Er1u-a,ti.on of the public about this disease is a. project of the 4-4 Club and the Club is requesting the Commissioners' aid in this effort via this proclamation. 2--CROP Ilk � Day in Orange County, is sponsored by Orange Congregation in Misssion. The effort to help raise money for the Meals-ono eels Progr'a in the County and internationally is in its third year 01r. There are activities being scheduled in May to publicize this designation and to urge participation in recreational programs by all Orange County ditizenS, urban and rural. In looking at the plat, it seems that the intent of the owner is to further subdivide the property. If this is the case, future lots should be considered as a regular subdivision and road improvements, etc. , should be required. N®: Property is located in Hillsborough Township on N.C. 86. There are 26 lots proposed out of 9.93 acres. The proposed roads are to be constructed to State standards. The lot sizes meet the minimum requirement for an RT-4 zone. The tract is located in the Orange Rural Fire District. IMPACT: The proposal meets the existing standards for lot size and access. Lots within. the subdivision average 0.23 acres or 10,018.80 sq. ft. in size. 10,000 sq. ft. minimum lot areas are required. Streets within the subdivision are to be constructed to N.C. DOT standards with lot access limited to interior streets. The area is designated as 10 Year Transition by the Land Use Plan. . Develop- ment permitted densities of four (4) units per acre in this location will have minimum impacts on the area provided certain improvements and other. conditions are met. Completion of the initial phase of 26 lots will result in traffic volume of 253 trips per day. This is based on an average trip rate of 9.72 trips per day for medium density single family dwellings. When this project is complete, additional 35.0 acres of land would be developed for single-family purposes at R-5 densities (7,500 sq. ft./lot) , while 29.7 acres would be uitlized, for condominuin development at R-8 densities (Sunits/acre) . The proposed R--S development would generate approximately 1,620 • trips per day. This is based on subtracting 18% of the total acreage (6.3) for street right-of-way and dividing the remain- ing acreage (28.70) by 7,500 sq. ft./lot, and applying the trip generation factor of 9.72 trips/single family dwelling. The proposed R-8 development would generate approximately 1,180 trips per day. This is basa'9 on multiplying the acreage (29.7) times .8 'units/acre and applying a trip generation factor of 4. 97 trips/condiminium. The net effect of the total development would be to generate an estimated 3,053 trips/day. Since the capacity of NC Highway 86 is 9,500 vehicle/day, the development would push existing., traffic volumes, (4,100 ADT) on NC 86 to near capacity levels within the developer's five (5) year time' frame for development of the project. The impact of these traffic volumes should warrant improvements to NC Highway 86 to handle increased traffic and turning move- ments. The subdivisio Regulations allow the r3oard of Commissioner uhL 010 NC 86 could be improved along the frontage owned by this developer to a full 1 of a 4-land travelway, or accel and decel lanes with travel lanes 200' long and tapers 495' long or only tapers 495' long could be required of the developer. RECOMMENDATION: The Planning Board unanimously recommended approval of the subdivision with the following conditions: (1) The Town of Hillsborough should certify that the Town will supply water and sewer service to this development. (2) There should be a note on the plat that no lots' shall have direct access to NC 85. (3) This total development may have significant impact on the traffic volumes on NC 86. There is a present ADT on NC 86 of 4100 (1981) . (4) Connection to the public sanitary sewer shall be made prior to the approval of the 76th lot in this subdivision. (5) Water and sewer plans must be designed by a registered engineer and be approved by the Water Resources Commission and Environ- mental Management Commission of the State • of N.C. Proof of approval must be submitted to the County and the Town. There are 6 lots proposed out of 6.62 acres. The owner is requesting to construct a "Class A" private road. The lot sizes meet the minimum.standards of the.Subdivision Regulations and Zoning Ordinance for an EC-5 district of 40,000 sq. ft. The average lot size is 48,061.20 sq. ft.,.while the maximum lot size is 76,665.60 sc The tract is located in the Orange Rural Fire District. The Tots would be serve, with individual septic tanks. Water service (6 inch line) is available in NC Highway 57 from the Town of Hillsborough. 'A-CT: The area is designated Agricultural Residendial in the Land Use Plan and the property is bordered by Residentially zoned land. The property was zoned EC-5 in October, 1982. Development of all six (6) lots for commercial use will have a maximum impact on traffic in the area. Commercial uses, in general , generate approximately 432 vehicular trips per acre. Definitions: As used hereinafter, the following terms shah, mean: Director:ector: The Director of the Orange County Health Department. Board: The Board of County Commissioners of Orange County. Wild Animas Dan;,erous to Persons and..Pro:ert• hereinafter referred to as 'Wild Animals : The term applies to species of animals not considered domestic,—specifically, all felines (other than the domestic house cat), nonhuman primates, bears, wolves, coyotes, reptiles (poisonous, crushing and giant), and any crossbreed of such animals which have similar character- istics of the a imals specified herein. In order to properly administer the provisions of tis Ordinance, the Board may add to or remove from the classi- fication of wild animal any bird, mammal, reptile, aquatic and amphibious forms, or other members of the animal kingdom. Addition& to or deletions from the list may be mad only if the Board determines, after receiving evidence, that such species because of habit, mode of life or natural instinct is incapable of being domesticated, requires the exercise of art, force or skill to keep them safely in subje tion, and would create a reasonable likelihood of hazard to the public. Each determination by the Board as to additions or deletions shall become effective I upon approval. 1 Owner: Any person, firm, or corporation who keeps, has charge of, shelters, feeds, harbors, or takes care of any wild animal in Orange County. Permittee: Any individual or corporation who has been granted a permit to keep, 7helter, feed, harbor, or take care of any wild animal in Orange County. Primary Enclosure: Any metal building, wire cage, paddock, pen or similar enclosure designed and used for the purpose of restraining and confining any wild animal, the keeping of which is regulated by this Ordinance. All such enclosures shall be constructed'and maintained accord- ing to the standards set out in Appendix A of this Ordinance entitled "Standards for Primary and Secondary Enclosures of Wild Animals". (RESERVED) Secondary Enclosure: Any enclosure which is not used for the primary con- finement,. exercise or training of wild animals. Each person, firm, or corporation keeping any wild animal shall construct and maintain continuously a secondary enclosure encompassing the complex of primary enclosures where such animals are kept. This secondary enclosure will be constructed and maintained according to the standards specified in Appendix A (RESERVED) and depending on the animals kept. Section 2. Primary and Seconds Enclosure Required. I C4 Section 3 Permit Required Permit Required - Permits shall only be issued for animals existing in Orange County Snd registered as of the date of this Ordinance enactment. It shall be unlawful for any person to possess or harbor in Orange County a wild animal as defined herein without first applying for and obtaining a permit from the Director. Furthermore, it shall be unlawful for any person to trade, breed, sell or barter any wild animal or their cages and any equipment used by or for the handling of said animals, unless exempted by the provisions contained in Section 4 of this Ordinance. No permit shall be required for the transportation of wild animalslthrough Orange County from a point of origin outside the County to a point outside the County. Re9uirements for Permit - As a condition precedent to the possession or harboring of any wild animal, the prospective owner or permittee shall have on the premises where such animal is kept, sufficient equipment and/or chemicals necessary to tranquilize or kill any animal for which the owner or permittee has a permit to kee . As a Furth r condition, the prospective owner or permittee must present evidence of tra.ning and experience in the care and handling of wild-animals. Prospective owners or permittees must submit an application for said permit which shall contain the following: (1) Name ud address of the applicant; (2) If a corporation, the State under which incorporated, the date of incorporation, the address of the principal office, and the names! and addresses of its officers; (3) If any other type of organization, the name thereof, the location . of its office, and the names and addresses of the principal officers, directors, trustees, or managing officials or partners; (4) Statement of the owners purpose in keeping the animal; I (5) The place of origin (city or county and state) of the animal'or animals or classes of animals, including the method of acquisition (gift purchase, etc.); (6) A description of the animal.(size, weight, distinctive markings, etc.) or animals including species; (7) List of previous incidents involving animals to be registered, including escapes, injury to persons or property, etc.; (8) The a dress of the premises where the animal or animals will be kept; (9) A des ription of the method, materials, and square footage of facilities for cpnfinement of the animal or animals; (10) Proof of the applicant's ability to respond in damages for bodily injury to or death of any person or persons or for damage to property owned by any other person which may result from the ownership, keeping or ma ntenance of such animal. Proof of ability to respond in damages shall be given by filing with the Director a certificate of insurance from an insurance company authorized to do business in•the State stating that the applicant is, at the time of application, insured by a policy (13) Keeper's training and experience with animals, especially wild ` animals, particularly the species in the application; and/or (14) A list of tranquilizing equipment, chemicals and instruments of destruction as required by this Ordinance . Only one permit shall be required for each location at which wild animals are to be kept. Investigation by Director — Each application for permit or amendment shall be filed pith the Director who shall inspect all locations for the keeping of any wild animal for cleanliness and safe possession of the animal. I Prior to the granting of a permit or amendment the applicant shall be required to prevent to the Director, for his inspection, a State of North Carolina Wildlife Resources Permit, if the keeping of such animal in this state requires �ny such perniit. Such perms or amendment shall be issued by the Director after satis- factory evidence by the applicant and personal inspection by the Director that the applicant will confine any wild animal in facilities that meet the standards contained in Appendix A. (RESERVED) Such perms or amendment will not be issued by the Director when he finds one or more of the following: (1) No permit or amendment shall be issued when any outdoor enclo ure designed for confinement of a wild animal is located closer than 100 feet from any property line; (2) Intentional misstatements or misleading statements of fact .n the application; (3) When the animal cannot or will, not be kept or maintained without menacing the safety of. any; perion or property; and/or..' . V (4) When he animal is, will not, or cannot be maintained in a humane manner. _;. Each applicant shall be notified by.,certified mail of the issuance or denial of a permit or permit amendment by the Director. If the Director does not issue a permit or amendment, the reasons for his not doing so shall be in writing and shall accompany the notice of denial . An applicant may request a hearing before the Director by written request within five (5) days after receipt of notice of denial of a permit or permit amendment. The Director shall render a decision including findings of fact based on the evidence presented at such hearing. In the event that the Director denies said permit, the permittee shall be entitled to a hearing before the Board by requesting same within five (5) days of receipt of notice of denial. Permit Revocation Procedures -- The Director may revoke a permit heretofore issued, if he finds violation of any section of this Ordinance. The Director will revoke a permit heretofore issued when he finds one or '042 , (3) That I an animal or:animals cannot or will not be kept or main- tained without endangering the safety of any person or property; and/or . It shall be the duty of the permittee or the person w o keeps and/or maintains the animal to care for the animal at all times and miaint in confinement as provided in the enclosure standards contained in Appendix A. RESERVED) When any wild animal is found off the premises approved for confinement or off the premises where it it kept and maintained without written permission of tb,e Director, the permittee or keeper may be charged with a criminal act. If convicted of a violation of this provision the Court may order the animal to be euthanized or the permittee or keeper subjected to penalties as provided in Section 6 of this Ordinance or both euthanization and such penalties. It shall be the duty of any permittee or keeper of a wild animal to immedi- ately report toithe Orange County Sheriff's Department when the animal is dis- covered missing Any person who willfully, negligently or in violation of the provisions of this Ordinance eepsand/or maintains a wild animal shall be liable for any expenses incurred in searching for, containing, returning or disposing of the animal when it is off the premises of the permittee and/or keeper. Section-6. Enforcement Any owner keeping or harboring a wild animal at the date of the adoption of this Ordinance shall comply with the application and permit provisions herein within thirty (30) days of the adoption of this Ordinance, and shall meet the primary and secondary enclosure standards within one hundred and twenty (120)days of their adoption . (3) 'o11gw-u Ins ection •- The Orange County Health Department, the Orange County Inspections Division and/or the North Carolina Wildlife Resources Commission shall inspect the enclosure specified in the Ordinance at least once during the period January 1 through June 30 and once during the period July 1 through December of each year or as deemed necessary by the Diredtor. No such follow-up inspections shall be required during any such 6-month period in which the initial inspection was made unless deemed necessary by the Director. Permit ands i Inspection Fee - Every person possessing or harboring a wild animal, whose premises are inspected by the Orange County Health Department, the Orange County Inspections Division, and/or the North Carolina Wildlife Resources Commission shall pay the County an annual fee per site for permitting and inspections as follows: Reptile Site . , $ 61.83 Single Enclosure Site 274.11 Multiple Enclosure Site 856.56 Investigations - The Orange County Health Department, the Orange County Inspections Division, and/or the North Carolina Wildlife Resources Commission shall investigate any complaints that a wild animal is possessed or harbored in Orange County in violation of this Ordinance to determine whether or not a violation has occurred. Penalties (1) 'Criminal Offense - A violation of any provision of this Ordinance Will onstitute a misdemeanor and shall be punishable as provided in No th Carolina General Statutes, Section 14-4. Each day's conti nuing violation shall constitute a separate offense. (2) Civill,Penalty - Any person who violates any of the provisions of this Ordinance shall be subject tea civil penalty of fifty dollars ($50.00) per day, per animal. No penalty shall be assessed until the person alleged to be in violation has been notified, of the existence and nature of the violation by certified letter. Each day of a continuing violation shall constitute a separate violation. The Orange County Board of Commissioners shall make or cause to be made .i written demand for payment to be served upon the person in violation; which shall set forth in detail a description of the violation for which the penalty has been imposed. If payment is not received or equitable settlement reached within sixty (60) days afterldemand for payment is made, the matter may be referred to the County Attorney for institution of a civil action in the name of the Counq of Orange in the appropriate division of the general court of justice for recovery of the penalty. Any sums recovered shall be used to carry out the purposes and requirements of this Ordinance. (b) Upon determination by a court that an alleged violation 044 is occurring or is threatened, it shall enter such orders or judgments as are necessary to abate the violation or to prevent the threatened violation. The institution of any action for injunctive relief under this section shall not relieve any civil or criminal penalty prescribed for violations of this Ordinance. Section 7. Severabil,i,t If any provision of this Ordinance or the application thereof to any person or circ tanee is declared to be invalid, such invalidity shall not effect other previsions or applications or the Ordinance which can be given effect without the invalid provision of application, and to this end the provision of th's Ordinance are declared to be severable. Poles shall be no more than ten (10) feet apart and shall be of sufficient height to extend to the top of the fencing. Fencing shall be placed on the Interior side of the steel poles and shall be attached firmly to the poles by means of steel wire ties spaced not more than one (1) foot apart and which are tied secu ely around the full circumference of the poles. (6) Other Requirements. Primary enclosures shall contain a den or retrleat to shelter the animal (s) from the weather. The den or retreat shall be constructed of concrete block or treated lumber so as to withstand weatherization and provide ease of cleaning for health reasons. The primary enclosure may be con- structed of wood, metal, glass or fencing material or any combination thereof sufficient to restrain and confine the reptile(s). Where solid wood, metal and/or glass enclosures are provided, holes shall be provided in the sides for venti- lation but shall be small enough to prevent the escape of the animal. Where fencing material is used, the spacing between strands of wire shall be small enough to prevent the escape of the animal. All enclosures must be of such construction as to totally enclose the reptile(s) and prevent the animal from opening the enclosure from within. (4) Safety Doors Required. At least one (l) side of the enclosure must have a window of glass or fencing through which the owner or permittee may see the location of the animal before opening the enclosure. In lieu of a window, one (1) or more sides of the enclosure may be constructed of glass or fencing to allow viewing of the animal. Aim 050 STATE OF NORTH CAROLINA FIRE PROTECTION CONTRACT ORANGE COUNTY This agreement is made and entered into this let day of July, 1982, by and between Orange County (hereinafter, "the County") and the Town of Carrboro (hereinafter, "the Town") . WHEREAS, the County has established the South Orange Fire District and wishes to have fire protection services pro- vided to the residents and property owners within this district by the C rrboro Fire Department; and WHEREAS, the Town has provided fire protection to the South Orange Fire District in past years and wishes to continue to provide such services at a fair rate of compensa ,tide in the future; and WHEREAS, the County and the Town are authorized to enter this agreement by Article 3A of Chapter 69 of the North Carolina ,3enerai Statutes . The percentage derived by dividing the assessed valuation of the real and personal property within the fire district by the total assessed valuation of all real and personal property within the Town of Carrboro and the fire district. The assessed valuation figures used in this calculation shall be those used by the County and the Town in budgeting for the upcoming fiscal year. 2. The percentage derived by dividing the number of fire calls within the fire district for the prior three years by the number of calls within the Town and the fire district for the prior three years. bI Add together the fire district percentage of: 1. The total budget for the fire department as shown in the an- nual town budget, except that for purposes of this calcula- tion only one half of the personnel cost of the Inspector's position shall be included in the budget; plus 2. The sum provided for herein shall be paid by the County to the Town in four quarterly installments, one each being due on July 1, October 1, January 1 and Mar h 1. 6. This contract shall be effective July 1, 1982 and may be cancelled by either party upon written notice to the other not less than 90 days prior to the end of the last fiscal year for which fire services are to be provided herein. It is the intention of the General Assembly that community advisory committees work to maintain the intent of the Domiciliary Home Residents' Bill of Rights within the licensee domiciliary homes in this State. It is the further intent of the General Assembly that the committees promote community involvement and cooperation with domiciliary homes to ensure quality care for the elderly and disabled adults. (b) Estal.ishment and Appointment of Committees. (1 A community advisory committee shall be established in each county which has at least one licensed domiciliary home, shall serve all the homes in the county, and shall work with each of these homes for 8`` the best interests of the residents. In a.. county which has one, two, or three homes for the aged and disabled, the committee shall have five members. (2) In a county with four or more homes for the aged and disabled, the committee shall have one additional member for each home for the aged and disabled in excess of three, up to a maximum of 20 members. In each county with four or more homes for the aged and disabled, the committee shall establish a subcommittee of no more than five members and no fewer than three members from the committee for each domiciliary home in the county. Each member must serve on at least one subcommittee. Any vacancy shall be filled by appointment of a person for a le-year term. If this vacancy is in a position filled by an a pointee nominated by the chief administrators of domiciliary homes within the county, then the county commissioners shall fill the vacancy from persons nominated by a majority of the chief administrators. If the domiciliary home administrators fail to make a nomination by registered mail within 45* days after written notification has been sent to them requesting a n urination, such appointment may be made without nominations. G.S. 131D-32 is rewritten to read as follows: " (a) The committee shall serve as the nucleus for increased community i volvement with domiciliary homes and their residents.. (b) The committee shall promote community education and awareness of the needs of aging and disabled persons who reside in domiciliary homes, and shall work towards keeping the public informed about aspects of long-term care and the operation of domiciliary homes in North Carolina. (c) Theq committee shall develop and recruit volunteer resources t enhance the quality of life for domiciliary home residents. t40'"` (d) Th committee shall establish linkages with the ",.. domiciliary lltome administrators and the county Department of Social Services for the purpose of maintaining the intent of the domiciliary home residents' Bill of Rights. (e) Mach committee shall apprise itself of the general conditions der which the persons are residing in the homes, and shall work for the best interests of the persons in the homes. This may in ,lude assisting persons who have grievances with the home and f cilitating the resolution of grievances at the local level. The amen of all complaining persons and the names of residents involved in the complaint shall remain confidential unless writt1en permission is given for disclosure. The committee shall notify the enforcement agency of all verified violations of the Domiciliary Home Residents' Dill of Rights. (f) The Committee or subcommittee may communicate through the v E committee chair with the Department of Human Resources, the county Department of Social Services, or any other agency in J relation to the interest of any resident. • (g) Each committee shall quarterly visit the homes for the aged and disabled it serves. For each official euarterly visit, a majority oaf the committee members shall be present. A minimum of three members of the committee shall make at least one visit annually tQ each family care home and group home for 072 subsection, and a majority of the subcommittee members must be present for any E visit. When visits are made to group homes for developmentally disabled adults, rules concerning confidentiality as adopted by the Commission for Mental Health, Mental Retardation and!! Substance Abuse Services shall apply. (- ' (h) The individual members of the committee shall have the right between 1b:00 a.m. and 8: 00 p.m. to enter the facility the committee serves in order to carry out the members, responsibilities. In a county where subcommittees have been established, this right of access shall be limited to members of the subcommittee which serves that home. A majority of the committee or subcommittee members must be present to enter the facility at other hours. Before entering any domiciliary home, the committee or members of the committee shall identify themselves to t a person present at the facility who is in charge of the facility at that time. (i) The committee shall prepare reports as required by the Department of Human Resources containing an appraisal of the problems of domiciliary care facilities as well as issues affecting long-ierm care in general. Copies of the report shall be sent to the board of county commissioners, county Department of Social Services and the Division of Aging. (j) Nothing l contained in this section shall be construed to require the expenditure of any county funds to carry out the provisions herein. " Sec. 3.
