PURPOSE: Consideration of the Preliminary Plan for Phase B New
Sharon Woods.
BACKGROUND: The property is located in Eno Township on the east side
of New Sharon Church Road (SR 1538) . New Sharon Church
Road is a paved State-maintained road and considered a
collector in the Comprehensive Plan. A 1991 traffic count
on this road indicated 800 trips per day.
The total acreage of the tract is 6. 83 acres. Six (6)
lots are proposed which average 1. 03 acres in size. New
lots will be served by individual wells and septic tanks.
The first two lots were approved through the minor
subdivision process.
The property is zoned Agricultural Residential (A-R) . It
is also designated Agricultural Residential in the
Comprehensive Plan. A public road is proposed to serve
the subdivision. The short cul-de-sac would extend
southeast off New Sharon Church Road. All lots would
receive access from Krystle Court.
The Planning Board reviewed the Concept Plan for Phase B
New Sharon Woods at its April 13 , 1993 meeting. The plan
was approved with the following condition:
1. All lots shall receive access from Krystle Court.
The Planning Board considered the Preliminary Plan for
Phase B New Sharon Woods on August 16, 1993 and

unanimously recommended approval subject to the conditions
contained in the attached Resolution of Approval.
RECOMMENDATION: The Administration recommends approval of the Preliminary
Plan for Phase B New Sharon Woods subject to the
conditions contained in the attached Resolution of
Approval.

The Board of County Commissioners hereby approves Phase B New Sharon Woods
subdivision preliminary plat, dated June 20, 1993 and containing 6 lots, subject to the
fulfillment of requirements specified herein.
Krystle Court shall be irrevocably dedicated to the general public and be constructed to
standards of the North Carolina Department of Transportation. The approval of this
resolution authorizes and directs the Orange County Manager to accept for Orange County
and on behalf of the public generally, the offer of dedication of Krystle Court. This
acceptance by Orange County of the dedication to the general public of Krystle Court shall
be without maintenance responsibility. This road shall be maintained by the owner/applicant
until such time as it is accepted for maintenance by the North Carolina Department of
Transportation or some other governmental body. Before the Final Plat of Phase B New
Sharon Woods can be recorded:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal, and
repair area, approved by the Orange County Division of Environmental
Health.
2. The septic system location may restrict the size and location of improvements. t`
This disclosure shall be included in a document describing development .
restrictions to be recorded concurrently with the Final Plat. The document
shall also disclose that information regarding the tentative location of septic
systems is available from the Orange County Health Department, Division of
Environmental Health.
B. Roads and Access f'
1. Krystle Court shall be constructed to standards of the North Carolina
Department of Transportation, within a 50 foot right-of-way, and the
construction shall be inspected and approved by NCDOT.

A letter of credit, escrow agreement, or bond shall be submitted to secure
construction of Krystle Court to the standards of the North Carolina
Department of Transportation. An estimate of the construction cost must be
prepared by a certified/licensed engineer or grading contractor and submitted
to the Planning and Inspections Department. The financial guarantee must
reflect 110% of that estimate and be issued by an accredited financial
institution licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the
Final Plat shall state that the financial guarantee will not be released until the
road construction has been inspected and approved by NCDOT.
2. Submit an erosion control plan for construction of the road.
3. All lots shall access onto the new subdivision road. This restriction shall be
stated in a document describing development restrictions and requirements to
be prepared by Planning Staff and recorded concurrently with the Final Plat.
4. At the street rights-of-way intersection, a 10' x 70' sight-triangle shall be
indicated in accordance with NCDOT design standards.
5. Approved street name signs shall be erected at intersection as required in
Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence
shall be submitted by the applicant that signs are in place or a copy of the
receipt for purchase of the signs shall be submitted to the Planning
Department.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and must be inspected and approved by the Planning and
Inspections Department.

Guaranteed financially through a letter of credit, escrow agreement, or bond
submitted to secure required landscape installation and preservation.ation
An
estimate of the cost for required preservation, plantings and their installation
must be provided. The financial guarantee shall reflect 110 percent of the
estimate and be issued by an accredited financial institution licensed to do
business in North Carolina.
2. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.

D. Parkland
1. Cash in the amount of$740.00 [($4,319/acre x 6/35 acre)] shall be paid to
Orange County as payment in lieu of parkland dedication.
E. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations.
2. The following easements shall be shown on the plat:
a. A 30-foot drainage easement shall be provided as determined by the
Erosion Control Personnel and shown on the Preliminary Plan.
F. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor
shall be notarized on the face of the Final Plat.
2. A Certificate of Dedication and Maintenance in the form provided in Section
V-D-6-b of the Orange County Subdivision Regulations signed by the
landowner and developer shall be on the face of the plat and included in a
document describing development restrictions to be recorded concurrently with
the Final Plat.
3, The Department of Environmental Health shall certify that all residential lots
contain sufficient area for septic tank disposal and repair.
4. The North Carolina Department of Transportation shall certify that Krystle
Court has been constructed to State standards or that construction plans have
been approved.
5. A Certificate of Approval signed by the Orange County Planning and
Inspections Department.

C. OTHER SUBMITTAL REQUIREMENTS
1. Twenty-five (25) copies of the preliminary plat. • j
2. One full size copy of an Orange County Tax map (with tax parcels involved clearly marked in pencil).
3. Where municipal or OWASA sewer is not available, a copy of the Preliminary Plat indicating Health
Department soils analysis approval/denial for each lot shown thereon.
4. Where a private road is proposed a written statement by the applicant or his/her authorized representative
which sets forth the justification for a private road (see Section IV-E-3-d-1 of the Orange County
Subdivision Regulations).
5. Auxiliary documents, in draft form, prepared in accordance with Section VI of this Ordinance which assure
completion and/or maintenance of improvements required by this Ordinance. Such documents may include, but
not be limited to, a private road maintenance agreement, and articles of incorporation and restrictive
covenants pertaining to a homeowner's association. These documents may be required as necessary as
evidence that the ordinance requirements are being met.
6. Fee - 5350.00 plus 55.00 per lot (1 fee for preliminary and final plat).

Cantrell asked how close the lots are to the
actual stream. Kirk responded a little less than
100 feet. Kirk continued that there is no
floodplain indicated on the insurance flood maps.
MOTION: Jobsis moved approval as recommended by the
Planning Staff adding lot 17 to the condition
listed by Staff. Seconded by Burklin.
VOTE: Unanimous.

( 1) Phase B New Sharon Woods

Presentation by Eddie Kirk.
The property is located in Eno Township on the

Agency comments were received from Soil & Water
Conservation, Fire Marshall, NCDOT and Erosion
Control. Applicable comments have been
incorporated into the Resolution of Approval.
The Planning Staff recommends approval of the
Preliminary Plan for Phase B New Sharon Woods
subject to the conditions contained in the

(2 ) Governor's Grove
( 116 Lots - Cedar Grove Township)
Presentation by Eddie Kirk:
The property is located in Cedar Grove Township
on the east and west side of Governor Scott Road
(SR 1351) . Governor Scott Road is an unpaved
State-maintained secondary road and considered a
major local road in the Comprehensive Plan. The
tract is 177 .28 acres with 116 lots proposed.
Lot sizes range from .92 to 4 .50 acres.
The property is not zoned, however, it is
designated as Agricultural Residential,
Watersupply Watershed and Water Quality Critical
Area on the Land Use Plan. It is also classified
as WS-II by the State. State-mandated standards
for the protection of classified watersheds must
be implemented by January 1994 . When zoning or
watershed standards are adopted, this area will
be zoned as Water Quality Critical Area and
require a two-acre minimum lot size. Out of the
116 proposed lots, only 14 will comply with the
pending two-acre minimum lot size standards. The
County is in the process of considering watershed
standards which are scheduled for public hearing
on August 23, 1993.
Paved, public roads are proposed throughout the
development. A 1990 traffic count on Governor
Scott Road indicated 230 trips per day. With 116
lots proposed, additional traffic could reach 1,
160 trips per day, ( 10 trips/day/dwelling unit)
at buildout. A traffic impact analysis has been
submitted.
NCDOT has just updated the priority listing for
paving rural secondary roads. Governor Scott
Road is number 13 on the rural secondary road
priority. This road is scheduled to be paved
during the 1993-94 NCDOT Secondary Roads Paving
Program. Turn lanes on Governor Scott Road will
be required with final plat approval of Phase 7 .
