PURPOSE: Consideration of Preliminary Plan for The Village of The
Oaks.
BACKGROUND: The property is located in Bingham Township on the
southwest side of Mebane Oaks Road (SR 1007) and Bradshaw
Quarry Road (SR 1115) . Mebane Oaks Road and Bradshaw
Quarry Road are paved State-maintained roads and
considered collectors in the Comprehensive Plan. The
tract size is 9. 54 acres out of 48 .43 acres with six (6)
lots proposed. Lot sizes range from 1. 00 to 1. 98 acres.
The property is zoned Agricultural Residential (A-R) and
Protected Watershed (PW-II) . It is also designated
Agricultural Residential and Protected Watershed in the
Comprehensive Plan. A public road is proposed. The road
would extend south off Bradshaw Quarry Road. All lots
would receive access from the subdivision road. A 1991
traffic count on Bradshaw Quarry Road indicated 350 trips
per day east of Mebane Oaks Road.
The Planning Board reviewed the Concept Plan for The
Village of The Oaks at its March 15, 1993 meeting. The
plan was approved with the following condition:
1. All lots shall receive access from the interior
subdivision road.

At its regular meeting on June 21, 1993 , the Planning
Board considered the Preliminary Plan and recommended
approval subject to the conditions contained in the
Resolution of Approval.
RECOMMENDATION: The Administration recommends approval of the Preliminary
Plan for the Village of The Oaks subject to the conditions
contained in the attached Resolution of Approval.

The Board of County Commissioners hereby approves The Village of The Oaks subdivision
preliminary plat, dated April 8, 1993 and containing 6 lots, subject to the fulfillment of
requirements specified herein.
Willow Oak Drive shall be irrevocably dedicated to the general public and be constructed to
standards of the North Carolina Department of Transportation. The approval of this
resolution authorizes and directs the Orange County Manager to accept for Orange County
and on behalf of the public generally, the offer of dedication of Willow Oak Drive. This
acceptance by Orange County of the dedication to the general public of Willow Oak Drive
shall be without maintenance responsibility. This road shall be maintained by the
owner/applicant until such time as it is accepted for maintenance by the North Carolina
Department of Transportation or some other governmental body. Before the Final Plat of
The Village of The Oaks can be recorded:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal, and
repair area, approved by the Orange County Division of Environmental
Health.
2. The septic system location may restrict the size and location of improvements.
This disclosure shall be included in a document describing development
restrictions to be recorded concurrently with the Final Plat. The document
shall also disclose that information regarding the tentative location of septic
systems is available from the Orange County Health Department, Division of
Environmental Health.
B. Roads and Access
1. Willow Oak Drive shall be constructed to standards of the North Carolina
Department of Transportation, within a 50 foot right-of-way, and the
construction shall be inspected and approved by NCDOT.

A letter of credit, escrow agreement, or bond shall be submitted to secure
construction of Willow Oak Drive to the standards of the North Carolina
Department of Transportation. An estimate of the construction cost must be
prepared by a certified/licensed engineer or grading contractor and submitted
to the Planning and Inspections Department. The financial guarantee must
reflect 110% of that estimate and be issued by an accredited financial
institution licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the
Final Plat shall state that the financial guarantee will not be released until the
road construction has been inspected and approved by NCDOT.
2. Submit an erosion control plan for construction of the road.
3. All lots shall access onto the new subdivision road. This restriction shall be
stated in a document describing development restrictions and requirements to
be prepared by Planning Staff and recorded concurrently with the Final Plat.
4. At street rights-of-way intersections, 5' x 100' taper-triangles and 10' x 70'
sight-triangles shall be indicated in accordance with NCDOT design standards.
5. Approved street name signs shall be erected at intersection as required in
Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence
shall be submitted by the applicant that signs are in place or a copy of the
receipt for purchase of the signs shall be submitted to the Planning
Department.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and must be inspected and approved by the Planning and
Inspections Department.
OR
Guaranteed financially through a letter of credit, escrow agreement, or bond
submitted to secure required landscape installation and preservation. An
estimate of the cost for required preservation, plantings and their installation
must be provided. The financial guarantee shall reflect 110 percent of the
estimate and be issued by an accredited financial institution licensed to do
business in North Carolina.
2. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.

D. Parkland
1. Cash in the amount of $385.00 [($2,250/acre x 6/35 acre)] shall be paid to
Orange County as payment in lieu of parkland dedication.
E. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V-D-2 and V-D-3 of the Orange County Subdivision' egulations.
2. The following easements shall be shown on the plat:
a. A 30-foot drainage easement shall be provided as determined by the
Erosion Control Personnel and shown on the Preliminary Plan.
F. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor
shall be notarized on the face of the Final Plat.
2. A Certificate of Declaration and Maintenance in the form provided in Section
V-D-6-b of the Orange County Subdivision Regulations signed by the
landowner and developer shall be on the face of the plat and included in a r
document describing development restrictions to be recorded concurrently with
the Final Plat.
3. The Department of Environmental Health shall certify that all residential lots
contain sufficient area for septic tank disposal and repair.
4. The North Carolina Department of Transportation shall certify that Willow
Oak Drive has been constructed to State standards or that construction plans
have been approved.
5. A Certificate of Approval signed by the Orange County Planning and
Inspections Department.

C. OTHER SUBMITTAL REQUIREMENTS
1. Twenty-five (25) copies of the preliminary plat.
2. One full size copy of an Orange County Tax map (with tax parcels involved clearly marked in pencil).
3. Where municipal or OWASA sewer is not available, a copy of the Preliminary Plat indicating Health
Department soils analysis approval/denial for each lot shown thereon.
4. Where a private road is proposed a written statement by the applicant or his/her authorized representative
which sets forth the justification for a private road (see Section IV-B-3-d-1 of the Orange County
Subdivision Regulations).
5. Auxiliary documents, in draft form, prepared in accordance with Section VI of this Ordinance which assure
completion and/or maintenance of improvements required by this Ordinance. Such documents may include, but
not be limited to, a private road maintenance agreement, and articles if incorporation and restrictive
covenants pertaining to a homeowner's association. These documents may be required as necessary as
evidence that the ordinance requirements are being met.
6. Fee - 3350.00 plus $5.00 per lot (1 fee for preliminary and final plat).

Presentation by Eddie Kirk.
The property is located in Bingham Township on
the southwest side of Mebane Oaks Road (Sr
1007 ) and Bradshaw Quarry Road (SR 1115 ) . Mebane
Oaks Road and Bradshaw Quarry Road are paved
State-maintained roads and considered collectors

proposed. Lot sizes range from 1 . 00 to 1 . 98
acres.
The property is zoned Agricultural Residential

Agency comments were received from the Health
Department, Recreation and Parks, Fire Marshall,
Soil & Water Conservation, and Erosion Control.
Applicable comments have been incorporated into
the Resolution of Approval.
The Planning Staff recommends approval of the
Preliminary Plan for the Village of The Oaks
subject to the conditions contained in the
Resolution of Approval (a copy an attachment to
these minutes on pages ) .
MOTION: Reid moved approval as recommended by the
Planning Staff. Seconded by Hoecke.
Walters asked if the applicant had plans to
development the remainder of the tract. The
applicant, Rachel Best indicated the remainder
of the tract will be developed in villages. One
difficulty is that a portion of the tract is
located in Alamance County. Walters expressed
concern about the number of entrances proposed
for Bradshaw Quarry Road. The applicant
indicated there would be two entrances once the
remainder of the tract is developed. One
entrance would be from the portion of the road
in Alamance County which is named Thom Road.
The applicant asked if a lot is located in both
Alamance and Orange counties, which county would
actually have approval. Ms. Best continued
that she owns a thirty-five acre tract that is
located in Orange County and, a larger adjoining
tract located in Alamance County. Willis
responded that the entire tract is taxed in
Alamance County. Even though it is taxed in
Alamance, each subdivision will be reviewed by
the County in which it is actually located. If
lots are created that split the county in some
way they must be signed off by each jurisdiction.
Perc tests would be done by the County in which
the lot is located. Willis continued that if a
portion of a lot is located in both Alamance and
Orange Counties, Staff would communicate with
Alamance to determine the most appropriate way to
proceed.

a. ZONING ATLAS AMENDMENTS
( 1 ) Z-2-93 Lake Hogan Farm
Presentation by Mary Willis.
This item is to consider a rezoning request for
property owned by Lake Hogan Farm Inc. It
involves an amendment to both the Orange County
Zoning Atlas and the Carrboro Zoning Map.
The area proposed to be rezoned is located on the
east side of Old NC 86 north of Homestead Road.
The property consists of all or part of seven
parcels totaling approximately 264 acres .
According to the Joint Planning Area Land Use
Plan (JPALUP) the property is categorized as
Suburban Residential, and is located within
Transition Area I of the Carrboro Joint
Development Review Area. This designation allows
densities up to 5 dwelling units per acre. The
