PURPOSE:
The Ordinance Regulating the Keeping of Wild Animals Dangerous to Persons and
Property within orange county requires the orange County Health Department to
report to the Board of county commissioners of orange county, whenever the
department has cause to believe that any person is violating or threatening to
violate this ordinance (page 8, paragraph 3a) . Following an anonymous complaint,
the Orange county Animal Control Director, Elma Rae Greene, investigated the
property of Odell Coley at 6500 Yarborough Road, and found a female "Himalayan"
bear caged in violation of the ordinance. A notice of violation was issued to
Odell Coley on August 4, 1993, and received by certified mail.
BACKGROUND:
The ordinance Regulating the Keeping of Wild Animals Dangerous to Persons and
Property Within Orange County was adopted by the orange County Board of
Commissioners on the fifth day of April, 1983. section 3 states:
"It shall be unlawful for any person to possess and harbor in
Orange County a wild animal as defined herein without first
applying for and obtaining a permit from the Director." It
further states that, "Permits shall be only issued for animals
physically located in orange County and registered as of the
date of this ordinance enactment."

Because the bear was not registered as of the fifth of April of 1983, the notice
of violation ordered the wild animal to be removed from orange county on or
before September 4, 1993. Upon verbal notice of Mr. Coleys request to the
Commissioner's for an appeal of this order, the removal deadline has been
extended to September 8, 1993.
The only exemption to the provisions of this ordinance was granted for:
"Animals used for teaching and/or research purposes
at the University of North Carolina at Chapel Hill."
Section 3, Requirements of Permits, continues:
"As a condition precedent to the possession or harboring of any
wild animal, the prospective owner or permittee shall have on the
premises where such animal is kept, sufficient equipment and/or
chemicals necessary to tranquilize or kill any animal for which
the owner or permittee has a permit to keep.
As a further condition, the prospective owner or permittee must
present evidence of training and experience in the care and
handling of wild animals."
Mr. Coley has not presented evidence that he has met either of these two
conditions. Furthermore, prospective owners or permittees must submit an
application for said permit which contains specific information outlined on page
three of the ordinance.
Mr. Coley has stated that his purpose in keeping the animal is to enjoy as a pet
and, "that he had plans to take her to area schools and teach students about
bears." Such a purpose classifies the bear as an exhibition animal which
requires a permit from the North Carolina Wildlife Resources Commission.
Mr. Coley has not obtained such a permit.
The ordinance further requires "proof of applicant's ability to respond in
damages for bodily injury to or death of any person or persons or for damage to
property owned by any other person which may result from the ownership,
keeping or maintenance of such animal." Mr. Coley has not filed with the
Director a Certificate of Insurance, stating that the applicant is insured by a
policy of One hundred thousand dollars ($100,000) combined single limit
liability for bodily injury and property damage.
Appendix A. to the ordinance lists the standards for primary and secondary
enclosures of wild animals. Section d. lists the requirements for bears and
hybrids thereof. Below is an assessment of the requirements and the current
status observed at Mr. Coley's residence.

NOTICE OF VIOLATION

This Notice issued to the above named person hereby
notifies the above named person that a violation of the Orange
County Ordinance Regulating The Keeping of Wild Animals Dangerous
to Persons and Property within Orange County has been observed
by Orange County Animal Control .
The aforementioned ordinance prohibits animals defined
in the ordinance being kept, sheltered, fed, or harbored within
the confines of Orange County without a permit. No permits may be
issued after April , 1983 , the date of the adoption of the
ordinance.
Therefore , the person issued this Notice shall remove
the following animal from the confines of Orange County on or
before :
September 4, 1993 . .
ANIMAL DESCRIBED:
One female "Himalayan" Bear
Black and white
ANIMAL LOCATION:
Livestock trailer on property at above address .
Penalties for failure or refusal to comply to this
Notice may result in criminal and civil legal actions being
pursued.

Of the nine (9) requirements for housing bears, Mr. Coley is in compliance with
only two (2) .
A review of the Orange County Commissioner's Minutes from February through May of
1983, reveals a clear intention to ban all future wild animals imported to Orange
county.
Health Director, Daniel B. Reimer, personally visited Odell Coley and his
fiancee, Tony Anderson, on August 31, 1993. He reviewed with them the
provisions of the ordinance, previously issued notices of violating both the
Animal Control and Wild Animal ordnances, and inspected the facilities. In spite
of respecting Mr. Coley's clear intent to be a responsible pet owner, the Health
Director finds no grounds to recommend that a exemption to the ordinance be
granted to Mr. Coley.
RECOMMENDATION(S): The Health Director recommends that an exemption to the
ordinance not be granted to Mr. Coley and that Mr. Coley
be directed to remove the animal from Orange County by
September 14, 1993.

The NOTICE OF VIOLATION issued on August 4 , 1993 to the
above named person for violation of the Orange County Ordinance
Regulating The Keeping Of Wild Animals Dangerous To Persons and
Property within Orange County, N.C. , has been extended by the
Orange County Animal Control Director.
The date of expiration of the Notice has been extended
from September 4 , 1993 to September 8 , 1993 .
The Notice of Extension applies only to the Notice of
Violation mentioned and does not apply to any other Notices Of
Violation issued or penalties imposed by authority of the
Orange County Animal Control Ordinance.
This Notice of Extension shall remain in effect until
September 8 , 1993 and shall be contingent on the following:
The bear is kept confined and under the owner ' s control
at all times and remains on the property listed above,
The owner remains liable for any and all actions of the
animal ,
The owner maintains the animal in compliance to the
Standards for Animal Care provided by the Orange County Animal
Control ordinance,
The owner allows Animal Control officers to inspect the
animals quarters to ensure compliance to the Ordinance and this
Notice.
