Commissioner Walker moved, seconded by Com- missioner Marshall, to approve the preliminary plan for Carolantic Investments. Vote: Ayes, 5; noes, 0. 4. Duke Power Company, Modification & Clarification of Special Use Permit Request: Mr. Cannity said that when the Special Use Permit Request was granted for the Duke Power Operations facility, it was unclear that outside storage of such materials such as wire, transformers, poles, etc., were permitted and Duke Power asked that such storage be permitted as it originally had intended such storage. In addition, Mr. Cannity said, the modification of the Special Use Per- mit included a gas island, flag pole and radio antenna at the site. Commissioner Willhoit, noting that such a request for clarification and modification seemed reasonable, moved, seconded by Commissioner Marshall , to approve the Class A Special Use Permit modification as indicated on the revised Site Plan and that outside storage of materials cited by Duke Power be permitted. Land Use Plan Amendment--Curtis Bane for Stonegate: Mr. Cannity presented the information for the Planning Department saying the proposed amendment to the Land Use Plan was for a change from Rural Residential to Twenty-year Transition. Vote: Ayes, 5; noes, O. 6. Public Hearing--Curtis Bane Planned Development Housing R-4Stnnegatm Commissioner Whitted announced that the Public Hearing to receive the recommendation from the Planning Board on the Class A Special Use Permit for3toneyatewas now open. Mr. Cannity, who was sworn at the Public Hearing on August 23rd, presented the evidence and recommendation from the Planning Board; he cited the findings of fact, found on pages ig4r62". of this Book, for the Class A Special Use Permit for Stone, gate. Mr. Cannity said the Planning Staff and Board had two concerns: 1) pedestrian 608 circulation within the Development; and, 2) that the use was not in compliance with the general plan as dopted by the Board of Commissioners. Mr. Cannity said, however, since the Land Use Plan amendment for the development had been approved, that second concern no longer existed. Mr. Cannity listed the conditions which Planning Board and Staff suggested be imposed if the Class A Special Use Permit is granted by the Board (see yages44/0- 4+A/ of this book for those twenty-five_ conditions). Both Planning Staff and Board recommend approval of the request. Commissioner Whitted declared the Public Hearing closed on the Class A Special Use Permit request for Stonegate. Mr. Cannity then reviewed briefly for the Board of Commissioners the location, density of development planned (114 units on 36'5 acres), parking facilities, roads, water and sewage plans for the development. He noted that the water and sewage systems planned had both been given preliminary State approval and final approval was expected. Mr. Cannity pointed out on the site plan the recreation areas planned and said that the site was to have as few trees removed for construction as absolutely necessary. Commissioner Walker moved that evidence presented at the Public Hearing enabled the Board of Commissioners to make certain findings of fact (see pages of this book) in the matter of the Class A Special Use Permit requested for the 3tonegate Planned Development Housing, R-4, and, that, therefore, the Board does, based on those findings, approve the rezoning request and said Special Use Permit request with the twenty-five conditions recommended by the Planning Board and Staff (see pages of this book); Commissioner Gustaveson seconded the motion. Vote: Ayes, 5; noes, O. 7. Roy Wilkerson Rezoning: Mr. Cannity said that during the zoning process the Planning Staff had overlooked Mr. Wilkerson's business in Hillsborough Town- ship, Tax Map 5 Block B P/O Lot 4. He added that the Staff had made a visual in- spection of the site and recommended that a portion 500' x 300/ be rezoned from Residential-1 to Existing Commercial-5. Nr' Wilkerson requests that the whole 6.62 acres be rezonged EC-5 and Planning Board recommends that designation also. Commissioner Gustavexon moved, seconded by Commissioner Walker, to rezone the Roy Wilkerson property, 6'62 acres as recommended by the Planning Board, to EC-5. Vote: Ayes, 5; noes, D' B. Proposed Text Changes to the Zoning Ordinance: Mr. Cannity presented the proposed changes to the Board, as requested, one at a time. ]z1,_ Mr. Cannity said the first change was to Article 4.1'8 and since it was linked with Article 0.16'12 he would present them together; they deal with tele- phone exchanges, subscriber loop huts, pressure regulator stations, water and sanitary sewer pumping stations, (Clerk's note: For the specifics please see . either the attachments to these minutes or the Zoning Ordinance,) Pending further clarification of 6,16.12, Commissioner Gustaveson moved to approve, seconded Commissioner Marshall, the amendments to Article 4,1'8 and the corresponding Article 6.16.12. Vote: Ayes, 5; noes, 0. Commissioner Willhoit moved, seconded by Commissioner Marshall, to table amend- ments to Article 6'16'1 g and 5'16'2.g until the next Commissioners' meeting. Vote: Ayes, 5; noes, O. Mr. Cannity said that the suggested amendments to Article 8.4.8 and 8.4.9 were to place the same time limitation on Special Use Permit Requests as are pre- sently on rezoning requests. Commissioner Gustaveson moved, seconded by Commissioner Marshall, to approve the/ / amendments to Article 8.4,8 and 8.4.9. During discussion, Commissioner Gustaveson amended his motion to read approval with the 12 month time limition on reapplication on Special Use Permits, if withdrawn after advertisement, but that the withdrawal oft the application is not to be considered denial of the petition Commissioner Marshall 's second stood. Mr. Cannity told the Board that, to his knowledge, only one request would be affected by implementation of such a moratorium at this time. JOCCA CSBG Application: The Board members considered the comments made by citizens at the public hearing JOCCA held on Septbmber 22, 1982, to receive such comments on JUCCA's present program and future use of Community Service Block Grant funds. Board members felt that the nutrition and headstart programs were of concern ' to this Board. Other concerns expressed by Board members were: 1)that the funds be used for emergency assistance payments; 2) that JOCCA focus on the coordination of programs with the funds being used to provide linkages; 3) that the center managers serve as nutrition site managers, too, and in addition provide information and na^k ferral service (rather than information and referral being a separate program). The _~ _ Board felt that JOCCA should examine its purposes and provide services the County could support 2. Programs for Handicapped Children: Commissioner Whitted said he would be attending a meeting on Tuesday, October 5th in Durham sponsored by the Governor's ` . Advocacy Council fOr Persons with Disabilities and he sought Board input into possible changes in federal regulations on educational services to handicapped children' , Board comments included the fact that promised Federal funds had been forth- . coming; that clarification needs to be made regarding access to buildings, 1,e' whether access will be to the entire building or just to specific classrooms. 3. Legislative goals: Commissioner Whitted reminded the Board that he was on the NC Association of County Commissioners' Committee on Legislative Goals. He asked what they would like to see considered by the committee as a legislative goal for the Association. OCTOBER 19, 1982 MEETING: The County Manager asked that the Board consider cancelling the October 19th meeting as he planned to attend the ICMA and to take Mr, Addelson and Mr. Laws from his office with him. He added that there were no items at this time which could not be considered at the October 25th meeting. Commissioner Gustaveson moved, seconded by Commissioner Marshall, to cancel the regular Board meeting for October 19, 1982. Vote: Ayes, 5; noes, O. 4. Economic Development: The County Manager presented the Board with a memorandum detailing models and issues pertaining to the establishment of an economic development program. The Manager summarized the memorandum for the Board and recommended that an Economic Development Commission be established; he detailed the duties, membership and County responsibilities to the Commission (the Manager's memorandum is on file with the agenda for this meeting). Some Board members expressed the concern that the Planning Staff may not be able to absorb the additional work-load and that the position not turn into a mini- "travel bureau'" Commissioner Marshall said that during a luncheon which she had attended in Raleigh, NC De partment of Commerce personnel were advising caution. The Manager said he needed Board response prior to his meeting with the Town Managers requested by the Working Committee on Economic Development. Board members expressed a d es i re that whatever model was chosen, flexibility, primary gnal% thought , 4 1 . ' '' . of staff time, water/sewer options, and responsibility of public funds going into economic development be considered. The Manager said that after further work he would return to the Board for a report' With no further business, Commissioner Willhoit asked that the Manager check out the need for a noise control ordinance in the County; he suggested the Manager examine Chapel Hill 's noise control ordinance. r^ Commissioner Gustaveson moved, seconded by Commissioner Whitted, to adjnurn. The property is all wooded'with deciduous trees c4 BEST USE The best use orthe:; property in our opinion would be a mobile home park. First, the- property is already bound on the north by a. fifty-four unit mobile park. , ': Second, the rise in the lay of the land makes it undesirable for structures of large width or depth.. The road (SR 1713) elevation is 455' mean sea level and 1900' into this property the elevation is. 500'. A dwelling 65' long placed on this elevation would- have a. foundation difference of almost 48 A 12' wide mobile home would have a: foundation difference of only 8" The developing plan has been submitted to the Zoning Office as "Stonegate'"'. The North Carolina: registered landscape architect of Coulter Associates has taken all of the irregularities of this property into consideration. The design of the lots, the placement of the mobile units and. the location of the roads, all make for a well: planned park. The 36.5 acres as designed by Coulter would have 114 units excluding- all roads-, storage and recreation as. The minimum lot size is 10,000., square- feet with. an average density of ,,,3J45ier acre. The average lot 'size is 75 wide'and 150' deep.- This is an average of 11,250 square feet per lot. A 14' x 65' mobile- unitoccupies 910 square. feet.. A parking area 25' x 25' has 625 square feet.. - Combined,, these two would occupy 1535 square feet, leaving 9715 square feet of yard, -area.. Te are that we be permitted to construct the park in four phases. Each phase will be a cul-de-sac. Each phase will be completed with water, p , ' sewer, electricity and road paved before occupancy. WATER - The park will have a community water system as approved by North Carolina Division of Health Services Division. The average daily water consumption should be about 32,000 gallons. The wells, distribution system and storage will all be designed by North Carolina Registered Environmental Engineer, Glen Davis, and ap- proved by North Carolina Division of Health Services. SEWER - The sewer system will be a Package Plant (Private Waste Water Treatment Plant). The State permit for this plant has been granted and a suitable plant is presently being checked out by our engineer. This system will also be designed by Mr. Glen Davis. Mr. Davis will also design the Sewer Collection System and super- vise the installation of both systems. This system will be installed to State approved standards. ELECTRICITY - All utilities are planned to be sub-terranial as much as possible, These include electrical , telephone and Cable television. All power supplies will enter from the back of the lots. All disconnect boxes, meter bases and other hard- ware will be kept as low as possible. ROADS - The road will be in a large circular configuration. This offers some natural speed control . The road will be 25' wide. The adjoining parking area will be 25' x 25'' The road edges, parking lots and mobile unit parking areas will be cleared "^ all necessary trees and graded to assure the easy movement of mobile units. road and parking areas will be well graveled to provide ample base. The road be paved and maintained by a reliable construction firm as each phase of the park is completed. STORAGE - Storage is an absolute necessity in mobile home living. Park rules will permit appropriate private storage houses, However, the Coulter plan has areas designed for additional storage. These sites as described below may also be located on plans submitted to this office by you entitled, "Proposed Development Plan, Stonegate" dated January 5, 1976. Sites are shown on referenced plans as follow: Site #1 is located on Lot 15 at a point approximately 140' east of the common lot line between Lots 15 and 16, 190' west of the common lot line between Lots 14 and 15, and 100' south of the northern border of the proposed development. Site #2 is located on the common lot line between Lots 13 and 14, 100' south of the northern border of the development. The above described well sites are approved by the Division of Health Ser- vices with the following provisos: (1) That the ground surfaces on the uphill side of the well lots be adequately ditched to protect the wells from surface run-off. (2) That no sewer or other source of pollution shall exist or be introduced within 100' of the wells. Buildings, dwellings, barns, etc., are considered to be potential sources of pollution. (3) That the ground surface around each well be sloped so that sur- face water will drain away from the well, (4) No permanent type building, other than the well house, is to be constructed on the well lot. • 6 2 5 • , Mr. Curtis Bane Page 2 April 16, 1976 Violation of any of the above mentioned provisos could lead to disappro- val of the well as a source of public water. Upon receipt of this letter and a well construction permit from the Divi . sion of Environmental Management, you may proceed with drilling operations. Upon completion of the well construction, a twenty-four (24) hour capacity test must be conducted in accordance with requirements of the North Carolina Well Construction Regulations and Standards. Copies of the well completion record, water analysis, pumping test, and three copies of documents and exhibits as outlined in the enclosed Guide for Obtaining Approval of Public Water Supply Systems must be submitted to the Engineering Planning Branch, Division of Health Services in Raleigh. Also, copies of the well completion record, pumping test, and chemical analysis should be submitted to the Divi- sion of Environmental Management. Until the plans and specifications have been reviewed and approved by the Division of Health Services, no construction on any portion of the water system, other than thee well head, is to be r,qrried out. The detailed plans and spe- cifications must be prepared by an engineer licensed to practice in the State of North Carolina. Since January 1972, continuous disinfection of public water supplies is also a requirement. If additional assistance or information is desired from this office, please do not hesitate to call on us. Pgs. 1-17 Phone WITainer: 732-8181 ext. 347 . . • PURPOSE: It receive Planning Board's recommendation on several proposed changes to the Zoning Ordinance text. • NEED: There axe. seven main changes proposed; 1) addition Of telephone booster stations as a permitted use with additional requiremnts; 2) add an additional application criteria to High Density Pesidential which would inc1e the full range of urban services; 3) change the application criteria of the Exi..5ing Commercial-5 district to allow it to be applied to previously zoned • 4) add efficiency apartrents to the Permitted Use Table with Single Family Residence;'5) require that residential accessory structures be placed behinc the principal residence; 6) set tire limits on reapplication for Ppetial Use Permit reqmsts that have been denied and for the start of oanstruction -- under a Special Use Permit; and 7) add definitions for lot area and effir oiency mart-rents to Article 22. DIPACT: ablephcrie bcaster stations (subscriber loop huts) will allow the telephone company to increase its capacity without considerable physical improvements. High density residential rezoning requests will be required to be in areas where the full range of an services are available. The EC-3 district criteria will be changed to allow the district to be applied to previously zoned townships and previously zoned parcels that are not located at activity nodes. It is the intent of the Ordinance to require all accessory residential buildings to be placed behind the principal structure. This wording wakes clear that intent. There should be a tire limit an reapplication for denied or withdrawn Special Use Permits and for the start of canstotinn on twos projects. There are two proposed definitions for lot area and efficiency anarbnants which will clarify sections of the Ordinance. • • EM• EMATION:: Planning Staff recommends" approval. NEED:. There are four major changes- proposed: 1.. addition of definitions of road types that coinside with N.C. D.O.T. ' definitions 2. definition of a lot of record in reference to subdivision requirements 3. revisions to road rights of way to coinside with revised N.C. D.O.T. standards (this also allows us to propose a reduction of private road right of way requirements) 4. deletion of Section VII Variances • IMPPCT The addition of the road types will make the Subdivision Regulations • definitions the same as the EePartment of 'Transportation, which will facilitate understanding.. The lot of record concept is used to determine, the administrative procedure a subdivision must go through for approval. The Department 9f Transportation has recently reduced the right of way requirements for secondary roads. The proposed changes reflect the new requirements. The requirements for private road rights of way have also been reduced.. The section that sets out variance procedures should not have been included in the Subdivision Regulations. The State enabling legislation does not. allow variation from the specific standards of the Subdivision Regulations; therefore, it should be deleted. RoOMIENDATION: Planning Board recommends approval of the proposed changes to the Subdivision Regulations with the exception of the variance section which was recommended to be referred back to the Planning Staff. „ Planning Staff recommends approval. :T. •7. • . • ," • . • • : • ;`. • , " 6 73 1 ti(„)o • •,., • --. - SECTION II. Itimber: ext 515 ext 498 (2) Resolution • PURPOSE: To consider adopting a Deferred Compensation Program for Orange County Employees. NEED: Adoption of a Deferred Compensation Program would provide County employees with an additional benefit at virtually no cost to the county.' Deferred compensation is a method whereby participating employees can set aside a portion of their incomes and not have to pay taxes on that income. In effect, our employees will be able tc add tax dollars to their own dollars and build up a fund to provide supplemental retirement income. Because of the tax shelter advantages and the higher earnings the employees can achieve through mass purchasing power, the employees will be able to accomplish far more than they could if they were trying to save on their own using after-tax dollars. In its simplest form, deferred compensation means, that, - — employees in a 20 percent tax bracket can put $5 into savings for only $4 of thee' own money. The higher the tax bracket, the more they get to keep for each dollar set aside. The extra tax dollar is tax money that would otherwise be gone forever With deferred compensation, employees get to hold on to that tax money and use it, along with their own, to earn more money. And they pay no taxes on the earnings the accumulate until the funds are received. The proceeds of this accumulation are tax- able when received but only on the amount received in any one year and at the em- ployee's itax rate at that time. If this is at retirement, with Sdcail Security ta: free and with double exemptions for persons over age 65, the employee can expect tt be in a lower tax bracket. In an effort to make a sound decision,on the feasibility of offering such a benefit to the employees three Deferred Compensation Plan Administrators were asked to present their proposals. The three were NACo, ICMA, and National Plan Coordinators. All proposals were judged on the basis of the following aspects: Service and Administration, Design, Investments, Communications, Flexibility, Local Accounta- bility, and Cost. Throughout the analysis it became quite clear that all three entities were well respected in the field of Befgrred compensation and were almost parallel in there offerings. However, the deferred compensation program offered by NACo does excell in two very important areas: Service and Flexibility of Invest- ments. As indicated in attachment #1, NACo uses only full time, fully trained, and fully dedicated deferred compensation staff that have proven experience in communicating with County employees, They will provide local staff to enroll and service the plan on an individual participant basis, In addition, they can offer the employees nine investment options, so that the employee can tailor his invest- ments to personal philosophy. Once enrolled, the employee may change his investmen package to maximize yields, IMPACT: As an additional benefit to the employees of Orange County in the fight against the effect of taxes and inflation Deferred Compensation provides (1) no current tax on savings, (2) no current tax on interest or other earnings, (a) signifi- cantly higher earnings on the money because of the mass purchasing power of member NACo counties. RECOMMENDATION: The Board adopt the Resolution establishing a Deferred Compensation Plan for the County of Orange, through the NACo Deferred Compensation Program, and authorize the Chair to sign it. • d~ . . | ' ~ 10d0 ' - ATTACHMENT 1 DEFERRED COMPENSATION t16, 1982 edition cd mre e " . _ The Counties The Best In Defferred Compensation." Whitted, Chairman Orange County Board of Commissioners 128 West Union Street Hillsborough, NC ?7278 Dear Mr. Whitted: I an pleased to announce that Orange • County has been awarded $4,219 in matching funds under the North Carolina Land Records Management Program. Your application requesting fiends defined a program of land records improvements that will benefit the county's operation and your taxpayers. With 28 counties requesting grants amounting to almost $2 million against only $334,532 in available appropriations, it was necessary to scale—down the requests according to an impartial and equitable formula. The figures for the recommended _ grant awards were obtained by prorating the $334,532 among all applicants accord- ing to. their documented eligibility for funding over the next fiscal year only. In addition, the amounts thus obtained were modified by the imposition of a "ceiling" of $20,000 per county and a "floor" of $1,000 or 50% of the requested grant, whichever was less. Attached hereto are fear (/t) copies of the LRMP Grant Agreement covering your grant award to be signed and' returned to this office. This Agreement states the rules and regulations that govern the funding of the state matching grant for your project. When signed by the proper county officials and returned to Donald P. Holloway, Director; N. C. Land Records Management Program, 116 West Jones Street, Raleigh, N. C. 27611, your decision to accept this grant will be formally recorded. Agreements not returned signed by October 22, 1982, will be deemed to have been turned down, and those funds will be redistributed to all other counties accepting their grant awards. As usual, whenigrants are made to counties, audits are required for the work performed under the agreement. Your county will also be required to send a quar terly report to the LRMP offices which will address all activities that are involved in the administration of this grant. We hope that the grant funds will help you to continue the excellent program which your county has undertaken. Sincerely, ane S. ' RE: Critique of Models and Outline of Issues Pertaining to the Establishment of an Economic Development Program This memorandum will set forth the legal background, financial aspects and other isues concerning an economic development program. The Board has been presented with four organizational models for an adminiotrat1 e structure. These will be commented on in terms of general lima— tations and Strengths. ' The term "economic development" is usually under- stood to include promotion and industrial recruitment programs; however, a broader defi tion would also include a utility extension policy, job training and job uppo'tunity requirements, tax incentives and financial assistance, and land use regulations and environmental controls. Organizational Modelu. The fpur models advanced as vehicles for Economic Development include the program becoming the function of: '- - _ . _ 1 . tie Chamber f Commerce 2. alprivate corporation— 3. COunty Government (Planning Department or Ma nayer`s Office) 4. reconstituted Economic Development Authority The Concept of Public Purpose | The evaluation of the efficiency d limitations of each model must take into h legal restrictions placed on the f public funds for ~c development.' »' p ty , lease or gift. It has been at least partial y in all four models. This brings about restrictions because of the "public purpose" doctrine of North Carolina constitutional law. The doctrine states that govern ment exists to serve the interests of the public at large, not the privte interests 1 a few individuals, and government may act only to serve public pur poses. Thu while private money spent by a private organization is not limited by the public purpose doctrine, public money (either County, State or Federal) appropriated to public or private economic development organizations, is. Public Funds Used for Economic Development Promotion The Jources of public funding for economic development promotion are also limited by the State law. General Statutes 163-A~l49 and 180A-209 state that property ta may be used for promotional activities only if approved by the voters. There are other sources of public funds which are available for promo- Board Members -2- Economic Development Program tion of economic development. The sources include sales taxes, ABC profits, utility profits, or general revenue sharing money. If the County gives an appropriation to a private organization, it must be for a specific purpose. Each expenditure by the organization must be approved in advance by the govern- ment and an end-of-year accounting must be made. Finanling Public Facilities The financing of public facilities is another area of economic develop- ment that islrestricted by State law. The laws provide for several different financing me-;hods. Two of the more common methods used by Counties are current revenues and capital reserve funds. Current revenues usually are not used for capital projects because of the large sums of money necessary for these projects Capital rese-ve funds, as permitted under G.S. 159-18-through 22, allow local governments 4,:o save funds over several years in order to acquire or build a capital facipty. If such a fund is established by ordinance or resolution, four points should be approved: 1. Tile purpose for which the money is being reserved, 2. How long money will be accumulated, 3. The approximate amount of money to be reserved, 4. Tle sources of the money. This type of fund may also be inadequate for large capital projects. The most widely used financing method for capital projects in that event is borrowing. ocal governments may issue General Obligation (G.0.) Bonds; or , _Revenue Bond . The G.O. bonds are secured by the taxing power of the govern- ment; whereas revenue bonds are secured only by the revenues generated by the project. G. . bonds are generally less expensive and more secure than revenue bonds. Revenue bonds do not need voter approval for issuance; G.O. bonds w= '=' ^ - ly do. Other financing methods are described in the institute of Government booklet Local Government's Role in Economic Develn"ment: Lg•a7 and Financial Aspects by awl' Lawrence, May 1982. Assi tuncg to a Particular Business Ass4ance of the local government to a particular business may be accom plished through two financing methods. They are industrial revenue bonds and what red to as "63-20 financing". As with most programs there are adva - tages and di advantages. Industrial revenue bonds have been an available financing method since 1976 h pnstitutionol amendment reversed early court cases. The advan- tage f the e bonds is that the interest paid to purchasers is exempt from fed- eral income Itax and, therefore, the interest rate is lower tahn for commercial loans. In North Carolina the County agency which issues these bonds 1s the Industrial Facilities and Pollution Control Financing Authority. This board is set up by t e County Commissioners. The bonds are issued for two broad cate- gories: The first is for any industrial or manufacturing fmcflity. The dollar limit for financing a particular project is $10 million, The second category is for the financing of a pollution control facility for an industry or a publ c utility. There is no dollar limit on the amount for a particular project in th s Board Members -3- Economic Development Program "63-20" financing gets its name from an Internal Revenue Service ruling which set thd ground rules for the practioe. In effect, the ruling gives tax exempt status to private business facilities similar to revenue bonds. Under ^63-20" a non-profit corporation constructs and leases a structure. When the obligations f the corporation are retired by the lease payments of the occupant-, the facility is treated like a governmental unit. The five conditions that must be met for 3-20/' financing are: ---- 1. Tlie corporation must engage in essentially public activities._ ' 2, The corporation must be non-profit. 3. The corporation income must not benefit a private person. 4. The governmental unit must have a "beneficial interest" in the corporation for while the obligation is being retired and must otain full title to the property when indebtedness is retired. 5. T1.e governmetal unit must approve the corporation and the igmtions undertaken. This thod of financing is useful because of the degree of fYeuibflitv allowed, which does not exist with industrial revenue bonds. There are two ' disadvantages: First, the corporation may not wish to have the government own the facility land second, it is not certain 63-20 financing 1s allowed due to recent chmng s in North Carolina law. Conclusions as to Public Financins The 4tention of the above discussion was to point out some of the possi- bilities and financial limitations placed on a local government undertaking an ecunhmic development pn}Bram. The main points are: 1. T e use of public funds in the Economic Development effort are restricted by State law and the State Constitution. 2. Private efforts that do not use public funds are not constrained bY these laws. 3. P ivate efforts using public funds must use the funds according to the State Lawy, 4. Tbere exists several different financing methods for local govern- ment to mount an economic development effort. 5. S me sources of funds necessary for development are not available in the private sector. Funcdons of the Economic Develo"ment Pro"ram There are at least ten functions that any one of the proposed models would need to carry out. It is reasonable to assume that there would be revisions toithis list, but it provides a starting point for discussion. An effort has been made to evaluate the effectiveness with which each model could be expected io achieve in carrying out the functions. This is a judgment evaluation staff's part and therefore subject to any revisions that a wider assessment might show. In the following matrix an asterisk indicates a high rating of effectiveness per each function. ~' . 8oar1 MubeFs '4- Economic Development Program CHAMBER ECONOMIC_ OF PRIVATE COUNTY UEVELOPMEMT FUNCTIONS COMMERCE CORPORATION GOVERNMENT AUTHORITY l. They include: 1. I it necessary to have an oversight commission or board? 2' there is a commission what will its role be? a\ Will it be supervisory or advisory for policy setting? b If the Council were advisory, then how 1s supervision of staff to be provided and to what extent (periodic or daily)? _ , Board Members -5- Economic Development Program 3. What should be the composition of the commission? a) Should members be included to represent geographic areas, . governmental units, the Chamber of Commerce, other business groups, agriculture, minorities and women? • b) What should be the degree of County representation in light of the fact that most of the developable land lies within the unincorporated area? -'--- Should utility providers (electrical , water, sewer, tele-- ' - and natural gas) be represented on the Council or shoUld they provide technical assistance and act as resources to the Council? 4. H w will support to staff be provided for such needs as office sliace and utilities, photo copying, vehicle, fringe benefits, expense account, clerical support. 5. W at means are available to insure confidentiality in the nego- t ation processes that will arise with particular industries? m) Public bodies can go into executive session to discuss real estate matters. b) Private organizations may set up their own rules or procedures. 6. What means would be available if an economic development program needed to be reorganized to better suit the existing needs? aY If a private organization is set up, changes could be made _ -- through alteration of by-laws and direction by the Board of` Directors. b Under a public organization the electoral process, budgetory review and personnel evaluation, and direction by an oversight commission are mechanisms for change. 7, Willat would be the costs of establishing an organization? a) A private organization would provide all the support services listed above in addition to the salary of professional staff. b) The public organization, if it were part of County government | could make use of the existing County facilities and programs. This could reduce the overall costs of the program. O. HOw can the costs of an economic development program be divided between several participants? a) There are two types of costs that need to be provided for, the first is the initial or start up costs. The second cost would be any additional operating monies needed during the budget year. Recommendation, The r comnendation which follows is the affirmative step which I believe the County should take at this point to take account of County-wide needs and to encourage other area groups in their continued pursuit of development cor- pnrntimns. I have the confidence the structure outlined will operate well _ Board Members -6- Economic Development Program based on prior prilr experiences and observation of other such programs. 1.
