Commissioners Present: Chairman Richard E. Whitted, and Commissioners Norman Gustaveson, Shirley E. Marshall and Don Hillhoit, Commissioners Absent: Commissioner Norman Walker. A: Damascus Fire District The Clerk to the Board said she had received the Certification of the Damascus Fire District Referendum held on June 29, 1982; the referendum to establish the fire district passed with 62 in favor of and 4 opposed to the district. That Certification is on page of these Minutes. O: Southern Triangle & Damascus Fire Districts Contracts Commissioner Marshall moved, seconded by Commissioner Gustaveson, to approve contracts for service for Damascus Fire District (and to set that tax rate at $0'04/hundred) and the Southern Triangle Fire District with the North Chatham Volunteer Fire Department. Vote: Ayes, 4; noes, O. C: Contract for IV-D Commissioner Gustaveson moved, seconded by Commissioner Marshall, to approve the contract for the Child Support Enforcement Legal Services with the firm of Coleman, Bernholz, Dickerson, Bernholz, Gledhill and Hargrave. Vote: Ayes, 4; noes, O. D: CD-Rehab Contracts Commissioner Marshall moved, seconded by Commissioner Gustaveson, to approve the contracts for rehabilitation for units # 120, 83, and 8 to McDuffie Construction for the amounts of $0,180'00, $9,265.00, and $7,720.00, respectively. There was some discussion about whether one contractor was receiving a dispro- portionate share of the rehab contracts. The Manager replied that a study done in November, 1982, showed that the contracts were fairly well spread out over thirteen contractors. Vote: Ayes, 4; noes, O. With no further business before it, Commissioner Whitted declared the Board meeting adjourned. Richard E. NEED: In April the Board of Commissioners called for a referendum to be held on the creation of the Damascus Fire District. This was held on June 29, 1982. The Board of Commissioners adopted the County budget on June 22, 1982. The Board scheduled a special meeting to set the tax rate for Damascus Fire District, contingent upon passage of the referendum. Upon certification of the referendum results by the Board of Electionsi. the Commissioners should, if the referendum has passed, set the tax rate $.04. as recommended by the Damascus Fire District Board of Trustees. IMPACT: Contingent upon the passage of the referendum, setting the tax rate and the signing of the contract with the North Chatham Volunteer Fire Depart- ment this district will begin to receive fire protection. This contract proposes an hourly rate of $45.00, an increase of $5.00 from prior years. Historically, we have represented the child support program since its inception. The first written contract between the County and our firm is dated April 29, 1976 and called for hourly compensation of $40.00 for work done out of court and $75.00 for work done in court. This contract was open-ended in terms of duration. In September 1976, the State office advised Flora Garrett, then Chair of the Board, that the State would not reimburse Orange County fully for legal services paid under this contract because the hourly rate exceeded State authorized guidelines. Thereafter, in the Fall of 1976, we agreed to a new contract calling for a single hourly rate of $40.00 for all services. This rate was approved by the State for reimbursement.(Seventy-five percent of all child support enforcement program operation expenses are reimbursed by the State from Federal and State funds. Likewise a substantial portion of the support money collected is directed to the State as reimbursement for these expenditures.) This contract was executed by the Board and our firm on October 19, 1976 and, by its terms, expired on June 30, 1977, Since October 1976 we have provided legal services to the child support program for an hourly rate of $4D.00. Each fiscal year since that time a contract has been executed reflecting this understanding. The State IV-D office will now reimburse counties for contracted legal services at a rate of $45.00 per hour. (This hourly rate has been authorized since May, 1981) The enclosed contract, for legal services from July 1, 1982 through June 30, 1983, reflects this new rate. We think the modest increase warranted given the history of the current fee basis. Also, the preliminary budget for the child _ support program recently presented to the Board_contained an amount. adequate to cover this increase in our charge. In fact, the total additional cost per year should not exceed $700.00, requiring an additional $175.00 in Orange County funds (25% of the total). Very truly yours, •wi 3 eoffrey Gledhill GEG/jac Enclosure cc: Mr. Kenneth Thompson •1 NORTH CAROLINA ORANGE COUNTY THIS AGREEMENT, made and entered into the 1st day Of July, 1982, by and between COLEMAN, BERNHOLZ, DICKERSON, BERNHOLZ, GLEDHILL AND HARGRAVE, attorneys at law, Orange County, North Carolina, hereinafter referred to as ATTORNEYS, and ORANGE COUNTY, North Carolina, hereinafter referred to as COUNTY: WITNESSETH: WHEREAS, the COUNTY has need for legal services not otherwise provided by the ATTORNEYS or other County agencies, in connection with matters which arise out of the COUNTY's administration of the Child Support Enforcement Program, Title IV-D of the Social Security Act under Article 9, Chapter 110 of the North Carolina General Statutes Section D0-128 et seq; and WHEREAS, it is the desire of the COUNTY to enter into an agreement of employment with the ATTORNEYS for the performance of such services that shall be required by the COUNTY from time-to-time for the Child Support Enforcement Program; and WHEREAS, the ATTORNEYS have agreed to represent the COUNTY as is hereinafter provided for a term extending from and after the date of this agreement to and including June 30, 1983; • NOW, THEREFORE, for and in consideration of the mutual terms and agreements hereinafter set forth, the COUNTY and the ATTORNEYS do contract, each with the other, as follows: 1. The ATTORNEYS shall perform such services and render such advise to the COUNTY on such occasions as shall be required. to. properly and adequately represent the COUNTY in its administration of the Child Support Enforcement Program. 2. The ATTORNEYS shall be compensated for all services rendered in connection with paragraph number I above based on an hourly rate for services rendered of Forty-Five and No/100 Dollars ($45.00), such hours and amounts to be furnished to the County Finance Officer for payment. The COUNTY shall be responsible for all costs and expenses incurred in the performance of the services rendered the COUNTY in connection with the Child support Enforcement Program. All costs and expenses advanced by the ATTORNEYS on behalf of COUNTY shall be reimbursed to ATTORNEYS. 3. The ATTORNEYS shall keep an itemized record of work performed for the COUNTY in connection with the Child Support Enforcement Program on a case-by-case basis and shall submit its bill therefor showing a breakdown of those services rendered on a case-by- case basis. 4. The ATTORNEYS may, from time to time, be awarded attorney's fees by the Court for representation of the COUNTY in the Child Support Enforcement Program. In the event the Court makes such -2- an award the ATTORNEYS shall account to the COUNTY for all such attorney's fees received as a result of a Court order. Such accounting shall be on a case-by-case basis. 5. Recognizing that from time to time representation of the COUNTY by the ATTORNEYS may result in a conflict of interest for the ATTORNEYS, it is agreed that when such a conflict arises, the ATTORNEYS may refer cases requiring legal services to other lawyers in Orange County. Such referrals shall be with the consent and approval of the County Manager. In all cases of referral, the attorney to which the case is referred shall be compensated in the same manner as specified in paragraph 2 above, and shall keep an itemized record of work performed for the COUNTY on a case-by-case basis, submitting a bill therefor showing a breakdown of services performed on a case-by-case basis as specified in paragraph 3. In the event such an attorney is awarded counsel fees by the Court in this regard, an accounting shall be made to the COUNTY in the same manner as provided for in paragraph 4 above. 6. This agreement shall exist and continue from the date hereof to June 30, 1083, at which time the parties shall be free to renegotiate this agreement and modify the same as the existing conditions may dictate, IN WITNESS WHEREOF, the COUNTY and the ATTORNEYS have hereunto signed this agreement in duplicate originals, one of which is retained by each party hereto and either of which is sufficient as the original.
