The Orange County Board of Commissioners met in regular session on
Monday, June 7, 1982, at 10:00 A.M. in the Commissioners' Room, Orange
County Courthouse, Hillsborough, North Carolina.
Commissioners prdsent; Chairman Richard E. Whitted, and Commissioners
Norman Gustaveson, Shirley E. Marshall, Norman Walker and Don Wil}hoit.
A. BOARD COMMENTS
Commissioner Whitted added an announcement to the agenda and litigation
to the executive session. Commissioner Marshall asked that when Proclamations
are written that the audience composition be considered for better c omphrensfnn-
B. AUDIENCE COMMENTS
There were no persons in the audience who wished to coment about items
. on the agenda or not on the agenda.
C. MINUTES
' Commissioner Marshall moved, seconded by Commissioner Gustaveson, to
approve the minutes of March 22, 1982,as submitted. Vote: Ayes, 5; noes, O.
Commissioner Marshall moved, seconded by Commissioner Gustaveson, to
approve the minutes of April 5, 1982, as submitted. Vote: Ayes, 5; noes, O.
Commissioner Gustaveson moved, seconded by Commissioner Marshall , to
approve the minutes of May 25, 1982, as submitted. Vote: Ayes, 5; noes. O.
Commissioner Gustaveson moved, seconded by Commissioner Whitted, to
approve the minutes of May 27, 1982, as submitted. Vote: Ayes, 5; noes, 8.
The Minutes of April 20, 1982, were approved after lunch but are included
here for conciseness.

D. DECISIONS BY BOARD
1. Conference for Children and Youth: Ms. Nancy Park asked that the
Board carry over into Fiscal '82-'83 the $100 stipend the County had received
to hold a follow-up conference on children and youth. She outlined some rough
, ) plans for two County conferences for the fall and next spring. The Board
indicated there was no problem with carrying over the funds into FY '82-'83'
AN�2, GOVERNOR'S STATEWIDE VOLUNTEER AWARDS:
Commissioner Gustaveson moved the nomination of Gladys Parker and Walter
Trott in the category of School Volunteer; Commissioner Marshall seconded the
nomination, Vote: Ayes, 5; noes, 0,
Commissioner Gustaveson moved, seconded by Commissioner Willhoit, the . |

nomination of Village Companies, Inc', in the category of Business/Industry
Volunteer Involvement. Vote: Ayes, 5; noes, V.
The Clerk was asked to convey these nominations to the Governor and to
seek further nominations for Youth Volunteer from the 4-H Clubs and Recreation
and the Youth Services Task Force.
3. APPOINTMENTS
Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to
reappoint Dr. Betty Landsberger to the Senior Citizens Board. Vote: Ayes,
5; noes, O.
Commissioner Marshall moved, seconded by Commissioner Gustaveson, to
. appoint Erma Jean Smith to the Senior Citizens Board. Vote: Ayes, 5; noes, O.
Commissioner Marshall moved, seconded by Commissioner Willhoit, to
reappoint Rodger Dalston to a term on the Chapel Hill Planning Board. Vote:
Ayes, 5; noes, 0.
Cominsioner Gustaveson moved, seconded by Commissioner Marshall , to
reappoint Mr. James Bullard, and Mr' Velverton Land to terms on the Chapel
Hill Board of Adjustment, Vote: Ayes, 5; noes, O.
Commissioner Nhitted moved, seconded by Commissioner Gustaveson, to
appoint Mr. Arthur Plumbeck to a term on the Hillsborough Planning Board.
Vote: Ayes, 5; noes, U.
Commissioner Walker moved, seconded by Commissioner Marshall, to appoint
Lorraine Parker from the ,Little River Township, to a term on the Recreation
Advisory Council as that Township's representative. Vote: Ayes, 5; noes, O.
Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to
appoint Michael Boyd to a term on the Energy Commission. Vote: Ayes, 5;
noes, o'
Commissioner Willhoit moved seconded by Commissioner Marshall, to appoint
Theodore Eason to a term on the Energy Commission: Vote: Ayes, 5; noes, 0'
The Clerk was instructed to advertise vacancies on the Orange County
�
U ~~
Planning Board (Eno and Cedar Grove Townships), Commission on Women, and the
Nursing Home Advisory Council. The Board is still awaiting recommendations
for the Southern Triangle Fire District Board of Trustees; appointment pro-
cedures for the fire districts were to be investigated. The Clerk was asked
to write a letter:. to Mr. McKerrow from the Board, thanking him for his faith-
' ful service on the Senior Citizens Board and the former Council on Aging.
4. JUDGE AND D.A.'S LEASE RENEWAL
Commissioner Marshall moved, seconded by Commissioner Gustaveson, to
approve the lease renewal for office space for the Judge's and D.A.'s offices.
Vote: Ayes, 5; noes, O.
5. CEDAR GROVE AND CALDWELL FIRE DEPARTMENTS--CERTIFICATION
Commissioner Walker moved, seconded by Commissioner Gustaveson, to
certify the rosters of the Cedar Grove and Caldwell Fire Departments. Vote:
Ayes, 5; noes, O.
6. DISCUSSION OF AUDIT FORMAT
The Board discussed with the Manager and the Finance Director special
schedules that it would like to see included in the County's annual audit.
The Finance Director passed out copies of schedules that he would like to
phase into the audit report while working toward a Certificate of Compliance
from the NFOA. The Board expressed satisfaction with the Finance Director's
plan and some Board members suggested a Capital Projects schedule in order to
more easily track a particular project through the budget. Commissioner Whitted
said he would be pleased to have Commissioners Gustaveson and Walker work on
the Audit Committee with the Manager and Finance Director. Commissioner Walker
said he would withdraw in favor of Commissioner Whitted and Commissioner Gustaveston.
7. VACANT COUNTY POSITION
The County Manager added consideration of a Clerk Typist position in
the Social Services Dapartment, Commissioner Whitted moved, seconded by
Commissioner Marshall, to fill both the Clerk Typist position and the Child
Support Enforcement Officer position. Vote: Ayes, 5; noes, 0'
8. PLANNING
a. Subdivisions
HICKORY HILL PRELIMINARY PLAT: Mr. Rick Cannity, Planning Staff, made
the Planning Department's presentation on this subdivision (for details see
page of this book). The Board expressed a wish that the number of drive-

ways entering directly onto the main highway (in this case NC 86) be limited
for safety reasons, Commissioner Marshall moved, seconded by Commissioner
Gustaveson, to approve the Planning Board's recommendation of approval of
Hickory Hill Preliminary Plat with the three conditions recommended.by the
Planning Board (see page /.I for those conditions) and the additional
stdpulatinn that the existing lot of approximately 1'8 acres be allowed
access to the proposed Class B road in the subdivision. Commissioner Nillhnit,
noting that the subdivision was divided by two different fire districts, offered
an amendment (which was accepted) that the subdivision be within one fire district.
Vote: Ayes, 5; noes, O.
ELIZABETH PEGG LATTA PROPERTY: Mr. Cannity made the Planning Department's
presentation to the Board on this subdivision (see page of this book for
specifics). Commissioner Gustaveson moved, seconded by Commissioner Walker,
to approve the Planning Board's recommendation of approval of this subdivision
with the attached condition (see page /1 for the condition). Vote: Ayes, 5;
noes, D.
Commissioner Nillhoit, questioning the wisdom of approving lots that don't
perk, asked that the Tax Supervisor prepare an analysis of valuation of befor,
and after tax values on such lots.
SANDBERG WOODS PRELIMINARY PLAT: Mr. Cannity made the Planning Depart-
ment's presentation to the Board on this subdivision (see page 147 of this
book for speoifioS). Commissioner Gustaveson moved, seconded by Commissioner
Walker, to approve the Planning Board's recommendation for approval of this
subdivision. Vote: Ayes, 5; noes, O.
EVERETT AND EVELYN RUSH PROPERTY: Mr. Cannity made the Planning Depart-
ment's presentation to the Board on this subdivision (see page /.6- of this
book for specifics). Commissioner Walker moved„ semnnded by Commissinner

Whitted, to approve the Planning Board's recommendation for approval of this
subdivision with conditions recommended by the Planning Staff (see page for
conditions). Vote: Ayes, 5; noes, O.
Commissioner Wilihoit moved, seconded by Commissioner Whitted, that previous
approval of the subdivision be contingent upon its being located completely within
one single fineAistr1ct. Vote: Ayes, 5; noes, 0'
b. ROAD NAME/SIGN POLICY: The County Manager told the Board that Planning
needed guidance on posting road signs on public non-State maintained roads. Com-
- misminner Gustaveson moved, seconded by Commissioner Walker, to adopt a

policy for posting public roads provided that: a) the roads are on the State
road system; b) the public, non-state maintained roads will be added onto the
State road system; and c) the public, non-State maintained roads will not
be added to the State system but there is a recorded plat showing the right-of
way as public and 51% of the residents want the County to erect a road name
sign. Vote: Ayes, 5; noes, O.
c. PUBLIC HEARING DATE
The Board set the RONAC public hearing date for July 8, 1982, to follow the
Midway airport on the agenda.
d. RECOMMENDED ROAD NAMES TAKEN TO PUBLIC HEARING ON MAY 18, 1982
Commissioner Gustaveson moved, seconded by Commissioner Marshall, to
approve the recommended names submitted by RONAC and taken to public hearing
on May 18, 1982 (that list is on pages /6-0e�of this book). Following dis-
cussion cusninn on a policy for maintenance and replacement of sign blades, Commissioner
Walker called the question' Vote on the motion: Ayes, 4 (Commissioners
Whitted, Gustaveson Marshall and Walker); noes, 1 (Commissioner Willhoit).
ANNOUNCEMENT:
The County Manager announced that he had received the resignation of the
Planning Director who had accepted a position in West Palm Beach, Florida. The
Board wished Mr. Polatty all the best in his new career position.
EXECUTIVE SESSION:
Commissioner Gustaveson moved, seconded by Commissioner Marshall, to
convene in executive session to discuss personnel, property and Tigitation
matters. Vote: Ayes, 4; noes, O. (Commissioner Willhoit was not in the room
for this vote.)
Following the executive xesSion, the Board adjourned for lunch; after
the lunch break the Board resumed deliberations with all members present.
10. WORK SESSION ON BUDGET
The Finance Director and the Manager reviewed the revenue picture for
the County Comminsioners, The Board set the following dates and areas of
discussion for budget work sessions: June 9 (Hillsborough) Public Works,
Capital Improvements Program, Manager's budget, Economic Development, Planning;
June 10 (Hillsborough) Sheriff, Jail, EMS, Commission On Women, Rape Crisis,
Battered Women and Women's Health Counselling; June 17 (southern end of County)
Health, D3%, general discussion and schools' budget.

Board members provided County Staff with suggestions and requests for
information in various areas for budget consideration.
At the end of the budget work session, Dr. Mike Simmons provided the
Commissioners with handouts detailing the reductions suffered by the public
schools and proposed reductions. He outlined the percentage by general funds
received by public schools over the past six years. These figures did not
include capital funds received by the schools. The Board thanked Dr. Simmons
for his information.

I have received notification that Orange County has received
a n00 stipend to hold a follow up conference on Children and
Youth. Commissioner Whitted asked that I contact you and ask
that you and those who attended the original December conference
form an ad hoc committee to come up with ideas for a follow
up conference which you may pass on to the BOC.
I am attaching all information which the BOC has received on
this conference. Please bear in mind that the stipend is
only $100.00.

Enclosed is the $100 stipend for your county's follow-up activities
evolving from the State White Hose Conference on Children & Youth. An
overview of the application forms reveals many and varied follow-up clans
for county activities that will hopefully result in innovative resp-nses
to the special needs of children and youth across North Carolina. The
stipend is intended to be the seed money that will help launch these local

Dear Jean:
A propos of your phone call last night, I would
like to nominate a teen of two people for the out-
standing volunteer award. They are Walter Trott of
62 Willow Terrace in Chapel Hill, and Gladys Parker
of 305 Lindsay Street in Carrboro. 72.1,o2/5
As you yourself know, no noney was appropriated
for landscaping when Carrboro Elementary School (and
others in the system) was built. As a result, the
grounds were a disgrace -- nothing but naked, rock-hard
clay surface. Well ■4alter rott, a retired school
principal from Pennsylvania, set to work. He cajoled
money out of various civic groups in town. He got the
Arboretum to contribute surplus plants. And he got
• the school system maintenance department to do the
rough grading and some of the heavy digging. Joined
by Gladys Parker, who at the tine had a son in Carrboro
Elementary School, they dug, planted, watered, and
weeded: not just weekends, but day after day. School
principal Randy Marshall estimates that each put in
about 450 hours of work -- unpaid of course -- each
year for the last five years. (Gladys, I should note,
has not had a child in the school for the last three
years.) As a result of their labors, "arrboro Elementary
School is now the showplace of Carrboro. People come
from all over the county to see the glorious displays
of pyrocantha (I think that's the spelling), of asaelas,
of chrysanthemums, of hollyhocks, and of all the rest
of the plants that await their turn to blossom and
cheer the entire community. For their contribution to

Mr. Baucom is an active member of the downtown Rotary Club and the K��nis

Mike Carson, former Chapel Hill Southern Bell Manager, was also active Youth In 1900-81 Mr. Carson served as -"~ `Orange County District n of the Scouting Program.
Southern Bell employees are active with the Orange County Association
of Retarded Citizens.
The employees union sponsors an annual fish fry raising money for the
Association for Retarded Citizens.
The employees have been pace setters in the past three United Way Campaigns
Southern Bell has sponsored blood donation drives for employees,
Schools: Many educational courses are offered by S Bell in the School
Systems for all grades. Active participation with science and history fairs
in the elementary schools.
Employees also participate in job fairs and career days at local schools and
have sponsored separate careers programs for mimnrites.
Local theatrical and playmaker groups often call on S Bell to donate
equipment for productions.

Management has been active in fund raising for the YMCA.In 1980 S Bell

Senior Citizens Board--The terms of both Dr. Landsberger and Mr. McKerrow
expire on June 30, 1982. Dr. Landsberger would like to be reappointed
(her letter is attached); Mr. McKerrow feels unable to continue service
at this level (his letter is attached). The position has been advertised.
Additionally, I am attaching the resume of Ms. Smith who is interested

Nursing Home Advisory Council--According to the by-laws of this Council, a
member must be added when a nursing home is opened. Hillhaven plans
to open one in August. This has not been advertised. For additional

Chapel Hill Planning Board--Mr. Dalston's term expires on June 60, 1982;
This Board has recoomended his reappointment. In addition, Mr. George
Meyer, Jr., has resigned from this Board; a recommendation will be forth-

CH Board of Adjustment--This Board recommends the reappointment of both Mr,
James Bullard and Mr. Velverton Land (again, please see Ms. Cherry's
letter).
CommdIssion For Women--I have received several resumes which have been for-

Hillsborough Planning Board--This item was deferred from the May 3rd meeting,

This is in reply to Ms. Pridgen-Pond's request of May 11, 1982
as to my interest in serving another term on the Senior Citizens '
Board. I have given the matter careful consideration and decided
it is not wise for me to be considered for reappointment to the
Board.
As you may know,, I was first appointed to the Board of Direct-
ors at the former Orange County Council an Aging in 1976 and served
as Chairman of the Search Committee which recommended the appointment
of Jerry Passmore to succeed Charles Martin as Executive Director -
a decision which has brought distinction and remarkable expansion
to the County's programs for its older citizens. I also had the
privilege to serve as Chairman of the Council's Board from October
1980 until it was dissolved in October 1980 following the estab-
lishment at the County Department on Aging and Senior Citizen's
Board.
Service on the Board of the Council and for the past seventeen
months an the Senior Citizens' Board has been a source of great
satisfaction and I shell always cherish the opportunity it has aff-
arded for association with the fine people I have come to know and
admire in their dedicated service to the senior citizens of the
County. I especially appreciate the courtesies always extended by
the County Commissioners,

assist the Department on Aging and other County services in meeting

The Reverend Mr. Curtis Tyler visited the office last week and asked that
several points be brought to the Board's attention regarding the addition
of a member to the Council.
1--All five of the present members are profeosinnals. Some lay input
is probably desirable.

2--All five of the present members are Caucasian.
J--There is only one representative from Northern Orange.
4--All terms expire in December of 1982' Perhaps the Board of Commissioners
would like to give some thought to staggering terms. For continuity
there would ideally be some carry-over (reappointment) of Council
members; however, the Reverend Mr. Tyler says most members of the Council
feel unable to commit to another four years.
At present there are three women and two men on the Cponcil .
According to the by-laws, 1/3 of the membership is to be nominated by
nursing homes; at the present time, two members of the Council are nursing
home nominees.

Rent would go from $250.00/month (has been that amount since January

between NELLIE DAVIS CHESHIRE of Orange County, North Carolina,
hereinafter called Lessor and ORANGE COUNTY, hereinafter called Tenant,
WITNESSETH:
That Lessor and Tenant wish to renew the lease agreement
entered into between them dated January 1, 1979 for that portion of the
first floor of the Cheshire Building situated at the northeast corner of
Churton and King Streets in Hillsborough, North Carolina not now occupied
by the law firm of Graham and Cheshire, to be used for offices and no
other purpose, for a term beginning March 1, 1982 and ending upon thirty
days written notice by either party delivered to the other at any time after
the commencement of this lease.
The rental to be paid by Tenant shall be $300.00 per month, said
payments to be made on or before the first day of each calendar month in
advance.
All other terms and conditions contained in the lease between
the parties dated January 1, 1979, a copy of which is attached hereto and
incorporated herein by reference, are in full force and effect as if fully set
out herein.

WITNESSETH:
That Lessor hereby leases to Tenant that portion of the
first floor of the Cheshire Building situated at the northeast
corner of Churton and King Streets in Hillsborough, N.C. , not

3. Tenant will during the term keep and at the expiration
thereof deliver up the said premises in as good order and condi-
tion as when said tenant took possession, reasonable wear and
tear and damage by accidental fire alone excepted, nor shall the
tenant or his employeeS or servants mar, deface or injure the
i walls of said premises, and any and all damages occurring to the
building or fixtures by the tenant, or tenant's employees in
moving in or out of same, shall be borne and paid for by the
tenant and paid for immediately, and any and all damages or
• injuries done by the tenant, his employees, servants or visitors,
I however caused, either to the building or fixtures, or to any
other tenant, or by the escape of water,esteam, gas or other
substance caused by negligence of tenant, his employees, servants
or visitors shall, be borne by the tenant and paid for immediately
after its occurrence, and all alterations, additions or improve-
ments made by either of the parties hereto upon the premises
except movable office furniture put in at the expense of the
tenant, shall be the property of the lessor, and shall remain

upon and be surrendered with the premises at the termination
of this agreement and lease,
4. It is agreed that the lessor shall not be liable for
any damage or injury to property of person from any source what-
. soever or at any time, in the leased premises or building, from
steam, gases,electricity, water or rain, or from defective
plumbing, pipes, wiring or defective machinery or equipment or
carelessness in operation, as the rental herein charged is made
on a basis of the tenant and his servants, employees and visi-
tors
assuming for themselves such risk.
5. If during the term the demised premises shall be
I damaged by fire or the elements, they shall be repaired by the

be so badly injured that they cannot be repaired with such

diligence so as to be fit for occupancy within thirty days from
such injury, the rent shall cease from the date of the injury

until they shall be so repaired; and the tenancy shall not be
terminated unless such repairs shall require more than sixty
days, in which case tenant shall have the option of vacating
the premises, provided always, that there shall be no such
cessation of rent if the damage shall have been the result of
the negligence, default, or willful act of the tenant or his
agents or employees.
6. Tenant shall give to lessor prompt written notice of
any accidents to, or defects in, the water pipes, electric wires,
or heating apparatus, to be remedied by lessor with due diligence.
7. The lessor agrees that the tenant shall enjoy said
1; premises during said term free from adverse claims of any person,
and that the lessor will pay all taxes and assessments that shall
be levied upon the same, except such taxes as said tenant shall
be primarily liable for. If the said tenant shall neglect to
make any payment or rent when due within ten days after the same
I is due, or shall neglect to keep or perform any condition herein
on his part, to be kept or performed, or shall violate any pro-
vision of this lease, or the rules and regulations hereunto
annexed and made a part hereof, then the lessor without any
I previous notice or demand may terminate this lease and require
I the tenant to vacate the said rooms hereby leased, or the lessor
• 1 may enter the premises and expel the tenant therefrom without
prejudice to other remedies; notice to quit possession and every
1 ether formality is hereby waived in case of any such default
Ior breach of this lease or said rules and regulations.
8 . The rules and regulations in regard to said building,
annexed to this lease, and such amendments and modifications
thereof as may from time to time be made by the lessor, shall
I be considered a part of this agreement, and tenant covenants
that said rules and regulations shall be faithfully observed by

9. All rights and liabilities herein given to or imposed
upon either of the parties hereto shall extend to the heirs,

I A. The entry, passages, and stairways shall nto be ob-

G. No tenant shall use any other method of heating than

oil furnaces.
H. The lessor shall have the right to enter any premises
at any hour to examine the same or to make such repairs and

preservation of the said building.

TI-LE CAFR'S STATISTICAL SECTION
The National council on Governmental Accounting (NCGA) has long reem-
" mended that every governmental unit prepare and publish a comprehensive
annual financial report (CAFTO covering all of its funds and financial
transactions during the year. The CAFR contains separate Introductory, Fin-
uncial, and Statistical Sections. The Statistical Section is intended to
provide CAFR users with a broader and deeper perspective on the financial
affairs of the reporting govermnent than is provided in its Introductory
Section letter et' transmittal and Financial Section-financial statements
and supporting schedules.,
Statistical Section tables differ frem Financial Section presentations
in that they usually cover more than two fiscal years and may present non-
, accounting data. In contrast to Financial Section information, therefore%
Statistical Section data are not usually susceptible to independent audit.
- -Statistical tables reflect social and economic data, financial trends and"
the fiscal cuOacity of the government.

In its 1979 Statement 1, Governmental Accountin and FinancialaR1
Princi les,1 the NCGA made certain changes in the recomnended Statistical
Section contents previously set forth in its 1968 Governmental Accountin
Auditin and Financial Re ortin:2 (GAAFR). This article discus.Ses those
changes and provides illustrations of the new statistical tables recommended
in Statement 1.„

PURPOSE: To consider approval of the Preliminary Plan for Hickory Hill
NEED: Property is located in Chapel Hill Township off SR 1009
(Old NC 86). There are 6 lots proposed out of 41.9 acres.
The proposed road is to be constructed to Private Class B
standards. The it sizes meet Orange Opunty's minimum
requirements. The tract is designated Rural Buffer in the
Land Use Plan and is located in the Orange Grove Rural.
And South Orange Fire Districts.
IMPACT: The proposal is bordered by residential development and
other large tracts of land. There is a gas company right-of-
way and underground pipeline that passes through the
property, however with the large lot sizes, this would
not be affected. This area is designated Rural Buffer and
development would have minimal impacts.
RECOMMENDATION: The Planning Staff recommends approval with the following
requirements:
1. The private road easement be extended to the western

2. That lots not having Health Department approval be
combined or listed properly on the final plat.
3. The name of the Subdivision be changed to keep from
duplicating or being similar to previous recorded
subdivisions.

Dear Mr. Cannady:
The Carrboro Planning staff presented the major subdivision
on Old 86 to the Planning Board on May 6, 1982. The Planning
Board has requested that they be notified of all Courtesy
— Reviews that come to the Planning Department.
The Carrboro Planning Board did not make any specific
recommendations on this site plan. After a brief discussion
the Planning Board recommended that the staff respond to the
review request.
The following comments are based upon our Land Use Ordinance
requirements:
1) The application is incomplete based upon the infor-
mation shown on the site plan.
2) If this site were within our jurisdiction, then a
major subdivision would require a Conditional Use Permit
from the Board of Aldermen and Final Plat approval before
lots can be sold or building permits issued.
3) A minor paved street with a minimum pavement width
of 20' and a 50' right-of-way would be required. This
requirement applies when a street served more than three
residential lots or three units, The Town does not
wish to be put in the position of having to pave streets
in areas that are annexed in the future; however, the
site in question is far enough out so that annexation
is a remote possibility at the present time. I under-
stand that the county ordinance does not require paving
unless more than 9 lots are served by the street.

We would encourage the county to adopt a stricter
paving requirement in major subdivisions.

4) Our ordinance requires trees along dedicated streets.
The trees should be an average of 30 apart and within
50' feet from the center line of the street. The Town
an
basically would like to have a canopy of trees over all
its streets in the future. Developers are also encouraged
to retain large trees (over eighteen inches in diameter)
on the site.
The major difference in our ordinances seems to be the road.pav-
ing requirement. Although we have no jurisdiction over
this subdivision we encourage the developers to pave the
street and request your consideration of stricter paving
requirements for subdivisions in Orange County; particularly
for the transition areas bordering Chapel Hill and Carrboro.

There are 4 lots proposed out of approximately 37 acres. All lots will have
state road frontage. The lot sizes meet the minimum standards of the Zoning
Ordinance and Subdivision Regulations, This tract Is located in the University
Lake watershed which is designated ':!ater Supply 'Iatershed on the Land Use
Plan.
nWPACT: The proposed subdivision meets the existing standards for lot size in the
University Lake iatershed and is bordered by other large lots and cesidentlel
development. This area Is designated pater Supply Watershed and development
with lot sizes proposed would have minimal impacts.
PECOVHENDATICN: The Planning Staff recommends approval with the condition that a
maintenance agreement for the continued upkeep of the dam be submitted
to and approved by Orange County prior to the approval of the final plat
and that the lot lines be :hanged so the dam is in one lot.

This is in response to your request today concerning the subdivision of
property at the subject dam.
As discussed with Warren Faircloth, the Land Quality Section has no authority
concerning subdivision of property at a dam site. However, we would be interested
in the following:
1. Any construction, repair, alteration or removal of a dam. The
Dam Safety Law of 1967 requires a permit for such activity
when the darn is under its jurisdiction.
2. Any construction below a dam which may change the hazard classi-
fication.
3. Any change in ownership.
4• Any potentially dangerous conditions at a dam site.
Notice to our office concerning item number one above is required before
any work begins at a dam. Information concerning item number two is derived from
our routine inspection program. Information concerning item number three is
either derived from our inspection follow-up or directly from the effected dam
owner. Lastly, item number four is covered by our inspection program, notifi-
cation from local residents, etc., and/or notification from the effected dam
owner.
In summary, our authority is limited to conditions which directly effect
the safety of a dam. It appears that in light of this limitation, we would not
require any information from the present owner at this time concerning the subject
dam. However, since this dam is on our inventory, we will schedule an inspection

PURPOSE: To set a policy to help deternane which public, non-state maintained
roads will be pasted by the County with road name signs
NEED: Orange County has named and posted public roadswithintheunincorporated -
areas of the County. These are roads that are state maintained. The
County subdivision regulations require road signs an all newly created
public and private roads. The Road Naming Advisory Comittee s (RONAC)
charge was to name all public and pdblic non-state maintained roads.
No policy has ever been set about posting signs an the public non-state
•
maintained roads.
Many of these roads were created after the 1973 North Carolina state law
establishing maintenance standards was passed but before the 1970 adoption
of County-wide subdivision regulations. There are about 190 of these
public non-state maintained roads. Approldmately 65 roads are paved,
and 125 are unpaved. About 45 of the 190 roads of these pdolic, non-
state maintained roads are in sUbdivisions which do not yet qualify
for, or are awaiting state neantenanceo Almost all unpaved roads and
antnknowe percentase of the paved roads will never be accepted onto the
state system. The County Menagerie proposed Saligt has left open the
possibility of posting all 190 pdolic, non-state maintained roads.
IMPACT: These public non-state maintained roads all serve dwelling units.
Therefore, these citizens have a potential need for location by the
County emergency services. Sore of these 190 roads might be private.
The legal status of soma of these roads is not clear. Without a title
search that status may never be known. If the County pests these
private roads, an cbvious contradiction would be created between our
subdivision regulations, which require develoeers to pay for their road
signs and this County action. The recontendatien would provide a policy
to help ensure that no private roads are posted and that the citizens
living an the road want a sign.
ECOMENERTION: Adopt a policy for posting all public roads if:
a) the roads are on the state road system
b) the public, non-state maintained roads will, be added
onto the state road system
c) the public, non-state maintained roads will not be adcd to the
state system but there is a recorded plat showing the right-of-way
as public and 51% of the residents want the County to
erect a road name sign.

names on these roads service by emergency personnel should be easier.

MBACT: Naming public non-state maintained roads is more difficult than naming
State maintained roads. Some of the problems to be considered are: the
question of ownership of the right of way (whether it is In fact public),
which of the many rights of way should be designated as a public road;
should there be a minimum number of dwelling units on a road before it
is named; since the ownership of the right of way is difficult to ascertain
some private drives may inadvertently be named. The naming of these roads
may be useful to emergency services and in helping citizens find addresses.
