PURPOSE: To consider approving a contract with Ballentine & Riley Surveyors for work at the
Southern Human Services site.
BACKGROUND: In order to begin site development of the Southern Human Services Project, a
survey of the property must be done. Hakan/Corley has done work with Ballentine in the past and
is pleased with the quality of the work product and has therefore requested that Ballentine be allowed
to do the work. Based on other surveys which the County has commissioned,the fee is comparable.
RECOMMENDATION: The Manager recommends approval of the contract with Ballentine & Riley
Surveyors in an amount not to exceed $11,200; and authorize the Chair to sign on behalf of the
Board.

PROJECT NAME/LOCATION: Orange County Southern Human Services Building Site

SCOPE AND EXTENT OF SERVICES: Deed research, field measurements, computations
& computer drafting required to prepare a Boundary & Topographic Survey with the
following conditions:
1.0 Scale, orientation, elevation datum point and date of survey. True north and
. magnetic north.
2.0 Existing streets and their widths (opposite side in plan view), sidewalks, curb
cuts, paths walks, roads, driveways, fences, gates, retaining walls, sidewalk
vaults, areaways, grilles, gratings, etc . ictlicating their elevations and
materials.
3.0 Easements_anti rights-of-way on record with local municipalities or in the deed
restrictions (including utility or clr,linlge).
4.0 Locate existing residence and a.;esso7 structures on site.
5.0 Locate and indicate species and size of trees in accordance with Town of
Chapel Hill Guidelines. Indicate significate rock out-croppings with their
spread and elevation, kind and infonnation.
6.0 Locate boundaries of property v/i 1c .1rrtension and bearings. Indicate if there
are existing boundary rnark.r ;n(? )f- what at '1aet:rial. If none exist., new
property corners will be set.

8.0 Locate utility or heating tunnels, electric and telephone utility poles,
underground or overhead service wiring, hydrants, gas, steam, water, piping,
sewage storm drainage, combination drains indicating size of pipe, flow and
pressure. Location of transformers, and current characteristics (overhead or
underground). Elevation of manhole, size and use. Elevation of inverts,
valves, and pipes.
9.0 Indicate all topographic elevations taken and connect same graphically for the
+ 34-acre tract. Contours shall be shown at 2'-0" intervals.
10.0 Scale to be 1" = 50'-0".
11.0 Survey drawing file compatible with Autocad Version 11.0.
13.0 Cross sections into site along site side of Homestead Road shall extend 400'
beyond the end of property line. Cross sections shall begin at center line of
existing roadway and extend into the property. Private driveways shall be
located in plan along Homestead Road. Sections shall be drawn to 1"=50'
horizontal and 1"=5'0" vertical scales.
15.0 Survey shall be delivered 30 calendar days from notice-to-proceed &
completed cross sections may follow 2-weeks later if necessary.
FEE AMOUNT: $10,500.00
FEE TYPE: Fixed Fee

SPECIAL CONDITIONS:
1. Underground utilities will be surveyed & shown as field located by their
respective agents.
The Terms and Conditions on the reverse of this form are a part of this Agreement.
This Agreement entered into as of the day and year first written above.

TERMS AND CONDITIONS
Ballentine & Riley Surveyors hereinafter called the Firm, will perform the services outlined in
this agreement for the stated fee.
Access to Site: Unless otherwise stated, the Firm will have access to the site for activities
necessary for the performance of the services. The firm will take precautions to minimize
damage due to theses activities, but have not included in the fee the cost of restoration of any
resulting damage.
Fee: The total fee, unless otherwise stated, shall be understood to be an estimate, and shall
not be exceeded by more than twenty percent without written approval of the Client. Where the
• fee arrangement is to be on an hourly basks, the rates shall be those that prevail at the time
services are rendered. Current rates are as follows:
Registered Land Surveyor II $60.00 4-man Survey Crew $85.00
CADD Operator II $4.5.00 3-man Survey Crew $75.00
Survey Technician $30.00 2-man Survey Crew $65.00
Billings/Payments: Invoices for the Firm's services shall be submitted, at the Firm's option,
• either upon completion of such services or on a monthly basis. Invoices shall be payable within
20 days after the invoice date; a 2% discount may be applied to invoices paid within ten days
from date of invoice. If the invoice is not paid within 30) days, the Firm may, without waiving
any claim or right against the Client, and without liability whatsoever to the Client, terminate
the performance of the service. Retainers shall be credited on the final invoice.
Late Payments: Accounts unpaid 30 days after the invoice date may be subject to a monthly
service charge of 1.5% on the then unpaid balance (18.0% true annual rate), at the sole election. •

the Client shall pay all costs of collection, including reasonabl attorney's fees.

- from and against any and all claims, damages, losses and expenses (including reasonable
attorney's tees) arising out of or resulting frcm the performance of the services, provided that
any such claim, damage, loss or expense is caused in whole or in part by the negligent act,.
omission, andi or strict liability of the Client, anyone directly or indirectly employed by the
Client (except the Firm), or anyone for whose acts any of them may be liable. Claims and
disputes shall he subject to non-binding mediation as defined under Article 7 of AIA Document
B141.

Termination of Services: This agreement may he terminated by the Client or the Firm should
the ocher fail to perform its obligation hereunder. In the event of termination, the Client shall
pay the Firm for all services rendered to the date of termination, all reimbursable expenses, and
reimbursable termination expenses.
Construction Costs_ Responsibility for construction costs will be in accordance with Article
5 of AIA Document B141.
Ownership Documents: All documents produced by the Firm under this agreement shall remain
the property of the Firm and may not be used by the Client for any other endeavor without the
written consent of the Finn:
Applicable Laws: Unless otherwise specified, this agreement shall be governed by the laws of
the State of North Carolina.
