PURPOSE: To consider options for the disposition of a parcel of County
owned land.
BACKGROUND: In 1974, Orange County acquired by foreclosure a parcel of
land, roughly one-half acre in size, on 10th Street in Mebane, just
inside the Orange-Alamance line. Recently, the grandson of the
previous owner (who is now deceased) approached the Revenue Director
and expressed interest in acquiring the parcel. The County' s financial
interest in the property is approximately $3,000, which reflects the
amount of taxes, plus 9% annual interest, that the County would have
received had the property remained on the tax roles. The current
market value of the property is estimated at $14,080.
Among the options that may be considered by the County are the
following:
1) retain ownership of the property;
2 ) sell the property under statutory provisions that govern usual
sales of County owned real property;
3) sell the property at private sale to a party formerly having an
interest in the property (pursuant to GS 105-376 (c) ) ;
4 ) convey the property to Habitat for Humanity, OCHC, or some other
affordable housing organization , assuming that organization
demonstrates interest and can produce a plan for the timely and
effective use of the property.
The Board considered this item at its June 7 meeting and requested that
staff and the Attorney investigate further to determine what interest
the grandson of the former owner might have in this piece of property.
It is the Attorney' s opinion that the grandson does not possess the
"interest in" the property that is contemplated in NCGS 105-376 (c) .
If the County wishes to provide the grandson an opportunity to purchase
this property, the best approach is probably outlined in NCGS 160A-269,
whereby the County can solicit or receive an offer and then pursue an
upset bid process. The Board could establish a minimum bid that it

would be willing to accept for this property. If the grandson is
unwilling to make a qualifying bid, County staff could enter into
discussions with affordable housing representatives that might lead to
conveying this property to an affordable housing entity for that
express purpose.
RECOMMENDATION: The Manager recommends that the Board authorize
pursuing sale of this property under provisions of NCGS 160A-269 at a
price of no less than the appraised value of $14,080; furthermore,
should no qualifying bid be received and should the Board opt not to
retain the property, that option 4 above be pursued.

The 100 x 200 ft lot owned by Orange County and located on
Tax Map 3 .18 .E. 7 would have been appraised at $14 , 080 using
the 1993 Schedule of Values had it been taxed on January 1 ,
1993 .
THIS FEE SIMPLE DEED, made and entered into this the day of 19_,
by and between Orange County
hereinafter referred to as the GRANTORS, and the,Department of Transportation, an agency
of the State of North Carolina, hereinafter referred to as the DEPARTMENT:
W I T N E S S E T H:
That the GRANTORS, for themselves, their heirs, successors, and assigns, for and in
consideration of the sum of $ 13,350.00 agreed to be paid by the DEPARTMENT TO THE
GRANTORS, do hereby give, grant and convey unto the DEPARTMENT, its successors and
assigns, in FEE SIMPLE the right of way located in Cheeks Township, Orange County,
North Carolina, which is particularly described as follows:
BEGINNING at a common property corner between Ernest Brooks, now or formerly, and the
undersigned, said property corner being a southeastern property corner of Ernest Brooks,
now or formerly, and a northeastern property corner of the undersigned; thence,
southeasterly along the eastern property line of the undersigned to the point of
intersection with the southeastern property corner of the undersigned; thence,
southwesterly along the southern property line of the undersigned to the point of
intersection with the western proposed right of way boundary of Buckhorn Road, said point
located on a line between the following two points: the first point located 60 feet
southwesterly of and normal to Survey Station 32+25, Survey Line Y Revised Al and the
second point P located 65 feet southwesterly of and normal to Survey Station 30+50,
Survey Line Y Revised Al; thence, northerly in a straight line to a point located 65 feet
southwesterly of and normal to Survey Station 30+50, Survey Line Y6 Revised Al; thence,
northwesterly in a straight line to a point located 50 feet southeasterly of and normal to

northwestern property corner of the undersigned; thence, northeasterly along the northern
property line of the undersigned crossing Survey Line - Service Road #1 Revised to the
point of BEGINNING.
The property hereinabove described was acquired by the GRANTORS by instrument(s) ,
recorded in the Orange County Registry in Deed Book 253, Page 1427
The final right of way plans showing the above-described right of way are to be
certified and recorded in the Office of the Register of Deeds for said County pursuant to
N.C.G.S. 136-19.4, reference to which plans is here-by made for purposes of further
description.
TO HAVE AND TO HOLD the aforesaid right of way and all privileges and appurtenances
thereunto belonging to the DEPARTMENT in FEE SIMPLE.
This deed is subject to the following provisions only:
It is understood and agreed that the undersigned hereby claims no interests in the
one story frame dwelling and two sheds that are located in the above described right of
way area.

premises in fee simple, have the right to convey the same in fee simple, that the title
thereto is marketable and free and clear of all encumbrances, and that the GRANTORS will
warrant and defend the title against the lawful claims of all persons whomsoever except
for the exceptions hereinafter stated. Title to the property hereinabove described is
