREAS, he Parties hereto desire to reduce their agreement with respect thereto in wri ling. NOW, THEREFORE, in consideration of the aforesaid the parties hereto do con- tract and ogre as follows: 1. County does hereby contract and agree with Authority for the operation of the County wide housing assistance payments program including Section 8 Existing and Section Moderate Rehabilitation. 1 1 P, 2. This contractual arrangement shall begin on the first day of January, 1983, and shall exist and continue until December 31 , 1983, whereupon the County has the option to renew after satisfactory review, and that such1review and option to renew by the County be done sixty days prior l to th' end of the contract period. Further, the County may, at any time, upon 60 days notice, terminate this contract. 3. The p rties hereto agree that the programs to be conducted hereunder shall be as set forth in the Administrative Plan attached hereto as Exhibit A and B except that any provisions set forth in this contract that are more stringent than those contained in Exhibits A and B shall supersede those provisions in Exhibits A and B. 4. The County will be responsible for preparing and submitting the quarterly letter of credit requisition to HUD U form 66 1 eq (HUD rm 62 3}. 5. Attached are the Authority's budgets for the Section 8 Existing and Secti In 8 Moderate Rehabilitation Programs (Exhibit C). Any amendment to the budget will require approval by the Orange County Board of Commis loners. 6. The Authority shall make monthly financial reports to the Orange County Manager as to the receipt and disbursement of funds for the Orange County Housing Assistance Payments Program'. 7. The Authority shall complete an inventory of all fixed assets (any piece of equipment and furniture or similar item with a value of$100 or more and a useful life of one year or more) acquired with Orange County Housing Assistance Payments Program funds by March 31 , 1983, and furnish a copyko the County Manager, Any changes in this inventory shall be I recorded and a copy of these changes provided to the County Manzo., _ ; 4 052 8. The Authority shall administer the Orange County Housing Assistance Payments Program in accordance with the U. S. Department of Housing and Ulrban Development Handbook 7420.7 Public Housing Agency Administra- tive (Practices Handbook for the Section 8 Existing Housing Program unless it has written permission from HUD to deviate. 9. The Athority shall submit to the County a copy of all reports to and correspondence with the U. S. Department of Housing and Urban Develop- ment pertaining to the Section 8 Housing Program. 10. It is agreed that the County may inspect all books and accounts of the Authority pertaining to the Orange County Housing Assistance Payments ., Program at any reasonable time it shall desire after notice. 11. The Authority shall comply with the attached Memorandum #521 issued by 1 the Department of the State Treasurer which states that housing:authori- ties are subject to the provisions of Chapter 159 of the General Statutes, Local Government Budget and Fiscal Control Act. 12. ' G.S. 119.34 requires that all public authorities have their books �"' audited after the close of each fiscal year. Therefore, each housing authority should contract with their independent auditor for an annual financial audit. We realize, of course, the financial implications of this requirement and also the need for adv nced planning in budgeting the anticipated cost. NEE: : Records within the Register of Deeds Office are indexed according to alphabetic listing of owners. Since 1980 a new index by property inden- tification number has been under development. In December 1982, the Department of Administration certified that the new index met the require- mets of Sate law Julyt1, 1983,aunlessrab local lact en viinghup recognize thedatadwerelapproved, The Register of Deeds desires to have an earlier approval date since the index is ready and since a cost saving could result, Currently, it takes 3,5 boxes of parer or S77 per month and 18 hours of computer time for the multiple printing of the alphabetic index. This could be discontinued once the computer is utilized for retrival. Representatives Anne C, Barnes and Joe Hackney are willing to carry a local act through the process for approval if the Board makes known its request for action. Authority to utilize the PIN index could become effective as of February 1, 1983, given this go ahead. Orange County's index would be the first of its kind in the State to receive official status. The inspection conducted on November 23rd, showed that your PIN indexing system was quaified in all respects. Therefore, under the authority granted me by G.S. 161722.2(d) , I approve the Orange County PIN indexing system and authorize its employment as the primary indexing system in your Register of Deeds office. The requested effective date of January 1, 1983, is approved upon one con- tingency. As you know, the statute requires a starting date of July 1st. It provides the Orange County Board of Elections with the option of establishing an office in Chapel Hill for the purpose of one-stop absentee voting provided that office has on-line computer access to the voter registration a information maintained in the Hillsborough office. I believe this will be a welcome convenience to residents of Southern Orange County, many of whom have spoken to me about it. T have disc ssed this proposal with Pat Carpenter, Chair of the Elections Board, and have sent her a copy of the draft. I have encouraged her to discuss it with that Board, and to be back in touch with me about it. .. Any expenseland arrangements for space , staff, equipment , etc. would invol 'e. the Board of Commissioners , as you know.
