SUBJECT: AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING FOR THE DURHAM- CHAPEL HILL-CARRBORO METROPOLITAN PLANNING ORGANIZATION DEPARTMENT: PLANNING PUBLIC HEARING Yes x No ATTACHMENT(S) : INFORMATION CONTACT: Gene Bell - 9-13-93 letter requesting Ext. 2589 adoption of revised MOU - Section III of revised MOU TELEPHONE NUMBERS: Hillsborough - 732-8181 Durham - 688-7331 Mebane - 227-2031 Chapel Hill - 967-9251 PURPOSE: To consider adoption of an amendment to the Memorandum of Understanding (MOU) for the Durham- Chapel Hill-Carrboro (DCHC) Metropolitan Planning Organization (MPO) . BACKGROUND: On August 17, the Orange County Commissioners adopted a resolution approving a new MOU for continuing, cooperative and comprehensive transportation planning in the DCHC area. The new MOU recognized an expansion of the MPO planning jurisdiction and the addition of voting representatives from the Town of Hillsborough and County of Chatham. Section III of the MOU addresses termination of participation by parties to the MOU. It states that the MOU shall remain in effect as long as 75% or more of the population within the Metropolitan Area Boundary is represented by the remaining members. A one sentence amendment clarifying representation has been added to Section III. It reads as follows: For the purpose of determining 75% representation, the populations within incorporated areas are represented by the respective municipal governments and the populations within the unincorporated areas of the Metropolitan Area Boundary are represented by the respective county governments. The revision is the addition of the last sentence on page 10. Once each jurisdiction has agreed to sign the M.O.U. , we will circulate original copies for execution by each party. Additionally, Durham County shall, coordinate zoning and subdivision approval within its jurisdiction in accordance with the adopted Comprehensive Transportation Plan and the mutually adopted Thoroughfare Plan. Orange County Orange County will assist in the transportation planning process by providing planning assistance, data, and inventories in accordance with the Prospectus. Additionally, Orange County shall, coordinate zoning and subdivision approval within its jurisdiction in accordance with the adopted Comprehensive Transportation Plan and the mutually adopted Thoroughfare Plan. Chatham County Chatham County will assist in the transportation planning process by providing planning assistance, data, and inventories in accordance with the Prospectus . Additionally, Chatham County shall coordinate zoning and subdivision approval within its jurisdiction in accordance with the adopted Comprehensive Transportation Plan and the mutually adopted Transportation • Plan. North Carolina Department of Transportation The Department will assist in the transportation planning process by providing planning assistance, data, and inventories in accordance with the Prospectus. The Department, to the fullest extent possible and as permitted by existing State and federal regulations, will provide assistance in the protection of necessary rights-of-way for those thoroughfares designated in the adopted Comprehensive Transportation Plan and the mutually. adopted Thoroughfare Plan. Section III. Parties to this Memorandum of Understanding may terminate their participation in the continuing transportation planning process by giving 30 days written notice to the other parties prior to the date of termination. If any party should terminate participation, this Memorandum of Understanding shall remain in force and the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization shall continue to operate as long as 75% or more of the population within the Metropolitan Area Boundary is represented by the remaining members. For the purpose of determining 75% representation, the populations within incorporated areas are I* represented by the respective municipal governments and the populations within the unincorporated areas of the Metropolitan 4rea Boundary are represented by the respective county governments.
