PURPOSE: To consider the Preliminary Plan for Raineywood
Subdivision.
BACKGROUND: The property is located on the north side of Lebanon
Church Road (SR 1306) off the east side of Daniels Farm
Road. Daniels Farm Road is a public road in Buck Run
Subdivision. The property is located in Cheeks Township
and is zoned R-1 and PW-II. The Land Use Element of the
Comprehensive Plan designates the area as Rural
Residential and Protected Watershed. It is located in the
Back Creek Watershed.
There are seven (7) lots proposed out of 9 . 8 acres. There
is 84 .5 acres remaining in the tract and the average lot
size is 1.4 acres. All lots are proposed to be served by
individual wells and septic tanks.
The road is proposed to be public and constructed to State
standards. It will extend from Daniel's Farm Road and
stub-out into the remaining 84 . 5 acre tract.
The Planning Board reviewed the Concept Plan for
Raineywood Subdivision at its May 18, 1992 meeting. The
plan was approved with the following conditions:
1. The public road shall have a temporary gravel cul-de-
sac as recommended by NCDOT.
2
2 . Lot 4 shall have a minimum 130 feet of road frontage.
3 . The property owner shall attempt to obtain sight
distance easements at Daniels Farm Road as recommended
by NCDOT.
4 . The right-of-way shall tie in with radii and not an
angle to the existing right-of-way.
The Planning Board considered the Preliminary Plan for
Raineywood on July 19, 1993 and recommended approval
subject to the conditions contained in the Resolution of
Approval.
RECOMMENDATION: The Administration recommends approval of the Preliminary
Plan for Raineywood subject to the conditions contained in
the attached Resolution of Approval.

ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS

The Board of County Commissioners hereby approves Raineywood subdivision preliminary
plat, dated May 14, 1993 and containing 7 lots, subject to the fulfillment of requirements
specified herein.
Raineywood Drive shall be irrevocably dedicated to the general public and be constructed to
standards of the North Carolina Department of Transportation. The approval of this
resolution authorizes and directs the Orange County Manager to accept for Orange County
and on behalf of the public generally, the offer of dedication of Raineywood Drive. This
acceptance by Orange County of the dedication to the general public of Raineywood Drive
shall be without maintenance responsibility. This road shall be maintained by the
owner/applicant until such time as it is accepted for maintenance by the North Carolina
Department of Transportation or some other governmental body. Before the Final Plat of
Raineywood can be recorded:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal, and
repair area, approved by the Orange County Division of Environmental
Health.
2. The septic system location may restrict the size and location of improvements.
This disclosure shall be included in a document describing development
restrictions to be recorded concurrently with the Final Plat. The document
shall also disclose that information regarding the tentative location of septic
systems is available from the Orange County Health Department, Division of r;
Environmental Health.
B. Roads and Access
1. Raineywood Drive shall be constructed to standards of the North Carolina
Department of Transportation, within a 60 foot right-of-way, and the
construction shall be inspected and approved by NCDOT.

A letter of credit, escrow agreement, or bond shall be submitted to secure
construction of Raineywood Drive to the standards of the North Carolina
Department of Transportation. An estimate of the construction cost must be
prepared by a certified/licensed engineer or grading contractor and submitted
to the Planning and Inspections Department. The financial guarantee must
reflect 110% of that estimate and be issued by an accredited financial
institution licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the
Final Plat shall state that the financial guarantee will not be released until the
road construction has been inspected and approved by NCDOT.
2. Submit an erosion control plan for construction of the road.
3. All lots shall access onto the new subdivision road. This restriction shall be
stated in a document describing development restrictions and requirements to
be prepared by Planning Staff and recorded concurrently with the Final Plat.
4. At the street rights-of-way intersection, a 10' x 70' sight-triangle shall be
indicated in accordance with NCDOT design standards.
5. Approved street name signs shall be erected at intersection as required in
Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence
shall be submitted by the applicant that signs are in place or a copy of the
receipt for purchase of the signs shall be submitted to the Planning
Department.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and must be inspected and approved by the Planning and
Inspections Department.
OR
Guaranteed financially through a letter of credit, escrow agreement, or bond
submitted to secure required landscape installation and preservation. An
estimate of the cost for required preservation, plantings and their installation
must be provided. The financial guarantee shall reflect 110 percent of the
estimate and be issued by an accredited financial institution licensed to do
business in North Carolina.
2. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.

D. Parkland
1. Cash in the amount of $220.00 [($1,100/acre x 7/35 acre)] shall be paid to
Orange County as payment in lieu of parkland dedication.
E. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations.
2. The following easements shall be shown on the plat:
a. A 30-foot drainage easement shall be provided as determined by the
Erosion Control Personnel and shown on the Preliminary Plan.
F. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor
shall be notarized on the face of the Final Plat.
2. A Certificate of Declaration and Maintenance in the form provided in Section
V-D-6-b of the Orange County Subdivision Regulations signed by the
landowner and developer shall be on the face of the plat and included in a
document describing development restrictions to be recorded concurrently with
the Final Plat.
3. The Department of Environmental Health shall certify that all residential lots
contain sufficient area for septic tank disposal and repair.
4. The North Carolina Department of Transportation shall certify that
Raineywood Drive has been constructed to State standards or that construction
plans have been approved.
5. A Certificate of Approval signed by the Orange County Planning and
Inspections Department.

C. OTHER SUBMITTAL REQUIREMENTS
1. Twenty-five (25) copies of the preliminary plat.
2. One full size copy of an Orange County Tax map (with tax parcels involved clearly marked in pencil).
3. Where municipal or OWASA sewer is not available, a copy of the Preliminary Plat indicating Health
Department soils analysis approval/denial for each lot shown thereon.
4. Where a private road is proposed a written statement by the applicant or his/her authorized representative
which sets forth the justification for a private road (see Section IV-B-3-d-1 of the Orange County
Subdivision Regulations).
5. Auxiliary documents, in draft form, prepared in accordance with Section VI of this Ordinance which ass...-e
completion and/or maintenance of improvements required by this Ordinance. Such documents may include, c-.
not be limited to, a private road maintenance agreement, and articles of incorporation and restrictive
covenants pertaininc to a homeowner's association. These documents may be required as necessary as

The property is located on the north side of

Marshall, Soil and Water Conservation, Erosion
Control, Environmental Health Department, and
Recreation & Parks Department. Applicable
comments have been incorporated into the
Resolution of Approval.
The Planning Staff recommends approval of the
Preliminary Plan for Raineywood subject to the
conditions contained in the Resolution of
Approval (copy an attachment to these minutes on
pages ) .
MOTION: Reid moved approval as recommended by the
Planning Staff. Seconded by Boland.

(9 Lots - Eno Township)
Presentation by Jim Hinkley.
The property is located on the east side of
Miller Road (SR 1554 ) between Walker and Baldwin
Roads in Eno Township. There are nine lots
proposed out of 20. 7 acres with an average lot
size of 2. 3 acres. The property is zoned AR
Agricultural Residential, PW-II Protected
Watershed. Lying within the Little River
Watershed, the area is designated Agricultural
Residential in the County Land Use Element.
The proposed subdivision is about 1/4 open and
3/4 wooded. Surrounding land uses are generally
residential and wooded. The west side of the
tract is bounded by Miller Road.
Lot sizes range in size from 1 . 62 to 3. 97 acres
with a 1 .4-acre, 1, 130-lineal-foot private road.
The Planning Board reviewed the Concept Plan at
its regular meeting January 25 , 1993 . The Plan
was approved with a Class B private road with two
conditions:
