Smith Reynolds Foundation, Inc. , Winston-Salem, North Carolina. BACKGROUND: In 1991 the County, along with 15 other counties, received a $20,000 planning grant to develop a final proposal and pilot program for the Z. Smith Reynolds Foundation' s Opportunities For Families Funds (OFF) initiative. Five counties in the state received a $1 million grant to develop programs to improve the conditions of low income families. Although the County did not receive the large grant, a group of dedicated citizens and staff who served on the OFF planning committee felt the County' s proposal was worthy of consideration by the Reynolds Foundation under their regular bi-annual funding cycle. In 1992, Dr. Frank Loda, John Hughes, Jan Scholper, Lucy Lewis, Marti Pryor-Cook, and Albert Kittrell developed an abbreviated proposal for submission. Under the bi-annual cycle the maximum grant awards are approximately $50,000. The County requested the maximum amount but received $30,000. The purpose of the grant is to assist the Social Services Department in implementing an "Opportunities for Young Fathers" (OYF) program. The primary goal of the OYF program is to improve the ability of low-income young fathers to contribute financial and emotional support to their families. This new initiative will enhance and complement the Department' s established Job Opportunities and Basic Skills (JOBS) program. The JOBS program focuses on the educational and employment training of young mothers. The OYF program will target young fathers. 2 To meet the goal of the program, the Department will contract with the Joint Orange-Chatham Community Action Agency (JOCCA) to provide case administration for the County' s Job Training Partnership act (JTPA) program and an On-the Job Training (OJT) contract for certain participants in the JOBS program. The addition of OYF will enable the agency to serve young fathers who do not meet the requirements for state and federal funded services. Grant funds will cover the program' s primary operating expenses. In-kind contributions for grant administration will be provided by the Department of Social Services. Matching funds are not required by the Foundation. RECOMMENDATION(S): The Manager recommends acceptance of the $30,000 grant from the Z . Smith Reynolds Foundation and authorization for the Board Chair to sign the Letter of Acceptance and Understanding. 2a Z. Smith Reynolds Foundation that the following grant meet all requirements of the Tax Reform Act of 1969 and amendments thereto: FOUNDATION ACTION: NOVEMBER 20, 1992 - PURPOSE OF GRANT: RESOLVED: That this Foundation grant $30,000 to Orange County, Hillsborough, N.C., for support of its Opportunities for Young Fathers program. This grant is herewith acknowledged and accepted for payment at the appropriate time under the following conditions: 1. Grantee confirms that the Internal Revenue Service has determined that it is an organization described in Section 501(c)(3) of the Internal Revenue Code (the "Code") (and is a publicly-supported organization and not a private foundation) and that said determination has not been revoked. Grantee will use this grant only for charitable and educational purposes consistent with such tax-exempt status. 2. The grant will be used only for the purpose specifically set forth under PURPOSE OF GRANT. Any portion of the grant not used for these purposes will be repaid to the Foundation. Any condition or purpose set forth in the grant resolution or in this Grant Agreement shall take precedence over any conflicting provision in the proposal submitted by the Grantee. 3. A written report will be submitted by Grantee annually to the Foundation on the manner in which the funds are spent and the progress made in accomplishing the purpose of the grant. ' 4. A full and complete final written report, showing expenditures of funds and the progress made in accomplishing the purposes of the grant, will be submitted to the Foundation when all funds have been expended. 5. Records of receipts and disbursements will be maintained by Grantee and such books and records will be made available to the Foundation or its representative upon request. 6. No funds from this grant will be used to carry on propaganda or otherwise to attempt to influence legislation, to influence the outcome of any public election, or to carry on directly or indirectly any voter registration drive. 7. Grantee will not use any of these grant funds to make any grant which does not comply with the requirements of Section 4945(d)(3) or (4) of the Code or to undertake any activity for any purpose other than one specified in Section 170(c)(2)(B) of the Code. 8. Grantee will promptly notify the Foundation if Grantee's tax-exemption status is revoked or modified in any way. 9. This grant is not earmarked for transmittal to any other entity or person,whether or not mentioned in Grantee's proposal or in any other communications with the Foundation. Rather, Grantee accepts and will retain full control of the grant's disposition and full responsibility for compliance with its terms and conditions. 10. The request should be made to: Mr. Thomas W. Lambeth, Executive Director, Z. Smith Reynolds Foundation, 101 Reyno/da Village, Winston-Salem, NC 27106-51.99. Payment of the grant should not be requested until grantee has need for actual expenditures of the funds. • If the grant is conditional or contingent, all conditions and contingencies must be met before payment will be made. Grantees should request payment at least 30 days priorto desired payment date. Checks will be issued during the first week of the month following request for payment provided the 30-day written notice has been given. MATCHING REQUIREMENTS: If the grant resolution provides that the grantee (1) must match the funds granted by the Foundation or (2) must raise additional funds, these conditions will be satisfied when the matching or additional funds are in hand or pledged, provided such pledges are reasonably considered to be firm and binding on the part of those making such pledges. (1) If the grant is to be matched on a ratio basis (i.e., 2-for-1, 3-for-1, etc.), grantee will have two years in which to meet the matching requirements unless stated otherwise in the grant resolution, and matching funds will include only those amounts secured on or after the date of the Foundation's grant resolution. The start of the two-year period will begin with the date of the Foundation's grant resolution. (2) If the duration of the project is greater than one year and additional funds must be raised from other sources to accomplish the project, grantee will have two years in which to raise the additional funds unless stated otherwise in the grant resolution. In-kind contributions, whether in the form of provision of staff, space, equipment or labor, may be considered in meeting the matching requirements if they reduce the actual amount required in the budget submitted to the Foundation and on which the Foundation based its matching requirements. Matching grants may not be paid incrementally unless specifically stated in the grant resolution. This means that the Foundation will not pay its funds until the entire matching amount has been raised by the grantee. • BUDGET CHANGES: In the event the budget submitted by the grantee to the Foundation,and upon which the Foundation's grant was predicated, needs to be modified during the course of the project due to the size of the Foundation's grant, the availability of funds from other sources, or other compelling circumstances, the revised project budget and objectives shall be submitted to the Foundation at the time such changes are approved by the Board of Directors or duly authorized staff member of the grantee organization. Any modification of grantee's budget or objectives which would substantially alter the proposed activities or outcome of the project shall be reviewed and approved in writing by an appropriate representative of the Foundation. SUBMISSION OF REPORTS: The Foundation will supply the grantee with a "Grantee's Reporting Form" which must be completed in reporting on the use of funds and the accomplishments of the project. A report must be submitted to the Foundation annually, using the grantee's fiscal year. The "Grantee's Reporting Form" must be accompanied by a detailed financial statement showing how the grant funds were spent. If the grant is for a one-year period or a one-time purpose, one final report will satisfy reporting requirements.
